So the prick Kempson has finally had his name suppression lifted. Big deal. I’ve known his name for almost two years but obviously couldn’t say anything because of our stone-age suppression laws.
OK, now he’s appealing the sentences for the various horrible crimes he’s been convicted of. All I can say is that I really hope that the judge who decides this has some gonads and not only throws his appeal out but adds at least six years to the non-parole period for wasting the court’s time.
But Angry Andy will probably come to his rescue.

  Question i have is i read yesterday that he was convicted of rape only a month or 2 prior to killing Grace milaine, is that correct or a typo? If so then the judge and minister in charge should be up for murder charges aswell for letting the scum remain in public to do as he pleased.

    No, he has had 2 further Judge-only trials after he was convicted of Grace Millane’s murder.
    
    He’s been in prison since he was arrested for murder.
    
    The conviction for Rape was in November 2020 (although the offence had occurred in April 2018)
    
    The Convictions for sexual assaults on a former partner were in October 2020 , although the period of offending was Nov 2016-April 2017.

    I tried to find ot again but typical stuffed content theyve changed it, obviously the didnt let truth get on the way of their story. Yesterday it clearly read thet he was “convicted” of rape just prior to graces murder whereas now it states the act took place then but convicted later.

  Last night on one of the “news” they had a clip of him abusing a judge in one of the other cases …..
  
  …..once upon a very distant and unwoke time said judge would have addressed the prisoner in the dock , not by the honorific “Mister” Kempson , given him a dressing down and then added a few months to the sentnce for contempt .
  
  But no doubt the young man’s disconnect from his cultural something or other is a cause of concern and to be taken into consideration…….

    It’s his right to appeal and anyone can apply for legal aid. NZ does not have ‘attorney firms’ we have law firms and barristers sole.

  Agree Capt – I feel upset about this whole case. The chap Kempson appears to have been affected by his parents divorce at age 3 and this meant that he’s been angry with women ever since. This highlights to me the importance of marriage and having strong marriages to raise the next generation of hopefully responsible young men.
  
  Secondly this tinder business doesn’t seem to lead to any good thing. It reminds me of the Australian guy who met a girl on a tinder date, they fought, she ended up on the balcony of his apartment and fell off to her death. The guy didn’t even look but calmly had a walk and a few drinks and I think some takeaway’s. Is there no other way that girls can meet guys than through these phone applications where women go off with complete strangers to their apartment? It just doesn’t seem to lead to any good thing.
  
  And lastly, and I know most people don’t agree with me, I think this is a good case for capital punishment. If the criminal mind understood that if you strangle a woman to death you will lose your own life, that is a pretty good deterrent.

      True, Maggy, but the statistics are clear: children from single parent homes are demonstrably worse off. The sadness is that children from broken homes are more likely to experience and perpetuate relationship violence as the grow up. As you have identified, this doesn’t apply to all, but it is definitely worth discussing.

      The really sad aspect is that when a woman falls in love and she finds a so called keeper, cut and run is on many occasions so hard to achieve.
      This can happen in reverse.
      About half are lucky in love long term in the world if divorce figures are anything to go by.
      The legal system has lost its way many years ago.
      This animal doesn’t appear to know what “love” means, he has been an animal in the true sense.

    How did you come to that conclusion? It’s possible that he could have been angry with people, and with the world in general since, although his criminal offending (being of a sexual nature) has involved women.

      That was some of the psychobabble presented in his pre-sentence cultural report:
      A pre-sentence cultural report submitted to the High Court, cited by Justice Venning in November as he jailed Kempson for three-and-a-half years for rape, said Kempson’s parents split when he was three.
      
      “Your father was at times violent towards you … your mother rejected you. That may go some way towards explaining your attitude towards women,” Justice Venning said.

        As a matter of interest, I’ve watched nearly every episode of CSI New York, and consider myself to be a bit of a Criminal Profiler. Let me just say that Jesse Kempson fitted 9 out of the 10 criteria pointing to him being the culprit. The only one that skewed the data was his name.

