Why are we even surprised at this outcome? After 25-30 years of the school curriculum being dumbed down relentlessly and almost nobody being able to “fail”, a proportion of those who have sought teaching as a career are demonstrating to school principals what most other employers already know about inadequate education standards.

I love the the following reference attributed in the news item to the Director of the Education Council, a PhD it seems (although it is possible that the interviewing journalist is responsible for mangling the language below):

“The rest [of the 174 incompetent teachers] had either not reached an agreement with the council, had decided to leave the profession, could not be located, had bad health or had died. They would need to meet conditions before their practising certificates became current again.”

I await information on what conditions the dead teachers will have to meet.

Exactly why I RIP’ed it. It is sucking up enough of my family’s wealth (not mine directly as I am currently serving time on Julia Gillard’s prison island) so I decided not to waste any more by dealing with it. I tried a while over the weekend on the Coddington thread but decided it was a waste of my time. I’ve been a lot happier since I don’t see the explosions of punctuation interspersed with indecipherable drivel spewed up all over the browser page in an orgy of dope and munchies.

Dr RUSSEL NORMAN to the Minister of Finance: Does the investment protocol the Prime Minister will be signing with Australia include any provisions that would stop Australians from buying shares in New Zealand State-owned assets such as Meridian Energy, Mighty River Power, Genesis Energy and Solid Energy, should a future Government privatise them?

english says new zealanders will be ‘at the head of the queue..’..(wtf assurance is that…?..)

norman points out the terms of our trade deals with australia….prohibit any such favouring of new zealanders..

english then takes a patsy question…and bangs on and on about how much new zealanders have invested in australia..(w.t.f..was that..)

goff quotes treasury document saying foreigners will have quarter shares after some years..

..english denies knowledge of this advice….

english lodges the treasury-paper saying just that…

norman asks about profits flowing offshore..and how does that help new zealand’ economy..

..in reply..english bangs on again..about how much we are invested in australia…

(banks take out $2.5 billion in profits each year..(!)..w.t.f..!)

english advises that new zealanders should save more..(!)…..and buy shares in those profiteering businesses…(!)

I got the following nice reply from Hon Tim Macindoe (Hamilton West) and a “Thank you for your interesting views” from Louise Upston (Taupo):

Dear Malcolm,

Thank you for your recent email.

National’s bottom line in reviewing the Foreshore and Seabed law has
always been to guarantee free public access in our foreshore and seabed
area for all New Zealanders. We also want to restore the right of access
to justice where it has been taken away.

The bill has been with a select committee for the last five months while
public submissions were heard. At the same time, the Attorney-General,
other Members of Parliament and I have been meeting with and listening
to constituents. Last year I participated in (and helped to organise)
two well-attended meetings on the Bill in my electorate.

The Government has listened to people’s concerns, and will amend the
bill to ensure greater transparency in recognising customary title.

We are amending the bill so any agreement negotiated with the Crown to
recognise customary title must be passed into legislation. This will
ensure full public and Parliamentary scrutiny, and will prevent any
future government from closed-door negotiations on customary title.

Any negotiated agreement must still meet the legal requirements for
customary title set out in the bill.

The Marine and Coastal Area Bill does not automatically grant property
rights to coastal iwi and hapu. Instead, it restores the right for iwi
and hapu to prove that property right through our court system, or via
negotiation with the Crown. Where customary title is proved, it will sit
alongside common area rights such as public access, fishing and
navigation, aquaculture, and port operation. Customary title does not
supersede these rights and activities.

All applications for customary title must be made within six years of
the enactment of the bill.

Now that the Select Committee has reported back to Parliament, the
Marine and Coastal Area Bill will go through full second, third, and
Committee of the Whole House readings in Parliament.

The Marine and Coastal Area Bill:
* Repeals the Foreshore and Seabed Act.
* Guarantees free public access to the common marine and coastal
area for all New Zealanders.
* Preserves all existing use rights – including recreational
fishing rights and navigation rights
* Protects the Marine and Coastal Area from being sold
* Preserves and in some cases extends the rights of vital
infrastructure, such as ports or aquaculture.

The new Bill does not affect the 12,500 existing private titles in the
Marine and Coastal Area, but means that no further private titles can be
created.

The Marine and Coastal Area Bill guarantees the rights of all New
Zealanders in the common marine and coastal area, including free public
access. It restores access to justice through the Courts and long
established common law property rights, which are both core National
Party principles.

Every party in Parliament agrees the 2004 Foreshore and Seabed Act
should be repealed and replaced. National wants to settle this issue so
that it does not remain as a weeping sore for New Zealanders and for
future governments. We’re determined to move New Zealand forward.

