Where do the guidelines say that precisely ?

Its fortunate that it doesnt because it was so fatally flawed with innumerable errors of assumption and fact. Something Simon Power would now be fully aware of.

Am all for the NZCRR so long it has nobody presiding as inept as the Commercial Lawyer Also the onus on Lundy, Bain etc to prove innocence it not meeting the cabinet based guidelines .

Now that some time has elapsed since that poor woman left her kid in the car and the kid died
of heatstroke.

Emotions may have waned to the point where we can ask,

Is there such a thing as, “Forgotten baby syndrome.”

And, is this an offence that should be prosecuted ?

Prosecution may have the effect of focusing parents minds to their responsibilities and thereby
reduce the incidence in future.

Points to consider.

There is no such syndrome described in the DSM1V

There is not even a term coined to describe forgetfullnes leaving your dog, cat, or pet in a car in the sun that
subsequently dies of heatstroke.

Should you be able to rely on a defence of “Forgotten baby syndrome’ when it is a child, given that
no such leeway is afforded to a thoughtless person who does the same thing to their pet ?

Calling it forgotten baby syndrome is just facile journalese.

The correct term is forgetfulness. We’ve all experienced it in one way or another. Many moons ago, I put the baby in his car seat into the car and then drove 150 miles. Problem was that I forgot to attach the seat to its anchors. Thankfully, it was an uneventful journey, but I was mortified to discover what I had failed to do.

btw, when I read terms like “forgotten baby syndrome” it brings on “want to puke syndrome” in me.

You are correct, however the question, and the point of my post is.
Is it a forgetfulness that is legally culpable ?

Say you are bathing your 18 month old and the phone rings, you quickly run out to the
lounge to take the call, you return to the bathroom and your child has drowned.

Are you culpable ?

Is the mother who left her child in the car culpable ?

Would prosecution and the publicity of such prosecutions help focus parents to their responsibilities ?

Or, should we invent a new term. “Forgotten baby syndrome” and absolve parents like that of any responsibility ?

“forgotten baby syndrome” I don’t think it’s a syndrome unless there are common signs and symptoms which have occurred in several similar incidents with similar outcomes.
Apparently there have been several such internationally.

I imagine that there are a few here who could say ‘there but for the grace of god, go I’ and I can imagine a woman getting into her car to go to work, with long day ahead of her, driving off, parking the car, getting out and walking into the office as she has done every day for x years.

Only this time, she was going to deliver her child to daycare because her partner couldn’t on this particular day. But her mind and routine were set.

What a dreadful, dreadful experience for a person whose whole professional life has been focussed on saving and prolonging life for others as best she can.

It doesn’t matter what the rest of us think – will she be able to save herself?

“Forgetfullness” and “Forgotten” are the same word essentially. In this case it involves a baby so I see no objection there. So it comes down to whether or not “syndrome” is an apt description.

The term syndrome derives from the Greek σύνδρομον, meaning “concurrence”.

What do you think the justice system could possibly do to this woman that is worse than what she has already done to herself?

I would argue that a pet and a child are not comparable and that with pets it is perhaps more likely due to not caring about the pet rather than a genuine horrible mistake.

Try reading the reported witness descriptions of the scene after the woman found her child in the car and then try and think of how you can make her life even more shit with criminal penalties.

@Cricko….. if I was selected for Jury service to hear a case of child death/ injury due to parental forgetfulness, I would have to step down from that civil duty as I could not in all honesty only consider the facts placed in front of me.

Both scenarios you have posed could lead to tragic outcomes…. one more so than the other probably. How the legal beagles argue the toss is beyond me….

Credit yourself with more common sense.
I do.
In a trial you would do your duty and you would be a fair juror.

One parent leaves a child alone in a cot.
Another parent leaves a child alone in a bath.
One is culpable should the child die, one is not.
(in the absense of any other risk to the child.)

You know the difference.
Forget the the legal eagles.

Why is it different if you leave your child ?

I have a sunroom in my house that my cat loves to sleep in. It’s not always obvious that she is there and if I were to lock her in during the day in winter, it would be no big deal. But in summer – it would be a death sentence. Consequently I am terrified that I will accidentally lock her in there, especially when we are going out for the day and I make sure to check the sunroom and where she is before I lock the house up. I’ve drilled this into my kids as well – to make sure they know where the cat is before they lock up the sunroom, and if they are not sure, to leave the door to the house open (not desireable, because the sunroom generates a lot of heat, but better than a dead cat).

