So Penny’s hovel is finally going up for auction. Obviously the Auckland Council eventually figured out that with flattening property values the pile of rotten firewood and rusted-out vehicles was only worth the price of the polluted land on which it sits and that their equity was rapidly going backwards.
Hugh, have you got a spare bedroom for the mad woman? She can share the bathroom, she won’t use it very often.

  She will either cough up before the hammer falls or find some other legal impediment eg sale procedures incorrectly followed. Any diminishing in values would not have come into the Council’s decision making – the land even if presented in the most disgusting way would be worth more than the owed rates and associated costs.
  She would be wise to cough up for three reasons:
  1. Prospective bidders cannot inspect the property and have to bid sight unseen – this will reduce the amount they are prepared to bid.
  2. They need to factor in that it is likely to cost money to dislodge her.
  3. The successful bidder can ask that some sale proceeds ($100000 or so) be held back to pay to gain possession of the property.
  
  There could be an element of ‘double counting’ in 2 & 3 which could benefit the buyer.

    The Local Government (Rating) Act 2002 sets out the sale process – see sections 67 to 76.
    
    Section 74 states:
    
    Presumption of valid rating sale or lease
    (1) A rating sale or lease made under this Act is valid for all purposes, even if there has been an irregularity in the conduct of the sale or lease.
    
    (2) No purchaser or lessee is obliged to inquire whether the sale or lease was properly conducted.
    
    So, in terms of your tentative suggestion above, Penny can’t argue that the sale procedures were incorrectly followed. In fact, I can’t see any scope for a challenge, other than evidence that she’s fully settled the rates account.
    
    I’m sure Penny will organise an “occupy” protest, but eventually the rule of law will prevail.

        Penny could commence a frivolous claim against Auckland Council. All that would achieve, though, is that Auckland Council would file an application for summary judgement and Penny’s claim would be dismissed with costs.
        
        Those costs, of course, could conveniently be tagged on to the current rates bill. However, on my reading of the legislation, Auckland Council would have to go through the whole process again for that to happen (ie to get a court order for an increased judgment debt). The more likely scenario is that Auckland Council would cut its losses (ratepayers’ losses) and proceed with the sale.

        Nostradamus – once the matter is passed to the High Court for a rating sale, it is sort of out of the Council’s hands, she would have to attack the sale by convincing a High Court Judge it is not right. She would have to pay $900 or so just to file the papers. The boot is now on the other foot.

      In which case Penny could get zilch at the end of the day. Depending on her stance after the sale, some or all proceeds could be held by the Court to meet the costs of getting her out.
      The property is held in a trust and she is presumably one of the trustees. The other trustees (assuming they are not similarly rabid) will not want a rating sale to actually happen and to protect their own backsides would need to commence legal action of their own.

        Alex – there seems to be confusion about this. Perhaps she settled it into a trust in the mistaken belief that it stop or impede recovery action, and when this failed had the trust wound up (perhaps the other trustees, even if close mates, were getting cold feet over their responsibilities)

    The Local Government (Rating) Act 2002 governs the process of rating sales.
    It is a slow process taking in excess of 6 months to get to a sale.
    As long as the process is carried out in accordance with the act by the Registrar of the High Court Ms Bright will not be able to do much more than grandstand. Unless of course she coughs up.

    The Council (similar to IRD) has almost draconian powers to recover overdue rates under the Rating Act. There are safeguards in the Act but she has exploited these to the full to delay the process. The greatest power is to require a mortgagee to cough up overdue rates – they do not mind, they simply cough up the overdue rates plus an admin fee. This deals with rates strikes and similar situations. Penny’s property does not have a mortgage so it is one of the rare cases where a rating sale process is needed.

        Yes, because that is what Parliament has decided. If people do not like these state powers they can vote for a party which promises to diminish them. For example the liquidation industry is rumbling about wanting the government diminish IRD’s priorities with regards to PAYE (and similar deductions such as Kiwisaver) and GST owing which indirectly means employees’ Kiwisaver and Student Loan deductions could be down the gurgler more often). Meanwhile the Official Assignee is seeking increased powers to drain bankrupts’ Kiwisaver accounts (having lost in the Court of Appeal over this).

      Your question is based on an incorrect premise. Why should Auckland Council (and the long-suffering ratepayers) give Penny special treatment? Penny is the first person to come on Kiwiblog and preach her “rule of law” credentials. Well, in this case, all that people expect is for Auckland Council to apply the law in an evenhanded manner. Sheesh, no less than a High Court judge (in the rates case that Penny brought) told her in no uncertain terms that she should pay her rates.

