Prosecuting Mils Muliaina for allegedly touching a woman on the bottom through her trousers on a busy dance floor?
If he did it at all, surely the worst punishment should have been a slap round the chops and a police caution.

World Rugby (aka the IRB) shows its class by throwing referee Craig Jobert under the bus:

Following a full review of match officials’ performance, the World Rugby match official selection committee has clarified the decision made by referee Craig Joubert to award a penalty to Australia for offside in the 78th minute of the Rugby World Cup 2015 quarter-final between Australia and Scotland at Twickenham.

The selection committee confirms that Joubert applied World Rugby Law 11.7 penalising Scotland’s Jon Welsh, who had played the ball following a knock-on by a team-mate, resulting in an offside.

On review of all available angles, it is clear that after the knock-on, the ball was touched by Australia’s Nick Phipps and Law 11.3(c) states that a player can be put on-side by an opponent who intentionally plays the ball.

It is important to clarify that, under the protocols, the referee could not refer to the television match official in this case and therefore had to rely on what he saw in real time. In this case, Law 11.3(c) should have been applied, putting Welsh onside. The appropriate decision, therefore, should have been a scrum to Australia for the original knock-on.

@ mandk – obviously some promotion-hungry cop’s eyes lit up when Muliaina’s name was mentioned. They went into overdrive, with global TV coverage of the arrest and “perp walk”, and strong hints of a serious sexual assault. Without in any way disrespecting the complainant, it is clear that in judge-speak, this offence would have been at the lower end of the scale, and there is major doubt over whether or not Muliaina had even had any contact whatsoever with the woman involved.

So twenty four hours later. World rugby have ruled “JOUBERT ” the referee who put the Scotland Rugby team to the sword by creating a phantom penalty for Australia,got it wrong. Poor consolation for Scotland,and one might wonder,why “Joubert” would make such a so called “mistake”.

Was interesting in the 2014 Super 15 Rugby final in Sydney Waratahs v Crusaders .Same referee “Joubert” gave a penalty right on full time to Waratahs which was slotted by Foley. Guess who was the coach of the Waratahs at the time. On reflection ,it was discovered that the penalty was also a phantom penalty, and should never have been given. Sadly it cost the Crusaders the Super 15 championship at the time. Surely just a coincidence.

Heritage protection to be slashed

Thousands of homes across Auckland have been stripped of heritage protection, according to new maps presented to councillors at a confidential briefing on Friday.

Entire suburbs, including Mission Bay, Kohimarama, St Heliers, Takapuna, Milford and Belmont, have virtually no heritage protection, leaving them open for demolition.

Other suburbs, notably Grey Lynn, have had their historic character areas increased. Parts of Westmere have been recognised for their collective value of bungalows.

The maps also highlight anomalies. Several streets of villas in Mt Eden and Balmoral – Grange and Fairview Rds and Marsden Ave – are only partially protected.

Several blocks of Art Deco apartments on Jervois Rd in Herne Bay have missed out on protection.

Councillors and Local Board chairs were given a copy of the maps on Friday and five days to provide feedback at a confidential session of the Unitary Plan committee on Wednesday. The maps will be finalised and approved at Wednesday’s meeting.

The elected representatives have been forbidden from sharing the information with Aucklanders, whose homes and neighbourhoods could be affected.

Once the committee has made changes behind closed doors, the maps will be forwarded to the independent hearings panel for the Unitary Plan and made public.

Only submitters to the pre-1944 heritage rules in the proposed plan are allowed to give feedback.

The city’s growth and housing shortage is putting pressure on the council to relax heritage and density controls in the Unitary Plan, with the independent hearings panel not convinced controls on pre-1944 houses were justified.

After applying a blanket demolition control across the city’s pre-1944 houses, teams of council staff and contractors have assessed every house covered by the rules in the proposed plan.

That said, Cairns has one helluva lot of questions to answer, on the evidence given so far. And I’d suggest his former lawyer and co-accused has probably already got his bag packed. That Skype call was damning evidence.