  The Court of Appeal has thrown out his murder appeal – the 17 years minimum still applies.
  Unlike UK, NZ appeal courts cannot increase sentences on their own volition. The Crown has to specifically appeal the sentence and the court will only increase it if the original sentence is manifestly inadequate, and then only increase it to the lower end of the usual sentencing range.
  That guy is going to have to give himself a massive psychological tune-up during the next 17 years if he hopes to get out then. Like Mr Vincent (who has been in prison over 50 years) it is highly doubtful that he would be up to the challenge.

  What I don’t understand is how the sentence for the multitude of hideous crimes this monster has committed is no greater than for just the one. Commit one, get one free. Effectively those other crimes become punishment free. If anything the punishment should be ramping up surely.

  Hi Captain…I agree about the sentence ‘add on’ if appeal fails.
  I read once that appeals of a sentence are welcome but if your appeal fails (no new evidence presented, no tangiable reason for appeal given/proven) then the sentence is increased.
  I think it was Indonesia if memory serves, apologies If I have the wrong country.
  Basically in western countries almost all convictions are followed by an appeal for no other reason, it seems, than to keep lawyers employed and because its standard practice to lodge an appeal after the guilty verdict is given.
  Now, if said appeal comes with a 50% additional jail time if unsuccessful then how many convicted tell their lawyers ‘dont appeal!’…..if its free to appeal, and appeal again and again with no consequenses then why wouldnt you NOT agree to waste the courts time, and mostly tax payers money, in appealing. How much has Lundy cost the NZ taxpayer in his many appeals.

  He had name suppression so as not to influence the other trials he was involved in.
  Unlike some jurisdictions what happened in unconnected crimes has no bear on the case in hand, as I understand.
  Judge can’t add time just because the bloke is exercising his legal right, no matter how repugnant that is to you.
  Andrew Little is no longer Justice Minister & he couldn’t interfere anyway.

I have been wondering about his strike warnings. Surely he got one for the murder. He should have got a second for the crimes against the next victim. If the last victim was raped that would be a third strike and should have meant 20 years without parole.

    That’s right. The strike warning is triggered by convictions prior to the offending date, as the theory is that the strike will deter future offending. Plus he has life on the murder charge, so there are no cumulative sentences.

    I do not believe they are independent. One only has to look at judiciary rulings with respect to the Treaty, the ammunition theft oops confiscation, foreshore, iwi roadblocks, jailing Vince Siemer for speaking out against judicial overreach, police corruption, etc, et al.

  He’s in prison for 17yrs before he comes up for parole at aged 45.
  One would have to think the parole board will leave him locked up for some time after that.
  I see there was some bloke released in his 80s the other day. It’s a bit pointless keeping the bloke that long. He was just a liability to the prison system.

        It has never been shown that harsher sentences have much, if any, deterrent effect. The worth of long prison sentences is removing violent offender from the community, hopefully until such time as the represent a much lower risk to the public.

        He is now, MCos. But from memory, he always was a fairly low functioning individual, had difficulties with impulse control, and those impulses involved young boys.
        
        I have wondered whether leaving him in prison might have been the humane thing to do, tbh. In his state of dementia, the familiar things and routine in his life might be more comforting and less confusing than a whole new environment. Just a thought.

        No, kowtow, but what MCos says is probably correct. If you look at the violent offenders in our prisons, the majority have been short on cuddles and long on kicks in the arse and worse. That’s not an excuse, btw, and perhaps the time for cuddles is now past, but it’s probably the reality of the situation.

      If people have had their arses kicked their whole lives then they need HARSHER punishments – not time off because they need hugz.
      
      For people who have been raised fairly well and with a respect of the law (eg my sons) just a warning is enough to deter future offending.
      
      But if you’ve been raised in a violent household then you need a firmer interaction to get the message across.

        “Correction” should involve the application of the least amount of force/violence/incarceration to get the message across that the behaviour is not acceptable and they need to change their ways.
        
