I see the prominent New Zealander who has name suppression in now basically saying the sex was consensual, the victim is lying and is the real victim. However, unlike the victim he is hiding behind name suppression.

If that was the case why did he plead twice. I hope anyone with views on permanent name suppression for sexual or violent offender watched the victims version on Sunday tonight.

The Herald wastes space this morning with an item where the Queenstown Man With No Name endeavours to protect his reputation, but is a little pointless since he still has name suppression and so legally we have no idea who he is protecting.

He was initially convicted and ordered to pay $5000 emotional harm reparation and $1500 in counselling costs.

Maybe this should be reviewed and he now pay more for the continuing stress he must be causing Louise Hemsley.

Time for advertisers to totally blacklist this disgusting left-wing media group, and let them rot in the gutter where they would appear appropriate. We no longer support any company that advertises in their outlets, unless it is an article that is unavailable elsewhere. Their journos evidently, have been the main contributors to Weasel Hager’s legal defence, and had a great financial influence in the disgusting ruination of John Banks; this will be revealed in his forthcoming appeal, no doubt.

Name suppression is a bit of a joke, I found his name after a couple of minutes googling (as with every other suppressed name).

It is time to seriously reconsider sentencing and name suppression laws as we now have a dual justice system, one for those who are ‘important’ and another for the rest of us. This is absolutely wrong and if someone ruins their career because they commit an offence and they have to revert to menial jobs then so be it. More the reason for them to keep their noses clean.

Meanwhile, in a different case where name suppression will play no part …… Former attaché at the Malaysian High Commission, Muhammad Rizalman, has been returned to Wellington and has been charged in court with charges of burglary and the attempted rape of Wellington woman, Ms Tania Billingsley.

After a high level of political and social commentary some five months ago following the original allegations, and before the accused has even entered a plea to the charges, several ‘public interest’ issues already come to mind:

1. Media reports indicate that Rizalman was escorted on the flight to NZ by two armed members of the Malaysian defence forces and three NZ Police officers. Can anyone understand that level of security deployment to contain one unarmed defendant on a single flight (under 11 hours) to NZ?

2. Highly-politicised media reporting and commentary at the time of the alleged offences – in the lead-up to a General Election – helped to ensure that many potential jurors are likely to be aware of the case in advance of being sworn-in. To what extent might their views now be coloured by their political persuasions?

3. This is a case in which the allegation of attempted rape has appeared so far to be grounded substantially on assertions of the complainant. So what evidence is likely to be presented to the court to corroborate the position of either of the two protagonists?

4. The upcoming trial has already featured on the front page of BBC News, which suggests that it will be watched closely – well beyond NZ’s shores. It will help if NZ’s major media outlets are able to deliver some quality court reporting that ignores peripheral matters and focuses solely on court proceedings and sworn evidence.

5. Regardless of the ultimate trial verdict, this high-profile case will require the Judge – in the interests of ensuring a fair trial – to enforce proper standards of spectator and media conduct, both inside and outside the courtroom. The case must not be allowed to develop into an ideological or media show trial.

Griff, this following judicial review will help. I find it sad that the left are happy to donate over $60k to Nicky Hager’s legal bill but few on the right are happy to help victims of crime get a law change.

We were automatically given name suppression in court as victims of a sexual crime but now many years later we’ve found that our abuser has hidden behind our name suppression. There is no justification for a criminal, more so a self-emportant one, to have name suppression once his victim has relinquished her right to name suppression.

1/ Security is paramount on international flights, the authorities are expected to transport suspects or accused people in a manner of safety first.
2/ Any Jury will be warned by the Judge to dismiss any information they have read in the media and only consider the evidence presented to them.
3/ Attempted rape (qualifying that no crime has been proved yet) is not usually in public, so by it’s nature it can’t be expected that there will be any ‘eye’ witness evidence, at least not publicised before the proceedings start – although there may be evidence corroborating that of one party, the other or both, we don’t know yet.
4/ The media should not play any role in ensuring that Justice is served, that is the responsibility of the Court. The media must comply with any orders by the Court about what may or may not be suppressed.
5/Judges are always in control of the Courts.

