High risk and violent but on home detention

June 15th, 2007 at 9:40 am by David Farrar

Home detention is a useful corrections tool. And inevitably some people placed on it will abuse the privilege (which it is).

But why,oh why, would you put on home detention a man who was assessed to be at high risk of reoffending, and had a violent past.

Amusing that Paris Hilton can’t get home detention, yet violent likely to reoffend prisoners in NZ can.

I note the LA Times has now done a review of sentencing in DUI-probation cases.

The Herald carries the Reuters story on the LA Times story here:

    http://www.nzherald.co.nz/section/1501119/story.cfm?c_id=1501119&objectid=10445855

Paris’ received a sentence harsher than 80% of people convicted of a similar offence in LA (and, one interpolates, far more than 80% of first time breachers of DUI probation).

Her record is probably in the 20% category of the worst offenders so its useless to compare with similar

    http://en.wikipedia.org/wiki/Paris_Hilton
In September 2006, Hilton was arrested and charged with driving under the influence of alcohol with a blood alcohol content of 0.08%, the minimum at which it is illegal to drive in California. Hilton’s drivers license was subsequently suspended in November 2006,[36] and in January 2007 she pled no contest to the alcohol-related reckless driving charge.[37] Her punishment was 36 months’ probation and fines of about $1,500.[38]

On January 15, 2007, Hilton was pulled over for driving with a suspended license and signed a document acknowledging that she was not permitted to drive. [39] On February 27, 2007 Hilton was caught driving 70 MPH in a 35 MPH zone, again with a suspended license. She also did not have her headlights on even though it was after dark. Prosecutors in the office of the Los Angeles City Attorney charged that those actions, along with the failure to enroll in a court-ordered alcohol education program constituted a violation of the terms of her probation.[36]

The breach of her probation a second time ( 1 month after the first) is something judges take very dimly.

Put all together she wsnt going to change!
Plus the judge may be HIS normal sentencing for such things.

The violent offender you talk about didnt get ‘home detention’ as you assert. He was sent to jail! The home detention came as part of his pre release at the end of his sentence.

Selma – you may be right about Paris, but I recall Ruth Dyson being convicted while an MP, and can’t think of any others off the top of my head (Donna, for example, was sacked before convicted; and Brownlee didn’t face conviction, and nor did Nick Smith (both their court matters were civil)).

    You think that’s bad?

A woman who ripped off her ex-boyfriend’s testicle with her bare hands has been sent to prison.

Amanda Monti, 24, flew into a rage when Geoffrey Jones, 37, rejected her advances at the end of a house party, Liverpool Crown Court heard.

She choked and spat it back into her hand before the friend grabbed it and gave it back to Mr Jones. Doctors were unable to re-attach the organ.

In a speech on Monday, Justice Minister Mark Burton praised the home detention scheme, which will soon be a sentence in its own right.

Madam speaker, I can give many examples of home detention prisoner’s engaging in the distribution of drugs , entertaining truant girl schools and selling stolen property as gangs think home d is the cats pyjamas. On one hand the deluded justice officials praise the scheme, while reoffending rates skyrocket at an alarming rate and prison workers like doctors and counsellors face enormous stress. Unfortunately these extremely experienced caring and compassionate professions want out of a totally dysfunctional system for the sake of their sanity. I had a screw only yesterday tell me that the prison system has been “ f##ked up by silly gummint as those criminal bastards got more rights than us and they enjoy laughing in our faces about it .”

The New Zealand department of Justice and Corrections are both in need of a total revamp and overhaul otherwise the tragic status quo will meander on for years, that is, murderous scum getting $60K from trany grany HRRT, corruption, prisoners housed in laundry cupboards and police cells. This utopian government is so far disconnected to reality I doubt a power surge from above would be hardly noticed by the delirious fools.

Selma, don’t start something you can’t (or won’t) finish. The question should be “What party ruined the career of a serving Police Commissioner?”

or “What party hangs serving police officers, civilian drivers and the DPS out to dry?”

or “What party orders its minnions to destroy evidence of art fraud?”

or “What party rewards “prima facie” cases of criminal behaviour with seats at the Cabinet table?”

Do you get the picture? No, didn’t think you would!