        For a highly compliant person that might just be a stern look and they will remember that.
        
        For others it might need a massive amount of punishment and retraining etc to get the message across.

      From today’s ODT , summary of shenanigans.
      
      ‘An upset man in his 50s arrested in Dunedin for allegedly throwing rubbish and harassing taxi drivers has prompted a warning for people not to take end of year festivities too far.
      Acting Sergeant Aaron Burgess, of Dunedin, said the 52-year-old man was arrested on Leith St about 5.45pm last night.
      
      “Upon police attendance he was very intoxicated and agitated and was arrested for disorderly behaviour.”
      
      The man was released with a formal warning, Sgt Burgess said.
      
      Later in the evening, a road cone was thrown through a car window by a drunk 30-year-old man in Corstorphine about 11.30pm.
      
      The man was arrested for wilful damage and later given a formal warning*.*
      
      An alleged drink-driver was stopped at a checkpoint in Green Island and blew double the legal limit, he said.
      
      The 35-year-old will appear in the Dunedin District Court next month for driving with excess breath alcohol.’
      
      Three cases of alleged criminal acts involving alcohol .
      
      Only one results in a charge , the driving one . The other 2 receive warnings.
      
      Surely all should attract a formal charge .

  Then there are the military personnel who are struggling with guarding MIQ facilities. Some needing psychological help. If police, schools and even the military need psych help, there are job opportunities right there.
  
  In practice police and military might just as easily be suffering from cognitive dissonance with what they are being asked to do compared to what they signed up for. Can’t blame them.

    For the police – based on the fact the rank’n’file police almost all voted for Cahill as their president and their public spokesfwit, they are getting to do exactly what they signed up for – steer clear of nasty crims as often as feasible, harrass the law-abiding as often as feasible, and do high-$-count stings of rich gangstas to boost the CosterBudget while leaving the neighborhood meth houses pretty much alone.

    Yes, I was listening to TalkBack ZB just prior to 6:30 this morning and the interviewer was talking to someone in authority about crime rates etc and the interviewee started to speak about Maori youth rate crime statistics and the interviewer talked directly over the top of him.
    It made me start to wonder if this has become a handed down directive from above that media are not to say anything derogatory about Maori and where possible, precede everything with a couple of Te Teo words?
    It certainly gets up my nose, but what’s the option? All NZ TV and Radio stations are doing it to the best of my knowledge. I guess there’s always the OFF switch.

    Have to agree, I am nearly 70, had a magic life, but I think we lived through the best era in 100 years, sadly the tail end is going to all about no travel and enforcement. The great reset is upon us.
    I have so many flight credits I need to run a spread sheet to sort them.
    On the positive side I have applied for permits to visit other states, will have Christmas without family. Have a great Christmas Poppa but sadly don’t set your standards for change to high for the future, you will will be just dreaming the nightmare will disappear, it won’t under a socialist led governments.

Number one Albatross is of course Mallard who deserves to be roasted out of the job, despite having the blessing of Ardern – foolish decision as expected.
Don’t worry Trevor we will not forget you early in the New Year.
Ardern’s neck will be continually stretched the longer she leaves his resignation out.
It will show in her polls soon and that is something she cannot take – even her women voters will not let that happen – after all it is believed that Trevor is only a disposable man after all.

    Sadly it is impossible or National to have a cohesive plan without access to the required information which is withheld from them by the Government and the media.
    If any good idea came up Labour would steal it and call it their own that National copied.
    The next 2 election cycles Labour must hold on the the middle voters, principally women, who did well for them this time. Cindy will be gone soon enough when she realises the damage that has been done. Child violence and Poverty and housing are her bête noir – the damage she has done is already showing – started well before the Virus.
    They will not be able to do it as the country continues to collapse socially and economically.
    Sadly National can only sit and watch and continue to nibble meaningfully as the corruption continues.

