Questions re Pike River fund….
1. How many individual contractors were employed at the mine?
2. How many perished?
3. Since “employees” will be getting redundancy etc… should not the individual contractors (not companies with several employees) get some priority in the allocation of assistance?

flipper – no, the receiver (and liquidator -probaby ‘when’) have no legal mandate to give some unsecured creditors priority over others. to say that ‘one person’ contractors should get a priority would imply a special legal status for them via a vis other contractors.

These ‘one person’ contractors could go off to the Employment Tribunal and argue that they are in reality employees and if successful would give them ‘priority’ over unsecured creditors.

Flipper, that’s a stretch too far.

Extending a redundancy notion to this type of situation is in complete conflict with the fundamental elements that distinguish contractor and employee relationships. Redundancy payments are an employee benefit as is, broadly, security of tenure depending upon the contract terms. Self-employed contractors are in the same position as contractors with more than one employee. They trade off employee benefits for business opportunity which includes, amongst other things, a premium charge above the cost of labour. The fact that it is their own labour in the case of self-employed contractors doesn’t alter that principle, nor does the fact that this is a national tragedy.

Assume for example, contractors at Silver Fernz in Te Aroha were in the same position, would that still be a case to treat contractors differently? The only difference between Silver Fernz and Pike River is death and thats why the emotions take over. If there had been no deaths at Pike River, would you have still put the question?

Why is it that the MSM have been so quiet about the disgusting racist comment by Trevor Mallard that Tau Henere was a chocolate covered banana? If and ACT MP made such a comment the Herald would have it on the front page for a week and censor the comments to their blog. We have Phil Goff saying Key should be condemning Pansy Wong yet I heard him on RadioLive saying that Trev’s comment were just banter and Trev gave as good as he got. I would like to know what Tau said to justify such a comment.

I guess on reflection that such a comment from from Phil likely replacement si not surprising from such a racist party. I think Louisa Wall is the first Maori Labour has given a chance at a safe general seat.

Maybe Trev would like to comment.

He even explained it last night on Back Benches, stressing that yellow was his main point. At times Mallard comes across as a determined, hard working, knowledgeable politician, but can’t help delving in the shitty side. His arm doesn’t look chocolate, too often.

I saw on a TV commercial about Brainetics, which is a program that’s supposed to accelerate kids learning in maths. I dig around the internet to see what evidence or opinions that has been said about the product and I didn’t find much. BUT watching the vids on their website and I came to my own quick conclusion:

#1) Such program is unlikely to get kids to excel when they’re advancing to higher level
#2) It looks like rote learning to me, which is a form of learning that won’t advance kids understanding
#3) It concentrates on a small sets of fact memorization (just multiplications or squaring of numbers) but not much about anything else in math
#4) They don’t teach kids concept formations (it is bad)
#5)… and may be more

Overall, I won’t be bothered to buy this program for kids since it hasn’t shown that it can help kids long term. It may help them in their quick multiplication , such as squaring of 2 digit numbers (eg : 75 x 75), but that is rote learning and not concept understanding & formation which is what underpins learning, ie, integration of different concepts and form them into a whole (with no contradictions). This will enable the learner to think outside the square.

Any parents here who have bought this program?

Peterwn, leaving the receiver etc aside, there is NOTHING to stop the shareholders reaching in their pockets to at least pay all the small contractors.
Pretty poor that THEIR employees are dead in a mine and it seems they have made no effort to get the contractors who took in the rescue attempts, paid.

A nasty cynic might just start to believe that those shareholders believe the mug taxpayer should pay for the recovery of the bodies.
Ah, the wonders of LIMITED LIABILITY.

I have been coaching Physics/Mathematics (both senior high school & university level) in the evening to students (mainly to those of families & relatives including some from the Tongan community) over the last 8 years or so. Rote learning is good for fact memorization (which I teach them only on a small number of facts), but I also tried to get them to understand the WHY’S & HOW’S? There have been some students that their parents came to me asking for help, which I found was too late, even if it was Einstein who was their tutor, they wouldn’t have improved. Overall, I have lifted their learning ability dramatically. All of those who came thru me have followed on courses in engineering, medicine and science.

It is only this year that I have started coaching primary school kids as well. There are 4 kids that I started a math program with them since the beginning of the year. There is one 8 year old, a 9 year old and a 10 year old. I find that the 9 year old learns better. His learning & understanding is getting faster & faster compared to the beginning of the year. The 10 year old is to sit Cambridge AS-level math (year-12 equivalent) and the 9 year old is to sit A-Level math (year-13 equivalent) at the end of next year (ie, November 2011). The 8 year old won’t be sitting any external exam until 2012 because I find her a little bit difficult. The 9 year old (which he’s also taking both Cambridge Mechanics papers – equivalent of Physics University stage 1) is my best student and here are some of his YouTube math vids:

#1) Calculus (Polynomial Indefinite Integration)
#2) Calculus (Polynomial Differentiation)
#3) Algebra (Linear Simultaneous Equations)

My primary students are not gifted (@ the beginning of the year), but I believe that their knowledge now, they can be regarded as gifted (not natural but manufactured – ie, via external help).