And for the record, the government has not defined prisoners’ rights…parliament did that…via legislation. Even scumbag felons – ummm….that would be you, wouldn’t it? – retain fundamental rights unless a court takes them away. That’s the way justice is done in this country.

Don’t go around citing anonymous COs as if you’re in a position of knowledge. Perhaps you should declare that your expertise in this matter – if you have one – is derived from your experience as a convicted criminal. That might help people understand the underlying context of your rants.

DPF: Why have you categorised this as a Corrections issue? Decisions about home detention are made by judges and the Parole Board. The only interaction with Corrections is to provide advice and information. In this case, Corrections’ advice was that the offender was high risk. The fact the NZPB goes off on its own tangent is not, I think, a Corrections issue per se

Yeah, DPF’s posting engine is a little cruddy. But here’s the thing Deadbeat Dad for injustice, you’ve managed to once again ignore the substance of the posts.

    a) you’re a convicted criminal – so it’s a bit rich to get obsessed with other’s criminal history
    b) you’ve been to prison – so your offending is at the high end of the scale. So, once again, it’s a bit rich pointing at someone else’s offending if they’ve not been to prison but you have!
    c) you’re clearly in denial about your offending and you still seem to be a present danger to the community. So, once again, I wouldn’t be chucking stones at parolees and the probation service. When you’re an unrepentent criminal – you have no valid view on the work of the probation service.

And don’t keep linking me up with those liberals. I am not with them. I am just against some crim trying to pass himself off as legit using the anonymity the web affords. No, it’s worse than that – not only tries to pass himself off as legit but also has the unmitigated gall to shout ill-constructed abuse at law-abiding citizens. If you acted in public the way you act in these posts you would have been arrested and slung back in prison. In fact, judging by the irrationality you clearly demonstrate on occassion, I wonder whether you’d end up in prison or in the Mason Clinic.

Most conservatives not only more prosecutions for transgressors – they want longer, harder sentences.

Geez, “stinky”, you multi knicked coward, talk about self serving bullshit.

Get real softcock. You’re just another brain damaged leftist hate merchant who repeatedly confuses opinion lies and personal attacks with fact.

Whatever terms I may use to describe leftists/ socialists/ Marxists, I at least try to stick to the topic Mr. Farrar has raised. Your messages here are always off topic and nothing but cowardly attacks on D4J at the complete expense of any discussion on the issue. You stalk him and turn every thread into a litany of abuse against D4J.

Your constant use of multiple knicks is another example of cowardly behaviour and shows you have absolutely no concerns with decency or what is right. You merely want to stalk hate and harass D4J by means of actions that totally undermine the coherency of discussion on this forum. If everybody emulated your disgustingly barbaric level of behaviour this forum would collapse overnight as nobody would have a clue who they were responding to.

Furthermore I am not “bedding down” with anyone. I am attacking your disgustingly barbaric and cowardly behaviour, and your self centered lack of regard for the mechanics that allow discussion to occur on this forum.

Here’s what I will say in respect of D4J. If he is what he is, its partly because you and your stinking leftist values that have made him that way. Any father falling into the clutches of that Marxist controlled monstrosity called the Family court is subjected to a level of injustice bigotry and partisan outcomes that could only exist in a sad socialist basket case of a country like NZ.

Any man that stands against these Marxist and feminist tyrants is going to suffer terrible injustices and unbelievably unfair treatment, and will most likely end up totally estranged from his children. (rejection of the Equal Parenting Bill is ample evidence of what a farcical organisation the whole stinking structure is) If D4J was a committed leftist the likes of you would be writing here asking for forgiveness and understanding because of the stress he was suffering from.

I concede he may not fully understand the politics of his situation, but he’s getting there, and like a lot of NZers, he’s finally waking up to the understanding that all of NZ’s social political and economic problems can in the end be sheeted home to the overpowering influence of a coalition of Marxists in NZ’s media, government and academia over the last few decades.

When you post these attack messages you call yourself ‘Stinky’. Good choice. The stench of Marxism hangs over this country like the foul air of a sewage farm, and its mostly emanating from fucked in the head control freak hate merchants like you.

We’re going to clear the air and rebuild this country Stinky. Soon it will smell like daisies. The Mortein is coming. Pfffft.. we’re gonna aerosol you away Stinky.
