SOE cuts off power and life
May 30th, 2007 at 3:51 pm by David FarrarHow awful. The SOE Mercury Energy (part of Mighty River Power) cut off power to an Auckland house, even after their representative was told a woman needed it for her home oxygen machine. She died shortly afterwards.
Now we only have one side of the story at this stage, but it sounds extremely bad from what we do know. Mercury and/or their subcontractor may even face homicide charges.

Sounds like an awful situation. I very much doubt that the contractor knew it might kill someone when he cut off the power – surely nobody would do that.
I’m tempted to point to failings in the SOE model, but ultimately I think this is just a tragedy that no organisation, public, SOE or private, would deliberately cause. I doubt very much that ownership structure is relevant.

It was on the late edition of 3 news with parts of the interview on Campbell Live. My first reaction was that it was a terrible thing to do – but then there was also a doctor who said that she would have had plenty of time to call a doctor/ambulance. And her son said that he offered to call someone but she said she was ok. 2hrs later she was dead.
Cutting off someone’s power to their oxygen is pretty sick (assuming the technician knew what he was doing) but she did have two hours before she died. Seems to me like she was just very stupid.
Can you really blame Mercury Energy for her inability to call an ambulance?

What concerned me was Trevor Mallard’s meeting with the Police. I appreciate he is Minister for SOEs, and Labour are low in the polls, but I would prefer that he didn’t interfere in Police business. Can they not make up their own minds whether there is something worth pursuing? Do all high profile cases have to be okayed by Helen?
There seems to be an awful lot of hand-in-glove-ery going on these days between the Gummint and the Police and it reeks.

It is Mallard’s fault. He is SOE Minister and you can be damn well sure that if there had been a National Government the Labour Party would be screaming from the rooftops asking for SOEs to be disdanded back into Government Departments and the electricity reforms reversed and indictments would be laid against Ministers. Let us see how Mallard deals with it, so far so good.

I have worked as a contractor carrying out disconnects/reconnects and my and sympathies lie with the poor fucker who was doing his job. Over the years I’ve heard every excuse under the sun, I’ve been attacked by mad women, had people set dogs on me,had people set their kids on me,had dog shit, human shit and nappy buckets thrown at me. I’ve had people run my ladder down, try to run me down, steal gear from my wagon, make threats against me and my family and of course there’s the usual claims about cheques in the mail or “it’s the banks/winz etc fault”.

Well, it’s not a ‘typical Samoan thing’. My palagi grandmother was every bit a ‘don’t worry about me, don’t make a fuss’ stoic; but not to the extent that any of us would have let an elderly, and increasingly frail, woman take silly risks with her own health and safety. And believe you me, towards the end she HATED being in residential care, rather than her own home.
Anyway, I know this is a {sarcasm on) minor technicality (sarcasm off), but what I find ‘extremely bad’ is that the media, yet again, has decided to act as prosecutor, judge, jury and executioner in a trial by media. Again. Perhaps this makes me a limp-wristed liberal pussy, but I actually believe in the rule of law, natural justice, due process, and all that presumption of innocence crap.

Obviously a huge PR disaster for Mercury but that will blow over in a couple of weeks.
The family is going to have to live with the fact that their mum is dead because they were too cheap to come up with the cash for her and too stupid to do something sensible when the situation deteriorated.

Nothing like personal responsibility – what was the family doing during the 3x hours while their mother was obviously in dire need?
Probably they expected Nanny State to do something . They certainly appear to have done zip, prefering to underhandedly, via their union rep spokesman, blame a company from which they were theiving and due process was being served.
I know that if I knew any person was in such dire need, I would have done everthing in my power to provide the necessities of life. I hold the family and no-one else responsible.

It might be worthy of note that this family was attempting to pay this bill, they had made 2 smaller instalments and weren’t that long overdue.
Very heavy handed all round I would say.
Certainly Mercury Energy’s brand is shot to shit at the cost probably of millions of dollars, piss poor management.

The Cave Creek disaster was the result of negligent procedure. I can’t recall whether anybody was held accountable?
This sad mishap appears to be lack of procedure by possibly all the parties concerned?

The sad part is that most of the comments here are coming from people who are blaming the family for their predicament. It’s a thin line between have & have not. Often people (especially those from non euro cultures)do not realize the seriousness of their postion till the s*** has hit the fan.

Mercury E need to at least make a statement regreting what has occured instead of being edited out, and being left with cold statements confirming that correct procedures were followed.

I find everyone in this discussion seems to be blaming the family. I find it highly disrespectful and insensitive, and to be honest extremely offensive (one person even called Mrs. Muliaga “stupid”). In a culture where they have been brought up with nothing but intangible values and qualities, pride is essential in their household. The inability to pay the bill is grossly misunderstood by many people as I find ignorant comments like “She was too lazy to pay the bill” or that she simply waited for “nanny state” to do something. Shame on you. The woman is dead and you bluntly insult her and her family (without any consideration for the rest of the facts in the case). Let me remind you that she was a full-time early childhood teacher, her husband an assistant chef. I would like to see insult your parents as they struggle to support 5 kids on one wage and an invalid’s benefit. I understand the responsibility that fell on the family to assist their mother, but no one has mentioned the role that Mercury Energy played in this tragedy. Although some of you may not understand why she refused an ambulance, I somehow doubt that either Mrs. Muliaga or her son would hide the fact the electricity was needed for her health (emphasising the word HEALTH and NOT life). Manslaughter? Definitely. To kill WITHOUT intention is essentially what manslaughter means. But I have a feeling this will NOT be the charge. There is a section of the law which says that no business has the right to endanger a life – this relates to an earlier post referring to ‘natural justice’ (which I presume means Natural Law). Natural law = a person’s right to live – TO BREATHE. This is something that Mercury Energy failed to submit to and it is here they have failed the Muliaga family.
