  Judges refuse to use the 3-strikes law, invoking the manifestly unjust clause for some reason.
  
  So, 3 strikes isn’t working as intended and labour in their infinite wisdom blame the law instead of the despicable judges who blatantly defy the will of the people of NZ!
  
  You can see why less restrained governments execute their judges.

All the prisoners that are released or sentenced to Home Detention will be turned into Police Officers and that way the numbers will be attainable.       What I would like to see is the reversing of their public statement which is in effect a softening on crime. Of course they are not phrasing it as this.
      
      I would also say that I can’t see NZF going for it, but they’ve already shown a few times they’re willing to swallow a dead rat – will they continue to do so with their current polling? I guess its whats it the secret coalition document!

      Justice Minister Judith Collins told Law News the number of defendants committing offences on bail has fallen from 15,754 in 2008 to 10,938 in 2012 – a 30 per cent drop.
      
      Figures, obtained from the Ministry of Justice late last year by The Herald under the OIA. Those figures revealed that between 2009 and 2012, some 31 people were killed by offenders out on bail – 11 were murdered, 14 were the victims of manslaughter and six were killed by bailed defendants committing driving offences.
      And of further concern were figures obtained earlier this year by the Waikato Times, also under the OIA. They showed that in the last two years, 25,323 people released on bail failed to appear in court, with 1,308 having been on the run for more than five years.

      That is a fair point but has backfired. Uptake of the scheme has not invited any more than the usual intake for universities. The usual lefty rabble at university level will always exist. Last election showed a poor turnout for young voters and even less of those were at university. That may change if we end up with a Trump like figure but we are soft as piss here and any future National prime minister will be just as soft as Key and Soiman. I don’t think Collins will ever be PM regardless of WO and others pushing it. If you had asked me in 2016 if the next National PM was in parliament yet? I would have said no. Ask me today and the answer is yes. One of the newest members and a bloody good guy with plenty of life experience including being a cop in his career.

    True, but longer intervals between offending results in lower crime.
    
    2. More could be done to rehabilitate inmates.
    
    True, but they don’t have to be released to do that.
    
    It’s also worth pointing out that Bill’s social investment approach had far more chance of changing the crime landscape (over a generation) than anything Labour is offering.

        Both groups constitute about 15 to 17% of the population but 51% of the prison population is Maori and only 12% are P I.

Angry is trying to out do her by catch and release so then nobody can tell if they are nutters or crims until they get close enough to see the blinking bracelet. Perhaps Angry could cover his arse by colour coding the blinking light on the anklet to indicate the wearers crime levels that got him the prize.     At a guess, the effect to the oil industry is only felt esoterically, and not really cared about in a sense. I’m sure if you polled the people and asked “Should we be moving away from oil and gas exploration, most would be for it, or not against it.

        Well we should certainly clarify and review the electoral law, MMP is good and everything when the calculations essentially reduce your list seats based on how many electorate seats you get, if the people voting for the small parties are also giving them their electorate votes.
        
        The issue is that the smarter cookies out their vote labour in the electorate and party vote NZ1st/greens, because NZ1st and Greens don’t have electorate seats, the result is an electorate vote for them is worth 5 votes for National (or something like that) in terms of seats per vote. Conversly, National can give a seat to act, heck they may as well give them 6 seats, and they can just pick up the number that they lost through the MMP adjustments to how list seats are distributed.
        
        So its not a good system, in terms of ensuring proportional representation, then there are issues about prisoners, do prisoners have the right to vote, there is nothing in the law preventing them to vote as far as I know, but as far as I know there is no polling stations accessible by prisoners, this would be like the electoral comission not putting any polling stations in the south island for instance, if the state is going to set restrictions on who can and can not vote, it should be done by the books and written into the statuttes.
        
        Also there are overseas voters, and resident voters, the issue is what should be the threshold to vote, should it be Income as some people have suggested, should it be asset wealth as other have suggested, age is a common suggestion, some people believe only people whom have a certain class of citizenship i.e. a resident or even just a citizen should vote, and what about IQ, should people of subnormal intelligence for instance vote, if we are to have an IQ factor where is that threshold drawn, should votes be abated by IQ or Wealth or AGE?. If the criteria is residency, should we even allow special votes by expatriates? Overseas voting?
        
        Its true that if we were to have a straight vote 1% = 1 SEAT, that the distribution in parliament would look quiet similar to what it is now, its also true that if we were to say have 50 electorate seats and 2% of the vote was 1 seat, that national would have had a majority, and then there is the question, should we have preferential voting, if we want to encourage smaller parties, and people to be part of those and have their views represented, then should we allow preferential voting?
        
