Bennett wins back Waitakere
December 16th, 2011 at 5:00 pm by David FarrarThe judicial recount of Waitakere has found a number of invalid votes for Carmel Sepuloni and the Judge has found that Paula Bennett received more valid votes, and with a majority of 9 is declared once again the MP for Waitakere. That’s a wonderful result for Paula, who so loves being the local MP out west. A big ups to her and her team.
For Carmel, she is out of Parliament entirely, and Raymond Huo is once again a Labour List MP. A bit of a blow to the rejuvenation efforts for Labour, but at least a boost to their fund-raising efforts.
Carmel might now regret her ungracious tone when she was declared winner after specials. Of course she has open to her the option of an electoral petition, but those things can cost $200,000 or so and off memory National has never lost an electoral petition, well for the last 40 years or so anyway.

Winston Peters was the expert in electoral petitions. He also advised Wyatt Creech on his one. THere was one other I cant recall – he ended up winning by one vote and always joked he bought his majority with him every time he came to Parliament.

I’m not a fan of Sepuloni but it must be a bugger of a time having your whole future hanging on the outcome of a count, then a recount. Same for Huo but at least he’s on the right side of the ledger this time.
Not so bad for Bennett who was guaranteed a job for the next three years anyway.

@Pete 5:13 pm
Not necessarily, Pete. Interesting possibility now. A successful electoral petition brought by Carmel Sepuloni would see Paula Bennett out of Parliament entirely, and therefore no longer a Cabinet Minister, and National would not get anyone back on the list to replace her.
EVERYTHING would then hinge on Peter Dunne, who is not too enthusiastic about some of the Nats / Banks’ more extreme policies.

I cannot help but be pleased by this outcome. How on earth the individuals concerned thought they were ever going to pull off electoral fraud is beyond me.

It will be interesting to see what Labour do with potentially so much at stake. Their coffers probably aren’t overflowing at the moment but may be tempted to see what they can do.
Everything already hinges on both Dunne and Banks, or the Maori Party.

Is an invalid vote necessarily electoral fraud?
Vote:December 16th, 2011 at 5:39 pm
@Toad – The National PArty would presumably seek for the Labour Party to put up costs in the first instance, on the very real grounds that Labour lack the ability to pay. I suspect that would mean Labour withdrawing their action.
And think about it – does new leader David Shearer want to financially ruin his party within days of becoming the leader, for someone as unpleasant and nasty as Sepuloni – who in all likelihood voted for Cunliffe?

This is fantastic news; Paula still has a lot to do from the looks of it to win back the trust of people in Waitakere with such a minor margin; something possibly yo be expected due to the high workload of a Minister but now she will have three years to do this as the Electorate MP

Personally, I don’t give a shit. And I’m never going to donate money to the Labour party, for an electoral petition or for anything else. Most of them look too much like Nat-lite for me – lip-service to environmental issues but when in Government do SFA about them.
I was just pointing out the possibility under our somewhat peculiar electoral law that could see Bennett out of Parliament completely and National not getting a List MP (who would otherwise be Aaron Gilmore) to replace her if Sepuloni were successful with an electoral petition.
Vote:December 16th, 2011 at 5:52 pm
Yes, Graeme Edgeler pointed that out on a recent thread. Rather obscure, and probably not deliberate, consequence of electoral law. I think Paula might have preferred things the way they were.

A nine vote majority while gets you back as a electorate MP, this is not a win to crow about. It’s time Paula does the hard yards and converts more people to her and the National party viewpoint.
We are in danger of losing the Waitakere Man and Women, and Paula and the National Party must do there best to sell them in 3 years time why the are the best party for them and NZ, otherwise National will be the out and as WhaleOil say the natural party of opposition.
We are not the Nasty party and I hope Paula thanks the Labour candidate for a competitive race for the seat and says she would like it to be a win for all people in her electorate.

@ Pollywog, I watched the rather sad display when your great socialist female face of the future, took on Mr Speaker and in the process, she demeaned herself, her party, her gender, her socialist beliefs and Parliament itself.
I am not visiting my glee on her however much she deserves it My clear delight is for The Hon Paula Bennett.
Ms Bennett has been the target of three years of sustained attacks for her personal life re a friend of her daughter, her success in climbing out of the welfare trap, her supposed ‘uncle Tom’ action in that because of collective cabinet responsibility she had to support the trimming of adult education and her personal appearance as regards her body mass.
Through all that shit she shines through as a good Minister and clearly enjoys the support and confidence of her leader.
During the recent election the Labour Party threw extraordinary effort to replace her with the pinup face of the future, racial acceptable, union supported Carmel Sepuloni and failed.
I am just so pleased that Paula with the added profile but seriously compromised ability to wage her campaign, prevailed.

Vote:December 16th, 2011 at 10:21 pm
It is lawful. It was a deliberate choice, because the alternative was considered worse (whether people agree is a matter for them). The rule was largely designed to avoid the following:
National wins the election, New Zealand First gets 4.07% of the vote and Winston loses in Tauranga. Government is formed, preparation for the budget are underway etc. Four months after the election, Winston wins his election petition, 5 New Zealand First MPs enter Parliament, kicking out two National MPs, an ACT MP, and 1 Labour MP, National’s Tauranga MP was well-placed on the list, so stays in, losing National another MP, the Government no longer has a majority and Winston holds the balance of power, a couple of months out from the budget, he conducts a new 7-week negotiation between National and Labour etc. etc.
Maintaining proportionality after election petitions, which can take months to determine can completely screw up certainty, so we made a call and decided to have certainty over strict proportionality. This is one consequences.

tvb 9:25. JFK said something similar about J.K Galbraith; who was rather tall; ‘If you squeeezed the bullshit out of him, he’d fit in a matchbox.’ It’s nice and sunny here too, despite the snow on the ground.
cheers

So a Labour candidate ended up having a whole lot of invalid, suspect votes.
Who would have thought it? Especially from the paragons of virtue in the left.

This is good news.
So Labour’s only real victory was Damien O’Connor railing again “self-serving unionists and a gaggle of gays”. There’s a lesson in there somewhere for Labour.

@Bogusnews: Or, votes that were marked as invalid initially were decided to be valid votes for Bennett. Or, the vote counter forgot to carry the one a couple times, or…. There’s no need to make assumptions where there is no evidence to support them.
@OECD rank 22 kiwi: A number of other victories, such as increased majorities in some places (Palmerston North for example) and I think one of the Maori electorates was won off the Maori party. Agreed that O’Connor’s victory is a lesson for Labour, made even clearer by their poor result which has seen very able MPs lose their place in Parliament in favour of less able MPs. Hopefully Shearer will be able to turn things around – we need a strong opposition in the future.

Labour cannot afford an Election Petition. They have no money and would not waste it on Sepuloni who they ranked so low as to be irrelevant.
Vote:And such a petition would only open up a can of worms for Labour and some of their electoral practices, especially by the likes of Sepuloni and her union colleagues.
Same as Lying Brown and the orchestrated South Auckland votes. A can of worms as to who can actually vote. Not good news if an enquiry were opened.
Anyway her union will welcome her back. Nasty peice of work – they aare welcome to her.

“I do draw the line at being a crew member at McDonald’s. I’m a little bit past that sort of thing.” – oh its beneath you! LMAO enjoy your one bedroom granny flat!
