Housing NZ Evictions

Housing NZ have really stuffed up the eviction of the Salt Family. By going for immediate termination they almost guaranteed a long drawn out legal battle. And worse one they lost as their evidence was so shoddy.

am sure they are aware of the Residential Tenancies Act 1986. Now if we go to Section 51(1)

(1) Subject to sections 52 and 53 of this Act, the minimum period of notice required to be given by a landlord to terminate a tenancy shall be as follows:

(d) In any other case, 90 days.

Yep just give 90 days notice, and you do not need cause.

They started trying to evict her for cause in January. They lost in June. Rather than now appeal they should simply give 90 days notice of termination of the tenancy agreement.
