This story will bring a tear to Johnboy’s eye:

Dunedin teenager George Sabonadiere has been crowned this year’s National Spelling Bee champion.

George also found himself at the centre of perhaps the most controversial moment of the afternoon.

When a fellow competitor was ejected for misspelling the word ”aplomb” George protested the judges to give him another shot, claiming the MC’s pronunciation of the word was off the mark.

”That would have definitely knocked me off my stride a bit,” he said. ”I wanted to win but I wanted to win fairly, and I didn’t see that as being particularly fair.”

Quite remarkable really. I’d struggle to spell “Sabonadiere” at the best of times – thank goodness he’s happy to be called “George”!

The UglyTruth approach to litigation:

[1] Mr Koyama seeks leave to appeal against a decision of the High Court which dismissed his appeal against two costs decisions of the Human Rights Review Tribunal and made a further costs order against Mr Koyama.[1]

[3] Mr Koyama’s submissions set out at some length the background to the many proceedings he has instituted against the New Zealand Law Society after being refused a certificate of character in 2005. The ground for his application for leave to appeal to this Court is that he was not given an opportunity to be heard by the High Court and that no hearing took place. Other grounds raised in his submissions include judicial bias, that the judgment was forged, and that the judgment violates the Judicature Act 1908, the Crimes Act 1961, the New Zealand Bill of Rights Act 1990, principles of natural justice and the International Covenant on Civil and Political Rights.

[4] The High Court judgment records that the applicant chose not to make submissions in support of his appeal, or to appear at the hearing.[2] It seems that, although it was his appeal, he protested the jurisdiction of the Court. The judgment also sets out at some length the procedural history of the appeal and records that the applicant was notified a number of times of the hearing date.[3]

[7] For these reasons it is not in the interests of justice for us to hear and determine the proposed appeal. The application for leave to appeal is dismissed.

So Mr Koyama appealed, but chose not to argue his case on appeal, then claimed he was denied all of his human rights in relation to the appeal.

I imagine if I were a grumpy old judge, this sort of case would make my day!

This is quite possibly the funniest judgment that has ever been written (and it all comes down to the footnote):

”Before the court is a motion entitled ‘Defendant’s Motion to Discharge Response to Plaintiff’s Response to Defendant’s Response Opposing Objection to Discharge.’ As background, this adversary was commenced on December 14, 2005 with the filing of the plaintiff’s complaint objecting to the debtor’s discharge. Defendant answered the complaint on January 12, 2006. Plaintiff responded to the Defendant’s answer on January 26, 2006. On February 3, 2006, Defendant filed the above entitled motion. The court cannot determine the substance, if any, of the Defendant’s legal argument, nor can the court even ascertain the relief that the Defendant is requesting. The Defendant’s motion is accordingly denied for being incomprehensible.”1

1: “Or, in the words of the competition judge to Adam Sandler’s title character in the movie, ‘Billy Madison,’ after Billy Madison had responded to a question with an answer that sounded superficially reasonable but lacked any substance, ‘Mr. Madison, what you’ve just said is one of the most insanely idiotic things I’ve ever heard. I award you no points, and may God have mercy on your soul.’ Deciphering motions like the one presented here wastes valuable chamber staff time, and invites this sort of footnote.”

Being a gentleman of some breeding I wouldn’t lower myself to bother to bleat to DPF about chaps that seem to have taken a dislike to me.

I shall continue to ignore them as a proper gentleman should! 🙂
