I note that Phil Goff was specifically mentioned in the coroners report relating to the death of Able Seaman Solomon, and that the Navy could have done more to prevent his death also.

It is my understanding, from informal contacts I have in the Navy, that the Navy did not want to accept delivery of the ship, but was ordered to by the ministry for political reasons. Perhaps an OIA application could help to shed more light on the matter.

Not quite so MM @ 10.20am. There WAS political pressure by Labour to get the HMNZS Canterbury into service. Canterbury was the flagship of their controversial Project Protector patrol ship project, which was years behind schedule (the entire fleet was meant to be commissioned from early 2007 to 2008. Canterbury was hastily commissioned in mid/late 2007 and the remaining 6 vessels didn’t commission until 2009/2010 from memory – whilst National played hardball with the supplier to remedy faults under warranty, rather than accept them into service prematurely).

One reason why (the new) Canterbury was rushed into service, was because the former Frigate (also named) HMNZS Canterbury decommissioned in 2005. Frigate Canterbury also served as the Navy’s training vessel (and the new Canterbury being built would take that role over). What happened of course is that because the old Canterbury decommissioned in 2005 and the replacement new Canterbury wasn’t scheduled to enter service in 2007, there was a 2 year gap and the result was (the media reported at the time) that sailors were quitting the RNZN because of the lack of ships (at sea). Labour ignored Defence’s request to lease an interim vessel from overseas as a stop gap measure to ensure sailors could be trained, retain their skillsets, and be ready for the replacement new Canterbury. Of course Labour didn’t approve the lease and instead pressured the Ministry of Defence, who in turn pressured the NZDF/Navy to get the replacement new Canterbury into service promptly despite there being no real sea trials undertaken and a long list of Health and Safety issues that needed to be rectified.

As today’s NZ Herald reports, former Defence Minister Phil Goff has “blood on his hands”.

The victims’s father, Bill Solomon, today said then Minister of Defence Phil Goff had questions to answer after maintaining the ship was safe, when clearly that was not the case.

“By rushing it into service, it clearly put people in harm’s way,” he told Newstalk ZB.

“From that point of view I think the buck stops with the Minister of Defence of the day Phil Goff, and in my view Goff has blood on his hands.”

Phil Goff & Labour also have blood on their hands in terms of the death of Lt O’Donnell in Afghanistan last year. For not deploying the NZ Army’s Light Armoured Vehicles (LAV’s) with their superior protection against IED’s; for scrapping the air combat force and not providing an alternative means for soldiers to practice calling in close air support strikes (these were covered in the report issued a week or two ago); for not providing/leasing the NZArmy with a couple of armoured Humvee vehicles (and the US grenade launcher mounted on them) so the Army could practice with these vehicles and systems in good time in NZ (the Army’s only training on these types were in theatre in Afghanistan, meaning there was precious little time to practice due to being on an active deployment and the need to get on with their assigned tasks).

If you accept the argument that the Swedish man was splitting atoms in his kitchen for fun, then you deserve to suffer the consequences if he was permitted to follow through on his experiments.
You don’t split atoms for fun, it is a deliberate attempt to create a reaction using a small amount of fusionable material. An extrapolation of this experiment is that this gent was creating a nuclear device, albeit a small one, but quite possibly one that can cause damage or increase background radiation.

The choice of equipment deployed and training undertaken is not at the whim of the government. The O’Donnell inquiry pointed out the Army’s own deficiencies in this regard. As for retaining the air combat force to facilitate Army training, that’s just nonsense. An air combat force should have been retained because it offers the highest bang we can afford, not because of a sideline training function.

@joanna – Are you for real? A Minister of the Crown can’t intervene / make statements about any Case currently before the Courts. Neither can the Police. Neither should the media (apart from reporting the facts). You should know that…

If the kid had admitted guilt in the first place, he could have received diversion. But no, his lawyer told him to plead not guilty but at the same time admitted that he had stolen some items. No option now – the process will be followed.

Yes, we can go “that far” that Goff has blood on his hands in that situation too.

The choice of equipment deployed, will be assessed within Defence and the Minister will sign off (or disagree) on Defence’s recommendations.

In terms of setting the scene: NZDF originally wanted US Humvees to replace the old Land Rovers in their inventory. Labour made Defence re-write the assessment criteria to rule out a 4 wheeled vehicle (as the US Humvee was the prefered choice) and instead agreed to Defence acquiring the European Pinzgauer 6 wheeled vehicle. (Labour also signed of on the LAV3 but bought too many). Come Afghanistan, Defence and Labour agreed to the deployment of the Pinzgauer modified for the SAS but didn’t then deploy the armoured Pinzgauer (or LAV3) for the PRT – instead leased Humvees off the US! Why? I don’t know, maybe it was cheaper to lease off the US then deploy NZ Pinzgauers (if so, it would have been a $$$ issue – which isn’t Defence’s call. But Labour should be accountable for deploying the best equipment fit for purpose, which NZ supposedly had under Labour eg Pinz and LAV3, but for some reason chose not to. No doubt Goff, Burton and Helen could answer that one.

