Why is he not in jail?

I’m all for rehabilitation but there comes a time where one has to put the safety of the community ahead of the 0.0001% chance someone may now stop offending.

The Press reports on Andre Charles Port who has been given merely a supervision sentence for assault despite being assessed as having a high risk of further offending.

Port went to the Kingslea youth detention centre at the age of 10 and had spent most of his adult life in jail for a series of violent or sexual attacks. By 1996 $250,000 had been spent on rehabilitation for him. He has made a series of attacks on mainly women.

To be fair to the Judge, the Crown actually suggested a supervision sentence. God knows why – he sounds like a case for preventative detention. I suppose once he has actually killed someone then it may happen.