        There are alot of things about the electoral law which are not well thought out, or even arguably maybe not lawful, is it lawful to not provide polls just because you don’t like criminals, I don’t like criminals, maybe they shouldn’t vote, but maybe if that is the case the law should say that, and if it doesn’t perhaps its a violation of their rights. If its not, what level of discrimination is allowed? I think its absoloutely time to review the electoral act.
        
        And not just voter eligibility but procedure, should someone be able to publish a big accusation at 11.59 on the last night, everyone wakes up and sees it on their phones in the news list, and no one has the right of reply, should politicians be able to say thintgs which aren’t true whilst campaigning, should their promises be legally binding? Should their proposals be costed and go through a select comitee beforehand?

    It was 88% No when I voted just before 8am Chuck. I see now there have been close to 2000 responses, so it’s a pretty blunt message for Little and his mates.
    
    And if he claims he will repeal Three Strikes in the next two weeks, that can only mean the NZ First has agreed to support the repeal. He wouldn’t have the numbers otherwise.

  I heard Hosking speaking to Little this morning. The world continues…Little remains a bumbling fool with less charisma than stale bread. I continue to favour Judith Collins as Leader of the Opposition but in reality Hosking is doing an admirable job presently. I can’t begin to imagine Bridges nailing even a fool like Little Angry.

Red Radio interviews psychologists who have spent their careers fussing around poor, misunderstood rapists and murderers who may feel a bit better if treated softly and *may* commit lower recidivist rates than if serving a longer sentence.
    
    But the question should not be ‘shorter or slightly longer sentence?’ The question should be ‘why on earth let people out *at all* if there is any risk of them raping or murdering again?’

      It’s amazing that in some states in the USA the reoffending rate of certain prisoners is zero. Now one has to be suspicious of statistics that may suggest a correlation with causation, but it does seem that those that have “that” injection, just never reoffend…..

  The reason the gag was lifted is that it served its purpose – to protect the integrity (eg minimise the chance of a mistrial) of a criminal trial. Indeed, the terms of the order almost certainly specified when the order would cease to have effect. So to say it was lifted in response to pressure is quite wrong. And it is equally wrong to say it was politically motivated – British judges (like NZ judges) will not be bossed around or bullied into making decisions to suit political agendas.
  It also needs to be remembered that a NZ judge could well impose a similar order in similar circumstances.

    I am very confused about all the out pourings regarding Tommy Robinson. It seems he has changed his name several times and has also been convicted for mortgage fraud. A relative in England who is right of centre described him as a fascist. As I say, I am confused since there seems to have been a massive groundswell of support for him on here. My question is: Do we really know the true man behind the name and was the response here knee jerk? It is a genuine question. We have to be careful that we can see the wood despite the trees.

      With the internet it’s not difficult to listen to a person’s opinions and make up your own mind. (That’s how I learned about the vast difference between Trump’s actual statements and the lies the MSM told.)
      
      I have listened to quite a few of Tommy’s speeches and interviews over the years. He has repeatedly stated that he is not racist, just doesn’t want islamism and the covered up grooming and rape that people got away with because the authorities were too scared of being called ‘racist’.
      
      The problem with islamism is that it *does* allow wife beating, FGM and sex with those ‘the right hand possesses’ – i.e. sex slaves. And islamists are keen to still live by those standards.
      
      Who are the ‘fascists’ here? Those wanting a totalitarian, theocratic state, such as Saudi Arabia or Iran, or those who want to maintain our liberties and equal rights for men and women?

    13 months for contempt of court is excessive. And the judge who gave that sentence was sending a very clear message , not about the sanctity of judicial hearings , but the sanctity of Islam.
    
    The guy who threw bacon at a mosque was also given a very hefty sentence , under the circumstances.

    In this case you’re quite wrong. In this case Robinson was recording in a public space outside the sentencing hearing. There is absolutely no way that his actions could prejudice the trial because the trial was over.
    
    This was a tyrannical, petty, political, and personal action by the police and judge and for no good reason, or rather for a very good reason in their heads – to cow the general population into doing what they are told.