I don’t even want to imagine the fate of death by heat on a cat, let alone a child, so my mind refuses to go there. I don’t want to imagine it.

I never had to worry about that sort of thing for my kids because they never went to daycare.

However, if I am that damn worried about a cat, how much more worried should working parents who drop their kids off at daycare be? Both parents need to be going through some sort of check before they leave the car every single damn time, even if they know their baby isn’t in the backseat. So it’s part of their repertoire just like checking for my cat is for me, so that what happened recently never happens again.

Poor baby – what a way to die.

If prosecuting the mother is a way of stopping other parents from doing this “accidentally”, then I’m all for it. Won’t be that bad for the mother, because as Weihana has said, what she’s already gone through is far worse.

On an individual basis it’s a bit tough to blame an individual woman for forgetting her baby. On a general basis though, when we tote up the infants lost to maternal neglect from all causes there’s a thread that can be followed all the way through.

That is…..a woman can never be judged wrong or declared guilty of this neglect because….wait for it…..she is a woman! In the manner of poor indigenous people, Muslims & others groupings that attract touchy-feely attention she will be judged a “special case”, never deserving of punishment but only hugs & counselling.

Case law built up by numerous defences mounted by ambitious lawyers will guarantee a farce of a trial at best or a six page interview by “Woman’s Day” at worst.

Have a look down your pants before you commit a crime & if you have a penis do something else.

I’ve just read a post at a blog with a record of breaking supression orders, so I won’t link to it.

It details a number of known facts, plus information that matches rumours I’ve heard, and additional detail.

It’s particulrly disturbing.

First I’ll say that if they are inaccurate then it’s awful for those named to be associated unfairly. That’s can be a risk of suppression of information of something that many people have an interest in and a determination to make public.

But it talks of erring MPs and political and police cover-ups that could be protecting their own.

And it talks of sexual assault against children.

If true this is extremely serious. And it needs to be dealt with. If those who should won’t deal with it then it’s up to others to make it impossible for them not to.

Rosemary Mcleoud wrote many many years ago that ‘parenting teaches you about humility and guilt’ – something I still refer to almost weekly with the 9yld.

Thanks to Rosemary I never found out the hard way, and from that have also found parenting in general to be mostly about forming good habits by practise. That then bonds you to your child and them to you. The oldest is now a good mother and wife and would not forget her daughter. Parenting is therefor inter-generational – some are good at it and some our not – due MOSTLY to their own parents behaviour.

A good parent would not forget kids – it just doesn’t happen. And in larger families the older children were ALWAYS made to be responsable for the younger ones.

So you are saying that Robin didn’t go to the toilet, which backs up the assertions regarding the amount of urine in his bladder a nights collection. Robin could also have gone and got the paper after turning the computer on before praying and David had hidden behind the curtain after returning from the paper run. It is all conjecture.

Back to the knelt down to pray. Oh dear how desperate, lets pretend the bullet went downward into his brain and that Dr Demspter and the other forensic experts just made it up. Round and round in circles they go, a spelling mistake that wasn’t, a man walking around in such a daze that he didn’t see a corpse in a doorway, forgot to put his porridge on and wore no underpants. Boy, the sisters are in a real spin.

I remember observing the real tiredness and memory loss that is caused to some mothers by raising a family and work, but particularly by child birth. Forgetfulness is not accompanied by mens rea even if a woman ties a ribbon around her finger to remember something she still might forget through lack of sleep, pressure of work, emotional strain.

UglyTruth, good morning. I saw – on video – aircraft crash into the towers. I saw – on video – the man who designed them explain how the fire weakened vulnerable trusses allowing the building to collapse due to gravity. His remorse and apology.

It might not be true, but it’s a straightforward explanation, which I prefer. Yours are always too convoluted and complicated. Thanks all the same.

Nostalgia. Yes, we all suffer from brain farts. Yours seem to be more long-winded than most. Strangely confined to the Bain killings. Must be something to do with your own experiences. Were you set up?

It might not be true, but it’s a straightforward explanation, which I prefer.

And an incomplete one, in that is doesn’t explain the reports of molten steel, the millions of gallons of water used to cool the site, the underground fires that burned for months, or the giant hole in the granite bedrock.

Yours are always too convoluted and complicated. Thanks all the same.

What is so complicated about nuclear devices generating the energy signature I just described?