      Sorry GoVege but I disagree. There are plenty of people in this country prepared to take the piss of rate payers and tax payers by thinking the rules of decent behaviour and societal contribution don’t apply to them. Frankly most of us net contributors have had a gutsful of that.
      
      I support Ms Bright in her right to protest and certainly in her disdain for the Auckland Council but as several have already pointed out; she should have made contingency for the potential failure of legal recourse. If her methods had been better thought out she would have received a lot of support from rate payers here in Auckland.

      Two people are having a fist fight, a spectator has a heart attack and dies – from your law (and extrapolating from your article), they can be charged with murder or manslaughter?
      
      Also as fernglas points out, when we are considering death-by-heart-attack, causation would cause all sorts of problems (especially in a case where the person went to hospital, was sent home, and subsequently died months later).
      
      That said, if it was my mother, then I’d been blaming the intruder too – but I’m not sure it would make good law.

      I can see that the law would have to be carefully drafted and possibly have a list of offenses. Someone could have a heart attack after having their lifesaving lost to a fraudster. That would not be an appropriate offense.
      
      There are a lot of rapes every year. One seldom hears of victims dying of a heart attack. However, if an elderly lady is raped in her own home and dies during or after the rape I think it should be up to a jury to decide if the POS should be found guilty of manslaughter.

  This is a vexed legal matter concerned with ‘causation’. It is not a matter of ‘some judges’, judges will take note of precedents especially those from a higher court and prosecutors will take similar note when deciding whether laying charges is appropriate.
  To change the law to make it easier to obtain a conviction in such circumstances would still raise issues eg if A harasses B and B gets a heart attack (which was coming anyway), should A be charged with murder or manslaughter.
  Or the hypothetical case – a drunk Pommie supporter ‘bottles’ a Kiwi supporter after a match and the Kiwi needs urgent life saving surgery. Kiwi refuses to let a Pommie surgeon operate on him but dies by the time a Kiwi surgeon is called in. Should the Pommie supporter be charged with murder?

    You case although unlikely is interesting. A thing that could happen would be if a JW who stuck their foot in the door and got injured when it was slammed and refused a blood transfusion and died.

      True story…..Two men well known in a local bar got into a fight and were ejccted from the bar. Both were showing signs of their involvement in the brawl and both were known by the Police. One was found dead at home next morning. The autopsy showed he died of a heart attack. That night there was a commotion in the Police Watchouse as a group of drunk men thrust another well beat up man to the counter and shouted “This is the bastard that killed Jimmy.” It was with difficulty that they were convinced that Jimmy died of natural causes…A few months later the bastard got into a violent argument with his neighbour. Family pacified them and they became so friendly that later they decided to go fishing in a delapidated dinghy. A storm blew up the dingy overturned and only the bastard made it back to shore. The coronor described it as a tragic accident. The locals were convinced the bastard got away with murder twice… Me I was there and I don’t know.

    Always interesting, but if A had no knowledge that B had a heart condition, then it is unlikely that A could be held accountable. Even if A knew, the immediate cause of B’s demise was a heart attack, not harassment.
    In terms of Kiwi being bottled, Kiwi’s refusal of immediate, potentially life saving surgery abrogates murder (though it is entirely arguable that a bottling would be manslaughter at worst). There are two causes here. He was bottled and did not die. He was offered and refused life saving surgery when he was alive. He died because he refused life saving surgery.

      I don’t believe that’s right. It’s the same if someone dies after botched surgery to repair, say, a brain aneurysm caused by a blow to the head. The blow is still a cause of death, as it would be with the JW who refused surgery.

        The example given was the injured person refused immediate LIFE SAVING SURGERY (the expectation is therefore that the surgery would have saved his life). Therefore the blow from the bottle did not kill him, the delay in receiving life saving surgery ensured he died. The decision to delay the surgery was made by the injured person.
        In your example, the blow AND the botched surgery contributed to the death.

Working mothers and stay at home mums take note:-

Consider this –

Early morning airbrush and comb over to make her look like the cheesy poster girl we all know –

Into the office for a quick pow-wow then off to the caucus rooms.

Instructs everybody how to behave for the next 24 hours, then tally-ho into the media scrum.

