I see that Obama is abusing his power again and appointing people (more Czars) in what he says is a recess – although there was no recess and he knows it.

The purported “recess” appointment enraged conservatives because the Senate isn’t even in recess. Senators never passed a resolution to adjourn, meaning it is officially still in session. That didn’t dissuade Obama, however. Now the president is seeking to use the publicity to raise money for his re-election campaign.

“We can’t afford to continue allowing Wall Street to write its own rules. But today’s action by the President is already coming under partisan attack, which we expect to intensify in the days to come,” wrote James Kvaal, national policy director at Obama for America, in Wednesday night’s email.
The fundraising pitch was disguised as a petition to supporters. Only when recipients click on the link to “stand with President Obama and Richard Cordray” and sign the petition are they taken to a fundraising page with a form to donate up to $2,500 to Obama.

Obama ignored 100-plus years of precedent on recess appointments when he tapped Cordray as the new consumer czar. He also appointed three members of National Labor Relations Board at the behest of Big Labor.

Both moves were immediately criticized. The Heritage Foundation’s Todd Gaziano called it a “tyrannical abuse of power.” He added: “The House of Representatives did not consent to a Senate recess of more than three days at the end of last year, and so the Senate—consistent with the requirements of the Constitution—is having pro forma sessions every few days. In short, Congress is still in session.”
Obama also ignored the legal advice of his own Justice Department, which confirmed in 2010 that a recess would need to be longer than three days for the president to make an appointment.

I turned the radio on this morning and Jim Renwick, head of NIWA, was being interviewed. He was asked about the current weather patterns, and all he could say with plenty of hums and ars, he didn’t know. He sounded like David Shearer, complete air head. How do these people get these jobs?
Also a good piece from Brian Leyland in this mornings Dim Post. He gives a good summary of the reality of the debate on AGW. It is just a matter of time before the theory of AGW is finally put to sleep.

Want to join the discussion on Pundit over whether the media should/can publish any comments made under Parliamentary privilege by Winston Peters on the two Johns’ ‘tea party tapes’?

Following is some of my considered opinion 🙂

In my considered opinion, after calling a media conference to cover the ‘tea party’ event, there is simply no way that John Key and/or John Banks should have been stupid enough to say anything during that time that they didn’t want the public to hear. They were almost literally ‘in a goldfish bowl’ with a compliant media outside – bristling with cameras – trying to record what was going on from outside the cafe.

Talk about an obedient, effectively ‘lap dog’ media!

Came when they were called, went outside when they were told, didn’t publish the transcript……….. ?

If I had been there as an independent member of the media, I wouldn’t have left the cafe. In my opinion, if John Banks and John Key wanted to have a ‘private’ conversation (ie: one they didn’t want the public to hear because it was politically sensitive) then they should have had that conversation in private, without first calling the media.

Why I am particularly grumpy about this, is because I stood as an Independent candidate in the Epsom electorate, campaigning against ‘white collar’ crime, corruption and ‘corporate welfare’.

I received effectively NO mainstream media coverage on my attempts to get ACT’s ‘ONE LAW FOR ALL’ equally applied to (former) ACT Party Leader, Don Brash, and ACT candidate for Epsom John Banks – both former Directors of Huljich Wealth Management (NZ) Ltd, who were never charged, let alone convicted, as was fellow former Director Peter Huljich. (ALL Directors equally signed Huljich Kiwisaver Prospectuses which contained untrue statements).

Members of Occupy Auckland marched with me, down Queen Street, to first the offices of the Finance Markets Authority (FMA) on 8th of November 2011, then the Serious Fraud Office on 14th of November 2011, with letters formally requesting that charges be laid against Don Brash and John Banks.

Both the CEO of the FMA Sean Hughes, and the Director of the SFO, Adam Feeley, in my considered opinion, failed to ‘do their jobs’.

Both declined to apply ‘ONE LAW FOR ALL’ to John Banks and Don Brash, as fellow former Directors of Huljich Wealth Management (NZ) Ltd.

Although mainstream media were notified, NOT ONE turned up on either occasion.

(Compare that with the 2008 election, when Rodney Hide made a complaint to the SFO against NZ First?)

Don’t you think that one or two members of the voting public might have been just a little bit interested in these actions?

Don’t you think that there might have been investors living in the Epsom electorate who could have been ‘bitten’ by some of the NZ 65 finance industry collapses since 2006, and might have supported ACT’s ‘ONE LAW FOR ALL’ being properly and equally applied to Don Brash and John Banks, who wanted to help run the country, but arguably couldn’t even properly run a Kiwisaver scheme?