Back when National were the government, around this time of the year, there were numerous stories in both NZ Herald and on Stuff of families in dire straits and not able to afford food etc. for Christmas including the Salvation Army and other organisations saying it has never been so bad, and the demand for help is higher than ever.
This year there doesn’t seem to be any / many of these stories. Are all the problems now fixed?

It’s funny how ideas suddenly spring out of nowhere and immediately take hold, are quickly mentioned and discussed by numbers of folk – often though without the slightest hint of substantiation, but even worse not even challenged.

(The classic example of this in recent years is ‘Diversity is our strength’. Have you ever read or heard a convincing substantiation as to why this is a valid statement? Or did we all just accept it at face-value? I was talking about this, and the claim that more diverse companies are more profitable, with my younger bro in Palmerston North a couple of months ago. The phone went quiet briefly and he replied “Go and tell that to the Brethren who own half of Palmy.”

Heh. Good point.)

The latest is that increasing the minimum wage improves firm productivity and that therefore this should be pursued relentlessly.

I may have seen it first on KB actually fairly recently. I’ve seen it repeated in other places as well, then we have Sam Stubbs chanting it in yesterday’s Stuff and now today here is Peter Davis referencing it in his Stuff column – in the form of the Helen Clark Foundation/NZIER Inclusive Growth Report.

(Note to Nostradamus – in Davis’ piece there’s that bloody ‘funding’ word again:

“For example, IPANZ asks whether we need more think tanks, how that might be achieved, how they might be funded, and how to deal with the quality of their research and the impact of their bias.”

Call me cynical but why do I get a sinking feeling that this is the initial salvo of a movement towards the public funding of Think Tanks. More taxpayer money for the luvvies.)

Anyway, back to the minimum wage/firm productivity issue. While I’ve never seen the link adequately explained nor substantiated, it seems to me that advocates are saying that if we make unskilled labour eye-wateringly expensive it will force firms to look for alternatives, innovate or change their product or service offerings into areas potentially more lucrative.

(Note to0 how airily the Helen Clark/IER piece dismissed the people locked out of the labour market by such a move:

“…placing less emphasis on short-term
disemployment effects and more on a medium
to long-term view of significantly raising the
minimum wage to encourage investment in
upskilling and gains to productivity when
reviewing the minimum wage….”

Well, here’s what I reckon. For forty years now I’ve seen successive political parties promise the world in opposition and then, when in government, spectacularly fail to address the exact issues they moaned loudest about. Not one government, including Helen Clark’s over NINE LONG YEARS, has ever fixed the chronic hard rump of unemployment, the increasing state dependency of an increasing proportion of our citizens, the failing scholastic achievement of our young, the booming numbers of our young people neither in work or study etc etc etc.

And all the while our minimum wage has been inexorably rising, more and more regulation and cost heaped on business, waves of unskilled and semi-skilled immigrants coming in every year.

And now we are supposed to believe Helen Clark and her hubbie when they say the solution is to ramp up the minimum wage much higher and even faster? You have go to be bloody kidding me!

You know it wasn’t that long ago when going to the pictures you have numbers of young folk guiding you to your seat with a torch. That when you went to the petrol station there were two or three young people standing at the pumps ready to fill your car, check under the bonnet and fill your tyres. I can think of numerous other examples. Great jobs that paid a bit, but far more importantly gave young people their start – their start to learn good skills and behaviours, learn to deal with the public, learn how to get on with their team and manager etc etc – and within a short period these young folk were off with their newfound skills to bigger and brighter prospects, earning higher wages etc.

Where have those jobs gone now? They no longer exist. They have been destroyed by our minimum wage policies.

Just imagine how many of our youth, have left school and currently sit in their bedrooms all day playing on their devices, or roaming the streets – could in fact be out working, in their first jobs (just as many of us did back in the day) if only our government hadn’t made it an illegal act for some local employer to give them that start at, say, $10 an hour.

