We’re not talking about the US constitution, so “Law of the Land” quite properly means all the laws in force in a country (in this case the UK) whether common law or statute.

I am just going by the emperical evidence that has been gained in those other countries. I know kiwis are very nice people, but I don’t get why we would have a significantly different result from Europe. Once you are over the threshold ( if it exists ) it is too late, and as stephieboy points out, you can’t just export them again. So it’s a one way road.

But, yes the kiwis did it to the maoris too, so it’s probably time we got our just desserts.

Please do enlighten me as to what Ngapuhi gained from the treaty apart from the regulation of Europeans within their rohe. As I recall, they were the ones dishing out most of the slaughter during the musket wars so probably needed little protection from anyone. So much so that they were still militarily more powerful than the new British government for a number of years.

That definition contradicts Blackstone, and it contradicts Blacks and Bouvier’s dictionaries of law. Blackstone is called one of the sources of the law because of his role in documenting the law of England.

Statute law has never been a part of the common law:

Statute, n. An act of the legislature declaring, commanding, or prohibiting something;
Black’s 5th.

What-ev-er.

The misrepresentation of the nature of the law by the state is a form of corruption.

Why should anyone use your definition instead of the historical meaning?

Actually, fifth generation Kiwi mikey. My Great great Grandmother was born in the Albert Barracks in Auckland in 1848, and that’s only my mother’s side of the family – the Nicholsons were in the British Military – we do have a family history in the military – including my Great Uncle Eustace Nicholson and my maternal grandfather, Don Piper were both in the first wave on Galipoli – both survived that fiasco and spent the rest of the war in France.

I could go on but I won’t bore you, because I suspect you are a liberal anti-militarist.

But I am very proud of my family and our history, and very proud to be a Genuine Kiwi – (and my wife has maori blood). 🙂

How can the law of the land encompass statue law without statute law being a part of the common law?

Again, why should anyone use your definition instead of the historical meaning?

The common law and the civil law (statue law in NZ) are separate because they have fundamentally different philosophies. Common law focuses on the well being of the people, while the civil law focuses on the will of the people.

Ugly Truth , As I pointed out earlier the fact that Hayat Boumeddiene, partner of Amedy Coulibaly,decided to go to Syria does not qualify as a false flag. As I stated its obvious that she likely helped assist and planned the attack then slipped away to Syria to escape the fall out.

Picture this cricket scenario. A big meat-head of an ocker bowler charges in, and bowls out a plucky little batter. The ocker bowler screams, Argghhhhh!!!!Arhhhhhhhhh!!!! Aaaahhhhhhh!!!!! C’mon!!!!!!!, as the plucky little batter dejectedly departs the field, ears ringing, head bowed. But wait! The ump wants to check for a no-ball!! Whataya know!! It’s a no-ball! A big one at that!! The ocker bowler is dismayed!! Even a little embarrassed, unusual for an ocker! The plucky little batter promptly spins around and marches briskly back to the crease, head held high. The bowler is seething. He directs a few words at the batter. The plucky little batter, emboldened by the reprieve, shouts a sarcastic “c’mon”! back at the bowler. This is too much for the ocker team. They crowd around the plucky little battler, and an exchange of words, somewhat heated, ensues. Happily, with the intervention of the umps, things are eventually quietened down.

A question then. Which side will Kiwis sympathize most with in this incident? Perhaps there will be some outrage at the provocative behaviour of the batter? Nah, of course not!! Kiwis, being ockerophobes, especially when cricket is concerned, will, quite rightly, side with the plucky little batter, sticking it to the arrogant ockers. And who wouldn’t?

anti-ocker ranting in the Kiwi gutter press is a fact of life. Been going on for yonks. Us more fair minded Kiwis, an increasing minority it seems, have come to accept this as a character trait of Kiwis, which will not soon change, must as we’d like it to. Anyways, over the weekend, I couldn’t help notice that bashing the ocker cricket team was scaling new heights, or lows, depending on your viewpoints. There was the usual, and expected twaddle from the increasingly downtrodden looking hack Chris Rattue, and the over-rated gobshite Mark Richardson, but I also happened upon an article, written by some grubby little prat calling himself “Andrew Alderson”, which just may have reached a nadir.

