Alleged rape victim charged with making a false complaint
April 15th, 2007 at 3:57 pm by David FarrarOh dear. Have just heard that the women who claims someone pretending to be a police officer raped her, has been charged with making a false complaint, and has been referred to mental health professionals.
She has needlessly terrified a lot of women in and around Papakura. And sadly she adds to the climate of doubt around genuine rape complaints.
I hope she gets the help she needs. But I also hope she does get sanctioned by the court. At least her false complaint was a general one, which isn’t as bad as a false complaint of rape against an actual individual (which can destroy their life).

Wonder where she got that idea.
At Midday , I was still hearing on radio bulletins, that ‘this person could attack again’.
You could actually ‘invent’ a ginger headed guy , 6 ft, blue jeans, black windbreaker, 35 or so, driving a white van, who is wanted for a brutal rape and would other women who may have been attacked, to contact police.

The problem is that is you let off false ausers with thae same sentences as rapists and murderers they are likely to get home detention on full benifit and release into the custody of their whanau for xmas.
BTW rapists rape. Police officers try to uphoold the law despite the berst efforts of the politicians and the judiciary.

Can’t you raise just a smidgen of anger at a woman who attempts to cast suspicion over ever more men? She was lead item on peak time news for two days. Who knows how much resource she has diverted from the rest of South Auckland.

Does anybody know why the government does not actually collect any statistic’s on how many people make false allegations of rape and domestic violence to the judiciary? How it is actually possible to effectively evaluate any safe guards, which are said to be in place to protect people from false allegations of abuse in the courts if they do not collect this information?

I hear on TV that 2% (or fewer) of rape complaints are false, so I thought I’d do some research.
Apparently
The 40% number of false complaints that you sometimes hear appears to come from the amount of women that recant (archives of sexual behavior (1994) this would be inflated by women who don’t want to go through the pain of court.
The 2% (sometimes 1.6%) seems to come from the 9% that were found to be “false” complaints in the UK and then taking out 7% or so because the police in the UK had a multi tiered system that tended to include “uncertain” false complaints as “false” (although they also appear to have included complaints with no defendant as true).
As I understand it this 9% would exclude those found not guilty (after all the conviction rate is quite low I believe) and those that took plea bargains (which is effectively a statement by both parties that it might not be worth going to court).
Anyway the breakdown of reasons the police in the UK gave was a bit over a third malicious about a third mental illness and a little less than an third ‘attention seeking’.
There is a similar claim that about 2% of murder cases are based on false evidence. Although more recent evidence in the US seems to indicate that more than 2% of murder convictions seem to be insecure. One would expect murder cases to be significantly less likely to result in false convictions and for false allegations to be less likely to lead to convictions than true allegations. (I.e. the number for false convictions should be lower than false allegations which is the number under discussion)
In about 25% of cases where DNA has been used the primary suspect has been excluded (which doesn’t say anything directly about false accusations but does say something about why charges are often not brought).
On the other side of the coin the conviction rate is about 5% in the UK (and if there are 2% false convictions its 2% of 5% or .1% compared to 93% guilty getting free i.e. 930 times) and about 8% are no crimed in the UK against procedure. (I.e. the sort of ‘not caring lack of response’ issue). Countries with Jury systems seem to get low conviction rates on rape by a huge margin compared to those with judge based systems.
Interestingly in Sweden 34% of women report having been subject to sexual violence since 15. I’d expect them to have some of the best reporting figures. Better not to be a woman in
Sweden though apparently, maybe the sweedish boys need a smack !

I think it depends whether a false complaint is laid against a specific person. If its a false complaint with no accused, then I’d deem it less serious.

BTW, I was slammed just a week ago for saying the Police investigations in the historic complaints as per the Bazeley report would bring the nutters out of the closet, I feel a little vindicated, and maybe I should retrain as a psycholgist.

If you were robbed, assaulted, or the women in your life violated would you want the first thought the police to think being “is this genuine or a nutter?”

