How does Kim Dotcom have a New Zealand passport when he has only been a permanent resident since 2010. The DIA website is quite clear that applicants must have been residents for FIVE YEARS before they are eligible for citizenship.

So Iran threatens to close the straits of Hormuz. Lo and behold, crude prices jump. Funny thing is, Europe doesn’t import a hell of a lot of Iranian oil. Iran’s top three customers are: 1) China 2) India 3) Japan

After the initial splurge of jumping to conclusions based on one’s level of determination to be able to be rip of intellectual property there’s a few very important questions starting to emerge about Dotcom.

Will those wanting to get stuff without paying for it keep rushing to the defence of someone who seems to have paid for things that shouldn’t have had a price?

Like many others I have a bunch of websites hosted by Hostgator in the States.
Now the problem is that if Hostgator have a site that acts as a cloud or a site that operates like mega, will the FBI shut down Hostgator and what will happen to mine and others legitimate content?

Big Daddy have been losing sites by the thousands because of this.

The intended consequences of appalling actions by the Feds and their money backers aided and abetted by the socialists who now control Free America.

Now wonder so much of the world despises America.

It does. All you need to do is live with them for about 2 year even less then get married and keep living togather I have 2 friends that did it succesfully. Beleive me, lazy sluts with NZ pasports are much easier to find then corrupt officials. I’d bet money that is teh case. Maybe law has changed in last 5 -6 years. Not sure.

Indeed. You get your perm residence with a lot less fuss, but same rules from there on apply on progressing to citizenship. I’ve been here 9 years and still haven’t bothered / seen the point.

Some research later (reading those citizenship docs I haven’t bothered to fill in): the standard minimum residence period is 5 years from getting your permanent residence visa and you need to have been here for 1350 days in that time. Under “exceptional circumstances” that can be shortened to a minimum of 450 days in 20 months since permanent.

It could be legit, but I’d like to know what those circumstances were…are you reading this Winnie? 😀

From my knowledge from days in the immigration industry, I don’t think the wife would qualify him in any event; here are the requirements for Citizenship from the DIA website:

Important Notice! Citizenship requirements changed on 21 April 2010. You may be eligible for a grant of New Zealand citizenship if you:

intend, if granted citizenship, to continue to reside in New Zealand;
are able to understand and speak English;
are of good character;
understand the responsibilities and privileges of New Zealand citizenship;
are a permanent resident of New Zealand; and
were physically present in New Zealand, and have had your New Zealand permanent residence for the last five years before applying for citizenship.

Each of these requirements is described below in more detail. Also detailed below are other requirements for applicants aged under 16 years.

Previously, applications could have been assessed under a three year residence requirement, however this no longer exists. For further information please contact us.

Being married to a New Zealand citizen entitles you to apply for residence under the Family Category. Once residence is approved, the five-year clock starts ticking until one can apply for citizenship. It was previously three years, but the rules changed in April 2010.

Just want to share this news with Kiwiblog readers! Mathkid, which is a (top) student of mine got his CIE (Cambridge International Exam) results yesterday for 2 pure math (calculus) papers. He got B grades for both papers (73% and 78%) and he’s disappointed that he didn’t get both A’s. His parents were ecstatic about the results but enthusiast mathkid (as we call him) himself in not, since he was expecting A’s. But anyway, I told mathkid (including his parents) last night that the results is still impressive even though he didn’t get the A’s he was hoping for. But Mark Vella (Auck Grammar deputy principal) had an encouring message to mathkid yesterday when he sent a message:

Given his age and the difficulty of the subject, his marks (73% and 78%) is a most impressive result.

Anyway, mathkid will be doing the full A-Level Cambridge Exam this year as a private candidate (1 Statistics, 2 more advanced pure math papers in calculus, 2 physics/mechanics), for a total of 5 papers. After that (considering that he will pass), then he will have the option of going to University next year (2013). I told his parents last night is to let mathkid hang around high-school for 2 or 3 years (regardless if he passed CIE this year) after this year because, he needs to be mentally prepared for adult learning environment (ie, University) and this was also the message that the University of Auckland, Dean of the Engineering School, Prof. Michael Davies, told his parents (before last Christmas) when we went all to see him about possibilities of CIE courses that Mathkid needs to take this year (2012) in order for him to be able to enroll at the Engineering school in 2013 or beyond. Prof. Michael Davies stressed that mathkid needs to be mentally prepared irrelevant of his CIE marks, because it won’t do him any good if he’s to enter the Engineering school at a very young age unprepared (mentally).