Buildings are made to serve people. Not the other way around. Just because something is old, that does not mean it is sacred.

In 200 years’ time, if buildings I designed are old and dilapidated, or if new research and knowledge has shown them to be less safe than contemporary practise, then I WILL RETURN FROM BEYOND THE GRAVE TO HAUNT any self-appointed third party busybodies who want to claim “heritage” or some other tenuous sense of ownership over buildings they do not own, and who try to bully or pressure or restrict what the rightful paying owners can or cannot do to THEIR BUILDINGS.

(Imagine suggesting Air New Zealand should keep operating the old Short Flying Boats from the 1930s or the old DC-10s from the 1970s BECAUSE HERITAGE. Never mind that they’ve probably been to the moon and back 20 times. No no no. HERITAGE!)

Want to save old houses? Buy them yourself.

RRM, you make a fair point. On the other hand, our city is in danger of becoming bland and conformist. Look at other cities in the world who have their great historical architecture and monuments. What do we have in Auckland now? We still have the old St James, I think (or at least its frontage). I’m not sure what else, but do we really need to tear down old lovely architecture to put in more bland apartment buildings and shops?

All in the name of money.

Although it now appears clear that Joubert should have awarded a scrum to Australia rather than a penalty it does not necessarily mean Scotland would have won the match. That scrum could have resulted in a try to Australia. It could have resulted in a penalty to Australia . An Australian back might have drop kicked a goal from that resulting scrum.

Rowdy students, including one armed with a golf club, have laid waste to a Victoria University hall of residence.

A Saturday night party at Katharine Jermyn Hall in Boulcott St, Wellington, ended up with an entire floor of students having to be moved out after partygoers started to destroy it, residents say.

The university has confirmed there was a “serious incident” at the hall on Saturday, with one person arrested, and that residents on Level 8 had been moved to other rooms.

Niko White, 18, said Saturday’s party was a last hurrah for the students before exams.

It was advertised on Facebook with the event title ‘KJ’s last piss-up’.

About 200 people invited with more than 100 saying they were attending.

“One of the floors got absolutely destroyed. All the ceiling tiles got broken,” White said.

“Everyone went a bit mental.”

Police were called to step in and shut down the party, and an 18-year-old man was arrested for wilful damage and was to appear in court.

As a result of the damage, level eight had since been “totally cordoned off”, with all residents of the floor being moved out indefinitely, White said.

According to witnesses, one man was using a golf club to wreak destruction on the hall.

Someone ran through a glass panel, a wooden table was destroyed, and the bathrooms were trashed, students said.

White said destruction was “the general idea”.

“If you were sober you’d be a bit concerned.”

Even the ABC themselves said that there was bias coverage in the gay marriage debate – and the ABC are funded with more than a $billionAU in taxpayers money. IMHO Scott will turn the funding into a billion $ gay marriage ad – with gays on every ABC show till ‘the vote’.

But that is precisely why there is no need to fear that lovely old buildings will all inevitably be torn down if they are not protected by regulation.

Just because people are not prevented from doing something crass, or stupid, or immoral, by regulation, does not mean that all of them, or indeed any of them, will do it.

Look, for example, at the Rugby World Cup bill, which some people said would mean that because they now could, loads of (other) people would get themselves trollied first thing in the morning.

What they were actually saying is that everybody else (apart from themselves and their friends of course) is really stupid and irresponsible, cannot be trusted to choose to do the sensible thing, and so must be closely controlled in every aspect of their behaviour.

The opposite happened. New Zealanders have shown triumphantly that actually they can be credited with a bit of commonsense and trusted to behave with responsibility. Bravo! and let’s have a lot more examples of Government and bureaucrats letting people decide for themselves.