Oh – silly me – OF COURSE mainstream media wouldn’t want to give publicity to this stuff – because our NZ democracy works according to the ‘golden rule’?

ie: Those who have the gold – make the rules, and we get the government that the majority of big business want us to have?

That public opinion can, and is, effectively be ‘steered’ by corporate mainstream media?

In 2008, the majority of big business didn’t want Winston Peters or NZ First to be part of any coalition government, and there was an unprecendented media campaign to discredit Winston Peters, so that NZ First would not reach the 5% party vote threshold.

It worked.

In 2011, the majority of big business wanted a John Key-led National Government back, primarily in order to achieve the proposed ‘partial privatisation’ programme.

Where was the mainstream media coverage exposing John Key’s Wall St ‘bank$ter’ background?

The FACT that when John Key worked for Merrill Lynch – he was HEAD OF DERIVATIVES – the collapse of the derivatives market being regarded as the cause of the current global financial ‘meltdown’ – so should take some responsibility for the ‘toxic’ financial products that he arguably helped to produce?

Is THAT the real reason for the attempted eviction of Occupy Auckland protestors at Aotea Square?

Arguably unlawful discrimination on the grounds of political opinion – because some of us were campaigning against the return of a National/ACT government, because they would best represent the interests of the NZ corporate and wealthy 1%? …

Penny Dim, what caused of the 1929 market crash? Look, there will be another crash at some stage in the future? You never learn or want to learn do you? It is not the derivative that’s the problem. How thick do you have to be to understand that? Derivative markets (options) has been around for over thousand years and why all of a sudden you blamed John Key for trading derivatives as if somehow he single handedly caused the recent financial crisis.

Yes, I can understand the offence someone naming their child Satin, Velvet or Denim would cause. However, if it is acceptable that the state take such an intrusive role in such a trivial matter, then surely the state – under the pretext of defending the welfare of the child and in its guise as the omnipotent nanny – should direct power companies to heavily discount power charges to homes in which children are domiciled.
I am guessing the crocodile tears being shed here for the harm caused by a tragic naming process would not extend to any tangible activity which would have a measurably positive impact on the well-being of our most defenceless citizens.

Why does POE have a management team?
It sounds like the union is running the POE.
Do they own the POE?
Why not sell the POA to the union and then they can run it the way they want it without interference from ‘management’. This will also solve Johnny’s gripe (See letter in the NZ Herald this morning) as he can then become the manager and solve all those ‘pay equity’ problems.
Come on ‘know it all’ Maritime Union, buy the place and show us how it works when you are in charge.
Or does it only work when you use other peoples’ money and property?

The state already has intervened in the power market: it artificially raised prices in a cynical revenue collection grab, hitting the poorest families hardest. Something that simply could not have happened in a competitive free market.

Polly and other statists here always seem to imagine that their precious state will use its powers of legalised coercion in ways that they prescribe. Just this week Polly was complaining about the bailout of the banks, yet that is just the other side of the coin: a state powerful enough to subsidise the power bills of families with children is also powerful enough to bail out wealthy bankers. And guess what, the wealthy bankers have more influence.

Hence my right-wing position that the state should not have such powers, since they have nothing to do with morality and everything to do with benefiting organised power over the rest of us.

If the Police do not act you can the take the matter to the Ombudsman, I understand, but may be corrected on that.
Try the simplest most obvious approach first.

Is this a form of corrupt practice, this failure of the CEO of the Finance Markets Authority to equally apply the same law – albeit to the former Leader of the National party, Don Brash and former National Government Minister of Police – John Banks?

Andy further to your post this quote is from the Herald story, by the union guy.

So this is the nub of it. The unions won’t accept any casualisation at all and the management won’t agree to not have it.

Obviously as a conservative I don’t think this is any justification for the union position I’m simply making that hypothesis that this is the nub. Which means a total shut-down and lock-out may be the only option for the management, unless they give way on this.

Firstly if this is the case then I think all the unions and the lefty politicians who support them need to come clean to the public and admit this is what the central issue is and lay it out, for public debate. This is not a private issue between a union and an employer, the union itself has put this on the public table and the lefties and the unions need to let the public decide. If I were POA I’d be hiring a PR firm right now to put this message out.

I wonder why you took the ‘Open Letter’ tell-the-whole-fucking-world approach, rather than simply ask for a date of expected response with the intention of pursuing it further under the Information Act, to compel a response, if one was not made?

So Penny you’re saying despite the Crown Prosecutors looking into it they don’t understand the law because in your opinion a political order was given “at the highest levels” to evict the Akld Occupiers which therefore you conclude makes Brash and Banks liable to those charges?

