Party A builds a wind farm. Later party B builds an adjacent wind farm, party A then sues due to loss of wind velocity caused by Party B’s siting of windmills.

With the likes of Mana Party leader Hone Harawira warning that selling shares in the state- owned power companies is like flogging off a car without the ownership papers, any equivocation by Mr Key would only spook potential investors and potentially derail the asset sales timetable.

The Maori Party, meanwhile, is caught in the crossfire. Its relationship with National has surprised many by its endurance but the Treaty is its line in the sand. It has been left in no doubt that emotions are running high over Mr Key’s comments.

Dr Sharples was yesterday prepared to give Mr Key the benefit of the doubt, suggesting the prime minister had only lashed out under pressure.
But Mr Key has too much to lose to accept the olive branch.

I was writing about the qualifications scam about 15 years ago..I wrote to a Min at the time and didn’t get a reply. Some time later I wrote to a journalist who wanted to know more but no more followup..Twenty years ago , forgery was right up there with drugs throughout Asia not just in China. There are likely to be a lot of these dishonest people here..The ones I was writing about years ago were linked up with a supposedly respectable NZ organization..Particularly the CHCH branch…I assume this organization still exists.I am a bit out of touch…I tried to raise this issue several times but gave up because no one seemed interested..Just more corruption in that little corruption free country.

Mr Key told reporters in Christchurch that “it’s just a statement of fact that the Waitangi Tribunal is not binding on this Government, in the way it wasn’t binding on other Governments.

It would have been more diplomatic to say “We will take their advice under consideration”.

It is odd.

Ms Bright acknowledges that she has been “trespassed” from Mr Banks electorate office yet appears to have visited that address on the 18 the of June as she is charged.

All the prosecution need to do is prove the elements of the offence which to my eye are simply:
a) Proof of service of a trespass notice on Ms Bright, and
b) evidence that after service of that trespass notice that she was present at the premises in question in breach of the notice.

I doubt Mr Banks presence will add much to the prosecution, or the defence for that matter.

Honestly, if she is out there portraying herself as “representing the people” and a “public watchdog”, and people overseas watch this and think “that’s what the average NZ’er is like”, I would just like to say we are not like that, people, honestly.

I would also like to apologise to the police here and now, on the public’s behalf, for the abuse that Penny subjected them to. So…that’s what the Water Woman looks like…scary…you could pass her on the street and as long as she didn’t say anything you would never know….

But I am a charitable chap, so Penny, this is how you effect service of a document:

Method 1:

1. Call process server and engage to serve your document. DON’T say anything else.

2. Send documents to process server along with written instructions. DON’T add any diatribes about water or anything else.

3. Receive process server’s report. PAY THE BILL.

or: Method 2:

1. Go to Wellington (on your macrobiotic bicycle, or via the state owned rail operator) on a day when the House is sitting.

2. Ask a friendly security (wo)man to direct you to “the black and white lobby”. You will need to spruce yourself up a bit so as not to attract attention and not be recognised.

3. When Mr Banks approaches on his way to the House, walk up to him and say – politely – “I have some documents for you Mr Banks.” DONT say anything else.

4. At the same time as step 3., hand the document(s) to Banks. If he doesn’t take them, drop them at this feet. Note date and time. DON’T say or do anything else.

5. Prepare affidavit of service.

There you go…dont say we right wingers aren’t generous. That was $75 worth of my time writing and checking that…

Wahine: Well, we are supposed to do pro bono work from time to time..help the indigent and disadvantaged and all that…Not I hasten to add, that Penny can or should in any way be construed as my client, or that any relationship of lawyer- client should be inferred from my friendly advice…then I’d need an instructing solicitor, and someone from The Standard might report me to the Law Society..again…

Actually come to think of it, why isn’t some legally qualified fellow from over at that cesspit offering to assist Penny in her endeavours?

KS: Damn…I think you are right! No, I wasnt being devious. I know you cant serve “proceedings” on an MP within the precincts…the question is whether a summons constitutes “proceedings”…something tells me a summons may be included.

Oh well, then it’s either method number one, or seek advice from one of those defenders of the poor and disadvantaged over at the Standard. I’m sure Mickey (what a guy) or one of the others will be delighted to assist Penny.

More news to make you question the theory of so-called Climate Change.

Nearly 25 years ago the earth suddenly started absorbing a lot more atmospheric carbon dioxide and scientists, including New Zealand experts, cannot explain why.

The new mystery of the sudden and very detectable increase is outlined by US scientists – working with Niwa’s Sara Mikaloff-Fletcher – in a study published in the Global Biogeochemical Cycles journal.

They say the discovery could have serious implications for what we know about climate change and the battle to reduce carbon emissions.

The scientists noticed, in their data since 1958, an abrupt shift in 1988 towards greater land biosphere absorption – in all the planet’s plant and animal ecosystems.

