Nostradamus

This week the High Court of Australia heard legal argument in an interesting case (Knight v State of Victoria & Anor) regarding a special law that applies only to a named convicted murderer. The named convicted murderer argues that the law is constitutionally invalid. The HCA has previously rejected a similar argument by another named convicted murderer who has his own special law.

The law is here.

The second reading speech relevantly stated:

This bill builds on the coalition government’s achievements by protecting the Victorian community from Julian Knight forever.
…
On 10 November 1988 Julian Knight was sentenced to life imprisonment, with a non-parole period of 27 years. That non-parole period is due to expire later this year. This bill means that Julian Knight will never be released except in very restrictive circumstances …. . The effect of these provisions are that Julian Knight will die in jail, or will be in such a condition on release that he will be a threat to no one.
…
The bill also includes a provision making it clear that the Charter of Human Rights and Responsibilities Act 2006 does not apply to the new section 74AA … . To provide legal certainty and to avoid a court giving the bill an interpretation based on charter act rights which does not achieve the government’s intention, the bill provides that the charter act does not apply to the new section 74AA which sets conditions for any parole order for Julian Knight. …

I’m not a criminal lawyer – or a human rights lawyer for that matter. What do people think about this approach being applied in New Zealand?

  While it sounds good in theory, I am very wary of this approach. You wouldn’t need specific legislation for individuals if the main legislation was strong enough and the Juduciary was doing their job as intended by parliament. This is an excuse no to correct the main legislation.

    In the New Zealand context life imprisonment would be mandatory unless ‘manifestly unjust’ (would not apply in this case) and he would be looking at a 17 year minimum at least. Granted the judge would not grant Life Without Parole but at most could make it 20 something year minimum. The judge is bound by Court of Appeal sentencing appeal decisions. It is likely that nowadays the Parole Board would not approve parole until he is too old and decrepit to be a danger.
    Similar legislation in NZ would require a BORA Section 7 report warning parliament that it would ‘breach’ BORA but if passed it would trump BORA. In the Australian case it is made complicated as it is a state law versus a federal law so it could be that HCA (equivalent to Supreme Court in UK and NZ) may declare it unconstitutional but the HCA also would respect the powers of states to pass laws – basically it would depend on what was agreed at ‘Federation’.
    Personally I do not go along with life or very long sentences – there should be a parole opportunity at 20 years and each 10 years thereafter – even if the circumstances are very strictly defined.
    No new age sensitive judge will sentence anyone to Life Without Parole and in case of second or third strike murders will invoke the ‘manifestly unjust’ provision (my guess is the Appeal Court will uphold both uses of the ‘manifestly unjust’ provision for the second strike murder cases – wish the judges will get their backsides into gear and deliver the judgment).

  Agreed, Callum. What about “life imprisonment without parole” as a more sensible sentencing option, rather than “life imprisonment with a non-parole period of 27 years”? Or rather than (as in this instance) a prisoner’s personalised sentence regime via legislation?
  
  Society creates this is the kind of conundrum for itself the moment that it accepts the view that no person is incorrigible, i.e. that no person is beyond rehabilitation in a prison environment.

  These Changes to Legislation have to be viewed in context of the rather Harsh Realities that Victoria and Melbourne now face.
  
  To name one of the many issues Melbourne and Victoria has a Massive Jihad Problem many of the proponents are Aus Born.

  Many with Links to Known Terrorist Organisations like I S I S if the Victorian Community are to remain relatively safe will need life imprisonment with no chance of Parol as a tool of prevention and disruption of organised criminal elements.

  These have been prevented so you can see why they are doing what they can through legislation they have quite a bit to contend with.

    Victoria and Melbourne has a lower crime rate, lower road toll, etc etc than NZ
    I was struck by the difference visiting a medium suburb like Essendon where car yards on main roads didnt have security fences 6ft high. Bottle shops had drive through sections with beer fridges easy access for customers. Here you would have to go inside a sort of closed fortress with 3 or 4 security people just standing there.
    
    Sure there are issues in a few places, but with the population of NZ , 4.6 mill people in one metropolitan area they are doing much better than us.

        Living in Thailand now, I can quite comfortably say that I feel safer walking the streets and sois of Bangkok at 2am than I ever did in Auckland or Christchurch.
        Talking to expats over here, we are all in agreement that the welfare state and lax sentencing by limp wristed judges in NZ is pretty much, mainly to blame. Politicians , and their lust for power was another factor mentioned. Special laws for maori, another symptom of the rot in NZ.
        Over here you work or you dont eat.
        Thais love their kids and family, you dont hear of people, week after week, murdering their babies. I told one Thai woman over here about the Nia Glassie case, baby in drier, hung on clothesline, beaten and stomped to death…she cried her heart out for hours. I kid you not.