Just what good would that do? It wouldn’t lift the name suppression nor would it make his name any more public than it is now.
No news outlet would be allow to report it.
No one else other than the people present in parliament would hear the name and all it would do is get Andrew Little or any other MP who does this into trouble. Contrary to what you believe this is not covered by the parliamentary privilege.

You all remember Michael Brown, the teenager who was shot recently by a policeman in the U.S, sparking the riots in Ferguson? Well, he mother didn’t like the fact that his cousin was selling Michael Brown merchandise, so attacked him with an iron bar and took $1400.

Police sources tell us Brown`s Grandmother, Pearlie Gordon, along with Brown`s Cousin Tony Petty, were selling t-shirts and other Michael Brown merchandise.

A police report describes a car pulling up and several people getting out. One of those people, was reported to be Michael Brown`s Mom, Lesley McSpadden. A witness described McSpadden yelling ‘You can`t sell this s%$&” One of the relatives, who was selling, reportedly demanded McSpadden show a document proving she had a patent.

The police report says that`s when an unidentified person with McSpadden assaulted Petty so violently that it resulted in a 911 call. A witness tells Fox 2 that the weapon was a metal pipe or pole. The suspect reportedly struck Petty in the face. Medics then took him to Christian Northeast Hospital. The witness said the assault suspect grabbed merchandise and a box of cash believed to contain about $1,400.

Why is name suppression necessary?
A guy cops a feel and you lot go crazy. Who hasn’t had their junk grabbed by women unknown to you? What did you do about it?
When you come on to a woman it all depends on the mood of the woman at the time or sometime afterwards whether your action is a violation. So how is a man supposed to evaluate that?
Time to ignore some of these dubious minor complaints and focus on real crime with real victims.

What! It wasn’t that this victim was playing “hard to get” it was the fact that this so-called upstanding pillar of society (lol) thrust his hand inside the pants of someone who did not invite it. She, married to another man, who presumably she loves, did not ask for this unwanted sexual assault. It is not hormones or mood or anything apart from crossing the line of human decency. You don’t stick your hands down the pants of someone without being given clear and definite permission to do so. He knew what he was doing, and I suspect this is not the first woman he has crossed the line with. He gives me the creeps… If you condone this behaviour then it speaks volumes my friend

If even these people like doctors and nurses who know how to protect themselves and use the proper equipment are getting Ebola, what does that say about how easy it is to catch? It really is that dangerous, and people shouldn’t make light of it (including Obama and his staged ‘hug’ with a nurse yesterday).

It doesn’t help either, when authorities (the police in this case) throw their used protective gloves and masks into a public trash can.

Hey waikatogirl I treat every woman I know with the respect they deserve. What annoys me is the change in interpretation of a sexual advance depending on who does it and when it is done. We recently sacked an employee due to complaints including one of sexual innuendo. He wasn’t a bad guy just opinionated; he made it clear he supported the Conservatives and became public enemy number one with some of our more left leaning staff. We have now verbally warned two female office staff for sexual comments and our up beat working environment is no more. P bloody C gone mad.
FYI: I am not embarrassed about looking after my body. It’s good for me and it’s good for my beautiful wife. Chances are our family won’t be a self inflicted burden on the health system, how about you?

Earlier this year Louise Hemsley gave her version of what happened.

On the day of the incident, she was about to leave to do some shopping with her daughter, she said.

While her daughter went to get the mail from the end of the long drive, the man followed her inside and ”he just grabbed hold of me from behind”, she said.

”He was tall and towered over me. I said: ‘What the hell are you doing?’

”And he said: ‘But you are so lovely’. It was horrible. His hands were all over me,” the woman said.

”He kept pushing his tongue in my mouth, pulling my head back and sticking his tongue down into my mouth and I was trying to push him off.

”His hands were all around my back, his hands down the back of my knickers.”

