Commissioner offers raft of excuses to fend off prosecutions

OPINION: Defence lawyers must be rubbing their hands with glee after the release of the Independent Police Conduct Authority Report into the Operation Eight raids in Ruatoki.
While it is unlikely they will pick up any new work defending the police officers who oversaw the “unlawful, unjustified and unreasonable” aspects of the raids (because they are unlikely to ever be held to account for their actions), they do have a wonderful new range of extenuating circumstances to prevent their criminal clients being convicted or even having to go to court.
These were outlined superbly by Police Commissioner Peter Marshall as he attempted to spin his way out of perhaps the most damning expose of police culture since the Royal Commission into the framing of Arthur Thomas.
Here are just some of the new “defences” available to avoid prosecution or investigation if you or a client have acted unlawfully.
1. The “I didn’t shoot anyone” defence. Particularly useful if you’ve kicked down a door at gunpoint and detained three young boys in a shed for nine hours without food or water. Sure some people might look on that as kidnapping but, according to the commissioner, if you don’t actually shoot anyone you’ve painted with your red dot sight, the police will probably let the whole thing slide.
2. The “We’ve reviewed and updated our policies” defence. This is a sure-fire get out of jail free card if you’ve set up an illegal roadblock to stop parents taking their kids to school, illegally searched them and breached their privacy by illegally detaining them and taking their photos. A lot more sophisticated than the “I promise I won’t do it again judge” strategy, this is likely to be very popular with drunk drivers.
3. The “But I mostly don’t break the law” defence. Use this if you’ve executed most of your search warrants properly but have gone over the top with three or four others. In Civvy Street it’s a great excuse for avoiding parking fines. “But I put money in the meter for most of the time the car was parked there, your honour.”
4. The “But look at what Tame Iti was up to” defence. A general catch-all strategy that basically diverts attention away from what you did wrong onto someone else. It helps if your diversionary target is a controversial figure, even better if he is part of a minority group that most people in the country don’t understand.
5. The “But I was hunting terrorists” defence. Great if you’ve been caught in a peeping tom situation or breaking and entering. Just tell the cops you were pretty sure there was some really important intelligence in the memory chip of the flat screen TV you were caught red handed with and they’re probably going to give you a slap on the back and send you on your way.
6. The “I thought what I was doing was legal” defence. While this strategy would appear to overturn the old maxim that “ignorance is no defence”, Commissioner Marshall and the GCSB have made it pretty clear you can get a walk if you can keep a straight face while swearing on a bunch of bibles that you didn’t know that car conversion was actually a crime. If you play your cards right you might even be able to get the law changed so it isn’t.
7. The “I’m a police officer” defence. At present only available for actual police officers who are fighting the scourge of terrorism and lawlessness that is sweeping our nation. Not a new strategy, it was made popular late last century by the team investigating the Crewe murders. Properly deployed, this strategy can lead to a long and successful career in the constabulary and a top level testimonial at your funeral.
These seven pillars of policing wisdom are clearly going to have a huge impact on our court and penal systems.
Once fully adopted we can expect a drastic reduction in the crime rate, judges will have to be laid off and most of our prisons closed.
We’ll still need plenty of police though to build bridges with the community and keep reviewing those operational policies to make sure none of them ever has to be individually identified or held accountable for their “unlawful, unjustified, and unreasonable” actions.

On a more serious n0te, there is a great story on Fox NEWS this am.
Today is part of their Memorial Day (= Anzac) weekend.

FOX carried a great story of the oldest living US Vet – a 107 year old black WW2 vet. He returned home after WW2, built a house in Austin, Texas, and still lives there.
He is about to spend several weeks travelling the US visiting Vets groups.

Asked what he would do when he returned: “Well, I’ll sit on my porch, smoke my favourite cigars, and enjoy whisky in my coffee.”

Not a bad way of spending down time!

Maori is now principally dominated by women, and it is becoming obvious that Maori men only have a ceremonial role, despite what they think.
Great selection – could not be better.
Taurima will return to TVNZ albeit that he has shown his bias publically, whereas the media has total left wing political bias, which they try and hide. At least with Taurima he has “come out”.

15 times the Earth-Moon distance is a pretty safe window if nothing unexpected happens. But stocking up isn’t going to hurt, it’s not like you’ve got to spend weeks worrying if it is a real threat or not.

I don’t know. All I know is that something is up and that an asteroid fits with what a few of he crystal ball gazers have predicted. Stocking up is just general disaster preparedness, you might think that the sensible thing to do would be to go for a holiday at some place higher.

British police are arresting people in the middle of the night if they have made racist or anti-Muslim comments on Twitter following the murder of a soldier by two Muslims in Woolwich, London.
Three men have so far been taken into custody for using Twitter and Facebook to criticise Muslims.

Two others have been arrested under the Public Order Act on suspicion of inciting racial or religious hatred. The police are now arresting people based on mere speech in social media, a detective said in a statement to the press:

‘These comments were directed against a section of our community. Comments such as these are completely unacceptable and only cause more harm to our community in Bristol.
‘People should stop and think about what they say on social media before making statements as the consequences could be serious.’