  Have you ever had to move a large group of women in sacks from one place to another. It’s mayhem. There is like zero visibility in those sacks.
  The can is a very valuable tool I know first hand.
  When I have to take my 7 wives out, getting them from the front door to the minivan is an ordeal. They stray, bump into each other, stop to adjust hair and makeup. I used to use a cane, but now in NZ I bought a very well trained dog from a bloke up north. Made life much easier.

  Damn, that’s a shame. I really enjoyed his stuff and the discussion there tended to be a lot more brain engaged than most other places on that side of the political spectrum. Hopefully there is a simple and irreverent explanation like a redesign or a side project and it’s not due to anything too serious.

RNZ ‘news’ is reporting an Otago Religious Studies survey which shows that the more people read newspapers and are exposed to the media the more negative are their attitudes towards Muslims.

It seems that the conclusion being drawn by our lofty academics- and pushed by RNZ- is that journalists need to be nicer about Muslims in their reporting.

Perhaps it is the Muslims who need to be nicer so that intelligent people in NZ who follow the news don’t have to read about Islamic terrorism, the denigration of women and gays, and the desire of Muslims to annihilate Israel and kill all Jews.

That might be a start!

The media should be treated with disdain when they allow Journalists to make comments about a past Act MP using a stolen babies identity when doing a column on David Seymour and the Act Party. This happened several years ago and DG has paid the price for his bad judgment and mom should be ashamed to have allowed it to be printed.

This is not good enough. If someone owes traffic fines, student loans, child support the money gets taken out of their benefit or super. It is not right that victims of crime cannot get paid the same way.

Justice Minister Amy Adams said the collection of reparation and fines was taken seriously and there were a range of sanctions available if people stopped paying. This includes re-sentencing an offender, seizing cars and property or putting a stop to overseas travel. That is just talk. Where is the action.

They owe their victims millions in reparation, but some refuse to pay back even a few dollars a week

A free society allows people free speech within the law. Allowing people to lie or write inaccurate articles is the bedrock of a free society. So is the freedom of others to challenge them. People have died for this freedom, and still do in many countries. This is deadly serious stuff as people in China, North Korea and many other countries know.

So the irony is that those who cherry pick and deliberately misinterpret my comments have a perfect right to do so, even though they imply such a right should not exist for others. Hypocritical or ignorant, take your pick.

The just published House of Commons report on science communication is a disappointment. It has sections on false balance, and embargoes, though it quotes no practising journalist’s views on these issues. Indeed in the whole report there is only one working journalist mentioned – the BBC’s Science Editor.

Once again there is a suggestion that in cases of journalists misrepresenting science there should be a government body able to “put things right.” This suggestion has been made many times in the past few decades, most notably after the Channel 4 programme, “The Great Global Warming Swindle,” in 2007. Then a group of self-appointed activists and scientists suggested that they form a committee (hopefully with government backing) to judge future science programmes on climate change.

I and a few other journalists were horrified that the freedom of the press should be subject to the views of an unelected committee

I remembered the words of Tony Benn concerning democratic freedom, “Who are you, who elected you, and how do we get rid of you?”

Did the pool have warning signs up saying “Caution:water causes drowning” and did the swimmer have his own personal lifeguard assigned to him?.

  I’m left scratching my head as to your point (and hoping that the unfortunate young man’s family aren’t reading this blog).
  Public pools are supposed to be safe places to swim, and a drowning at one is worth examination. If I hit my head or had a stroke or a heart attack, I’d like to think I’d be noticed fairly quickly.

  Why foreign tourists would even venture into Northland is beyond me. Who advises these travellers on the danger spots in NZ? I was at a petrol station recently when two German girls speaking very good English asked for assistance at the pumps. They were by any standards very pretty, and I thought when confronted by our ferals, how vulnerable they must be on the isolated parts of this country. Hopefully the recent migrant crisis in their home country may have made them more ‘street wise’.

    It will only need a single attack on a cruise ship passenger visiting the Bay of Islands for a day for the warning flag to be run up by all cruiselines calling in to NZ. A second attack would see cruiselines cancelling Paihia as a port of call.

    Icelandair are a very smart airline and the world’s first low cost carrier. I recall back in the 70s Icelandic Airlines as they were then were detested by the ‘establishment’ airlines who operated on the Atlantic. Icelandic had dirt cheap fares from New York to Europe but they flew older aircraft (prop driven then) and all services operated via Reykjavic just as they do today. The Iceland Stopover is still in place and the very astute Icelanders use it to show Icelandair passengers the highlights of their country.
    
    Highly recommended and beats row 74 on a run of the mill airline any day of the week.

He provides an Afghani map that show Tirgiran village does exist. He has also done an analysis of Stephenson’s Maori TV documentary, and says this:

“And here is a another pesky fact, Jon Stephenson himself identified these villages in his self referencing Maori Television documentary as Tirgiran village…contrary to his claims now. The claim about the village, with Jon Stephenson himself saying “Tirgiran village” is at 3:19 into the video. He also says the village has no cell phone coverage and is more than six hours walk to the nearest road. Which begs the question as to how he managed to contact the local doctor?

