This has been a sad case for everyone involved…. What a horrible start for such a young kid….

Children are very resilient and he is at an age the trauma can be minimised .I hope he can settle and form a loving bond with all the nurturing from his caring dad.
I agree it is most insidious for irrational adults who use children as weapons of war, however adversarial tactics for effect are far to common in the family court these days.

A well expressed sentiments D4J.
Only about 5-10% or so of separations end up in the Family Court. The rest may be a little messy for a while, but even if one side feels agrieved or cut off for a while, the smart thing to do is simply pull back for a while, and be patient. Inevitably once the parents stop provoking each other with legal battles, sanity returns…sooner or later.
At that point both parents can almost always get on with sharing the parenting role in a manner that is mutually workable.
If there is one thing that is misery-making for any child, it is the fact of their parents fighting….all the waffle from Jones about the “kidnap” being “traumatic” for the kid is bollocks…he’s probably had a nice quiet 5 month holiday from all the chaos with his equally loving grandfather. Personally I find all the jubilation from Jones a bit rich. Frankly any adult who has so relentlessly pursued a family matter like this, (whatever the rights and wrongs of the whole tragic affair) should be a little more reticent about the publicity.

I suspect there’s a lot about this case we don’t know or ever will know.
Takes two to tango and I cannot believe one side are lily-white.
Poor kid – I don’t envy him either parent!
January 23rd, 2007 at 7:41 pm
“Takes two to tango and I cannot believe one side are lily-white.”
In many situations that’s a line I would use, in some cases of child custody it’s probably a bit like saying it takes two to tango when a crime is committed, the perpetrator and the victim.
In a lot of cases one parent is happy with shared custody, the other wants full custody, end of argument.
January 23rd, 2007 at 8:35 pm
RedRag – I don’t think we should prejudge but to be honest five months away from your parents without even a phone call would upset most kids.
January 23rd, 2007 at 8:50 pm
Just for your information Andrew W often the – “it takes two to tango” theory is a delusion, as often a non custodial parent faces flimsy false allegations of psychological and emotional abuse that form a lock tight prima facie case , which can see a parent completely shut out of their children’s lives. The alleged perpetrator of inappropriate behaviour soon becomes the victim suffering from the effects of parental alienation syndrome (child brainwashing or coaching). Some dads suffer this condition for years and years .
I am thankful in Jayden’s case that the maternal family came to their senses and realised that it is extremely detrimental to poison a young child against the paternal family.
Kids do best when they have both a mum and dad in their lives .
January 23rd, 2007 at 8:55 pm
While they’re at it can they charge the parents for calling him ‘Jayden’ ?
January 23rd, 2007 at 8:59 pm
I’m arguing against the “it takes two to tango” theory being appropriate, D4J.
January 23rd, 2007 at 9:44 pm
Sorry Andrew for the misunderstanding regarding your post. Any person learned in the dealings of the family court knows how much of a fallacy “it takes to tango theory” really is.
It the family court realised that BOTH a mum and dad helped create the child it would stop the widespread resentment non –custodial parents face when they face a system that holds zealously to the principle that there is no presumption of access.
People do not produce children for “ the best interests of the child”, however lawyers, psychologists and judges get rich on lengthy litigation proceedings based around this principle, which trumps all others and allows them all to sleep easily in their beds.
A better approach would be to acknowledge the strength of the bond between parent and child , to work for a settlement which as far as possible kept both parents involved in the lives of their children ( so long as they would do them no harm), and to take firm action against a parent who jeopardised this arrangement.

The police have continually described this event as a kidnapping. I have no complaint with that definition. I am, however, very concerned that this child was missing (kidnapped) for over five months and the police were unable to locate him. He was only recovered because the kidnapper (no doubt with legal advice) chose to hand him in.
How much effort was really made to get him back into some form of proper care. It doesn’t make the police look good. I also question the morality of the legal advisers to the Headley family who do not seem to have acted expeditiously to have him returned in a more timely manner.
January 24th, 2007 at 9:14 am
Agree totally cubit. If the police wanted to find him they would have.Unless the public are in danger or there’s money involved, the police don’t bother anymore, I got chased around town the other day by a police car because I committed the seriuos (victimless) crime of not wearing a seatbelt. He passed me going the other way, I saw him do a U turn in my rear vision, I tried to slip away (we were in heavy traffic) but his tenacity and cunning won out, and he got me for $150. Point is; the police are under resourced and can’t attend every crime, unless of course there’s some money in it for them.

Iwikiwi – HE WILL BE A GREAT ACHIEVER, I THINK NOT !! your comment.
This kid will be a hell of a lot better achiever than the Kahui twins! you think?
The mother and Grand father broke the law, right or wrong they broke it and now have to deal with the consequences.
I don’t know the exact truth behind this story, but in NZ for a mother not to be awarded custody over a father is enough questions answered for me.
History shows, Judges in this country will always place children in the care of a questionable mother before even considering an exemplary father, the last 30 years have shown us this to be true!
Sadly the mother will not be able to share a real relationship with this child, this is entirely her own doing and a consequence of her actions!

> Only about 5-10% or so of separations end up in the Family Court.
That’s a helluva lot of cases given the number of separations involving kids.