“Our team applied mathematical techniques that haven’t been widely used in this field to detect the shift,” said Dr Mikaloff-Fletcher.

It was a significant rise – one billion tonnes more of carbon each year, or about 10 per cent of the global fossil fuel emissions for 2010 and could not be explained by the El Nino weather pattern.

“The physical processes driving it remain a mystery.”

The scientists say that without this natural increase in absorption, the amount of carbon dioxide in the atmosphere would probably have increased even more rapidly over the last two decades.

The team is now investigating what caused the shift and what it can it reveal about land’s ability to absorb carbon dioxide and what that might mean for climate change.

They also are trying to figure out if the carbon uptake is temporary – if it is it may make global efforts to reduce carbon dioxide levels even harder.

Measurements stretching back to 138BC prove that the Earth is slowly cooling due to changes in the distance between the Earth and the sun.

The finding may force scientists to rethink current theories of the impact of global warming.

It is the first time that researchers have been able to accurately measure trends in global temperature over the last two millennia.

Over that time, the world has been getting cooler – and previous estimates, used as the basis for current climate science, are wrong.

Their findings demonstrate that this trend involves a cooling of -0.3°C per millennium due to gradual changes to the position of the sun and an increase in the distance between the Earth and the sun.

‘This figure we calculated may not seem particularly significant,’ says Esper, ‘however, it is also not negligible when compared to global warming, which up to now has been less than 1°C.

‘Our results suggest that the large-scale climate reconstruction shown by the Intergovernmental Panel on Climate Change (IPCC) likely underestimate this long-term cooling trend over the past few millennia.’

It astounds me that his research and inventions are so little known. I’ve been asking colleagues for years if they know who he is, just as a test. The more intelligent ones have normally heard his name, but none of them to date, have any detailed idea of what he really did. Considering this guy was much greater than Edison and all of us are taught in school how great Edison was, isn’t this astounding.

Considering his inventions could solve AGW, isn’t it also interesting none of the alarmists have ever advocated exploring his technology. There’s some very interesting stories about what has become of his technology since he died in 1943, but it’s a fact that all his papers disappeared, and none of his research has ever officially surfaced. And bearing in mind everything he achieved was real, as in demonstrated, in front of people, it’s impossible to allege he wasn’t what he appeared to be.

In 1994, Shakeshaft published a report based on a four-year study of 225 sexual abuse complaints—184 in New York State and 41 in other states—against teachers made to federal authorities from 1990 to 1994.[3] She found that “All of the accused admitted sexual abuse of a student, but none of the abusers was reported to the authorities, and only 1 percent lost their license to teach. Only 35 percent suffered negative consequences of any kind, and 39 percent chose to leave their school district, most with positive recommendations. Some were even given an early retirement package.”

In 2004, Shakeshaft published Educator Sexual Misconduct: A Synthesis of Existing Literature for the United States Department of Education.[2] The report indicated that nearly 10% of U.S. public school students, or 4.5 million students, had been the victims of sexual harassment, rape or sexual abuse. The review described the prevalence of educator sexual misconduct, offender characteristics, targets of educator sexual misconduct, and recommendations for prevention of educator sexual misconduct.[2]

A 2002 New York Times report quoted Shakeshaft, “Only 1 percent of the cases did superintendents follow up to ensure that molesting teachers did not continue teaching elsewhere. In 54 percent, superintendents accepted the teachers’ resignations or retirements. Of the 121 teachers removed this way, administrators knew for certain that 16 percent resumed teaching in other districts… Moving molesting teachers from school district to school district is a common phenomenon. And in only 1 percent of the cases do superintendents notify the new school district. The term “passing the trash” is the preferred jargon among educators”[7]

A 2007 Washington Post report noted, “It’s a dynamic so common it has its own nicknames: ‘passing the trash’ or the ‘mobile molester.'” In addition, “Maine…has a law that keeps offending teachers’ cases secret” and that “in Hawaii, no educators were disciplined by the state in the five years the AP examined, even though some teachers there were serving sentences for various sex crimes during that time. They technically remained teachers, even behind bars.”[8] The report also said, “Laws in several states require that even an allegation of sexual misconduct be reported to the state departments that oversee teacher licenses. But there’s no consistent enforcement, so such laws are easy to ignore. School officials fear public embarrassment as much as the perpetrators do, Shakeshaft says. They want to avoid the fallout from going up against a popular teacher. They also don’t want to get sued by teachers or victims, and they don’t want to face a challenge from a strong union.”

Returning to Catholicism is certainly a step toward regaining traditional religion, but don’t count your chickens yet; the church Holmes chose just happens to be the same church Nancy Pelosi frequented while she was Speaker of the House.

You might think any Catholic Church Pelosi felt comfortable at would be somewhat marginal, as Catholicism goes, and you’d be correct. The Church of St. Frances Xavier is a left-wing incarnation of the Catholic Church; its members have marched in New York City’s Gay Pride parade for years.