He confessed he had always liked her.

”I was totally shocked. It took me by surprise. But I wasn’t scared because I knew my daughter was about.

”I was trying to push him off and he took my hand and put it on his what’s-it and he said to me: ‘This is what you are doing to me’.

”I pulled my hand off and said: ‘Leave … just go!”

She also said ”He is a dirty bastard and people should know.”

While we can’t be certain about what actually happened we can judge a few things for ourselves.

The veil of secrecy has been lifted by Auckland Transport – the super-city’s roading, rail, ferry and cycleway arm – which has begun publishing details of commercial contracts given to private businesses.

Auckland Council, which controls Auckland Transport, is poised to follow suit. Self-styled anti-corruption campaigner Penny Bright believes if the super-city does, a domino effect will begin around the country.

Many councils have long held back from publishing lists of contracts and contractors despite government departments publishing such lists regularly.

Auckland Transport is now publishing the cost of each contract awarded on its website, the work to be done, the date it was awarded, and the method of award – whether by tender or direct appointment (see p4).

And in a brief statement to the Sunday Star-Times, the council said it intended to be “proactive in publishing council information, including matters which are frequently requested via the Local Government Official Information and Meetings Act [LGOIMA] by the media and others”.

This, a council officer said, included lists of contracts similar to those Auckland Transport is now posting.

“The parameters of that are being worked through,” the council statement said.

Bright has refused to pay her rates for seven years in protest at the council not revealing where the ever-expanding rates-take is being spent.

She has been demanding contract lists be published, and now faces a bill for over $30,000 for unpaid rates and penalty fees. Auckland Council has also begun court proceedings to seize and sell her home.

She’s tried to use LGOIMA requests to get the information she believes should be published.

The most recent attempt, in 2011, was turned down, with the council citing the cost and difficulty of getting the information. Previously she was also told the information could not be released because it was “commercially sensitive”.

Auckland Transport has shown it is possible, Bright said, and that there are no legal bars to prevent the council following suit.

Lawrence Yule, head of Local Government New Zealand, says publishing contractor lists has become “best practice”, and he

expects councils will increasingly follow the example of Auckland Transport but, he stressed, some councils are already doing it.

Yule’s local council, Hastings District Council, already publishes the information, he said, and it allowed proper scrutiny of the governance around procurement.

He said just because some of the 78 councils nationwide had not taken the step of publishing contractor details yet did not mean they were unwilling to do so.

Bright says the only way she is going to back down on her rates protest is if Auckland Council begins publishing contractor lists, though she says the council has now offered her the option of a “rates postponement” rather than her being forced to sell her home.

“Until I see the same details on Auckland Council’s website, and all the council-controlled organisations’ websites, I will not consider their offer of rates postponement,” she said.

Bright maintains councils that don’t publish contract lists are breaking the Local Government Act 2002, which is unequivocal about the obligations to open government that local councils are under.

It states that: “In performing its role, a local authority must . . . conduct its business in an open, transparent, and democratically accountable manner.”

“I get $20,000 in penalties for not following the law. Where are the penalties for the councils not complying with the law for all these years?” Bright asked.

For Bright, the contract lists would be a step in the right direction, but she wants even more transparency. She was successful in prompting the council to begin publishing a public register of councillors’ pecuniary interests, something MPs have long done, but she believes that must be extended to include council executives tasked with handing out contracts.

I am unsure that Mr Rizalman can get a fair trial.
The complainant Ms Billingsley and the compliant Media have already exploited any chance of a balanced trial.
We saw this in the Christchurch Civic Creche fiasco.
The Feminazi, of which the complainant is one, backed by Logie, the Green Party so called MP, and the media looking to make up stories, as usual have already decided that they will ensure their result whatever.
We have only ever heard one side of the story, but that is enough for the media.
I wonder what the complainant will say in Court – I am right he is wrong – finish, and the media and cohorts will cheer.

It’s unfortunate that a political party got itself involved.

