Whale Oil breaks an alleged scandal

Whale Oil has a story from Stephen Cook (ex Herald on Sunday) with allegations from an Auckland Council employee of an affair with Auckland Mayor .

Obviously they are allegations, and there are often two sides to a story. However the woman has provided a sworn affidavit (which is a serious offence if false) backing up the allegations, and also it seems has retained some text messages.

This is an explosive story, and again we are yet to hear if the allegations are denied or not.

In terms of whether there is a public interest in the allegations, my answer would be there isn’t if she wasn’t a Council employee and any (alleged) encounters took place away from the Council. But if the allegations are correct, and they involve a Council employee on Council premises – that is harder to pass off as no public interest.

I have no first hand knowledge of the allegations beyond what has been reported, and the fact that a sworn affidavit has been provided. The allegations are incredibly detailed and specific.

    Damn, that’s pretty horrific all round. I may be a bit of a prude, but I really don’t see the need for Cook to go into such a level of detail. That’s just brutal and only in there to serve as ritual humiliation. The story would have been far more effective if he’d left out the salacious grit. Imagine if Len went and topped himself after this? He’s not exactly a poster child for mental stability – we’ve all seen that side of him before. Cook has form so worth knowing that when you read something like this.

    If the US is anything to go by, sex scandals only seem to end the careers of politicians on the right who have more of a sense of shame when caught. Numerous lefties have survived mostly because the media are gentler and wont hold them to the same exacting scandal plus they trot out faux apologies and seek ‘help’ and the media let them get away with it. Case in point – President Clinton. Only serial offenders like the egregious abusive San Diego Mayor Bob Filner and serial sexter Anthony Wiener of NYC mayoralty Democrat primary fame finally fell from grace.

    Assuming the allegations are true and not denied, I’m predicting Len Brown will take time off for some therapy and then appear with wifie in tow and shed tears at a soft presser and tough it out.

    This, says the woman, included numerous times in Brown’s council office and once in the “Ngati Whatua Room” at the Auckland Town Hall – an area of special significance to Maori – where they were caught in the act by a security guard.

    Again, is this illegal?

    At the time, the woman says, she was completely naked and Brown had his pants down around his ankles.

    Was she cold or something?

    Nevertheless, a coup for Whaleoil. I don’t feel sorry for Len Brown getting caught, but you have to feel sorry for his wife and children reading all that.

    The reason the right feel more pain on these is usually that they profess family values and the like to a greater extent. Particularly with gay sex, it looks bad if you’ve been in government railing against homosexuality, then it turns out you’ve been using rent boys for years. On this particular matter the left are less likely to get on their high horse, so it’s less far to fall when it turns out they’ve been up to no good.

    What I am disappointed about (in a political sense) is how these things are coming out after the election. In a normal country these things would be fodder for the election campaign.

    They will be, once they check the facts. You can’t leave this hanging out in the open. Either Len sues for defamation or he resigns, and since there’s reportedly a security guard as a witness, it’s going to be a bit hard to sue. And he has to resign, because he did it in work time on work premises. John Palino was the runner up in the Mayoral race – does he step in? What happens in a situation like this?

    Also that anonymous text that was sent, threatening her job, that also is grounds to force a resignation.

    Different era. Lange didn’t have to contend with social media. This will spread like a virus. It doesn’t matter if mainstream media pick this up or not, everyone will see it. The gallery are pretty good at drawing a line between public/private, well some of them are. I’ve heard of a few misdemeanors among current MPs that have gone unreported, as they should be. Online media don’t follow those rules. At the very least, Brown is going to be asked about this and forced to deny it. If he doesn’t deny it, then off it goes growing legs each day. If he does, then that affidavit will get tested.

    I’m not saying he will I’m saying he has to do either that or resign, one of the two. And the purpose of suing is not to recover damages its to discredit the accusation in the eyes of the public. And like I said, with a 3rd party as a witness who happens to be a security guard: i.e. credible, successfully suing may be a bit difficult for him. Not to mention the hotel booking records, which will no doubt be drilled into.

    If it was a tryst outside work I could see him getting away with it. Since it wasn’t, since he took her to meetings and heaped praises on her, since he rooted her in his office and in a Maori meeting room, this raises questions of employment law in addition to the other moral questions. One assumes Maori will be annoyed at the desecration of the meeting room which no doubt will need re-blessing. How can he retain any credibility after all of those questions have been gone through?

    That’s not evidence of sexual harassment. IIRC you have to prove that there was an actual quid pro quo or that Brown’s actions created a hostile environment. I can’t see how either of those can be proven here.

    This looks like a consensual affair. She undressed completely in a Maori meeting room and allowed Len to root her.

    Yes I know that and you also have to establish whose phone it was and who sent it and if it wasn’t Brown then who requested and/or authorised it to be sent because that Tom, is an instant firing offence right there, in and of itself. For an effective CEO to say that to an employee, is quite frankly, marched out of the office with a security guard escort type of offence.