I think in fairness to the police investigating this case, they were suspicious at the outset this may not be the ‘real deal’ as they were running ‘tandem’inquiries…This woman should be and will probably be slam dunked however this does not prove that women who lay rape complaints are all liars as many other posters would like us to believe. I dont know what would constitute a just punishment but given the amount of time and resources that went into these inquiries, a bill for her efforts does not seem to be unreasonable option to start with.I dont imagine she will have engendered much sympathy or support in any camps and she has almost certainly undermined the genuine victims of rape and their quest for justice. A cruel and loathesome act for sure!!!

Finding the statistics for false rape claims is next to impossible, but it certainly is much higher than 2-5%.
Most false accusers get permenant name suppression, and are never charged hence the vastly inaccurate and misleading statistics often quoted by those who rely on funding and ACC sensitive claims thriving so they can retain their jobs.

The recent false rape hoax highlights a problem that is unfortunately far too common, spokesperson for peterellis.org.nz, Brian Robinson says.
The crime of false allegation is not rare. In the last decade there have been over 400 cases each year of proven cases, the majority relating to false allegations of sex offences. Most of these cases are not publicised.
There are also many more cases where false allegations occur but the perpetrator does not confess. In these cases the victims suffer severely, and some are even wrongly convicted. Very few victims are as fortunate as Clint Rickards was, to have a family photograph of himself in a plaster cast that indicated the complainant was lying.
It is unfortunate that the media sought comment about the latest hoax from people who have a history of minimising the problem of false sex allegations. Their response was sadly predictable.
Dr Kim McGregor of Rape Crisis claims that only two to six percent of rape allegations are made up. The only thing made up are the statistics that she provides. Psychology lecturer Dr Neville Robertson says that false complaints are extremely rare. He is presumably basing his claim on the tiny proportion of false rape complaints that are reported in the media.
Victoria academic Dr Jan Jordan provides an excuse for perpetrators by claiming – without justification – that they may have been sexually abused. She could well study the more common reasons why false complaints are made.
Regardless of how common or uncommon the problem of false allegations is, all allegations should be treated seriously, and investigated impartially. Justice for real rape victims is not enhanced by simply routinely believing the stories of those making false allegations.

BTW, saw in the paper this morning that the woman in Papakura has apologised for the anguish she caused her neighbours.
This is a very brave thing she has done and she should be applauded for this. Most of the falsely accused want nothing more than their accuser to feel remorse for what they have done, and believe me this women’s actions were a lot less malicious than if she had deliberately targetted an individual.
After initially being very impressed with the head of the investigation, I was dismayed at his scathing comments about the apology being too little too late. At least this accuser did not cause the damage the police do when they ignore evidence and alibis in false accusations of rape and cost the tax payers and individuals very dearly. in time and money. How many police officers do you think would be honest enough to admit they got it wrong and say sorry?
I have always believed we are accountable to God for the acts we do, and the guilt of destroying the lives of others intentionally must eventually become a huge burden.

Speaking as a man who was falsely accused of rape and several other charges by a step-daughter, and was convicted of Lewd and Lascivious Behavior and Criminal Threat when I was able to show that I was in another state an hour away at the time of the alleged offense. The whole thing about innocent until proven guilty does not mean SH@t. After the trial was over, the prosecutor stated in front of me, my attorney, my mother, the Judge and myself that he did not believe his client and he felt bad that he “had to represent her to the best of his ability”. After having been asked if I would submit to one, I offered to take a polygraph test to prove my innocence and was denied. I later was able to show them an E-mail of hers from an account that I had sat up for her, that she admittedly lied about the charges and that at 14 she was sending nude photos of herself to a 26+ year old man. This from the kid who said she refused to be examined because it was too embarrassing. Do you think this did anything to help my case? No, they took the evidence and locked my ass up for invasion of privacy and violation of a no contact order. They never even went after the man she had sent the nude photos to. So having to live with this type of B.S. hanging over my head, I have no sympathy for a woman who does this type of thing. I think she should be imprisoned as a sex offender and made to suffer the same fate as the one she falsely accused would endure.