Prof. Michael Davies is very interested in mathkid’s progress in his maths/physics CIE learning/examination that he invites him to attend the teachers/students for high-school seminars/conference held at the Engineering school this year (6 times a year).

PS: Mathkid wants to do electronic engineering, and I’ve given him an old physics textbook of mine to just browse thru it (not necessary learning it) and the question he asked me recently is to explain to him (since he saw the topics in the textbook I gave him) the relation between Thévenin’s theorem and Kirchhoff’s Theorem in electronic circuit laws. I said, that he has to wait a few more years for his knowledge to be developed before I can explain the difference to him.

Entitlement to a New Zealand passport

Only New Zealand citizens are entitled to a New Zealand passport.

Citizenship checklist
Were you born in New Zealand?
Were you born in Niue, the Cook Islands or Tokelau?
Did you receive citizenship by grant, or by decent?

If you believe you are entitled to citizenship by grant or decent but have not obtained a citizenship certificate you must establish your citizenship status before you can get a New Zealand passport.

So citizenship is mandatory.

So either:
– he somehow got citizenship fast tracked
– he fraudulently got a passport
– he was issued a passport incorrectly
or
– the court report was incorrect
– the information presented in court was incorrect

Do you honestly think that if he was in posession of an illegal passport it wouldn’t have been mentioned by the Crown?

There will be several explanations as to why he may have a NZ one.

My main questions are:

1. If this guy is the master crim why has he set up here in NZ where there is an extradition treaty with a country that can do him harm.? He is obviously very clever and he hasn’t thought of this? please

2. If he was a criminal with his cash assets why wouldn’t he be squirreled away in some ex-Russian crime zone with the kiddie porn and drug barons and be completely untouchable.

3. Why are some judging him because he has done dodgey shit in the past that he was totally hones about,never happens here what about Mark Ellis drug questions ,goes on to become very wealthy when his company sells. Is there much gnashing of teeth? Answer No.

4. Is this guy importing, manufacturing methamphetamine in industrial quantities and selling it to Nzers like the Triads of whom most of the top guys travel on NZ passports.? Answer No

5. What really concerns me still is we have a New Zealand resident who has not broken any laws in New Zealand with a foreign power demanding he be handed over because the FBI have put together an indictment with information supplied by an ex US Senator who is now in the pay of the major studio’s.

6. I think all talk of passports and residency should just be put on hold and we as a country should worry more about what potentailly could happen to any number of us. It is happening to a 15- 16? year old British kid, they want him extradited to face possibly 20 years in the slammer.

Last Friday, CNN’s Piers Morgan asked Santorum to clarify his reasoning…

I’ve always, you know, I believe and I think the right approach is to accept this horribly created — in the sense of rape — but nevertheless a gift in a very broken way, the gift of human life, and accept what God has given to you.

As you know, we have to, in lots of different aspects of our life. We have horrible things happen. I can’t think of anything more horrible. But, nevertheless, we have to make the best out of a bad situation.

That’s a good place to start.
Taking into account that dotcom has lawyers why was no effort made to ask him to surrender. The argument will be by some that there was important information that he might have destroyed, however the ‘arraignment’ had already been made – obstensibly all the evidence needed was already obtained.
Somebody might be able to help me, how many cops and helicopters were required to bring Doug Graham to account. I bet he and his lawyer were invited to the Police station and I doubt he was ever arrested.
The passport like the firearms are irrelevant until or if he is charged in connection with them.
The story on the ‘firearm’ has gone full circle as is reported today as having been a pistol.
When the public are fed changing stories attempts at ‘judicial mischief’ are being made, unjust.

Bridgecorp directors’ trial starts again

Rod Petricevic, Rob Roest and Peter Steigrad deny 10 charges under the Securities Act.

The case is expected to run until March.

Two other directors have already admitted the charges. In an 11th hour move in November, Gary Urwin pleaded guilty and was to have been sentenced last month. However, that was adjourned to allow for a three-day disputed facts hearing beginning on April 2. The nature of that hearing was suppressed.

