Brian Gaynor has another good article in the Hooerald today on the Chinese bid for control of Silver Fern Farms that is being sold as a partnership with the present co-op.

Here is one interesting extract:

The partnership agreement contains a “Casting Vote Matters” clause whereby the Shanghai Maling appointed Co-Chairperson has a casting vote. This casting vote will apply in the following situations:

• On the approval of the annual business plan.

• On the approval of the annual budget.

• On the approval of the annual financial statements.

• On the appointment or dismissal of the chief executive and determination of the chief executive’s compensation arrangements.

• In relation to the dividend policy and the quantum and timing of dividends.

Labour MP David Cunliffe joins a protester at Bunnings New Lynn.

Bunnings workers protested at one of the country’s newest DIY stores as the deadlock continues over new contracts.

About 40 staff picketed outside Bunnings New Lynn in West Auckland on Saturday, just a few months after the mega-store opened.

It is the latest strike action against Bunnings as workers protest new contracts across the country.

First Union secretary Maxine Gay said the DIY store is refusing to compromise with workers.

Under the contracts, workers would lose the right to mutually agree with their employer over hours and rosters, she said.

“Management will have the power to chop and change start and finish times, even what days of the week a worker is rostered on for can change on a manager’s whim.”

Fucken hell. The employer can tell the employee when they want them to turn up and leave. What a pack of utter bastards. How dare they. What next. Demand a dress code? Luckily Dave’s right onto it, let’s hope though that instead of tooting, no-one tries to run him over instead. That’d be a national tragedy.

What’s interesting about the shooting in Oregon yesterday where the gunman killed based on whether his targets were Christian or not.. You don’t see hashtags popping up like #ChristianLivesMatter or similar. If the victims had been black or Muslim there would have been a national outcry. Instead of politicizing the event over gun control Obama would have got up and condemned the religious intolerance of the shootings. What we get instead is largely an apathetic response around the fact that the victims were Christian, and the few networks that report the fact do it as a sidebar and it is not discussed.

The report I saw said he shot the Christians in the head and he shot the others in the leg. So apparently, it did matter.

The whole thing for this reason – that a white guy asks about religion – therefore screams psyop. WTF does a white guy growing up in the US care about someone’s religion?

Could be wrong, and let’s see what happens.

But no doubt, in either case, the sheeple will still go:

‘We are told they may be close to reaching a final deal on the Trans-Pacific Partnership Agreement (TPPA) in Atlanta, and longer monopolies for Big Pharma over biologic medicines is the final sticking point’, according to Professor Jane Kelsey, who is in touch with people on the ground in Atlanta.

The US is insisting on eight years total monopoly protection. Several countries are holding firm. But there are real fears New Zealand could cave.

Trade Minister Tim Groser.

Trade Minister Groser is quoted in this morning’s Herald as saying every country will have to swallow multiple dead rats to finalise the deal in an ‘ugly compromise’.

‘In New Zealand’s case, the dead rat seems to be a dairy for medicines deal’, said Professor Kelsey.

“If this happens, we can expect the Minister to hail the “net benefits” of the TPPA to New Zealand, playing up supposed gains to dairy exports that remain to be seen, and playing down New Zealand’s agreement to longer monopoly protection for biologics.’

‘But the stark reality is that any such deal to close the TPPA would cost New Zealander’s lives.’

Health economists calculate that every added year of protection for biologics would cost New Zealand many tens of millions of dollars in current spending, and much more in the future as more biologics come on stream.

‘Future New Zealand governments would have to stump up hundreds of millions of dollars more to Pharmac. Yet this year the National government refused to fund even the modest budget increase Pharmac sought to meet rising costs.’

‘Cancer sufferers in Atlanta described the biologics provision as a “death sentence clause”. Do Prime Minister Key and Minister Groser want that recorded as their legacy?’

Seems that three key advocates for the TPPA, in my opinion, are all personally conflicted, in that each of them stands to personally gain from NZ signing it?

Trade Minister Tim Groser wants the job of Ambassador to the USA.

Former NZ Prime Minister Helen Clark wants the job of UN Secretary-General.

Current NZ Prime Minister John Key is a shareholder in the Bank of America.

It would be nice, in my opinion, to have ‘leaders’ who put the ‘national interest’ of New Zealand ahead of their own?

Well, economists are consistent..if not always seriously wrong.

Actual Sept jobs were just 142,000 and July+August were revised down 59,000. So that imminent rise is not so certain afterall. Should keep someone pleased (and a baked bean hoarder feeling a little less nervous about over stocking on emergency supplies).

Meanwhile I shall apply an internal grape-based liquid remedy to soothe my outside pains from having just flea’d and wormed my cats….