Irwin Schiff:

“You, sir, would be the lawbreaker, not I,” Mr. Schiff told a federal judge in 1980, if he were sentenced for not paying taxes that “are obviously not authorized by the Constitution.” The judge, T. Emmet Clarie , sentenced Mr. Schiff to six months in prison and a fine of $10,000 for deliberately not filing tax returns for 1974 and 1975.

It was his first prison term. His most recent was for personally evading taxes as well as advising more than 3,600 others to follow his example by withholding from the federal government about $56 million in revenue. (One year of the 14-year sentence was for contempt of court.)

In that case a Las Vegas jury convicted him of multiple charges, including conspiracy, tax evasion and tax fraud. He also served three years of a six-year term he received in 1985.

In essence, Mr. Schiff argued that the Constitution had established that the value of the dollar is based on a certain amount of gold or silver, and that after the so-called “gold standard” was phased out, starting during the Depression, citizens no longer earned dollars, or income.

An attempt by UN officials to get countries to decriminalise the possession and use of all drugs has been foiled, the BBC can reveal.

A paper from the UN Office on Drugs and Crime (UNODC) has been withdrawn after pressure from at least one country.

Quite some time ago there was debate over whether digital files stored on a computer could be “property” for the purposes of the Crimes Act.

This issue was raised in the trial of Jonathan Dixon, former security guard in Queenstown, who thought it appropriate to commandeer footage of the then English vice captain (one Michael Tindall) and display it to the world.

In the District Court, the judge found that the footage was “property”. The Court of Appeal disagreed but concluded that Dixon had secured a “benefit” under a different section of the Crimes Act.

Dixon then appealed to the Supreme Court which has restored the District Court’s initial decision and found that documents found on computers did constitute “property”.

Obviously this is going to have some implications as far as the rawshark hacking of Slater’s computer is concerned and may even be problematical for the journalist who received the property knowing of its dubious provenance.

Things might well get very interesting.

The Government is scrambling to put in place monitoring of some of the worst criminals being sent back from Australia. The most serious immediate urgency is for a 48 year old woman who tried to kidnap her 12 children back who had been placed in care. The ‘mother’ who left NZ as a 3 year old has spent a year in prison for incest resulting in several inbred children.

She has no family or contacts in NZ. She does not know anything about NZ and looks to be ongoing trouble to our law enforcement and be a drain on the taxpayer.

Talk about Aussie throwing out all the flotsam that they have had living there. I agree with the Aussie’s having the right to kick out those who commit crimes, but get ready NZ for news stories of these unwanted kiwis causing trouble in an unknown and unwanted home.

How does that work? Israel never had control of the Western Wall from 1948-1967, and it was never in their territory as per the original UN partition plan that the negotiators for the soon-to-be state of (secular and modern) Israel accepted.

Plus, by that rationale, isn’t allowing Israel control and access to the Al-Aqsa Mosque, as has been the case since 1967, anti-Palestinian and anti-Muslim?

If Israel claims they must continue to hold the entire temple mount for reasons of national security…ok. But that is a different kettle of fish from the original Zionist intentions. After all, Judaism has functioned without a temple for nearly 2000 years…

I read in The Guardian that the former Labour Party Health Minister under Tony Blair, Lord Warner, has resigned the Labour Party whip. The article quotes a letter Warner wrote to Cobyn explaining his resignation;

“I have watched for some time the declining quality of the Labour party’s leadership, but had not expected the calamitous decline achieved in 2015. The Labour party is no longer a credible party of government-in-waiting. The approach of those around you and your own approach and policies is highly likely to to worsen the decline and in the Labour party’s credibility.

“I fear for the future of the Labour party if your supporting activists secure ever control of the party’s apparatus and process, and the role of the parliamentary Labour party diminishes further in the selection of a leader and the formulation of policies likely to win an election.”

Careful how you answer that one. I know you have that alleged sacrament of Confession of which to avail yourself, but “do not put the LORD to the test” surely applies. 😉

Just as Oliver maybe found it a thoroughly amusing and honest breath of fresh air…which I seem to recall was the original intent of the interview.
