  Justice is not consequences that are utterly disproportionate to the alleged wrong. Having all interest wiped for a rather minor issue is very disproportionate. The justice system is not a powerball lottery.
  The borrowers will still get justice but in proportion to the alleged wrong.

  That article sounds like absolute bullshit to me, did the banks not just get reprimanded over another botched bank charge hand was gorced to pay it back? Can anyone show anywhere where Nats have tried to stop anything they keeps pressure on banks, in fact are they not getting tough on banks for deciding they don’t work with petrol stations snd farmers, are they not trying to make banks more competitive

So some significant health infrastructure spending confirmed. At the same time media are reporting that health professionals are not happy – striking, overworked, leaving New Zealand in droves. Many will have been expensively educated by NZ taxpayers, no problem with that of course.

However, there is that age old option – make or buy. It has become easier for the moderately wealthy to come here under the golden passport. That is NZ buying what someone else has made.

Is there a golden passport to ‘buy’ health professionals? A fraction of the taxpayer cost to ‘make’ could be repurposed to bring them here, intensively top up training with a stipend for a few months, make sure jobs are available, bond for a few years, allow families to accompany. Keep the new arrivals happy and working in our hospitals and clinics.

How about a new Waikato med school dedicated to wraparound for these valuable immigrants.

  I have a lot of family in the health sector. Some are going. Some are coming back. Health is a disaster in the UK, Canada and increasingly Australia too. The causes are common: dysfunctional bureaucracies. The solutions are simple and don’t usually involve more money: simplify. Unfortunately, the smartest voices in the room are often the quietest.

      Like all these concepts money is needed, a lot of it.
      It appears the consultant business is getting into top gear. And growing .
      Solid and sound decisions with cost benefit analysis are needed from those in charge now .to minimise the very considerable additional cost of wishy washy decision making.
      Make it happen.or it is the consultants who will own the budget!
      ( Worst case Example is the Museum in the news midday today.)

  I don’t have much sympathy for doctors especially those higher up the tree. At a hospital near me, a few examples: consultant on stress leave for a year on full pay plus an on- call allowance when not on call.
  Another consultant with a brain tumour 18 months on full pay.
  Health care assistant with cancer, used up all her sick leave and annual leave for kemo, now having to plan her kemo for the end of her 5 day shift so she has two days to recover before returning to work.
  Is that a caring health service or a gravy train for doctors?

    I do wonder if it isn’t a gravy train. Consider a GP visit hourly rate is $520 (130 x 4 fifteen minute appointments). Even if they were taking in revenue for only 9 of the 12 months that’s just over $800k revenue for one GP.
    
    The patient pays $65 for the 15 minutes, the govt pays the rest.

        11 GPs each taking appointments for 9 months in a year, leaving 3 months for admin, study, holidays = 8800k.
        
        STAFF
        11 GPs $250k
        1 manager $95 to 120k
        2 other managers $80 to 100k
        4 receptionists 55 to 60k
        1 nurse practitioner 130 to 150k
        9 nurses 85 to 95k
        2 health care assistants 60 to 70k
        Total annual salary costs using upper values = $4,455k.
        
        Sure, there’s property and materials costs, but they’re not significant in the above.

      That money does not all go into the GP’s pocket. The GP has to contribute to the cost of running the practice – premises, equipment, consumables, practice nurses and anciliary staff etc.

    some with serious staffing challenges.
    
    countless administrations have abused medical staff’s loyalty to patients and colleagues by not dealing to the issues.
    
    presently the rehire and overseas grab of specialists is fucked.
    between medical council, MOH and DHB’s it is a shit show in some areas, all over dysfunctional.
    
    so I can’t agree with your statement of a gravy train.
    12 yrs to get qualified and 3-5 yrs to get good at it is a serious barrier to entry.

      But let’s hear you justify the discrepancy I highlighted between the treatment of consultants, very rich consultants and the treatment of other health staff?

        I guess the numbers are dictated by market power. We would all love to find a way to pay doctors less and inveigle enough of them into the health system … If you have a way around this please share it.
        
        The most active ones are the RMOs (newly graduated ones aka “junior doctors”) who have had a super-negotiator for years. Take a bow Deborah Powell ….
        
        The RMO negotiators have been so good that the top of the RMO scale overlaps the bottom of the SMO scale. How much sense does that make?

    Tragic stuff. However the bottom line is that a lot of the state-employed specialists could double their income by taking a 3 hour plane ride west.
    
    If current salary levels are OK we should easily be attracting enough new staff to fill the (undisputed) excess vacancies. Not happening. Go figure.

      Unhappiness amongst staff of any persuasion is usually summarised in the “”we are underpaid”” complaint.
      
      The main problem is that they are underappreciated, especially by overpaid, overbearing Bureaucrats/Management.

      That is just not true, most consultants are up around $500k . It’s much the same in Aus. Consultants get very high locus rates. Funny how these overworked GPs and Consultants have the energy to do so many locums when the amount they get is usually their pay rate times 3. Maybe that’s why so many take extended stress leave to open up more locum hours for their mates. Don’t tell me that doesn’t happen, I know it does !