Upcoming public meeting in my old home town – Carterton – where I’ll be giving FACTS and EVIDENCE which prove what a $UPER RIPOFF has been the forced amalgamation of Councils in the Auckland region – where 8 democratically elected Councils have been swapped for 1 supposedly democratic Council and 7 undemocratic, unelected ‘Council Controlled Organisations (CCOs), run by unelected, appointed business people, in order to ensure that the Auckland region is run ‘like a business, by business, FOR business’.

For the majority of citizens and ratepayers, rates have sky-rocketed, as has Auckland Council debt, while Council services have been reduced, and ‘democracy’, ‘transparency’ and ‘accountability’ have plummeted.

Who has benefited?

‘Follow the dollar’ – except that you can’t – because ‘the books’ are NOT ‘open’, and the ‘devilish detail’ to which citizens and ratepayers are lawfully entitled under the Local Government (Rating) Act 2002, the Public Records Act 2005, the Local Government Act 2002, the Local Government Official Information and Meetings Act 1987 – is not being provided.

(Which, as some of you may know, is the reason why I have disputed and refused to pay rates? )

I saw on the news the other night that Carterton is developing a fairly vibrant anti-super city group. Good on them. I just hope Penny’s appearance in support of the status quo doesn’t persuade too many people to vote the opposite way.

It’s a worry that Mike. Mind you although I haven’t set foot inside the RSA there for zonks she may not find her audience as receptive as she might expect. I do remember the patronage consisting of about half a dozen old timers from the nearby rest home having a nap in their chairs halfway through their jugs of flat warm DB.

Since then I’ve noticed that the hitching rails have gone & in their place stand rows of gleaming mobility scooters.

Perhaps you’d be good enough to take one for the team & attend as our representative. I’ll arrange for a couple of boxes of rotten tomatoes for you to pick up at the door. 🙂

Whatever you think of me – the FACTS are that I was one of the tiny handful of concerned citizens who (correctly) predicted who would benefit from the Auckland ‘Supercity’, and thus opposed it WAY back from 2006.

(Unlike ANY of the then political parties.)

Given that you’re apparently not an Aucklander Mikenmild – you probably don’t have as much knowledge and understanding of the work I’ve done as the nearly 12,000 Aucklanders who voted for me in the 2013 Auckland Mayoral campaign?

Feel free to come along to the meeting and ask whatever questions you like.

FYI – here are background documents which confirm how there had never been any form of ‘cost-benefit’ analysis of the CCO model – before it was forced upon us in the railroaded ‘Supercity’ legislative blitzkreig which set up the framework and the unelected Auckland Transition Agency (ATA).

There has been an awful lot of chest-thumping and crowing from the NZ Sports media following the recent run of good form by the Black Caps…’Brendon McCullum is the greatest since Bradman!’ etc etc (Though anyone with an ounce of cricketing knowledge and the ability to look up a Test average on Cricinfo may disagree..)

In the interests of consistency then, one law for all, if 45 (1) g [ the activities or groups of activities of the local authority that will be funded from each rate ] applies to Auckland Council why does section 60, same law, not apply to Bright?

Local Government (Rating) Act 2002
60 Invalidity of rates not ground for refusal to pay rates.
A person must not refuse to pay rates on the ground that the rates are invalid unless the person brings proceedings in the High Court to challenge the validity of the rates on the ground that the local authority is not empowered to set or assess the rates on the particular rating unit.

Before whatever courts the various actions against Bright may now be, it is through Council action, rather than what the law stipulates Bright should have followed.

Penny, I do admit though that you have highlighted the fucking appalling ineptitude Auckland Council shows in collecting rates in arrears and the penalties due. They are abysmally hopeless in that respect.

Or – it’s all good with you for citizens and ratepayers to be just be treated as a cross between a GIANT ca$h cow and ATM machine?

Also – FYI – seems the Council may have stuffed up on the penalties …….

The hearing of my rates case, (when it is eventually set down) – is going to be rather interesting, as is the outcome.

I predict a LOT of good will come from it regarding transparency and accountability in Council spending.

Setting rates

During the year, it became apparent that there were several widespread problems with rating practices. Our audit work on rates revenue found that most local authorities had some level of compliance failure. Problems ranged from potentially serious legislative breaches, which created a significant financial risk to the local authority’s revenue, through to low-risk legal breaches.

