Witness regrets going public after All Black Aaron Smith’s airport toilet encounter with woman

A man who witnessed All Black Aaron Smith slipping into a disabled toilet with a mystery woman says he regrets going public and apologises to the player.

The man, who has asked not to be identified, said he “absolutely” regretted going to the media with the story, after he and his wife and their children saw the couple at Christchurch Airport the day after an All Blacks test last month.

In an email to the Herald, the original tipster said the only organisation they had thought to report the incident to was a particular airline, as they believed the woman involved was an flight attendant or airport employee.

“We thought that was very unprofessional of her. We didn’t end up saying anything to the airline, though.”

He said he never imagined the story would “blow up this big”.

“We have had a lot of abuse since the story broke.

“It was actually my wife who wished to go to the media and it has therefore caused a lot of strain in our relationship this past week,” he said.

“I would like to formally apologise to Aaron Smith and the rugby union for reporting the story.”

Smith received a one-match suspension after the news of his bathroom meeting was made public last week.

Before a flight back home from South Africa, he gave a tearful apology in front of media; apologising to his fans, family and his partner, Teagan Voykovich.

The witness acknowledged that they had a video of the incident, but would not be releasing it publicly any time soon.

“Due to the backlash, we have chosen not to distribute the video.”

Lawyer Natalya King told The Spinoff the couple who made the recording of Smith’s toilet tryst and the outlets that broke the story may have committed an invasion of privacy.

Legally invasion of privacy was the “highly offensive” disclosure of private facts.

The closed toilet cubicle was considered a private space and Christchurch Airport was a private business that prohibited filming within its premises unless permission was granted and a location charge paid.

King said even if the airport was considered a public space that didn’t mean Smith’s sexual activity automatically lost its privacy status.

And even if Smith’s prominent All Black status put him in the public eye, according to law a person’s right to privacy could be diminished if there was legitimate public concern in the matter. This, according to the courts, covered issues like public health and safety or the conduct of the government.

She said although that might automatically mean well-known figures had a lesser right to privacy an All Black and his sex life rated at a far lower level in national importance.

Veteran Auckland public relations consultant Cedric Allan said there was little chance Smith would ever shake the infamy.

It would cost him financially, in lost potential endorsement deals, and emotionally.

“It’s up to the All Blacks’ management whether this affects his future playing career. [But] he will always be known as the All Black who did this, just like older people know [former All Black] Keith Murdoch was sent home from the [1972] tour for punching someone.

“That’s the thing with reputation – it can take a lifetime to build and less than a second to destroy.”

Redemption could come, but it would take a long time.

A quicker journey might be to distinguish himself in another career, or do something so amazing it eclipsed his previous behaviour, Allan said.

“He’d have to save half a dozen drowning people at the beach. He is going to pay a horrendous price for this, way out of proportion to the seriousness of the offence.”

  I didn’t and don’t agree with him being named, and would have preferred the RU do say that it was a private matter, it must have been a close decision for them not to do so and he may well have a claim against them for constructive dismissal if his contract affords him that basic right. I think they’ve let him down, so now is the time to support him if the damage is not too deep and he decides to take a hike.

  Public figures, celebrities, all have a right to privacy and in this instance Aaron Smith’s privacy was violated because the interior of Christchurch Airport is private property and secondly filming or recording audio in a toilet is a criminal offence.
  The public interest argument is fallacious, it is not an excuse to break the law by invading a person’s privacy in such a surreptitious manner.
  Should video of the incident surface in the media then I would expect the Police to uphold the law and prosecute the offenders.

    But it is a private matter with little or no intrinsic news value, with a public “need to know”. Or have you not noticed it is hardly ever reported when public broadcasters, or even politicians do it?
    
    And “rooting while kids are around”?! What a load of crap.
    
    The (toilet) door was closed. Pretty much like any responsible adult should do at home when kids are around. Plus, courtesy of the media, kids today live in a sex-saturated world.     I thought Smith was on his down time waiting for a flight, although admittedly still in his All Black blazer. I think the NZRU would be struggling to enforce a “you can’t have sex in the extended weeks and sometimes months while in the All Black camp” ban in their employment contracts. And it was not in a public place.
    
    At worst Smith used a disabled toilet cubicle when he isn’t disabled. Which is pretty crappy (excuse the pun) and not good. But that isn’t the real story for the media, nor the reason the original arseholes dobbed him in

      Yeah but it was not a disabled toilet; it was a toilet that could be utilised by men, women and was suitable for those with a disability, it was not exclusively a toilet for the use of those confined to a wheelchair (or some other form of disability)

        Just by way of conversation – I imagine that team management can be a bit of a Scylla and Charybdis situation as well. Some want you to be the fence at the top of the cliff for people with problems or potential problems (e.g., Murdoch, Hewitt, Guilford), others want you to “let boys be boys”.
        That’s a more general comment rather than relating to Aaron Smith in particular.

        From what I know speaking to those who have been there, while you get the “special projects” you have to work on, unless they do shape up and can be managed to a certain extent, especially by senior players, they have to go. If not, the core-culture of the team starts to rot, and it is only a matter of time before everyone pays. Longknives and big bruv can be a bit tiresome, but they are probably old enough to remember some of the “arrogant All Blacks” of yesteryear. There was a particularly bad crop in the 1980s and 1990s.
        
        Professional and/or international sport is high pressure and results-driven, both on and off the field. It is not the place for people with serious “issues”, nor passengers, and therefore there is a limit to how much the “set-up” can assist, or even prove unproductive to mental and emotional well-being. Those with “serious issues” will crack. I don’t put Smith in that category, but the others you mention – yes, sadly they were better off out of it. Jesse Ryder, despite his supporters, is another. Or at least he has thus far.
        