      Ed – there seems to be doubt about the status of the trial. Other reports indicate the trial was still proceeding. Yesterday newspapers were reporting his imprisonment indicating the order had lapsed since it would have served the intended purpose – to avoid prejudicing a trial.
      Also which part of the ‘good behaviour’ bond did Tommy not understand? It was pretty simple – stay away from courthouses or you are inside. What could be clearer? If he thinks 13 months is excessive (and AFAIK this was the second time he was trifling with the administration of justice) he should have appealed. There were other ways he could register his protest without goading the judiciary.

    Stephieboy – I would think that most reasonable people would be very disturbed by what has happened to Tommy Robinson. For the “offence” of reporting what was happening in the trial of Muslim rape gangs he was summarily arrested, tried and incarcerated all on the same day. The newspapers and media were forbidden to report on Tommy Robinson’s case.
    
    Anyone with a sense of freedom and the appropriateness of justice would be appalled at what has happened. Why was Tommy Robinson dealt with in such a hasty fashion and no one allowed to talk about it?
    
    I can tell you the reason. It’s because above all things the British authorities want to censor and downplay the phenomenon of Muslim rape gangs. They do not want to tell the British public what is really going on. And they want to protect the Muslims.
    
    Let that sink in for a moment. They want to protect Muslim immigrants and rapists. They do not seem interested in protecting their own British people. I am sure that Muslim rape gangs are still going on in Britain. But it is massively underreported and massively under investigated. The British authorities should be cracking down on this and making it stop. If it were Christians or white men the authorities would be acting.   He is not a political prisoner. He was given two chances (I think) not to interfere with the administration of justice and was given a 13 month suspended sentence on the second occasion. He interfered with the administration of justice a third time, thus activating the 13 month sentence. It is not the politicians who brought this about – it was the judges who got fed up with his interfering in the administration of justice. The judge who imposed the temporary gagging order was most concerned that his actions did not risk a mistrial having to be declared because of possible witness or jury contamination..

      I do not have any ‘inside’ information about the case. I just stood back and tried to figure what actually happened and why. Once all the nonsense, bias, etc is stripped away it is pretty obvious what the situation was – a guy who had a third attempt with interfering with the course of justice after being warned twice, and the need to protect the integrity of the trial (ie avoid a mistrial) by a temporary ban on publication.

      If I was a witness or juror I would take exception to being filmed while entering or leaving the courthouse and would expect to have my privacy protected. I would not expect my image to go viral on Youtube.
      He was subject to a ‘good behaviour’ bond. So the Court can impose conditions which go beyond the requirements of the law.

OK, we are closing in on the 3 months that the ‘enquiry’ was to take in the labour youth camp debacle where young girls were assaulted and alcohol freely available…I have a few questions before the verdict is in:
1: Will the enquiry continue until JA has the baby thus pushing any bad outcome off the front pages?
2: Will there be no prosecutions as the ‘victims’ didn’t wish to proceed and the perpetrator could not be found (or no 100% proof it was him and thus no conviction)
3: Labour Youth wing to be slapped with a wet bus ticket and promises going forward no alcohol to be on same premises and more adult supervision in place (in other words…we got caught out and it won’t happen again, promise)

Any other gems you can foresee?, or like me it a pretty foregone conclusion that the labour Party will be whitewashed out of the whole affair and Labour Youth get to take the blame?

You have to remember their was three victims and if their parents don’t want this A/H charged then they are irresponsible and prepared to let it happen again. All these utterances are directed at one person, and you don’t need to be a mensa candidate to figure out who. But when those on the left see such comments directed at one of their own, watch out.

Another rest home maggot story….not surprised at all.

As I’ve said, my partner worked in one of these places (one of the big ‘respectable’ ones) as a nurse and on night shifts she was responsible for nurse care of 40 residents — these are old people with all sorts of health issues.

Every single one of those patients requires a set of notes to be written at the end of the shift…that alone could take over an hour. At the same time she is writing handover notes she was supposed to be attending to residents — literally impossible for one person to be doing 2 things at the same time.

Even 4 nurses would have been tight.

It all comes to money — you don’t want maggots, then pay more for better staffing ratios.

There is no honesty in the industry or among families with elderly parents in care.

What the EU are trying to do with copyright law is extremely relevant to the Stasi arrest of Tommy Robinson.

Key mechanism:

A tax on internet links.

Yes – that’s right. The Brussels government is going to tax internet links to websites and online data that serve as sources for commentary and opinion.

So for all of us here, if we link to any material relating to the EU – DPF will be served with demands for payment of licensing fees to EU based license holders. So for example, in the Tommy Robinson case, in order to upload a video of his Stasi arrest, you would have to pay massive fees to say, the BBC, or else yourself be subject to arrest on entering the EU, or massive fines imposed on you via default judgment in absentia.