Solves all our national woes and speculates on solutions for other world woes, and winds up with:-

“I manage to look this good and do all this work today, and raise a daughter at the same time – and that’s just before lunch !!”

Now I have enormous respect for those raising children – but IT AIN’T NO PART TIME JOB !! And it’s not a job that you should do over the phone from another city.

I absolutely adore my grandchildren, but I’m always glad to hand them back to mum at the end of the day. It’s hard work keeping up with them. Unless – of course – you give them an iPad and leave them to watch Youtube kids all day!

To minimise the effort required to raise children with “Oh, I can do that and run the country at the same time” is just plain insulting to all those mothers (and fathers) who invest everything they have into their child raising efforts.

Now we are faced with a situation of having two massive jobs, Cindy should choose NOW which she is going to do properly !!

  Mind you, she is being hailed in the media as “Superwoman” so anything’s possible.
  Why do I say this? Because I am a mother myself and a grandmother and whenever my kids have babies, I’m there to pick up the pieces and keep things on track for the Mum as the newborn wrecks havoc on the once, in-control unit. I can’t see that the PM’s situation is going to be any different to any other family with a newborn so how the bloody hell she thinks she can run the country and be a mother at the same time is just more virtual signalling from someone who hasn’t a bloody clue, quite frankly.

Watch the first opportunity the Aussies have to impose visa restriction to New Zealanders prior to entry.
This along with the change in visas the current New Zealanders (approx 450,000) have who live in Aussie would be a nightmare.
The Aussies have full details, and have had for many years, just waiting for the media to shit stir to enact changes.
Years ago I had a UK passport and had a usual hassle to get a visa to visit Aussie. Virtually hand delivered your passport to Auckland Consul and had to wait some while then a note to say it was ready along with a hefty bill.
Living in Wellington did not help – became a New Zealand Citizen soon after.

It never fails to surprise me that so many heterosexual social progressives support gay ‘marriage’ and see it as something to be lauded and promoted yet despise marriage as an institution that they as heterosexuals should be bothered with.

It seems we have a PM who is happy to have a child to the man with whom she currently cohabits but does not see it might be in the child’s best interests to be in a legally committed relationship with that man.

  I had a girlfriend like that many years ago. She thought the idea of marriage was stupid but when the NZ (Labour) government pushed for homosexual marriage, she was completely for it.
  
  She was unabashed Green voter/supporter, so hypocrisy was her middle name; she was the most environmentally unfriendly person I knew. Public transport? Nope, drive there. Walk a short distance? Only if her car was broken down, otherwise drive there. Loved and kept cats? Yes. Everything into the general rubbish? Yes. And so on and so forth. I don’t consider myself environmentally conscious but compared to her, I was an environment saint.
  
  (Yes, she was a “Trotsky” socialist).
  
  (No, I’m not against homosexual marriage, it was the hypocrisy of her stance that amused me).

The judgment was for $34,182.56 in rates and penalties outstanding as of 30 June 2015. The council has been awarded total costs in the District and High Courts of $20,329.20.

What about since 30 June 2015? Or have the rates been paid since then – I doubt it.
If Teina Pora’s payout can be updated, surely Penny’s payout can be too.

“In my personal view …” as Penny has often said, to allow her to say anything … Had Penny Bright perhaps possessed the honesty, transparency and integrity she demands of the Auckland Council, she would surely have kept a dedicated account equivalent to the rates, penalties and court costs (roughly) – since, at one point at least, her entire argument was based on one section of the Local Government Act, while she ignored the rates objection procedure as laid out in later sections of the same act.

If her faith in the Act was that its earlier sections supported her, she should have adhered to the stipulations of the later provisions as being likely as correct in what they said.

In my personal view, Penny Bright’s present disposition is of her own making – but slightly compounded by Auckland Council’s utter incompetence.

  Rating sales are rare (they do not happen with mortgaged properties since the council simply taps the mortgagee for outstanding rates which are plus an admin fee tacked on the mortgage). Where they do occur the owner has either abandoned the land or is too feckless to do anything about it eg the Manurewa rating sale a year or two ago).
  In most cases where owners want to attack rating decisions (eg the Mangiwhai ratepayers) they usually attack the legality of the rates and if need be try and restrain the council from levying or collecting the rates.
  In Penny’s instance she has attacked the Council’s procedures under the Rating Act which have never (or hardly ever) been tested and gained some temporary success. There are means of exploiting the Act to spin things out.
  The Council will not be out of pocket on the Rates itself, the cumulative late penalties would be greater than what it would cost the Council to borrow the money. She also needs to meet Council’s expenses except where procedural slip-ups occurred, so the Council would be slightly out of pocket here. The Council would be more out of pocket where this has occupied time and effort of senior officials which probably cannot be ‘charged out’.
  So the Council cannot be held completely to blame.