Penny I think you’re risking public nuisance charges being laid against you. I really do. If I were I would cease and desist immediately lest you be arrested and thrown in jail for being a complete idiot. I suspect you will go through nevertheless but don’t be surprised if that happens one day.

When challenged to provide any evidence (about anything, ever) or to answer a question of any sort she is curiously absent. And silent.

If you have laid your FACTS formally with the Police you can then ask under the Official Information what action is to be taken. They are obliged to answer within a certain time frame. I don’t see what your problem is yet.

So lest some misunderstand, let’s all recognise this is in response to severe provocation including requiring countries to choose between the US and Iran if they trade with both.

That’s the state of play here, so let’s not anyone pretend this is an agressive action by Iran. It’s a provocative one, but it’s in response to all the other aggression we have seen take place in the last several years, lest anyone attempt to ignore or minimise those clear and present facts which really have happened, haven’t they.

But this is a major move. What the hell does Iran think the US Fifth Fleet is going to do? Apply to Tehran for permission? Of course they won’t and Iran knows that so what is it doing here apart from the obvious which is to ratchet up the clock a notch to cause a resolution to this be that a confrontation or a negotiated backdown, one of the two.

See as I’ve said for years, Iran reportedly has missiles capable of taking out an aircraft carrier through kinetic energy which can’t be stopped by known defensive systems and all they have to do is loiter in the mountains bordering the gulf and then bloom, fire and drop.

So let’s see what happens next. I can’t wait, although I wish the west wasn’t forcing the issue, this whole thing is totally unnecessary, in my view. It’s just a large part of the western public have been sucked into this fantasy that Iran is actually a threat because of look, you see, Hezbollah and what proper state does that, they say. This blindening program has been enormously successful, given the number of westerners who eagerly if ignorantly jump on the bandwagon.

Sad really, given the enormity of the diabolical reality which is nothing less than the war on terror is exactly like the war on drugs. Designed to be expensive, interminable and never ending but requiring vast networks of security and military infrastructure on a global scale. Why people don’t get that’s what’s behind all of this I don’t know. Perhaps they’re all waiting until it’s all been built or something. That must be it.

I don’t see what your problem is yet.

Her problem Yvette is she’s already received an answer she didn’t like so without evidence she imagines someone in the highest offices ordered the eviction of the occupiers which means Brash and Banks are guilty of some sort of fraud. This is here problem Yvette. She of course doesn’t see the minor flaw which is of course the unrelated nature of the connexion, but I know you do, straight away.

You mean Ron Paul? Yes, if so. Not in everything but most things he says make sense monetary policy most of all. He’s revolutionary only because the nation long ago departed from the mainstream and no-one called it and now, his policies are the only rational ones, which sound radical to most ears. That’s the problem. I mean he’s probably the congressman with the longest experience specialising in monetary policy. In a monetary crisis which the GFC is, who else is better qualified. Forget everything else, it’s the economy, dummy, this election. It won’t be, Obama and the MSM will make it about other things and as I’ve said, I’m picking Obama will play the race card: if you don’t vote for him, you’re a racist. Let’s wait and see, but yes, Paul is the best of any of them, but he won’t get past the nomination, that won’t be allowed to happen.

I don’t think they’re as bad as the western media portrays them as but unfortunately in order to see what I see in them, you have to, I think, have a degree of understanding of what it is to be a spiritual person.

Iran is looked at by the Muslim world as the holder of the Holy Key. By that I mean they are seen as the purist Islamic state. Everyone in the ME knows Saudi for example is ruled by desert gypsies who got lucky, they don’t for example look up to people like Saudi at all, even if it does have Mecca in its territory. Understanding this is a critical factor in understanding Iran and also ME dynamics. This means in this context it’s an extremely telling move if the West attack it, let alone if Israel does with the West supporting it.

Most people don’t seem to understand this perhaps because they don’t understand religion is not about having a seething cauldron of hatred feeding in your belly 24/7/365 until one literally feels like exploding. To most religious people this never seems to happen. But many perhaps most people in the west don’t have that understanding and seem to believe that most if not all Muslims do in fact have this bubbling cauldron of scalding lava-hot rage just waiting to explode so they treat Iran rather like a powder keg. This is so not the case, it’s not funny, but nevertheless millions even billions really believe Iran and all other Muslim nations are really truly like this. Power of propaganda, you see.

So as a world we either treat Iran like we are now which is that it really is full of violent fanatics, or we treat it seriously and with good faith just like any other country, especially given its respected status in the Muslim world.

The fact the world is doing the precise opposite in what appears to me a not accidental but rather precisely engineered way, gives me the shits quite frankly Andy. For where this ends, I don’t know, but wherever it is, I don’t like any of the calculations.