      Salaries for specialist doctors:NZ salaries from $200 to $500. In private practice up to $700.
      Aus $200 Aus to $310 in private practice $500 +.
      So the salary difference isn’t that much.
      Sure if as a nurse or doctor you want to work in the outback, living in a compound with no pubs , no resteaunts and no life you could get more.

      To be fair on Chippy, he could genuinely be gender confused, having been exposed to the females in the Labour Party, Greens, Maori Party, LGBTQI, and other fringe radical groups, he may think that some, while being adult females, do not have the true qualities of a woman.
      
      One definition of woman is “an adult female, with feminine qualities traditionally associated with females.” “She is very womanly” is not a term that would apply to various left wing females.
      
      One definition of a man, is “an adult male, with the qualities traditionally associated with males, such as bravery, spirit, or toughness.” Doyle, despite being an adult male, does not earn the right to be called a man.

  This has implications here with the law commission presenting recommendations in July on the subject of correct sexing in publications.
  Their starting point was an inclination to criminalise this where it went against the wishes of the individual.
  For example Benjamin Doyle could presumably lay a police complaint for being referred to as “he” in the purest interpretation.
  Indeed the herald managed to find a Victoria University professor to accuse Winston Peters of misgendering Doyle.
  Lara someone I think.
  
  This ruling says sex is binary, so in English law Doyle would now be making a false statement claiming to be non binary.
  
  The law commission should look very carefully at this ruling before making complete idiots of themselves.
  
  A next step should be to mandate correct sexing in court and in court reporting to turn back the idea of women raping other women

    Not really. The court has ruled that only the “biological” (as if there’re any other) women meet the definition of a woman under the equality laws. The ruling doesn’t stop people from calling themselves “non-binary”, hippopotamus or whatever other names they want to call themselves.

    According to Plunket on the Platform this morning , and I concur , it is a deliberate tactic by the Herald to distract from the Green’s Bussygate .
    
    If that is the case and I don’t doubt it , another question is ;
    how long has the Herald been sitting on this “story” and who decided to use it now .
    
    We do know from the msm Uffindel hit job /smear that the msm had that story in their “armoury” as it were , waiting for the opportune time to publish , which in that case was after the National’s successful annual conference.

      Good point about the herald banking this for a rainy day.
      I seriously doubt Maiki Sherman or her ilk would have the nous to go looking for such a tenuous link to an unknown MP.
      However , Peter Lineham, the resident expert on this sort of thing seemed primed and ready to go for the media interview rounds.
      He speculated and insinuated in a legally safe manner, but it was my impression that maybe he was possibly a little bit too much of an instant expert.

      Others in Two By Two have come out and said he is an Elder. They have a hierarchy of labels it seems. Campbell has made the mistake of not being entirely upfront with his role and involvement. A silly mistake as the truth, which isn’t significant in any way, was bound to come out. The beat up by the press for someone belonging to a religion that others elsewhere in the organisation have allegedly done bad things is ridiculous.

    I disagree, the media was always on a witch hunt here. And it ‘s not like there is a formal membership process, so when Hamish described it as an association last week then that is possibly a better technical description.
    The NZ Herald headline is bad enough, but the way it appears on the NZ Herald homepage is “Well embedded: National MP now admits being member of ‘cult’ under FBI sex abuse probe”. That headline looks quite defamatory to me, even with cult being in quotation marks, as what he actually said in his statement was: “I am a member of a small Christian group who meet in people’s homes on Sundays rather than go to church. I have hosted a small number of meetings at my home,”.
    It is a long bow to equate a “small Christian group” with a “‘cult’ under FBI sex abuse probe”, and I’m not sure if Hamish considers them to equivalent, and so quite possibly wasn’t admitting to being a member of the latter.

I know many here were upset about the Treaty Principles bill and its demise. However fear not gentle reader, some good news is on the way.

The coalition as per the agreement between National and NZ First are setting out to amend 28 laws to either take out or amend references to the Treaty of Waitangi.

As we know Winston Peters is of the view, correctly in my opinion, that the treaty of Waitangi has no principles, it was simply an agreement between two peoples. Therefore references to the Treaty should be taken out of legislation unless directly applicable.

This is a promising approach as it means that future judges cannot refer to the principles of the treaty of Waitangi if there is no reference to the Treaty in the legislation.

Also in other welcome news:

“At the same time, officials are preparing advice for ministers regarding the coalition promise to change the law governing the Waitangi Tribunal “to refocus the scope, purpose, and nature of its inquiries back to the original intent of that legislation”.

The Waitangi tribunal is simply out of control and needs to be brought to heel.

Predictably these moves have been met with opposition in the usual quarters, none more so than the “wise” folk at Victoria University:

“Victoria University of Wellington senior law lecturer Luke Fitzmaurice-Brown says the Treaty Principles Bill has been the “most egregious and blatant example of more of a sledgehammer approach to getting rid of the Treaty, or diminishing its effect, in law”.
But these other policies have the potential to be “much more insidious and could be much more impactful”.

I must confess I do like the second paragraph? “More impactful” does sound very promising.