  I might have some sympathy for Penny if, at the begiining of the rates strike, she had set up a trust account and paid the rates money into that each month. That would have enabled her to settle the bill when/if the courts found her strike to be illegal. That would have been the transparent, responsible thing to do.
  
  That she now faces losing her house because she has not made provision for the payment of a substantial debt is nobody’s problem but hers. Having made her bed, she now has to lie in it.

    Trouble is, Penny’s philosophical grievances had no direct connection with rates collection so she had no legal basis whatsoever to refuse paying rates.   I paraphrase slightly but you’ll get the gist:

According to Oxfam of course. Stuff have passed this off as fact, even though they quote “Oxfam has estimated New Zealand’s richest man Graeme Hart had increased his wealth in 2017 by $4.26b to $13.05b”.
So, Oxfam have “estimated”. Oxfam “say” the gap in wealth has increased. Of course it has Oxfam. Its called the time value of money and it happens. And Oxfam do not mention that there will ALWAYS be a growing gap as young people have fewer assets that older people. The lack of critical analysis of information given by Oxfam and the like to Stuff (and not at all surprisingly, the Labour Party) is risible.

I listened to Kerre McIvor yesterday morning and finished up, very disappointed. She’s not even remotely a patch on Leighton in so many respects. Leighton is objective, querying callers when unclear – Kerre rides over the top. Leighton listens – Kerre seems to moot her viewpoint first and foremost – and if she’s not interested in pursuing the track – one was quite topical about the PM letting the country down by having concealed her pregnancy -she doesn’t.

Worst of all, to an audience of long-time Leighton listeners who don’t want any change at all, she arrogantly intoned something to the tune of “I’m not Leighton and I’m not going to try to be.”

All I can hope is that someone far more suitable will be found to take over NewsTalkZB’s “Leighton slot” – and that Kerre will be returned to the relatively uncomplicated and generally inane talkback of the afternoon slot.

      As regards “radio performance” I think your question might be answered, somewhat obliquely, this way: –
      
      · A man will pay $2 for a $1 item he needs.
      · A woman will pay $1 for a $2 item that she doesn’t need, but it was on sale.
      
      There’s a quite a distinction as to objectivity – however, it may not be understood or even accepted by those on the Left whose limitations of intellect can only allow them perceive Leighton as being less than “brainy.”

      No, I hope what happens is someone fills the huge space being created in the radio market for some serious balanced programming. It doesn’t have to be all talkback and it doesn’t have to be all centre -right type broadcasters. eg. Kim Hill does some great interviews on Saturday morning ( I assume she still has that slot). I know you can get this stuff on podcasts but we need better news and sports coverage as well.

It’s a great pity because once she was well and truly out on her own, but bias is bias and that’s something I can’t stand whichever way it falls. So late last night I openned my local rag and there was an article about “growing wealth inequality.” I think was Oxfam NZ’s report, every year they come out with the same nonsense both globally or their NZ branch. They make outlandish claims that the lowest 30% own only 1% of the wealth and that the top 1% own 28% of the wealth. The big problem is that Credit Suisse also publishes a Global Wealth report, and their data compares countries. And guess what? NZ always comes out as a very equal middle class society compared with every one else. Our wealth gini coefficient is one of the lowest, that top 1% is low, most countries it is 40%> and the lowest 50% in NZ have alot more wealth than Scandinavian countries, who have high wealth inequality. This is the inconvenient
truth for the left, the countries praised up in that flawed “The Spirit Level” have shocking wealth inequality. As for the lowest deciles, they always have negative wealth, why? Because they are students and children. It counts Dental, Pharmacy, and Med students with enormous debts, that they can though payback within a short time. It also counts on our figures students who have fled the country, but their debt is still credited to us. Oxfam always do this, compare the owners of the best few companies in the world with the children, from non-market third world countries. Much of this fraud is being pushed by Max Rashbrooke, a couple of years ago he wrote a book claiming we were getting increasingly unequal, yet the truth was the richest 1% and 10% owned less in 2012 or 2014 (or whenever) than in 2000/2001 as a percentage of total wealth. Max is wrong, yet he is a clone of Thomas Piketty. These arguments are always static and they always forget about the rising household wealth of some 2 million home owners in this country. In fact the idea that rich foreigners (mainly Asian) were overpaying for middle to upper middle class real estate may have served as a check that kept the wealth of rich locals in check with the middle class, stopping this may increase wealth inequality if the stock market keeps rising and housing flattens off. The truth is NZ is very much a middle class society, but we do need more successful new companies to emerge. And sorry for rambling.