I believe that my methods if being applied to other kids (gifted or just average), they will improve in their maths 100 folds. I believe that my method is not special at all. It is that kids’ minds are very receptive & absorbent at those young ages to concept formations. I just happened to give it to show it to them, but they’re there waiting & ready to roll.

Finally, I may publish a series of online articles of how to accelerate kids’ math learning, i.e., condensing what’s being taught in 10 years to just 1 year. The more likely site that I will publish these is Not PC blog. It will be a tutorial, showing step by step of how to teach topics from low level up to higher level.

My online tutorials will be much better than the Brainetics program I mentioned above. Parents can follow them (with or without knowledge of math) and watch their kids knowledge of math grow.

Not all Maori are the same, they can range form 1840 obsessed to modern blended versions. The range of Maori MPs surely should reflect and represent the diversity.

All the Maori party are fluent,most of Labour hori MPs as well, it can be learned, the Nat so called hories who do not speak it well are just too bloody lazy to learn.

Wall gets a shot in the Labour Party more for her being an angry lesbian than being a Maori I expect. And the Maori Party MPs are not fluent… well all of them except Tariana and possibly Rahui. And in any event te reo shouldnt be a prerequisite given the state of fluency among the general (Maori) population. Just would like to see some effective Maori politicians of whatever persuasion – Hekia is promising, as was Shane Jones before his hand shandy escapades; apart from some of the Maori party the rest are pretty useless and have been for some time.

I’d rather someone given equal recognition in English rather than shoved to the back, no matter how many languages they can speak. Not all Maori customs fit in the modern world, so all part Maori MPs don’t need to go the whole old hog.

Ask someone who is familiar with the cultural Maori world.

Retaining some culture is fine, it adds colour to the community – I’ve heard a few bagpiper led parades lately, it’s graduation season here. They usually have a Maori component to proceedings as well.

It may be useful for MP’s to learn Spanish or Chinese before they become MPs. Once you’re an MP, you’re going to be too busy to learn a language fluently. John Key has picked up some Te Reo phrases, but as he says, he’s just too busy.

In all the media discussion about the state of NZ cricket at international level, not once have I seen an open query about the competence and performance of CEO Justin Vaughan.

He’s the boss of NZ Cricket, isn’t he? Does he not draw up the list of cricketers to be offered NZC contracts? Didn’t he recommend the appointment of coach Mark Greatbatch? Approve the strange management structure of the NZ international team? Organise the NZ domestic and international fixture list that draws pathetic numbers of paying customers?

I know of no business whose performance is so dire where the CEO continues to speak soothingly to the media without being challenged as to his own “contribution”. On the surface of it, the loss of Martin Sneddon to Rugby World Cup 2011 (an inspired appointment by the rugby boys) has proved to be an organisational disaster for NZ Cricket.

WTF…another case of lead tainted toys…three years after the first cases came to our and the worlds attention and after repeated assurances from the appropriate authorities that the checks were in place,the toys are still popping up on the shelves…inspecting/testing after the fact is a recipe for disaster.It is obvious that they cant check for everything and if we continue to import goods from nations where graft and business go hand in hand we will always be at risk… buyer beware.

I voted National! – What a mistake?

The seabed and foreshore bill should not go ahead!

I have been galvanized into action and am in disgust with the National party’s treatment and disregard for the majority of New Zealanders.

The Seabed and foreshore bill is the first time I have taken an interest in what is happening with politics, due to the number of people I know who have expressed and voiced the same concerns to me. I am sure there is a lot more things I should have been taking notice of as well.

In the main I have trusted that Good Kiwi People in Parliament will always do the right thing by people and for those that support them.

Unfortunately with the National Party that is a misguided trust and the old saying ‘never trust a politician’ it would seem aptly applies to the National Party and John Key

National Party does not have a mandate to proceed with the repeal of the seabed and foreshore bill

I wonder how many other bits of legislation are being passed with no mandate or support?

With my new sudden interest in politics, I submitted my first submission and went to voice my concerns at the ‘pro’ Maori affairs Select committee hearing!

I was given a whole 2 minutes and was grouped with 4 others who each were given 2 minutes! yet other people were given individual time – I assume that was because it was a Maori affairs committee and we all opposed the bill.

The ‘attitude’ questions that were asked by the pro Maori committee were ‘do you have a problem with Maori owing the foreshore’ and ‘what about all the rich Americans and Dutch that own coastal land – have you had any problems accessing their beaches’. There seemed to be a little bias attitude in the committee!

Well I personally, in all my years of surfing, have only ever had problem with Maoris and beaches, with intimidation, threats, and abuse, charging fees, Maoris on Horse back with black alcathene pipes being threatening. Maoris have always been the most unwelcoming people.

I have never had that problem with any other race of people who own coastal land.

I have surfed on pretty much every beach that has surf on in New Zealand Nth and Sth and have done so with respect, and simple requests for access and leaving it as you found it attitude!