He also says Tirgiran at 4:54. At the 8:17 mark Jon Stephenson tells us that Tirgiran is a sprawling village, despite him never going there…clearly still using Tirgiran as the name of the village. Not single piece of footage in the entire video is from that village or even the region. Tirgiran is also mentioned at 11:49. At 12:50 he asks his informants if they’d like to send a message to John Key stating he had prior knowledge about the “Tirgiran raids”. At 13:13 he states that “Tirgiran has not been forgotten”…except perhaps now because it doesn’t suit their narrative.”

A simple search on Google Earth for Tirgiran brings up the village. It does not show any locations called Naik or Khak Khuday Dad. I do see however that some 4.7km SE of Tirgiran there is a village of Nayak. Allowing for spelling variations (eg: Divalak (Google) or Dewalak (the Afghani map) – to the SW of Tirgiran), could Nayak be Stephenson’s Naik? If so, its location surely removes any likelihood of it being the village ‘assaulted by the NZDF”!

Another nail in the Hit & Run coffin here: http://wikimapia.org/28171418/Tirgiran. This destroys McLeod’s argument that Tirgiran is an area and that “It is plainly wrong to conflate an area into a village as the NZDF has done …”

Watched rubgy last night. What a complicated game. It evan has rules about rules. Its so complicated the ref’s (god bless them) cannot follow it and therefore only rule on the bits they can see.
Never saw on mall that the front bit did not seperate from the ball carrier. One tackle that players were not held and stopped getting back into a defensive position. One scum that was not reset.
It seems that the object of a scum it to get from the other side a penalty and with luck a yellow card.

Rugby is now listed in the low 20’s in Australia for participation, the next on the list is archery!!!! the list came out last week. Income Tax Revenue as a % of GDP chart, behind Denmark and Sweden.

Unlike us, Denmark has a low income tax-free threshold.

New Zealand needs smaller government and lower taxes.

  You’ve got to be really careful that you make apples-to-apples comparisons.
  
  Some places (eg. USA, UK,..) have a relatively low tax take by just increasing the Natioanl debt – not a good way to handle things.
  
  Sweden and Denmark at least do not have huge national debt. Nor does NZ. Let’s keep it this way.

Airport mix-up sees Winter Olympics delegation land in Pyongyang after pilot files wrong flight plan

A delegation of corporate sponsors of next year’s winter Olympics in the South Korean city of PyeongChang was flown to the North Korean capital Pyongyang by mistake, it has emerged.

According to the Around the Rings website the pilot of the corporate jet made a mistake when he entered the flight plan into the aircraft’s navigation system.

Bemused flight control staff at the North Korean capital allowed the Gulfstream and its passengers to land before the plane was ushered to a remote part of the airport.

I guess the fat little fellow is busy executing someone for not reporting a live missile targeting opportunity.

  I learnt pretty quickly after my first trip to Korea that I’d better learn to read and write Hangul (Korean script) if I wanted to get to any location.
  
  There was no way I could pronounce Gwangju, Gyeongju or Gongju distinctly enough to be sure I wasn’t going to end up in the wrong city.
  
  Jeonju, Jeongju and Cheonju are 3 other cities that sound identical to my ear.

Subsidised wind and solar power generation is making harder for older thermal plants to compete, though there were power cuts in eastern Australia over the summer.

The coal-fuelled Hazelwood station that supplied a fifth of Victoria’s electricity closed on Friday, and other coal-fired stations may follow. Hazelwood’s owners said it was now uneconomic.

Wind and solar generation can be restricted by weather.

Islamic State’s deputy leader Ayad al-Jumaili killed in air strike

Deputy Islamic State leader Ayad al-Jumaili is believed to have been killed in an Iraqi air strike near the Syrian border, according to intelligence reports.

Isil’s second-in-command was reported to have been killed with other Islamic State commanders in a strike carried out by the Iraqi air force in the region of al-Qaim, near the border with Syria, on Saturday, a military intelligence source said.

The US-led coalition said it was unable to immediately confirm reports of the death of al-Jumaili, believed to be the deputy of Abu Bakr al-Baghdadi.

  His natural preference is to his roots with National, and as to legacy to complete a successful coalition with them after the fiasco of 96-99.
  
  And he has always gone with the largest party.
  
  Doing otherwise would depend on bottom line policies – maybe land ownership restricted to residents. Even then going with Labour would only work if Greens backed a Labour-NZ First coalition AND the three had a clear majority (no given) without other parties.

The Dusseldorf state court convicted the 19-year-old defendant under juvenile law Friday of rape, robbery and bodily harm, it was reported.