The university expert on all things Maori goes on to say:

“Taken as a whole, the policies and legislation – along with the rhetoric from some ministers – seeks to water down or minimise the strength of provisions for Te Tiriti o Waitangi obligations in law, as well as the power of the Waitangi Tribunal.”

And I would say, I already agree with the policy, you don’t need to sell it to me! 😎

        He was responsible for elevating Ardern & putting the most inept Govt in recent memory into power. We are still trying to recover the economy from that decision.
        
        At one point he wanted the Govt to take our personal Kiwisaver accounts to solve a Govt debt problem. He railed against capitalism when part of a Labour Govt. His inconsistency has broken many MMP Govts.
        
        He couldn’t understand whether he was single or in a relationship for eight years.
        
        He claimed not to know about a pay-for-play scheme, his partner was on, under a NZF foundation that took “donations” from interested parties.
        
        Many of these actions would be enough to ban him permanently from Govt office in any honest democracy.
        
        Now he travels the world in luxury as our Foreign Minister acclaimed alike by friendly media and tribal National party supporters whom he has betrayed several times before. Peters reminds me of the scorpion on the frog.

      G: there’s been considerable work done by the WT and Courts to define the Principles over the years. To establish that the T does not have principles will take several Acts, mostly amendments. The opposition will be huge including carkois and demonstrations. It will take a great deal more determination than National has shown thus far. IMO the Maori opposition to this will be bigger than that re the ACT Bill which Luxon studiously avoided. ACT at least went along with the T having principles. National will now be saying it doesn’t. 40 years of jurisprudence down the gurgler. Do you now understand where I’m coming from?

  That was a coalition agreement 18 months ago! Nothing has actually been done.
  
  If the TPB had progressed, the whole matter would have been resolved before this “approach” will have started.
  
  By doing nothing so far, I don’t believe they will have all 28 amendments made before the next election.

  The competition, Bluebridge, aren’t subsidised and yet can offer similar prices. All of the kiwirail staff are paid the full rate and are obliged to perform. Its irrelevant what the customer pays.

    The subsidies are relevant in that the people who are travelling benefit from the subsidies.
    
    Yes, Kiwirail are wasting that money for sure, but if people were paying full price for Interislander tickets then they would support the Bluebridge option (and other non-state options that would likely emerge).
    
    The same applies to the bus services, rail services etc.
    
    The state should never compete in any market that has a functional non-state option.

      The rail service was sold off once in the past and was run into the ground by the new owners and had to be bought back.

        Yes. Absolutely.
        
        A state service has a very unfair advantage in that they have zero risk. To have a state service that is getting hundreds of millions of dollars a year “competing” with the private sector is ridiculous.
        
        As soon as the private sector can provide a useful service, the state sector should withdraw. Very likely other companies would enter the market and compete with Bluebridge.
        
        Being a “Vital link” is not an excuse. There are thousands of “vital” services we use each day that do not involve the state.
        
        You likely had food to eat in the last 24 hours. That vital service did not involve the state.
        
        What do you think would happen to your toast supply if the state got involved in bread baking?

    People working for kiwirail are paid WAY more than in Bluebridge. Check in chick in Welly I know earns well over $100 k plus incredible time of in lieu. She works at the people and vehicle check- ins and has no staff or seniority.

  They pay for a service, it’s not provided and there’re financial consequences for the people affected. Whether the provider of these services is “subsidized” or not is neither there nor here. It has nothing to do with the passengers, who have no influence over the (mis)management of the Interislander vessels.

    However the Europeans take it a step to far which results in commercial pressure to Fly because of extreme financial compensation.
    Same with the Ferries, This will lead to sailing even though it may be a 50/50 call and as always it would be a Captains call ( A real one //) to sail or not.
    As far as I am concerned , Any reason not to sail against commercial pressure is a good one as far as Inter Islander is concerned.

    The polls matter because some of what he needs depends on the support of Congress. There will be nervousness for the mid terms, which means incentives for congressmen to drive hard bargains for their vote in the House.

* Simeon Brown said senior doctors’ average pay is $343,500.
* ASMS states closer to $240,000 than $343,500.
* Union sought pay increase of 12%.
* ASMS has about 5500 employed by Te Whatu Ora.

So can we say the average pay is $290,000.
This means an average of $34,800 each.
Therefore the total Te Whatu Ora increase would have been around $191 million.

They likely are.

But those are not matters of law are they?

I was thinking more of all the laws giving women and men different rights and which are applicable to people based on what is in their pants.

For example male strikes female is a crime. Why does that exist alongside other assault laws?
The argument goes something along the lines of men are stronger than women, therefore women need more protection from men. Yes, typically that is correct but then does not cover the case where it is the other way around (eg. a female with the power of Val Adams starts thumping a weedy nerdy guy).
It would make more sense to rather make the special law strong person strikes weaker person. That would make the law far more useful and no longer depend on sex and gender etc.

It appears the media knew this story was going to break soon

Twenty-seven New Zealand-based people have reported allegations of sexual abuse within the secretive Two by Twos church, police have confirmed today.

As a result, police have launched “several” new criminal investigations – and there may be more to come.
