On the tree – are there any lawyers among us?

I am wondering whether instead of needing to go as far as actually acquiring the land, the tree-lovers could pay the landowner to subject his land to a covenant protecting the tree. Obviously, in order to get the landowner to accept such a deal, the price would have to be high enough to adequately compensate him for the reduced development potential and re-sale value of his land.

Assuming both parties freely consented, would that be enforceable?

Penny Bright has won her present court encounter this morning –

Bright’s counter claim now centers on a section, as mentioned on kiwiblog, she hadn’t noticed until late last year –
Local Government (Rating) Act 2002
Section 45 – Contents of rates assessment
(g) the activities or groups of activities of the local authority that will be funded from each rate

Because her rates assessment form doesn’t comply with this section, Penny rightfully declares the form invalid.

Reports suggest –
Her next step was to go to the High Court and seek a declaratory judgement on the validity of the rates.

Funny.
That is exactly what several people on kiwiblog have questioned her about many times.
If Penny accepts and uses the first part of this Act to gain her reprieve, it is a corrupt inconsistency to not observe section 60 of the same Act –

Local Government (Rating) Act 2002
Section 60 – Invalidity of rates not ground for refusal to pay rates
A person must not refuse to pay rates on the ground that the rates are invalid unless the person brings proceedings in the High Court to challenge the validity of the rates on the ground that the local authority is not empowered to set or assess the rates on the particular rating unit.

In the meantime, I had decided to request the transcripts on a weekly basis, the week after each press conference.

Then last week I got a note from Sia Aston, the PM’s chief press secretary, saying they had addressed my queries by posting them on the Beehive website (www.beehive.govt.nz) down the right hand side.

When I asked why the transcripts were not searchable, Sia said it was decided that making them searchable was the “safest” way to present them so they could not be “manipulated.”

Teenager Beaven Wallace Loretz was granted bail while awaiting trial for murder. (lucky boy)

Not the smartest kid on the block he cut off his electronic ankle bracelet and took off
into the wind because he was frightened of going to jail. (stupid boy)

He lasted a couple of days, was recaptured and is now remanded in custody untill his trial
sometime in November. (this is a kid who thinks things through carefully before he acts.)

Will be interesting to see what defence he comes up with for the murder.

You are spot on about the NZFS and forestry research.

NZ was built on our agricultural and forestry scientists and the skilled and progressive farmers and foresters who implemented their ideas.

Kauri rotation plantations at 60-80 years isn’t impossible economically, given the value of the wood. It’s just at peak about twice the rotation for Douglas fir (Oregon timber) I think, and the great kauri wood would fetch well over twice the price, especially with tropical hard wood forests being cut and burned.

I still think kauri plantations might help Northland.

Seems that Auckland Council won’t be selling my house any time soon – given that today I just won in the Auckland District Court and the underpinning rates ‘Judgment Debt’ upon which they were relying, was today ‘set aside’.

How do you feel about that IGM?

Well done, Penny. You surprise me (or at least the court decision surprises me) but, as Alex Masterley said, one can never tell with litigation. Can you post the decision? Did the court state that the rates are not payable because of the deficiency in the notice or was it because there was some confusion with the amount?

I can remember the Judge saying that he or she didn’t have a lot of confidence in the Council not being able to determine the exact amount claimed to be owed, and one of the Council staff claiming that it was ‘complex.’ Anybody would be concerned that an organisation such as a council considered they could simply steam ahead in manner where due process wasn’t the foundation, and using a tool available to itself that could be considered disproportionate and oppressive against an argument of asking for transparency

A blonde was on holiday and driving through Darwin.

She desperately wanted to take home a pair of genuine crocodile shoes
but was very reluctant to pay the high prices the local vendors were asking.
After becoming very frustrated with the “no haggle on prices” attitude of

Just then, he spots a huge 3 metre croc swimming rapidly toward her.
With lightning speed, she takes aim, kills the creature and hauls it onto
the slimy banks of the river.
Lying nearby were 7 more of the dead creatures, all lying on their backs.
The shopkeeper stood on the bank, watching in silent amazement.
The blonde struggled and flipped the Croc onto it’s back. –
Rolling her eyes heavenward and screaming in great frustration,
she shouts out……..

Faux may be most trusted among republicans democrat’s dont trust any media especially faux.

Among Republican voters, 58 percent say they trust Fox News the most, with 13 percent favoring CNN, 7 percent for NBC and CBS, 5 percent for ABC and 2 percent for MSNBC.

With Democrats, CNN is the top choice with 32 percent, 15 percent for NBC, 14 percent for CBS and MSNBC, and 8 percent for ABC. Only 3 percent trust Fox News most.