As for the Army’s training deficiencies, sure there were some, but again choices are determined by budgets. The Govt (Labour) allocates the budgets. There should have been enough budget released for Afghanistan to ensure the NZ Army could practice with some of the equipment in NZ, not on active deployment when personnel numbers and time isn’t sufficient to allow weeks of training. And again Goff didn’t deploy the LAV3’s which could have ensured Lt O’Donnell survived the IED attack, and allowed the patrol to return precision fire against the insurgents from their protected environment.

As for the air combat force, I agree with you in that they “should have been retained because it offers the highest bang we can afford” but as mentioned on another occasion, Defence need to practice-practice-practice to ensure they get it right and can self-improve. The air combat force was thus used to train with the Army and Navy, in order to train these other services on how to liaise and interoperate with friendly air forces (in the heat and confusion of battle) and to train these other services on how to counter an air attack. You seem astute to know that the Govt was making money from the Australian Govt in terms of deploying some Skyhawks to Norwa, Australia, to train the Australian Navy against air attack. Again, an air combat force has a training aspect, which comes to the fore when the other services are deployed.

IMO the biggest failure of the previous Labour Govt (and this current National Govt) in terms of the air combat force, is that Labour’s rhetoric when elected in 1999 that the Skyhawks (and proposed F16 replacements) were never used and thus not needed. That may have been true to some extent once the Cold War ended, but was certainly not the case after 9/11. When NZDF deployed to Afghanistan with the PRT in 2003 – they found they needed to be able to work with coalition air combat forces in the close air support role (for the first time since the ANZUS breakdown in the 80’s).

In fact I should offer Goff some leniency because he must have realised this and tried unsuccessfully to have Cabinet return the RNZAF Aermacchi into service under his watch as Defence Minister, to train with the Army and Navy. Sadly Cabinet didn’t support Goff on that one and National’s early soothing noises on restoring the Aermacchis came to naught as well (National say because the Aermacchi’s orphan engine is unsupported, but the situation seems to be they don’t want to spend the extra money – tens of millions – to overcome the engine issue with Rolls Royce from my readings of the situation).

Had the kid admitted what he’d done (pleaded guilty) then he would have (most likely) been granted diversion. Somehow, he has instead entered a plea of not guilty and the process from here is locked in. The Police cannot recommend diversion, as the acknowledgement of guilt is a prerequisite (for diversion).

IMO, this shouldn’t be a Police beat up – I actually think that this kid has received poor legal advice.

I think only the Army can really be held responsible (in part) for O’Donnell’s death. Lt-Gen Jones conceded that training with respect to IEDs had gone ‘down the list’ amid all the other things our troops were doing in Bamiyan!

The government might be indirectly respnsible if appropriate equipment was not deployed to Afghanistan, but that depends on the exact advice sought and given, and I’m not sure that is in the public domain.

I agree with pretty much all you say on the air combat force. We missed out badly by not grabbing those F-16s.

It is a good point you make about his legal advice. He couldn’t possibly be expected to have understood all the ramifications. I wonder about his lawyer.. whether he has some close issue about disability and /or something about how police have treated a previous client ? Since the large psych hospitals closed , many people with mental illnesses have ended up in prison..Many , I cannot recall how many..inmates are on anti-psychotic medication; many make suicide attempts.

On a serious note, in this case the lawyer may well simply be responding to his client’s wishes. If no crime is admitted, for reasons of limited responsibility of some sort, then it’s quite possibly that he may be found not guilty.

It’s a spectrum. You can’t generalise about anyone with autism any more than you can generalise about neurotypicals.

Arie Smith Voorcamp is said to have Asperger’s.
If you’ve met one person with AS, you’ve met one person with AS. Each person is an individual, not a condition.
I think there are one or two regular posters on Kb who could well be Aspies. Pretty sure they know right from wrong.
Aspies face a hard enough time of it being accepted in life as it is, without all being written off as disabled or inferior to NTs.

The engineer in my family, for instance, might not perform well in court because he is so literal, but he is a highly respected professional and wouldn’t thank anyone for saying he has an ‘intellectual disability’. Because that sounds patronising.

The following night the man was there again. Everyone was astounded that he had come for the third consecutive night, but he paid Natalie and they went upstairs.
After their session, Natalie questioned the man. “No one has ever used me three nights in a row. Where are you from?” she asked.
The man replied, “Wellington.” “Really” she said. “I have family in Wellington.”
“I know,” the man said. “Your father died and I am your sister’s lawyer. She asked me to give you your $3,000 inheritance.”
The moral of the story is: Three things in life are certain:
1. Death.
2. Taxes.
3. Being screwed by a lawyer.

We never got livestock for as wedding present but I did get bloodstock for my 21st birthday.
I got a mare in foal to Test Case, and sold the foal as a yearling at Trentham.