The arrests come at the behest of British Muslims, who fear a backlash against them following the death of Rigby, the New York Times says:

The police and Muslim groups have said that there have been anti-Muslim episodes in many parts of the country, the most common involving derogatory messages on social media sites like Twitter and Facebook.

A number of arrests have been made, with criminal charges being leveled in some cases under laws against inciting racial or religious hatred, and Muslim community leaders have reported rising concern among the estimated 2.5 million Muslims in Britain.

Two men were detained in the middle of the night after they expressed anger at Muslims on Twitter, the Independent quotes police as saying:

“We began inquiries into the comments and at around 3.20am two men, aged 23 and 22, were detained at two addresses in Bristol.
“The men were arrested under the Public Order Act on suspicion of inciting racial or religious hatred. Our inquiries into these comments continue.”

Fletch, the English are responding just as I predicted. Muslims hacking off heads in public streets is not the problem. Tweets are ! Fortunately I stopped caring about the lost culture of the English long ago. They sold out and surrendered. They deserve all they get.

There is a small chance that if things get bad enough we will see a return of the true British spirit. Those pasty faced wimps only come to the fore when under extreme hardship, so I guess there is hope yet.

And yet here in good old NZ we have Desmond Wanoa from “Moai Crown” posting youtube videos threatening to put a bullet through the head of Queen Elizabeth and with a facebook page with 1200 or so comments many of them well out of line.
Any sign of action from NZ Police?

@UglyTruth. Explain the double slit experiment in quantum mechanics, you know, where a photon goes through both slits at the same time and interferes with itself like a wave, hits the screen as a particle and part of the interference pattern.

Some things I can’t explain and don’t understand I accept; some I don’t. Finally, it’s personal preference.

Great wisdom from Plunket.
He is correct and what makes this worse is that Tolley on Q+A yesterday attempted to make the point that the police didn’t deliberately set out to break the Law, so in her eyes there actions were OK.

So, next time we all get a speeding ticket, we should defend ourselves in court with the Tolley Defense. That piece of video should be preserved to present in court as a defense.
i.e. that we didn’t deliberately exceed the speed limit, therefore its quite ok Mr Judge.

Of course we all know what reaction we would get both from Mr & Mrs Plod and the Judge.

Normally Im a little biased towards the police. Think they do a great job the vast majority of the time, under often very difficult circumstances. The completely misguided political alignment between the police and the beehive under the shebeast should never have been allowed, and points more to her ability to create her own police state than anything else. But I digress 🙂

Many years ago, my wife and I, pre kids, were holidaying in the south island. Driving north to Christchurch, in my then Holden SS, we picked up a cop, coming up behind us. We were sitting on 105, cruise control on, knowing its cop central. Lots of traffic coming the other way, so he couldnt pass, but still he tailgated. He finally passed at a huge rate of knots, and vanished into the distance. We turned up at the local police station, his car parked outside, and laid a complaint. Saw the fat fucker in having tea as we did.

Letter a few weeks later – he wasnt breaking the law, was in a hurry to respond to a call, would only have exceeded the speed limit momentarily – we noted he wasnt light up.

Ive still got that letter. Ive used it once to respond to a speeding ticket, which I got off, refering to the letter and written police policy.

Happy to photocopy and send out if you face a speeding ticket 🙂

That doesn’t explain why if you close one slit after the photon has passed through both it doesn’t make an interference pattern on the screen, that it “knows” after the event you have tried to “fool” it.

Going to work this morning a lot were looking at the western sky, half was covered with a black raincloud and the other half was clear blue – with the waning moon smack in the middle of the blue. People were taking photos while standing at the bus stop.
The performers today are still clearly suffering from the full moon on Sat morning – so amusing

He always does a runner when put on the spot, then comes back claiming he “proved” you wrong and “won”. Meanwhile reality carries on its relentless march.

@Kea. No, UglyTruth has constructed an intricate and beautiful model of the Universe with everything in its place. Unfortunately the model is not reality, but that doesn’t matter. The main thing is everything is in its place. Neat, clever and wrong. Better to be wrong than uncertain. That is too upsetting. Better to change the facts than the model.

You blatantly are.

You are assuming that the movement of energy from the point of emission to the point of absorption does not involve any interaction with the intervening medium. The wave characteristic of interference (i.e. your single “photon” passing through both slits) requires the existence of this medium.

The problem is that modern science wants to abandon the aether of classical physics in order to maintain consistency with the fundamental assumption of relativity that there is no preferred frame of reference.

I don’t claim to have a complete understanding of the nature of light. But I do claim that the wave-like properties of light mean that the nature of the medium that light travels in must be taken into account in in order to develop a complete understanding.

the present impacts will increase until it becomes apprent that future civilisation is in jeopardy.
Usa severe drought
Australia massive heat wave last year
England had been alternating between drought heateave and flood
We will see hundred year extremes become ten year than normal weather
2030 is my educated guess at the point where the impacts will start causing chaos globaly
Hunger will cause massive migration and conflict on a world wide scale
we need to debate agw without the wingnuts denial clouding the debate
2c is the international recognise limit on safe warming
all evidence points to this being the result of our present 400ppm hence 350.org
civilisation is up shit creek if we don’t change our energy sources away from hydrocarbons now.
Denial hinders the chance of this happening