        But the way with teams these days is for players especially to set the protocols and standards…and hold fellow players accountable to it. But everyone tends to say the “right thing” when those are set. The real test is when you have to hold people accountable. Then there is the temptation to let it slide or make excuses. But you also have to remember that the environment in which they have to operate is so artificial, almost military. Human nature wants and almost needs to rebel from time to time to retain some sense of individuality, even if subconsciously.

I even suffered the newspaper advertisement video and understand why the contractors took the ‘art’ away; it was shit.

One of the things that will have to go so we can pay the living wage to council staff.

Has anyone calculated the additional cost downstream as those in the system who have seniority, better qualifications, more time, etc. who will see their position margin reduced, demand more money to maintain their position within the council structure? Those on $20.00 / hour who have been there for ten years, those with some sort of tertiary qualification, those who produce some value for the organisation?

$4 mil is not anywhere near the end of it.

–The widespread protests against the name Washington “Redskins” were pure left-wing hysteria — ended only by the revelation through polling that the vast majority of American Indians couldn’t care less about the name.
The examples are endless: from the alleged epidemic of heterosexual AIDS in America and preschool molestation scares in the ’80s to the wildly exaggerated dangers of secondhand smoke and the baseless fears about electronic cigarettes.
We are regularly forced to endure a new left-wing manufactured, media-supercharged hysteria.
The latest is the tsunami of horror in reaction to Donald Trump’s gross and juvenile comments made in private 11 years ago.
The tsunami of condemnation of his remarks is quintessential left-wing hysteria. That more than a few Republicans and conservatives have joined in is a testament to the power of mass media and hysteria to influence normally sensible people.
This is hysteria first and foremost because the comments were made in private. I would say the same thing if crass comments made by Hillary Clinton in private conversation had been recorded. In fact, I did. In 2000, in a Wall Street Journal column, I defended Hillary Clinton against charges that she was an anti-Semite. That year it was reported that Clinton had called Paul Fray, the manager of her husband’s failed 1974 congressional campaign, a “f—ing Jew bastard.”
Even the left-wing newspaper, the Guardian, reported that three people — two witnesses and Fray — confirmed the report.
Nevertheless, I wrote in the Journal, “I wish to defend Mrs. Clinton. I do so as a practicing Jew and a Republican. … We must cease this moral idiocy of judging people by stray private comments.”
I gave two more examples:
One was Harry Truman, who often used the word “kike” when referring to Jews. Yet, he was the Jews’ greatest friend when he changed Jewish history by resisting powerful State Department opposition and recognized the State of Israel.
The other was Richard Nixon, who made anti-Jewish remarks in private conversations in the Oval Office. These were revealed on tapes he himself made of his conversations, and he was accordingly widely labeled an anti-Semite. Yet, as president, Nixon appointed the first American Jewish secretary of state and, more importantly, literally saved Israel’s life with his quick airlift of military supplies during the 1973 Yom Kippur War.
As I concluded:
“It is highly misleading to probe private comments for evidence of anti-Semitism, racism, bigotry and sexism.”
In addition to not taking all private comments seriously, Republicans, conservatives and independents need to ask themselves if what Trump said — not did, but said — in a private conversation is any way comparable to the truly awful things Hillary Clinton and her husband have done both to women and to the country.
They also need to ask themselves if it is worth giving the left the White House over such trivia.
If Hillary Clinton wins, will Republicans and conservatives who gave up on Trump because of this recording really think that it was worth: having a left-wing Supreme Court for the next 30 years; having left-wing judges completely dominate lower federal courts; radically curtailing religious liberty in America; having speech codes go from colleges to the society as a whole; massively increasing the size of the government and of the debt; bringing in tens of thousands of refugees from the Arab Middle East; and having open borders?
How can anyone answer in the affirmative?
The answer is the left-wing hysteria got to them.
On the same day the recording came out, so did leaked emails that revealed that Hillary Clinton told a Brazilian Bank in 2013 that she is for “open borders.”
Open borders mean the end of the United States as we know it.
That, my fellow Americans, is worth getting hysterical about.

  The students are physically large and it would be foolish for a female teacher to impose herself between the fighting students for fear of injuring herself.
  The fight was short in duration, senior students were able to diffuse the situation.
  It was proper and correct for teachers in attendance to call for back-up in the contingency the fight escalated to involve a larger group of students. Media reports that teachers stood by idly are sensational and completely false.
  The scenario of students fighting is an example of the conditions teachers throughout New Zealand have to contend with on a daily basis and this type of activity is not restricted to low decile public schools but can be found in most schools where boys and sometimes girls respond to adolescent peer pressure with acts of physical aggression.

Cubs win the game and the series right at the end. After trailing 5-2 for most of the game they pile on four runs in the top of the 9th – their last chance – and then Chapman and his 100mph+ pitches buried the Giant’s batters.

Now on to another tough series against whoever wins the Nationals-Dodger’s playoffs.

Hillary’s 8 point plan is conflicted and personal. Taking on Qatar and Saudi Arabia puts her at odds with big time Clinton Foundation donors.

Things get further complicated when we remember that in 2010, (as reported by The Intercept) Clinton’s top aide said that the up to $60 billion weapons transfer of fighter jets and helicopters to Saudi Arabia was a “top priority.”

On August 17, 2014 Hillary Clinton sent an email to John Podesta (then counselor to President Barack Obama, now current Hillary campaign chairman), where HRC details her roadmap to defeating ISIS, propping up the Kurdish forces in the north, and striking a decisive blow to Assad in Syria…
