Changng subjects from things Siemer and what is or is not the rule of law, I see that Greenpeace has been determined not to be a charity, so those who have been claiming tax deductions for donations made cannot now do so.
Pity that. Couldn’t have happened to a nicer bunch of people.

My apologies to everyone who was bored to stupefaction by the seimer/rule of law exchange. I didnt realise how prolix it had all become.
A thought for Simon Power before he puts himself out to graze. We have a distinct backlog of cases in the civil courts.Some people are crying out for there day in court. Some have pressing and meritorious cases. Yet, we continue to tolerate the cluttering of our court system with cases and litigants who are singularly lacking in merit. Maybe it is time that the court started ordering such litigants to pay for the court time as well as the costs of the other party.

For the life of me, I can’t understand why you even bother. If you actually want to debate, you can get someone to pay you to do it. The only thing your charity in endeavouring to reason with the mad hatter produces is non-chargeable time.

The mad woman is a grade AAA+++ guilt-edged and gold-plated wing-nutted nut-job with an extra helping of wingnuts dressed with aluminium foil.

I see that the court was of the view that non-violent but potentially illegal activity was one of the factors leading to the decision. Deductibility of donations basically means that the average taxpayer, in some small way, has been forced to contribute to life-endangering situations such as the idiiocy that has been going on off the northern coast. Not much but enough to make it objectionable in principle. Give Heath J a DB.

Absolutely right. I have decided that I get a more intelligent response from a brick wall. Some good news though. It seems that vince and his entourage may be otherwise engaged preparing for round 35 in court. Vince will be preparing his filibuster and penny will be out shopping for a new toothbrush. He may need 6 or 7. Some time for me to make up tomorrow I guess.

Our poor friend Penny clearly doesn’t know the meaning of the expression “Rule of Law”. She seems to think that the word “Rule” applies to a particular statutory prohibition or requirement that can be “broken” specifically.

The ultimate bush lawyer that Penny is should go away quietly, do some very basic research on the subject, perhaps even ask a qualified lawyer what is meant by the Rule of Law. On the other hand she never listens to anyone on anything, so the poor sod of a lawyer will be wasting his or her time even trying to answer her question.

I think “bush lawyer” is a bit unkind. I have a lot of bushes in my garden which are much more conversant with the law than pb and they would be most offfended by your analogy. You are on the button with your last sentence.

A true failed state. The traitorous Pakistanis cry foul.

Pakistani Prime Minister Yousuf Raza Gilani defended his country in an address Monday, suggesting that while Pakistan is relieved bin Laden is dead, the U.S. had better not try another raid like that without first informing the government in Islamabad.

He said his country would not relent in rooting out terrorists, but warned any “overt or covert” attack against its assets would be met with a “matching response. “Pakistan reserves the right to retaliate with full force. No one should underestimate the resolve and capability of our nation and armed forces to defend our sacred homeland.”

One senior Pakistani government source told The Telegraph newspaper the country would act if there is another “violation” of its air space. “We’ll take appropriate action if any further violation takes place. We will defend our air space by any means we have,” the source is quoted saying.

Nookin, I only saw the headline so will ry if time permits to read the decision as it does impact on one of my areas of practice.
The Charities Commission seems to be taking a robust appproch to what is and is not a charity. For example the Masons and one of two others.
There is a consitent line of authority being developed in the High Court.
Next time I see Heath J I will congratulate him on his decision.

I should have added that if you are so inclined, you should have no reservations about updating the progress of Sensei Don Quixote Siemer as he slides downhill through the legal system and accelerates towards the plug-hole at warp speed. It is an amusing and rollicking tale of failure and stupidity on a grand scale. One man’s epic struggle against his freedom and his bank account. I’m waiting with baited breath to see if Stiassny sues the mad woman for recycling Sensei Siemer’s defamatory remarks.

BTW, has he been bankrupted to your knowledge?

As far as I aware he has been bankrupted in NZ. They professed to have US assets but, not surprisingly, have not resorted to them to satisfy NZ debts.

I found a report that contained a quote from the judgment. Basically, Greepeace is “too political”to be charity. Can’t really argue with that given current day practices.

The eco-terrorists lose their charity status.

Greenpeace has lost a High Court battle to restore its status as a charity.

The environmental lobby group was deregistered as a charity last year after the Charities Commission decided it had an overtly political role, particularly in its promotion of peace and disarmament. The High Court declined Greenpeace’s appeal, saying it is clear the group sees itself as an advocate rather than an educator.