The problems we saw were related to all aspects of the rating legislation. Many of the problems seem to have arisen because of insufficient attention to legal requirements. The power to rate comes with obligations that need to be given the appropriate level of attention. It is important that local authorities use their legal powers to impose rates on their communities properly.

Local authorities need to lift their game and improve their processes and practices for setting rates.

So – why doesn’t the OAG have a bloody great HOLD POINT when it comes to ‘systems’ checks of Councils, in order to ensure that before Rates Assessment notices and Rates Invoices are put in the envelopes and sent out in their hundreds of thousands to citizens and ratepayers, that they are fully compliant with s.45 and s.46 of the Local Government (Rating) Act 2002?

Why doesn’t the OAG do a ‘systems’ check of ‘in-house’ legal staff employed by Councils to ensure that they are QUALIFIED and COMPETENT when it comes to the relevant local government legislation, and they have ensured that before Rates Assessment notices and Rates Invoices are put in the envelopes and sent out to citizens and ratepayers, that they are fully compliant with s.45 and s.46 of the Local Government (Rating) Act 2002. and all other relevant legislation?

Seems pretty commonsense and straightforward to me.

Mind you – I have had a Quality Assurance background – so I do have some understanding of ‘process’ and ‘systems’ …..

And – although I have never been to University – I’m not stupid and can read.

‘Seek truth from FACTS’ and READ the legislation for yourself! – sort of thing 🙂

Renderer – no I don’t have the money set aside to pay my rates should I lose my case.

However – I have been offered ‘rates postponement’ – which I have said that I am prepared to consider – once links to details of awarded contracts are made available on the front pages of the websites of Auckland Council and ALL ‘Council Controlled Organisations’ (CCOs) – including ‘legacy’ CCOs.

What is wrong with the citizens of the Peoples Republic of Christchurch ?

Judging by who they vote in as either their mayor or MPs they elect the majority of them must be either
socialists or even communists.

The current mayor is an admitted liar. And they keep on voting for that other woman, election after election
you know, that pisshead who when Labour minister for ACC almost single handedly bankrupted it and caused the cost
of all our car regos to go through the roof.
Not to mention how we self employed are still being levied today to pay for her past fuckups.
They keep returning her useless snout to the trough.

Go figure.

FFS why do they keep sending her back to Parliament as one their representatives ?
Couldn’t bring her name to mind @ 6.36 cause she keeps a low profile these days as
a senior Labour MP and now relegated to back bencher.
But she will be happy as long as her snout stays in the trough.
And guess what, for some in inexplicable reason the voters in Port Hills will keep sending her back
as long as her arse points to the ground.

Maybe a voter from Port Hills could tell us why.

You know Mike,

many of us preppers are just like you and I (well maybe not you as none of us hold as much faith in the power of government as you do).

What you see on TV are stereotypes to drive audience ratings and give people a laugh at those “crazy preppers”

We run small businesses, hold 9-5 jobs in the white collar or blue collar world and you’d probably walk past many on your way to work (unless you live and work in Wellington).

Most won’t go “bugging out” but hold 1-2 weeks of bottled water and food stuffs on hand so that if the shit were to hit the fan, we wouldn’t be relying on government to help us help. 20 years ago such advice would be common from Civil Defence but now the ethos is, don’t worry, don’t insure yourself, don’t develop any useful skills – the Government is here to help you out.

Seeing everything else the government has stuffed up (Christchurch earthquake, Novopay, IT) I’d much rather be self sufficient thanks.

I disagree, EAD. I think the ‘get ready, get thru’ message has got some real traction. I do enjoy the cinematic value of the more extreme preppers, though. Maybe not the ones doing the defence drills against the day the UN’s black helicopters come to take away their guns, but the ones practising to drink their own urine seem good fun.

Fair enough.

A fair and honest way of assessing a player is how he handled different playing conditions.

Bradman’s time had South Africa, India (including India, Pakistan, Bangladesh and Sri Lanka), New Zealand and the West Indies playing test cricket.

Look up both players’ averages in away tests against those teams (with DNPs = 0) and the one with the better overall average is surely the better batsman.
