Rodney on s92A

NZPA quotes Rodney Hide:
ACT leader Rodney Hide wants the controversial Internet copyright law repealed and says he will recommend that to the Government.
“It’s one of the stupidest new laws imposed by Labour and I am taking steps to get rid of it,” he said at his party’s annual conference in Auckland today.
“It should be repealed…it is fundamentally flawed because it breaches the principles of natural justice. It makes people guilty without trial and that is wrong.”
Go Rodney.

Yes, it’s excellent news.
Rodney also just mentioned this in his Leaders Address, which is still going on.
ACT on Campus are live-twittering the conference here: http://www.twitter.com/actoncampus

If this was a Labour govt initiative why hasn’t National simply caned it
Why does Rodney have to fight it.
The way he’s going, Rodney’s gonna be the PM after John has finished his tenure.
I can see him becoming very charismatic.
Can’t see Roger being around in eight years though, but ACT…. wouldn’t be surprised if there’s a Young Act branch soon.
THat’s to say ACT isn’t going away this half of the century.
Have to say though, be pretty sad if Labour and National are still squabbling by 2050

Er, http://www.actoncampus.org.nz
we’ve been around since the very start of ACT.

I’d be interested in an analysis that supports the view that section 92A breaches natural justice. (We’re not talking about “guilt” here; there is no obligation for criminal fair trial rights…)
And, of course, even if this is a situation where some sort of quasi-hearing rights or other natural justice principles apply, then section 27(1) of the Bill of Rights would apply, such that the statutory provision or policy mandated by it would be interpreted to required the provisions of these rights.

You sure Rodneys not talking about the proposed ’3 strikes’ law?

I’m REALLY enjoying seeing Labours bad legislation being ripped out and torn up.
Almost as much as watching the reaction from the the socialist lickspittles.

Actually Phil, I wouldn’t have said that about Rodney for nothing.
He’s very consistent and hasn’t let up since he’s been in parliament. Never tires.
He’s definitely stood out to the electorate and if he secures the image of keeping National honest, even with their good ratings, he’ll ceate an electricity.
Act is definitely the next option after Labour and National and Labour is severly wounded. If it doesn’t get shots to its system to improve its health, Act is going to balloon. They will cast the Greens in their shadow. Any up and comers from their youth branch to give the party a fresh palour will only do it more good.
Mark my words Phil, if ACT becomes a movement it will be unstoppable filling the void.
Who thinks National can smell it?

Aren’t ACT at something like 1.2% in current polls? How do you become a ‘movement’ that ‘will be unstoppable’ from 1.2% support?

“…it is fundamentally flawed because it breaches the principles of natural justice.”
You sure Rodneys not talking about the proposed ‘3 strikes’ law?”
Please explain how it breaches “the principles of natural justice?’
It puts away scumbags that have REALLY breached the natural rights of others….and deters others from making a habit of it.

‘Please explain how it breaches “the principles of natural justice?’’
Don’t read the news much do you James? It was the Attorney-General Chris Finlayson who said it may breach the Bill of Rights.
The ACT response was “So what?”, “Alter the Bill of Rights Act. We’ve got too hung up on people’s rights.”

You mean a a bit like this? YesWeDid?

Read my post properly.
THere is a great chasm opening between National and Labour.
If it continues unabated Labour won’t heal.
They largely lost because their suport base felt too humiliated to vote. Obviously, their support base is not as communist as its leaders.
Under MMP there are two parties vying for position: Act and Maori.
Maori don’t have tha mainstream support to lead.
Act has the ability – I saw their grass root campaigning in small town NZ – to fill the void.
But here’s the scenario I see in a the next decade: English being leader and Rodney his deputy.
If Winston proved anything he proved how the potential of MMP can be wrung and squeezed like a wet cloth.