Right, so the father shouldn’t have pursued this matter and should’ve let his son live with his g/f in the bush, in contravention of court orders? You don’t work for CYFS by any chance?
January 24th, 2007 at 11:52 am
Like culma I was surprised that the father had custody. The Family Court does appear to have an aversion to equal opportunity when it comes to custody and even shared custody.Thank God I didnt have the need of their questionable services. Likewise I have a most uneasy feeling about CYFS or whatever its name is this week.Seems these outfits have had a brain transplant as to common sense.None of them inspire confidence All seem to be run by wackos out of left and I do mean left field
January 24th, 2007 at 1:18 pm
Ideally I would agree with the comment that children should have the benefit of input from both the maternal and paternal families.
Realistically some families are not able to be matutre, honest or compassionate about their differences and so therefore children can become innocent victims of adults selfish and malicious behaviour.
The rights of children must be upheld at all costs and they should be protected from those that are unable to act in a manner lacking hysteria and prejudice.
Let’s hope Jayden’s family can rise above this awful mess, but clearly Jayden’s Dad is the best place for him to be at present as clearly his mother’s family are unstable.
January 24th, 2007 at 1:27 pm
gd – just to digress a little, in the PC society that has been erected around us, through the age of the struggle for equal opportunity the Kiwi bloke doesn’t get any of the same considerations shown to him that are heaped upon other sectors of the population.
I say good on you lads, and it shows the average kiwi bloke is a hell of a lot more mature and restrained than he is given credit for, although you’d have trouble convincing Helen and the carpet munchers on the 9th floor of this!
CYF’s miss most of the child bashing and maiming anyway so what are they there for? Is this part of Labours total employment strategy, “don’t care what they do as long as they don’t show up in the unemployment stats”
Food for thought anyway!

obviously most respondents to this thread have not been doing their homework!
The mother has used every means posible both fair and foul to stop the father haveing ay access to the boy. Including but not limited to.
1 has used over 20 different lawyers
2 has made many outrageous claims to ploice and the courts about the father (all and every have been found to have no truth in them
3 took the child to australia against the explicit instructions of the court and only came back when threatened with arrest.
4 Bodged up a false DNA test to con the court into believing that the father was not the real father (later proved to be false after a real DNA test, and they look like peas in a pod too).
This woman has gone beyond any semblance of decency and if it wasn’t for the additional damage that would be done to the wee lad I would recommend a lengthy jail term and a ban from seeing the boy till he is 18.

Culma ,if Jayden stays forever with his dad ,and he returns to school, kids who are cruel will tease him, MUMS in prison, etc etc,his dad is having a kid by another women, he will become second fiddle,he will be watched like a hawk ,and have no real freedom, because his mother ,if she dosnt top herself , because of non access might do something stupid,But this is all in the future, Shes not going to drop this unless she imprisioned for years and would you love your dad if mum was there because of(prision)

Sorry Russel little boys love their mothers and not pregnate strangers, This prison term you want her to get, LONGER than what graham burton is likely to get ,ten yearsSorry Russel little boys love their mothers and not pregnate strangers, This prison term you want her to get, LONGER than what graham burton is likely to get ,ten years< do you think haydens going to bond with this strange women, and a dad that in haydens mind put his mum and gran in prison, SHIT GOING TO HIT THE FAN,in this case and CYFS and the family court seems to be run by out of toach tossiers,. a tragity in the making
January 24th, 2007 at 5:56 pm
Russell I have had 28 lawyers and my case that has only cost the country a few million, however I get bagged for bringing it up so all I will say about it –Question – was all the public money well spent Dishonourable PM Helengrad? Enjoy it did you? – Yeah right!!!
For me the Jayden Headly case has given me a small glimmer of hope and some inspiration that the feminazi influenced family court may have come to its senses. I have been arguing the parental alienation syndrome (PAS) since 2001 to no avail.
I am stunned that a judge would mention classic symptoms of PAS like;
“ Jayden should be returned to his father, who offered consistency rather than conspiracy “ And the court was told – “Jayden was anxious and confused and had been schooled to think in a particular way – exposing him to on going manipulation –a plot by the maternal family to systematically alienate”.
Never, never, never give in d4j – justice is coming watch the sky….. the F4J Bat will fly

Interesting that Nat Radio reported before 6pm on day of Jaydens reappearance that a ” Social Worker or Pyscotic expert had determined that Jayden had been brainwashed and manipulated.Amazing how quickly they can determine that without interview. TVNZ tonight reported that Jayden lived in a tent and ate 2 wild birds a day caught with a piece of string. In the absence of Golden Eagles or Wild Turkeys( except those in the Beehive and in most SOE’s)this has no credibility so, are the state broadcasters being economical with the truth again or are they so thick they report total bullshit without realising it?
Also of interest is the Judges comment that the Grandfather cannot be bailed as he is a danger to society – its fact he took away his own Grandchild – admittedly a wrongful act – but did no physical harm and returned him without force. Compare this to release of the Kahui twins alledged murderer who is released on bail and the police bitch about the Headleys family non co-operation – could be they did not know anything – compare to the active obfuscation of the police by the Kahui family. As a caller to Radio Lives JT & Willy Jakcson show the only explanation appears that the Grandfather did not have brown skin.We need more sites like the CYFS watch one to expose, name, shame and detail the assholes who pretend to be social workers, police or family court judges and get it wrong too often so that society is aware of what is going on and by whom – if you have nothing to hide what have you to fear – I hear this used against the citizens reasonable fear of mainly Labour govt interference in their lives so the message is Helen et al if the kitchen is too hot F**k Off.