I trust this response has clarified and corrected the misinformation
that is being deliberately spread by our opponents for their own
political purposes through media advertising, leaflet drops and email
circulars at the present time. As a proud and patriotic New Zealander
of European (pakeha) descent, I am convinced that the Marine and Coastal
Area Bill is a fair and balanced solution that reflects core National
Party principles including one law for all, respect for all races,
cultures and the rule of law, and in years to come I believe that the
inflammatory and divisive claims of the Bill’s critics will be shown to
have been false and without substance. If we do not resolve this issue
now, it will continue to divide our nation and we will have abrogated
our responsibility to our children and grandchildren.

Our solution is enduring and just, and a positive outcome for all New
Zealanders. If you are one of my constituents (resident in the Hamilton

person to discuss this issue and your concerns about the Bill, please

@Malcolm, there are so many half-truths, outright lies and weasel words in MacIndoes communique I’m not sure where to begin (although I do congratulate him for actually responding).

(1) Why is it when the government is talking about Maori’s avenues for gaining title, they always say “it restores the right for iwi and hapu to prove that property right through our court system, or via negotiation with the Crown”. If they were being honest, they would say “It gives Corporate Iwi the ability to negotiate with the Crown, and in the unlikely even they don’t get the outcome they want, they can go running to the Courts”. The political avenue will always be attempted before the Courts are approached and if anybody thinks this is anything other than arse-about, they are seriously in need of some of Phool’s medicine.

(2) Why is it they are lying about free public access? The bill as reported back from the Select Committee does not specifically mention free public access. Chris Finlayson has promised to include it but the wording has not yet been released. Anybody silly enough to take the hopelessly compromised Finlayson at his word on this issue deserves what they get. Also, the Apartheid Party have said previously that if the new law provides a guarantee of free public access, they will not support it. So who does Finlayson support? His current employers (all the people of New Zealand), or his former (and future) employers (Corporate Iwi, in the guise of the Apartheid Party)?

(3) Why do they never talk about the massive proportion of submissions in opposition to this outrageous law, and Quisling Key’s promise to withdraw it if there wasn’t widespread public support?

In short, the National Party and their supporters are liars on this issue. Quisling Key and Tinkerbell Finlayson are trading New Zealand’s heritage for 5 votes (well, 4, because John Hatfield has already said he won’t support it) that they don’t need.

A different news item in today’s online “Herald”:

“The former national property manager for the ACC has today pleaded guilty to corruption charges brought by the Serious Fraud Office.”

The allegations against this person have been around for some time, but his guilty plea now is a fresh development. That doesn’t interest me quite so much as why the Herald should see fit to place the story in its Business section. It’s got very little to do with business:
– ACC is not a real business at all, it’s a Government-operated entity running a state-sanctioned monopoly over most forms of personal accident insurance.
– The former ACC national property manager is not a businessman – he’s been a public servant (for over 30 years?).
– While there are no doubt occurrences of corruption in real businesses as well, this story is not an example of such corruption or any indication of its likely frequency or seriousness.

I just wish that the Herald’s journalists, sub-editors and business editor would learn to keep that publication’s sparse business content strictly to genuine business stories and information. Otherwise we may as well read about the “business plans” of the Ministry of Education or the Office of Prime Minister and Cabinet for our daily business media fare.

On a brighter note, well done to the SFO for nailing the ACC fraudster.

Maori Affairs Minister Pita Sharples has called for urgent negotiations to repair a growing rift between Auckland Council and its Maori Statutory Board.

The board has hired a barrister to prepare legal action against the Auckland Council for slashing its 2011/2012 budget from $3.4m to $1.9m in a close decision last night. Its chair David Taupiri said that the funding cut was unlawful, as the council was bound by legislation to meet the reasonable costs of the board.

Dr Sharples said the council needs to get used to a Maori board with real authority and work constructively with it.

He blasted Local Government Minister Rodney Hide for saying he never agreed with Maori having special representation on the Council.

The study used hair samples from 36 children, aged between two months and 16 years, who had lived in houses which contained a ‘P’ lab and compared the levels of methamphetamine found with adult users.

Eighty-nine per cent tested positive for methamphetamine, and levels of the drug found in the hair samples were similar to adult users.

And to answer your question, they’re ramming it through under urgency because that is what politicians do when they’re pulling a swifty which, if they left it to the usual course, would stink like last week’s leftover smoked fish pie.

The whole process is an egregious assault on democracy, and the resulting law will be a blight on this country for decades to come.

NickB I think the Tomlin quote has been somewhat undermined (at least in NZ) by the revenue authorities ruling that where such an arrangement is made with the sole intention of reducing liability, it constitutes avoidance and is therefore actionable.

The problem we have in New Zealand is the pool of legal talent is about as deep as a carpark puddle. That is why Wilson’s no-mandate move to remove the ability to appeal to the Privy Council, and set up her own coven of Progressive Activists, is such a damaging move for jurisprudence in New Zealand.