I can only imagine more of this ‘Maori Welcoming attitude’ once John key and the National party hands the coast over

The Seabed and foreshore act should remain as it is, where all New Zealanders are treated equal for access, ownership, rights and equal opportunity for economic benefits and be able to have a say on this resource.

With one rule for everybody no matter of race, colour or belief.
No body should be able to do a back room deal with a minister for a privileged opportunity where nobody else in New Zealand can be heard or allowed to voice a concern.

No one based on colour should be given vast economic resources that belong to all New Zealanders
This is just plain wrong!

We are all one people, – New Zealanders with one rule for all

No one group should be given preferential opportunity over another.

Why is there a dispensation only for Maori and not for all in respect of the resource consent?

It is time that New Zealand moved on from race based legislation.

This type of race based politics does nothing to endear respect for the National party and in fact respect of the Maori people. -It is very divisive.

I am appealing to you to do the right thing and stop this nonsense and do not repeal the seabed and foreshore Act.

The National Party has already acting against the wishes of the majority of New Zealanders and from what I can see the majority of National Party supporters in certain bills and acts, and legislation.

Chris Finlayson would have to be a liability, calling good concerned New Zealanders clowns for opposing his blatant pro Maori biased support! – For which he is prepared to give up his holiday to help the Maoris. – I am offended by his comments! why doesn’t he join the Maori party

I for one will not be voting National Again due to this piece of racist, divisive, legislation being forced on good kiwis

Good on the Labour party for actually standing up and not supporting the bill!!

My votes up for grabs and I would be certain that everyone else who I can tell about these exploits will not vote National

Looks the the new Super City councillors are already going to give themselves a pay rise off the back of upping rates.

Increase in council charges and pay rise for Auckland councillors

The proposed rates increase of 4.9% is not the only shock in store for Auckland Ratepayers.

The council is looking to increase the fees and charges it makes for a variety of services such as dog registration, liquor permits and licences etc.

Another increase proposed is Councillors’ salary levels – an additional $200,000 has been awarded to the councils Governing Body by the Remuneration Authority, but will be funded from rates.

On Thursday the council will consider raising the Deputy Mayor’s salary to $120,000, committee chairpersons will get $96,000, and councillors $87,000.

Local Board members are also in for pay rises averaging $2,000 each.

This council needs to consider the plight of many ratepayers who will simply not be able to afford any rates increase – let alone a 4.9% increase.

The call from many ratepayers is ‘cut spending’ – and the council should pay close attention to the recent changes in legislation which require councils to decide ‘core services’ and impose their own limits on the level of rate increases.

Yes, unconscionable if incoming councils can decide their own salary increases almost as soon as they start their term. This is the worst possible look – but it may not be just those elected. Why the heck would the Remuneration Authority award them more money right now? Preposterous.

Gaffey has been busy with getting stuck into Pansy, holding onto his job and raising concerns about a matter involving a particularly attractive Asian woman to deal with this minor matter of credibility.

Plus he has to keep practising his new walk which involves endless visits to the gents in order to insert/remove the cucumber as required.

He’ll get onto the house sale when he’s got a moment. The coincidence in timing with the “journos” enquiries is just that. The matter was always in hand.

British Government to make the poor pay for pie in the sky eco-socialism.

Electricity bills will have to rise by up to £500 a year to pay for a new generation of environmentally friendly power stations, it emerged.

Chris Huhne, the Energy Secretary, will outline government plans today to encourage energy companies to develop low-carbon power plants, including nuclear power stations and wind farms.

Energy analysts say the Coalition’s plans will put Britain on course for a “high cost, low carbon” electricity market where consumers pay the price for environmentally friendly generating technology.

Energy companies say that the shift will require them to invest more than £200 billion in new power stations and networks over the next 20 years.

This wouldn’t have been a problem if the Greenpeace terrorists fucked off and they built nuclear power plants ten years ago. Alas.

Cops are implementing 5kph excess speed tolerance again , from 24th Dec to 5th Jan.

This looks like it will become a regular theme each holiday period.

A bit rubbish really, it is so easy to creep up 6kph on a really wide and straight open road.

Personally, i’d like to keep the 10kph tolerance, and permanently reduce the speed limit on some of the more marginal roads and/or black spots. Some of our 100kph roads are just not designed for that speed.

Proportionately how many accidents are caused by people driving between 100-110 kmh as opposed to higher speeds?

5%, 10, maybe 15%? The cops should use one of these if they want to catch dangerous hoons who cause accidents through speed, which is apparently what they say they want to do.

The really dangerous thing with holiday traffic are the slow ones who won’t pull over at every single opportunity. After 30 years of driving in holiday traffic my experience dunno about yours but mine is I’ve seen a few dangerous hoons over those years but not a lot, but almost every single long trip during holiday season I strike at least one often more people in the slow and inconsiderate category.

The country needs to rise up against power companies.

Just got a letter from Contact. Daily gas line charge up by 20% and the usage rate up by over 4%.

How the hell can these pricks justify these continued increases? It was only several months ago they went up to counter the ETS and a few months before that for some other non reason.

Electricity prices going up, petrol over $2 a litre, so the governmenet must be raking in the tax dollars (including the few cents added by the dreaded ETS).