Trotter in the Christchurch Press today, and presumably in other Fairfucked NZ newspapers, says in a column gushing about Jacinderella :

…the hard-nosed decision of their [baby-boomers] own generation’s pre-eminent politician, Helen Clark, to forego the experience of motherhood as the unavoidable price of achieving high public office.

So Trotter knows Clark chose selflessly not to become a mum because that would interfere with her serving the country. How does Trotter know enough to dismiss these possible reasons for Clark not having a family? First, Clark just didn’t want to have kids; or, second, that Clark for some physical reason couldn’t have kids; or, third, that maybe Clark didn’t like the heterosexual act that creates children?

Trotter has been writing the same mindless, Leftist drivel since he wasted his time at university scribbling for the student magazine.

Trendsetters, I just gotta share this with you !!

Last night I was having a quiet beer at my standard here in Phuket, down at Rawai beach. Got talking to this young fella who was sitting opposite by himself, turned out he was an American dude who was in Thailand for a couple of days, en route to Morocco for some car racing. We talked shite for a while, played some pool, talked about each others countries..Trump etc.. sank a few beers..turned out this guys an actor, I said ‘awe ok, pay good coin?’ ‘Reasonable, he replied’.
Cut a long story short..it was LEONARDO DICAPRIO!!! I shit you not.

      Direct from the LA Times:
      
      “In retrospect, lighting the match was my big mistake. But I was only trying to retrieve the gerbil,” Eric Tomaszewski told bemused doctors in the Severe Burns Unit of Salt Lake City Hospital. Tomaszewski, and his homosexual partner Andrew “Kiki” Farnum, had been admitted for emergency treatment after a felching session had gone seriously wrong.
      
      “I pushed a cardboard tube up his rectum and slipped Raggot, our gerbil, in,” he explained. “As usual, Kiki shouted out ‘Armageddon’, my cue that he’d had enough. I tried to retrieve Raggot but he wouldn’t come out again,so I peered into the tube and struck a match, thinking the light might attract him.”
      
      At a hushed press conference, a hospital spokesman described what happened next. “The match ignited a pocket of intestinal gas and a flame shot out the tubing, igniting Mr Tomaszewski’s hair and severely burning his face. It also set fire to the gerbil’s fur and whiskers which in turn ignited a larger pocket of gas further up the intestine, propelling the rodent out like a cannonball.”

A looming change in how mānuka honey is classified is being challenged as a breach of the Treaty of Waitangi with a claim Māori were not consulted.

The change in classification is being pushed through by the Ministry of Primary Industries in a bid to rid the highly lucrative trade of inferior honey.

But it could also reduce export earning by millions as honey currently classified as mānuka could be downgraded to bush honey, which does not attract a premium price.

  1) Leptospermum scoparium is also native to parts of Australia so the wankers would be pushing shit uphill to claim the plant as a taonga.
  
  2) Manuka honey & bush honey are differentiated by a laboratory test…..not by where they’re harvested.

Bill English appears to side with China on the issue of overseas Chinese buying houses in NZ.

Noting there are talks on upgrading the China-NZ free trade deal, English said:

“They’ve yet to see whether the Chinese are going to take a deal where they give us something for our dairy and agricultural produce – which is really important to us – but whether they’ll take worse treatment than Australia on this housing issue.

However, I believe the position is that Australia in general restricts foreign residents (with some exemptions, such as New Zealanders) from buying existing houses. They can buy new homes, or land and build new homes.

In general, non-resident foreigners need to apply for and receive foreign investment approval before purchasing any residential property in Australia.

If the NZ Government does buckle on Chinese investment in NZ real estate, let’s hope China also buckles on letting New Zealanders buy freehold property in China, and invest (if they are silly enough to want to) in China’s core industry, steel.

In the meantime, is National going to learn from the election reversal, or is it going to try to bulldoze voters “back into line”?