Yea I agree OK. Although I think the test now is more “parliament’s intention”.

How exactly one is to ascertain Parliament’s intention no one seems to know, it would be like herding cats at the best of times.

It was ironic that the doctors lost on this point in the court of appeal through their use of trusts, bearing in mind the number of Trusts our parliamentarians have a beneficial interest in. For this reason I find the “parliamentary intention” test a bit ironic 🙂

Two government allies have locked heads over the Auckland Council’s Maori Statutory Board with one calling for the other to resign.

ACT Party leader and Local Government Minister Rodney Hide said it would be up to ratepayers whether the board was value for money.

The reaction to the board’s budget, which was cut to $1.9million from the original proposal of $3.4m, was democracy in action, he said.

“I opposed it of course, in statute it exists to advise the council and to recommend one or two members to a council committee… obviously the council have decided to give it a considerable role

Hide said it was not democratic to give the appointed board members voting rights.

He earlier threatened to quit over the issue of designated Maori seats on the new Auckland Council.

Maori Party co-leader and Maori Affairs Minister Pita Sharples said if Hide could not accept the councils decision to appoint the board he should stand by his threat to quit.

He said Hide would have to come to terms with the fact the board was not a toothless advisory committee.

“The issues that went to Cabinet were quite clear. I proposed dedicated Maori seats, and Minister Hide threatened to resign if Cabinet supported me…if he cannot accept the decision, Hide should carry out his threat to resign.”

Many of us would agree he should stop supporting this mortally bankrupt Govt.
That and Dunne refusing to vote in the foreshore Bill would be good for everyone. Early election right in the middle of world cup.

After several frustrating experiences today, I have finally decided that the culprit is the Inland Revenue advertisement that sits above the Kiwiblog masthead. If excessive taxation is such a dead weight on the economy at large, it’s hardly surprising that the presence here of Inland Revenue is enough to stuff the usual efficiency of DPF’s site.

Let’s look at the way the 2 partners have been treated by this shameless group of Liarbore interlopers pretending to be a National government, shall we?

The Apartheid Party demands a review of the Foreshore & Seabed Act, and gets it. Off the back of that, their “inside man” and paid lapdog Finlayson is ramming through a replacement that will make it a shit-load easier for the racists to get their hands on the foreshore & seabed. In addition, Key has given them concessions in the form of insulation and other beads & blankets as part of getting the Emissions Tax Scam rammed through.

On the other hand, what has ACT got? Part of ACT’s deal was a taskforce to look at how New Zealand could “catch” Australia by 2025. Regardless of whether the idea of “catching” Australia is a silly goal*, the taskforce was implemented and every single one of its recommendations promptly ignored.

About the only good thing to come from the ACT deal was the Three Strikes legislation.

ACT should walk, and walk now. National are fast approaching the point where the sheeple will awake and hold them to account, and ACT will want to be well clear when that happens.

*rather than catch Australia, howzabout you start with a goal to arrest New Zealand’s speed-race to the bottom of the OECD charts?

The Government has been criticised for spending millions of dollars on 34 BMW limousines at a time when it is telling people to tighten their belts.

The limos for ministers and VIPs, which cost about $200,000 each, will replace the current fleet, which is three years old. The Government is understood to be getting a discount.

A Department of Internal Affairs spokesman said the new limousines were bought under the terms of a deal signed by Labour in 2007. It included a clause stipulating replacement with new vehicles after three years. That contract expires after another three years and the Crown will go back to the open market for its next fleet.

Finance Minister Bill English last night told One News: “We could go out and buy second-hand cars but one way or another, cars need to be maintained and you have to renew them eventually.”

Auckland Council caused controversy by proposing the city’s Maori Statutory Board get $5.4 million over two years.

“My concerns about having this board in statute have been borne out because it is inherently divisive and controversial. I made it very clear that I wouldn’t introduce legislation that would put seats around the council because then those un-elected members would be controlling the budget.

As it stands, the council controls the budget and only elected members are on the council so ultimately the responsibility is with the council.”

A taxpayer-funded job scheme was given more than $30,000 to round up wild horses in the Ureweras only for them to be released back into the mountains.

Most of the horses caught in the six-month scheme were sent back into the wild after a bid to sell them to Maori activist Tame Iti fell through, it was reported last night.

The scheme is one of several under scrutiny as the Government faces questions about its $57.3 million Community Max programme to help young people get work experience and jobs during the recession.

Scheme organiser Richard Tu Marae said the aim was to identify the horses’ owners and look at the potential to sell some to Tuhoe’s Mr Iti. But the sale was called off after he offered only $250 each for 20 of the horses. As a result, 27 were returned to the wild.