Also in November, the former Bridgecorp chairman Bruce Davidson was sentenced to nine months’ home detention, 200 hours of community service and ordered to pay $500,000 in reparation to investors after pleading guilty to the 10 Securities Act charges.

Interesting to see the verdict given the amount of money isn’t that dissimilar.

Close Up are starting the year trying to make a bit of impact, tonight they are reporting on:
Our nation’s shame: How CYFS are failing our children.

Last night they had a report that highlights a real concern:

Police investigate men in online sex grooming sting

A Close Up reporter confronted men in parkland and other Auckland locations after they arranged to meet the fictitious 14-year-old.

A Close Up producer set himself up as a 14-year-old on a chatsite commonly used by young people and men were quick to make contact, with sexually explicit suggestions and requests.

The programme is passing complete recordings made with the men online to the police.

This is showing remarkable signs of being investigative journalism.

It’s a real worry that it was so easy to chat up and meet a number of men, all coincedentally said it was the first time they had done it and it wouldn’t have gone beyond an innocent meeting. It didn’t say what brand of beer they drink.

Weirdly Close Up said they fuzzed the men’s faces not to protect their identities but to protect people associated with them, but anyone who knew them well would have easily recognised them.

It’s a big concern seeing how freely peodophile predators operate. Here. Online amongst the kids of our country.

Actually, they have. In a book called Victims and Victors.

Most people assume that a woman who becomes pregnant through rape or incest would want an abortion. But few people have thought to actually ask women who have been there to talk about what they want or need, or to share their stories.

In this compelling book, 192 women reveal the seldom-heard truth: most women who become pregnant through rape or incest don’t want to abort!

Instead, many of the women in this book are calling for compassion, meaningful support, a chance to heal, and real choices for women like them and their unborn children.

Based on the largest survey ever done of women who became pregnant through sexual assault, Victims and Victims reveals that:

* Nearly 80 percent of the women who aborted a pregnancy conceived in sexual assault reported that abortion had been the wrong solution.

Just goes to show, that you can’t assume anything. Is best to go ask the people affected what they think, rather than women’s groups.

Just goes to show, that you can’t assume anything. Is best to go ask the people affected what they think, rather than men, especially men entrenched in religious institutions. There might be varying opinions – and needs – so dictating one non-negotiable position may be unfair.

Yes but I bet Iran would never truly attempt to close the straights. America would relish the prospect of unleishing the subs that are undoubtedly lurking nearby. Would be over in a matter of days imo.

What I think Iran intends with these empty threats is simply to drive up oil prices to compensate for lost exports to Italy and the Netherlands because of the EU embargo. Just another move in this silly political game.

Of course, it is in America’s interests to take Iran’s empty threats at face value in an effort to “win over domestic hearts and minds”

No one is advocating that abortion be mandatory for those who are victims of rape or incest so cherry-picking a few examples of women who favour having a child even in such cases does not justify forcing all victims to go through with something against their will.

Rape is the use of force to violate a person in a very personal manner. Giving them the choice of aborting gives them their autonomy back. Forcing them on the issue is a continuation of the violation of their privacy and their freedom.

I found it ironic (read: “hypocritical”) that Penny would complain about her so-called lawful rights being infringed. I read with interest this update on the “OccupyAuckland” website under “general-assembly-minutes-17-december-2011″:

Really? Penny Bright, of all people, would advocate STEALING power that you have not paid for? I’m just … stunned. Mind you, this fits in with her earlier antics of STEALING water that she hasn’t paid for.

Penny was the HART person in the Carterton back in the early 1980’s and was one of Minto’s rabble. Clearly, some things haven’t changed…. 🙁

I had the misfortune to see Penny for the few seconds she was on TeeVeeWon News last night – wailing like a banshee about something written on a sheet she was holding. All rather pathetic. When she gives up her life of pushing doors marked ‘pull’, she should apply for the job as the foghorn on the Interislander.

Or as the noise generator that scares birds at Auckland Airport. 😀

It is not particularly surprising that a person pretending to be a teenage girl on the internet will attract males looking for sex like bees to honey. Reporting this fact is not original and hardly even qualifies as news except perhaps to only the most naive of people. It is not a feature of NZ society in particular, you’ll find the same potential for online predators elsewhere in the world.