An interesting article in The Telegraph on the growing Islamist movement in Libya – it’s not good, Libya has become the latest Isil conquest.

But as bad as that story is in the wake of the US-French-British toppling of Gaddafi (which I supported), what hooked me was the backstory of the author:

Born in Libya in 1967, Noman Benotman first adopted radical Islamism in the mid-1980s after reading the books of Sayyid Qutb. In 1989 he travelled to Afghanistan where he fought against the Soviet Union, taking part in battles around Khost, Gardez and elsewhere. After the Soviet withdrawal, he helped set up the Libyan Islamic Fighting Group which aimed to violently overthrow Colonel Gaddafi and establish an ‘Islamic state’ in Libya. In 1994, he moved to Sudan where he forged close links with Osama bin Laden, Ayman al-Zawahiri and other key members of al-Qaeda. Since 1995 he has lived in London where he was initially part of the ‘Londonistan’ scene alongside other senior extremists such as Abu Qatada and Abu Musab al-Suri before gradually distancing himself from Islamism.

He is currently President of the Quilliam Foundation, and leads Quilliam’s work on de-radicalisation processes in the UK and abroad.

You can’t get deeper into the movement than being converted by the readings of arch-wierdo Sayyid Qutb, fighting in Afghanistan against the USSR, and hanging out with the likes of Bin Laden and al-Zawahiri – so there’s some hope.

All we need are another few hundred thousand Noman Benotman’s.

Obviously it’s beyond the richest nation on the planet to provide comfortable conditions for their mandatory quarantines.

Upon arrival at Newark University Hospital, Ms. Hickox was placed in a tent set up as an isolation ward adjacent to the main hospital building. Her temperature was again taken with an oral thermometer and was normal.

Hospital personnel are keeping her in isolation and have not informed her of any next steps, including additional blood tests to confirm Ebola infection with certainty.

She has been issued with an order of quarantine, which does not clearly indicate how long she must remain in isolation.

While she is being provided with food and water, the tent is not heated and she is dressed in uncomfortable paper scrubs. She was permitted to bring personal belongings into the tent

Actually, dad, given that the justice system is run by people , all of whom will have their own unique world view, and has to deal with other people, whose world view will inevitably colour their perception of the case, in highly adversarial and often emotive situations, never has the benefit of the same infinite knowledge and grasp of every material fact and experience in life of its most vocal critics and doesnt have the same benefit of hindsight, I think the justice system makes a pretty good fist of a vast majority of cases.

Nookin, the answer is probably no.

However, judges are meant to administer justice without fear, favour or prejudice.

That is clearly not happening in many case and probably not this one.

The judge’s spiel that the result would have been the same if it had of been Joe Bloggs is almost word for word what another judge said when he let off someone because of their occupation. In that case I would say it was highly likely the judge knew the person. As far as I can tell if a judge knows a party they are not required to disclose the fact or recuse themselves as a juror would. Feel free to correct me if you are sure.

If that is not corrupt it is getting pretty close.

NZ has a pretty good justice system compared to a lot of other countries. Look at the dopey judge in SA. Four shots through the toilet door and she say Oscar did not think it was highly likely anyone behind the would be dead.

He knew Reeva was there and that was clear beyond a reasonable doubt. I do not consider a chance in a million reasonable. For all the faults with juries I would not like to see judge alone trials.

So – why haven’t Auckland Council and the rest of Auckland Council Controlled Organisations (CCOs)?

Why have the elected Mayor and Auckland Councillors not ensured that the oath they swore to the public to uphold the law – has been kept regarding statutory obligations for ‘open, transparent and democratically accountable’ local government?

Why have they been so bloody useless?

Why have the statutory ‘third party Public Watchdogs’ – who get paid public monies to help ensure Councils act LAWFULLY equally been so bloody useless?

What role have the NGOs who are purportedly supposed to advocate for ‘transparency’ – such as Transparency International NZ and the Tax Payers Union equally been so bloody useless, in helping to ensure that ratepayers know exactly where public monies are being spent on private sector consultants and contractors?