The Legal Affairs Committee of the European Parliament is voting on this on 20, and 21 June of this year.

So there are two key tools:
1) Link taxes; and
2) mandatory filtering.

Once these laws pass, anyone wanting to form an opinion or share information relevant to anything in the EU will have to implement upload filters and pay a link tax.

It encompasses and ends Fair Use.

The Brussels soviets will impose a tax for linking to other websites as sources in news blogs and commentary blogs. Contents like videos and articles will all be filtered through an automated copy right detection system to detect materials belonging to someone else.

This will destroy Fair Use.

You wouldn’t be able to comment on or share data or footage you didn’t own – even in the context of Fair Use for commentary, satire, opinion etc.

Currently you can use copy right footage for comedy, parody, satire, news reporting, or some form of transformative purpose.

Google and Facebook already filter material against copy right considerations. The laws the EU are imposing are going to favour big tech at the expense of small companies.

The mandatory filtering is going to be imposed by creating massive ‘intermediary liability’.

They will make platforms liable for all copyright infringements by their users. The only defense will be showing they’ve done everything in their power to prevent copyrighted content from appearing online – by deploying ‘upload filters’ (Article 13, paragraph 4). This is ‘optional’.

Like going to jail for speech is ‘optional’ in that if you say nothing you won’t go to jail.

The only way to avoid extortionate ‘linking tax’ is not to allow material to be uploaded to your platform at all.

They’d have to use filters to prevent all that material appearing in the first place.

Every single alternative media creator we subscribe to and watch will be eliminated online.

They are not only going to imprison us for ‘wrong think’ justified by the fake dimensions of ‘diversity’ ‘social justice’ ‘equality’ they are going to tax us for ‘wrongthink’ and ‘hatefacts’ as well.

The only other possibility is that people just ignore the concept of ‘copyright’. The only way around this would be for everyone to create things, not copyright it, and therefore avoid the possibility of link tax.

But I can guarantee these slithering politicians will add laws which effectively punish people who don’t seek copyright, or which automate it.

  Puting someone in prison for over a year, through a secret trial, with no real legal representation and what in my understanding is no presumption of innocence (for a contempt of court case) isn’t a misscarriage of justice, it is a complete absence of justice.
  
  Even worse the very same judge that tried him was allegedly looking out the window as Tommy was being arrested and laughing, how can one even begin to expect a fair-trial when the judge laughs as you are arrested?

The muslims control the law enforcement agencies of Europe, particularly in Sweden, France, England.   I too went to the public meeting at Waikanae to hear Simon Bridges.
  
  I came away quite impressed to tell the truth: sound bites on the radio and TV do not do him justice, he is intelligent, articulate, prepared and affable.
  
  The meeting was well-attended ( yes, most of us were elderly but as far as I know that is not yet a crime ) and both Simon Bridges and Nathan Guy answered all questions promptly and respectfully.
  Those “doddery” people are probably more likely to vote than anyone else.

Amazon to block its US website for Aussie shoppers over new GST rules

Australians will be blocked from shopping on Amazon’s international websites and restricted to using its smaller local platform so the e-commerce giant complies with new GST rules on online purchases.

Amazon said on Thursday that Amazon.com, its American website, and other overseas sites would no longer ship to Australian addresses from July 1. Shoppers visiting those sites will be redirected to Amazon.com.au, which launched late last year.

    There are many Johnboy – I posted three earlier today – here are a few more thoughts:
    1. Repeal legislation allowing councils to impose a fuel tax.
    2. Enact legislation that ensures recidivist. offenders are put away for the maximum period and force the judiciary to follow the law.
    3. Re-impose sanctions on welfare recipients that do not complete their obligations to the State.
    4. Renew licensing of oil and gas (or any mineral) exploration.
    5. Remove benefits for horse-breeders.
    6. Conduct a binding referendum on Maori seats – and enact the result.
    7. Reform the RMA – and do it first.
    8. Remove free student fees.
    9. If keeping a winter-energy-payment, impose an income test (which can be easily done by using an existing mechanism such as the Community Service Card).
    10. Increase the age of eligibility to NZ Super to 67 and plan a progressive increase in age in line with the ageing population.
    11. Reintroduce Partnership Schools and enshrine them in legislation.
    12. Introduce pay levels tied to performance for teachers in State Schools
    
    That’s just 12 off the top of my head.