Griff – I am a private citizen who does not receive public (taxpayer) monies, apart from occasional personal donations from those individuals who choose to support the work which I have done on a self-funded basis over the last FIFTEEN years.

Unlike the Office of the Auditor-General (OAG), Ombudsman, National Office of the Archives, Police or Serious Fraud Office, the job I choose to do on a voluntary basis, is not covered by statute.

Why don’t you focus your attention on these statutory ‘Third Party’ Public Watchdogs, who receive public monies and have legislative requirements to look after the public and the ‘public interest’?

(Meant of course in a caring way 😉

Interesting article in the Herald about the second thoughts Germans are having about letting in all the refugees.

FFS there is Albanians and Pakistanis described in the article. When were these two countries in the middle of a war? Stories of refugees rioting, trying to lynch other refugees and getting drunk and harassing locals.

I’m not a gutless sheepish SLAVE Big Bruv – I’m an informed CITIZEN who knows my lawful rights and Auckland Council’s statutory duties.

You may like being bled dry by the (in my opinion) corporate ‘robber barons’ in whose interests the Auckland region is now being run ‘like a business – by business – for business’ – I don’t.

Unlike a lot of whining Kiwibloggers, I’m actually taking action, which cannot be ignored.

If you don’t know your rights – you don’t have any.

If you don’t defend the rights you are supposed to have – you lose them.

Unlike a lot of whining Kiwibloggers, I’m actually taking action, which cannot be ignored.

I think Penny you’d improve the strength of your argument if you made a without-prejudice part payment toward the rate arrears. After all, if every Aucklander followed your example, how high would the rubbish pile now be and how many rats would you have infesting your home as well as every other in Auckland?

Just a thought. I don’t want to get into the rights and wrongs of your case, I don’t know it well enough. And those types of payments are made all the time in law. It doesn’t affect your standing.

Things with Penny have taken another twist, if I recall correctly some prima donna in the council has used over $100,000 in public funds suing Penny. This council is out of control. Whatever is happening between the council and Penny it will be resolved through the Courts, probably through mediation as it appears council has shifted to more transparent financial reporting. But how does the council end up spending over a $100,000 defending the reputation of an employee, I’d like Len Brown to comment on that. Penny makes her own decisions whether they’re liked by others or not, those decisions and the reasons for them are being tested under the Law. On the other hand the decision to spend rate payer moneys over some apparent outrage that has flown under the radar is misguided to the extreme. If Penny’s opinions are so important to Council employees then why haven’t they sought to resolve them. It simply looks like the arguments held that transparency of spending is not the business of rate payers in fine detail can be overcome by throwing money at some kind of side show. This a council that goes out at night to issue traffic infringements then backs down on them, a council that paid a fortune to a fraudster on he basis of false invoices that corresponded to personal trading in a back up job funded by council, a council who tried to delegate the job of mowing their own berms to ratepayers, who leave storm water drains unfiltered thus allowing plastic free entry into the harbour. Do the little jobs first and don’t worry about ‘City Vision’ and ‘Liveable Cities’ until the basics are right.

Auckland Council applies to strike out Penny Bright defamation proceedings

Auckland Council has applied to have Penny Bright’s defamation proceedings struck out, with the matter to be heard by the High Court at a hearing on 5 November.

Separately, Ms Bright has initiated defamation proceedings in relation to comments concerning her unpaid rates made by the council in a press statement last year, which the council is defending against.

Auckland Council’s General Manager Finance Kevin Ramsay says: “Auckland Council did not initiate these defamation proceedings but clearly we need to respond to the claims Ms Bright has made. As we have said previously, we believe the views expressed about Ms Bright were fair and accurate, and we completely reject the accusations she has made.
…
“Ms Bright’s offer to settle the defamation case with an apology and a payment to her of $10,000 was unacceptable from our perspective. It is open to Ms Bright to stop the court action at any time without further unnecessary costs to ratepayers.”

The courts have discretion, but routinely award costs to successful parties. Costs will be sought if the application succeeds.

So, the Penny Bright show goes back to the Auckland District Court on 7 October 2015 for the unpaid rates case, and then moves to the High Court on 7 November 2015 for the defamation case.

It looks like Penny’s defamation case will be thrown out, with costs awarded against her, which may (I say “may” because I haven’t analysed the relevant statute with respect to this issue) be recoverable as part of the house sale.

Judgement day is coming Penny!

I think you may have the cart and horse the wrong way round. ‘Tis Penny who is suing the council, not the other way round. I think, also, that her claim is for a sum in excess of $300,000 and she has offered to accept $10,000. I wonder if she had in mind offering the $10,000 in satisfaction of rates arrears?