And what about a number of Kiwibloggers, who whine about Len Brown’s Auckland Council and rates increases, but attack me for standing up for myself and YOUR lawful rights for transparency and accountability in rates spending, to the extent of putting my freehold home on the line?

Chuck, while it is likely that the judge knew of the person, it does not follow that the judge knew the person. My experience is tHat most. Judges recuse themselve if they know a person involved in a case, or even a witness. I cannot, tHerefore, draw your conclusion.

The judge can only act on information provided. In this case the judge did not have the benefit of a 15 minute, one on one meeting with the complainant. We do not know what facts were presented to the judge. As far as I am aware, the was not evidence from the complainant. The judge would have received the facts from the police. If some of the facts were contested, the police may not have been insistent that there facts were incontrovertible. The police may even had reason to believe the accused’s version ahead of the complainant. Point is, we just don’t know and it is wrong to conclude corruption, favour, fear or prejudice without more.

I am surprised, Penny, that you see fit to abuse others just because tHey do not necessarily share your concerns or subscribe to the methods that you adopt to express them. Those bloggers who gripe at tHe perrennial rates increases may well take the view that the issue is not whether the services are provided in house or contracted out. In fact many may well take the view that contracting out is a much more efficient way of providing services that the council deems appropriate.

No, their gripe is probably that they do not see the need for the services at all. They may not see it as a council function to provide particular services.

Next point. They have not elected you as their spokesperson. They may not want you protecting their rights. They may see you as counterproductive and a negative effect on their cause or such of their causes as they may wish to pursue.

A further reason for any lack of sympathy for your position is that even though the amounts are small (given the big picture), they may well take the view that they should not bear any part of any financial burden because you chose not to pay your rates. As you have been told on a number of occasions, consciencious objection is not a valid reason for non payment — especially when you still enjoy all the services privided by the council.

You have not been singled out by the council. The council has been extremely lenient. Has it not had judgment against you for a number of years?

The position in which you find yourself is of your own making. Nobody asked you to do it. Had they been given the opportunity, all of them would have said that this will only end in tears.

The staggering point is that, having appointed yourself as a watchdog, you seek to be excused your lawful obligations and then abuse those who do not consider the situation altogether kosher.

Oh, Chucky, I know you have problems comprehending even the simplest arguments, but do try every once in a while. Just where did I express such a concern?
Why is it that your are trying to attack me in such despicable manner as you are trying now.

I simply pointed out that you are calling on MPs to do something that is against the law and against the rules of parliament. And above all would not result in naming or shaming that individual that you are referring to nor any other.

It’s not only about the power to sell the home nookin. There is no doubt that the council have the right to recover their money, even if the money has not been paid for reasons attributed to the Council not being transparent with its spending. If it is simply 2 propositions, 1 that the money has not been paid to the applicant, and 2 that it has not been paid because the allegedly ‘errant’ debtor is not incapable of paying, but in fact asking for transparency from the council as to what it does both with the money of the single protester but all the money paid by rate payers. Auckland City defends itself against allegations of not being transparent with its spending by selling the home of the protester to recover a relatively minor debt. I’d go for greater transparency, instead of backing a council deeply in debt, not willing to open the books to the people it taxes. Remembering that is a Council which is by some estimations grossly over staffed, with a team of spin doctors somewhere near the helm. Penny may be wrong to challenge the Council, that doesn’t make the council right in not being transparent.

Nookin, I did not say the CoA judge knew Mr Queenstown. What I am saying that it does happen and that people get favourable treatment because of their job an social status. It is hard to prove in individual cases but it happens far too often for it to be coincidental.

There is one well known case where the judge not only suppressed the offenders name but his profession. You can guess what the profession was.

This is the sort of thing that bring the judicial system into disrepute not people like me who believe we cannot have just justice system until judges are held to account.

I think some reasonable and basically fair judges convince themselves that they would treat Joe Blogs the same as professional. It happens far too often to convince me.
