Thats why it shouldn&#039;t be suppressed in the first place...Besides what do impressions matter once the case has been determined. The important thing should be that Justice is transparent and that Judges are accountable for their orders.</description>

As I understand it the decision was made by the Court of Appeal and must be followed by any lower court.  I think the distinction between the suppressed evidence and that allowed was that the suppressed evidence had a prejudicial component that was irrelevant to the Crown case whereas the evidence about Robin and Laniet had a direct bearing on motivation in this case.</description>