    So let’s just hope that as the entire NZ journalism corps descend on this woman and the various people associated with all things Len re: this, that Len really does have no idea whatsoever how on earth that text came to be on that woman’s phone, and he can prove that he had no idea.

    Brown had problems using his council credit card for personal spending at his last job. I recall that after all the head slapping, he promised to physically cut up the card.

    If I were a journo I’d be asking to see all Brown’s expenses to see if he has been buying stuff for the woman, or if he has paid for meals where she was present. I’d also want to know if her colleagues knew, and she’d been promoted or received other employment benefits.

    Rooting (between consenting adults) per se is not illegal, and yes he is a douchebag, to put his family in the spotlight and to have them suffer the emotional stresses that this sordid nonsense will bring.

    Reading the affidavit, and between the lines, it seems to me that had Len thrown, jewellery, cars, apartments, 1st class holidays etc etc at her, this may never had seen the light of day. A woman scorned.

    The one thing I do disagree with you though Tom, is that in my humble opinion, this has a high chance of killing Lens career, as I am sure you well know this type of thing has a tendency to do., rightly or wrongly.

Not so nice for him that he’s doing it whilst married with children – if he was single and pulling young chicks, then good work. But not so good when others are impacted.

    Bottom line, this is embarrassing for him, and he should have known better. As they say, you don’t pay prostitutes for sex, you pay them to leave afterwards and not tell people. I guess this lady has worked that out too – she didn’t get paid, but she’s getting her slice of revenge now. He potentially could have avoided that by perhaps treating her a bit better too.

    Council chief executive Doug McKay went to the mayoral office at the Auckland Town Hall about 3pm to meet senior staff in Mr Brown’s office and deputy mayor Penny Hulse.

    Talks took place in Mr Brown’s personal office.

    After the talks he told the NZ Herald he had spoken with the mayor’s staff about the situation.

    “My job is to go back and run the organization.

    “He needs some space to deal with it. He has got some family and personal issues to work through and I think we should give him a bit of time to do that,” said Mr McKay,

    He said he had not spoken to Mr Brown about the matter.

    Mr McKay said the mayor was not at the mayoral office. His mayoral car was not parked at its spot outside the town hall.

    I don’t live in Auckland, have no idea what Brown has been up to, and have nothing to do with Whaleoil except reading his site. But I love a challenge.

    We’re looking for a 32 year old woman. Not a council employee, but connected with the council. Stood for a community board. And some of Brown’s txts refer to her in terms normally associated with Asian women.

    Bevan Chuang seems to fit these criteria. Stood for one of the Mt Albert boards. Is a member of the council’s Ethnic Peoples Advisory Panel. And looks about the right age based on her candidate photo here: http://www.vote.co.nz/2013/candidates/bevan-chuang-8902

    Her candidate Facebook page is listed in Google but seems to have been taken down.

    Brown is not facing reality. He says he has a priority to “repair the damage” and get back the trust of his family. I don’t see how that’s possible, what he’s done can’t be repaired in most relationships.

    And he is still putting a priority on his job as mayor as well. Even if by some miracle he could be forgiven by his family that will only happen if he puts them first, foremost and his sole priority.

    Perhaps he knows his marriage is already beyond repair and doesn’t want to lose his “passion”, his job as mayor.

    With all the work involved in organising an incoming mayoralty and council it’s probably the worst possible time to take time off. There are things that have to be done.

    In most marriages this sort of betrayal can’t be forgiven. The broken relationship can’t be fully repaired. If the forgiveness and moving on is attempted I think most people will question how genuine it is.

    Brown may get forgiveness and acceptance of what he’s done as just one of those common things that happen from some of the public but his family situation will never be the same.

    In the Campbell interview last night there was a major contrast between Brown’s family situation:

    And it is now there where I need to go and do some extraordinary repair work, and show my family that I am worthy of their trust and love.

    Once broken trust on something like this can never be fully repaired in a marriage relationship, and more often than not it is irreparably broken (although I don’t know what sort of relationship Mr and Mrs Brown had).

    Brown also has a major problem due to the allegations of where some of his dalliances occurred. If it had all happened in private, in hotels, then it would be easier to pass of as simply personal.

    I’ve loved that job with a passion and I love this city and I want to stay in that job, so yes, it is my intention to stay as the mayor.

    A pity that attitude didn’t apply to his marriage and family.

    But his passion and love was not just for his job and his city. It was for another woman as well. Brown did not keep it a private affair. His mayoralty seems to have been an integral part of the affair.

    Any meeting in Brown’s office, and any event Brown is involved with in the Ngati Whatua room, risks reminders of what might have taken place in those council locations.

    Many people who have future dealings with Brown will now think differently about him. His integrity and credibility have been severely challenged.

    And this is based on what is known now. We don’t know yet if there will be further revelations – apart from what has already been subsequently claimed on Whale Oil. This could get even dirtier for brown, and more difficult for his family and his mayoralty.