“Close Up” is copying the US TV show “To Catch A Predator”. Not exactly high quality journalism but surely a ratings winner.

Not really. What he rejected was approving it by the February deadline set by Republicans. This is all politics. The republicans want a decision before the 2012 election so it will get environmentalists upset with Obama if he approves it and get labour unions upset with Obama if he doesn’t approve it. Obama likely wants to approve it after this years election so he can approve it without worrying about re-election.

TransCanada are able to submit a new application to the State Department and they have said that they intend to do just that.

The main figures?

Criminal legal aid lawyers down from 1400 to 940.

Family from 2102 to 1161.

Civil from 2272 down to 625.

Mental health from 646 down to 217.

Duty Solicitor from 1070 to 675.

Those are some fair drops, especially in Family and Civil.

“The real surprise to the Law Society is how many lawyers have been prepared to do the legal aid work under the new regime that’s operating now, and we’re very grateful to those members of the legal profession who are going to stay in,” (NZLS President Jonathan Temm) said.

However, right across the board were were significant drops in the number of lawyers prepared to do legal aid work.

“And that will continue into the future – particularly when these new applicants see the legal aid contracts they’re going to have to sign, which to a large extent make them civil servants of the Ministry of Justice,” he said.

but

He said he did not accept the view that lawyers were just being greedy and now could not get the money they used to get.

“The rate that legal aid lawyers are paid now is the 1997 remuneration rate,” he said. “You can’t take a cheque in 1997 dollars down to your bank manager and expect them to be impressed. But we still turn up and do the work. Lawyers have suffered unfair criticism from the media and from politicians about the quality of the work they’ve done. The work by and large, has been excellent.”

Mr Temm said the then government had been told in 2006 that if it wanted to increase the number of New Zealanders who were eligible for legal aid from 750,000 to 1.3 million, it would cost more money.

“They said they were prepared to pay it. When the bills came in, they changed their mind. The blowout [in legal aid expenditure] was entirely the result of government policy at the time. Nothing to do with lawyers’ remuneration rate or anything similar,” he said.

So a lot more lawyers will now have to be employed by the government to make up the shortfall. I wonder if they will have to set up a Public Family Legal Aid Service?

And before you all call us greedy, it is just worth noting that many of us are now working in more profitable areas. For some, it has meant a complete move out of criminal law and into civil, which is far more lucrative. I like environmental law, as it pays well also…

EDIT: Don’t forget that a lot of criminal lawyers also do a bit of family work, so a good proportion of those 940 criminal lawyers will also be on the family roster.

The French are idiots.Sarkozy keeps playing around the edges of a massive problem the French have. ie burqa ban and this. He also opposes turkish entry to the EU. There are perhaps 500000 Armenians in France but 5 million Muslims.
He is trying to appeal to the French nationalists ,lets hope they don’t fall for his trickery.France needs real direction and leadership and that can only come from the Le Pen crowd. Alas it won’t happen.

As a general rule, “less” describes mass nouns, and “fewer” describes number nouns.

A couple attending an art exhibition at the National Gallery was staring at a portrait that had them totally confused. The painting depicted three black men totally naked, sitting on a park bench. Two of the men had black penises, but the one seated in the middle, had a pink penis.

The curator of the gallery realized the confused couple were having trouble with interpreting the painting and offered his assessment. He went on and on explaining how it depicted the sexual emasculation of African-Americans in a predominantly white, patriarchal society. “In fact”, he pointed out, “some serious critics believe that the pink penis also reflects the cultural and sociological oppression expressed by gay men in a contemporary society”.

After the curator left, an Irish man approached the couple and said, “Would you like to know what the painting is really about?”

“Now why would you claim to be more of an expert than the curator of the Gallery?”, asked the couple.

“Because I’m the guy who painted it,” he replied. “In fact, there is no African-American representation at all. They’re just three Irish coal-miners. The guy in the middle went home for lunch.”

The only problem with a move to civil litigation while lucrative is that there isn’t much of it around at the moment as a consequence of the reduction in commercial activity.

Of course if you do insolvency work or appear in the Weather tight homes tribunal it is a boom time.