Let’s see if I’ve got this: store manager Shane Singh (an ethnic Indian I assume) has been abusing Satnam Singh (an ethnic Indian). How can this be “racial” abuse if they’re both of the same race? (Abuse to be sure, but “racial” abuse?)

ROMANCE WRITTEN BY A GUY

“I’m a bad girl” she whispered “Punish me in a way only a real man can!” “Alright” I said and left my wet towels on the bathroom floor.

Wandering through Courtenay Place last night – seeing all of the bars etc – shit there must be a lot of people who go out spending money to keep them all going. A whole street of bars and side streets of bars. At least there’s a big selection unlike everything else that’s owned by one or two mega-overlords. Being NZ I suppose you’ll later find out that Foodstuffs own half of them – hahahaha.

I went to NW Chaffers St. You won’t find one empty space on a shelf in any aisle. It’s their thing. It’s weird. They have shelf shifters and that’s their whole job – eliminate every single space asap. As per NW Chaffers St hiring policy – I walked along the checkouts – Asian, Asian, Asian, Asian – they all looked like the life of the party – so I kept going to the self-checkout. The white young fella had an earpiece on. One of the space stoppers had one too. They’re all linked up for efficiency or something. Hard to get answers from self-scan bloke about the earpiece. Their self-scan has no volume control option. You can’t turn the voice off. I asked self-scan bloke how he does it listening to it all shift. *please place bag in the bagging area* times a million each day. And then when they’re all going at the same time that’s insane real life nightmare stuff. *please please place bag please place bag bag please bagging place please place bagging area area in the bagging please in the please place area area in the bagging area*. Yeah. NOOOOOO !!!!

As I left town an Indian skinned bloke did a U turn from being parked in front of me without looking. It’s usually a non-kiwi looking person. The gormless look on the face – open mouth braindead guppy yawping moron.

You’ve got to love the Gloriavale breeding programme freakshow.

14 of them leave for Timaru. When you leave ‘the system’ all of a sudden 14 might as well be 1 400. Yeah. What are you meant to do with all of that lot ? Sweet – seven bedroom house, no problem.

They want their privacy. That’s nice. Well – why are they in the national fucking media then ? Oh – that’s right – because now that they’re on the outside with nothing – they need lots and lots of charity – money and stuff given to them. So what – they need publicity so that everyone else can fund their retarded breeding programme – but we’d like our privacy. Deranged.

I’ve got some fucking questions – now that they’re not being told to have as many babies as it is humanly possible to by their beloved overlords at Gloriavale – are they going to actually stop at twelve ? How bad would it be if they kept going, huh ? Oh whoops – there’s another one – er ha haaaaa – deary me – ok, that’s the last one – seriously. Baker’s dozen. No, sorry – 14. I mean it now – 14 and that’s it. That would just be the end if they had another one on top of twelve. They can get stuffed with the hand-outs at that point. Point blank: birth control – going to use it now or what ??

And there’s a few other questions like – are they going to be ‘normal’ now ? What weirdness might they retain ? Are the kids going to be allowed to watch ‘devilvision’ and look at the ‘interdevilnet’ ? Are they still whatever weirdo brand of godlianity that they are at Gloriabreeders ?

And the good news is – more families might follow them in leaving. Oh goody goody goody. They’re so much better than everyone else until it’s time for the taxpayer and do-gooders to prop them up. By its very nature – Gloriavale creates a mess of shit that ends up spilling back into the mainstream. Should introduce a big breeding tax for every unit born after four of them. No wonder they’re leaving – you’d have to put up skyscrapers Dubai style to keep up with their third world birth rate – bloody zealot addled retards.

Oh yeah – the latest celebration of chocolate – Chocster coming up soon. Chocmas and chocster. Those great chocstian events.

At the shop – you can get a ‘princess bunny and egg’ thing -you should see it in its little cardboard casing – too much. Doesn’t make any sense at all. Also from the same WTF category – chocolate penguin staffed chocolate pirate ship – 400g. Yeah, ok. Hmmm – random mode of transport and random animals. Hahaha – made in China using Belgian chocolate – marketed in Australia. Say what ? Um – made in China using Belgian chocolate. They send the chocolate to China and the Chinese shove it in the mould ? What ? I don’t even know where to begin – I’m certainly not buying that BS or Noah’s chocolate easter pirate ark of penguins.

Everything is chocolate. Chocolate. Chocolate. Chocolate. There’s no eggs made out of cabbage.

Saw some 25g Cadbury eggs – they worked out at about $80 per kilo – um – straight away I’d go for Roses at $20-30 per kilo, not some shitty rip-off plain milk chocolate egg ?

And finally last and least – an Official All Blacks Easter Egg. Made in Australia. I’m here all week kia toa mate.