The older I get the more distinctly unimpressed I am about anything coming out of the government, or anywhere else, which talks about grand plans to upskill the workforce, train our youngsters, improve business performance, transform this, transform that etc etc – as far as I am concerned these days, when it comes to young people, if they’re not inclined to study, is get them working, get them working, get them working.

At any cost. At any price. 95-98% of them will be onward and upward from there.

And as for sharp raises in the NZ minimum wage, I cannot think of a more destructive wrecking-ball of a government action to the hopes and aspirations of our young and unskilled, and especially right now with the large shock to our earnings through Covid.

Getting back to my original statement – I urge NZers not to fall for this latest idea sweeping the media. Challenge it. Demand answers. And if you don’t believe me, just ask yourself a simple question: generally speaking, if the price of something rises do you buy less of it or more of it?

      I had a PhD student that did his PhD half between U Hawaii and half at U Yaoundé. At the latter some days they couldn’t even keep the electricity/lights on. Mind you, at the former, we often couldn’t keep students in class as they were off surfing (not /s).

  Wasnt that long ago there were paper boys, 20ish years ago i was an eager young chap that loved to get up early and deliver the morning paper in the lovely southland rain and snow. I really enjoyed it but health and safety and minimum wages ruined it, the 20+ young paper runners were replaced by several fat middle age women on mopeds that hated the job.
  We were all happy with our work conditions and our 70-100 bux a week (pretty good for a 12-15yr old back then) but govt thought otherwise.

  If the Govnt stopped immigration except in cases with actual hard to get skills like neurosurgeons then wages could naturally rise without the aid of legislated increases. Not rocket science really.

Michael Reddell, at his Croaking Cassandra blog, has a good piece on the Productivity Commission and its new chairman, the Leftish economist Ganesh Nana.

A taste :

This [Nana] is someone who has spent 20 years in the public economics debate in New Zealand, from his perch at BERL, and yet as far as I can tell his main two views of potential relevance are that (a) inflation targeting (of the sort adopted in most advanced economies) is a significant source of New Zealand’s economic underperformance, and (b) that a much larger population might make a big difference (notwithstanding use of that strategy for, just on this wave, the last 25 years or so.

So the new head of the Productivity Commission believes in the population-growth Ponzi strategy that has seen New Zealand’s GDP per capita slide out of the top 40 in the world. Heaven help New Zealand.

I’m considering converting to Islam. Being a product of my time it will be strange discarding values of gender equality and subjugating the female(s) in my life. I don’t really feel comfortable with the thought of a 9 year old bride but apparently that is perfect behaviour. Throwing away my upbringing of being tolerant and indifferent to homosexuality will be an adjustment and I’m wondering if refusing to murder people for being gay will cause any ripples in the new religion of peace community I will join.

Can anyone advise on how best to manage discarding 21st century values as I roll my social and family values back approximately 1,600 years.

Surely there are many females reading this blog that can assure me they will treat me with the respect my gender demands once I start treating them as second class citizens.

Are we missing the bigger picture with our educational performance?
Is too much time having to be devoted to ‘problems’ since the introduction of ‘To-morrow’s Schools.’
Has the ‘rights’ of the student/pupil meant a system that is scared to take action, and when it does the action is ‘watered down’.
An example I have discussed with a kindergarten teacher is a pupil who accused a teacher of hitting them. Fortunately, there were several witnesses of the incident but the handling was complicated by OT association. Extra time spent handling what was a relatively common occurrence.
One on one actions are no longer possible with some pupils, witnesses are necessary and it means time, recording and costs.
Does all this mean much least teaching time because of administration add-ons.

DePerno explained that when ballots are put through the machine, a whopping 68.05% error rate means that 68.05% of the ballots are sent for bulk adjudication, which means they collect the ballots in a folder and ship them somewhere else where they can be manipulated).

    What a crock. Of course they are going to lie and say that. What’s true is that in Michigan the security records for the software, year 2020 are missing, as are the adjudication files, and the internet connection records. And the software was changed within the 90 day Safe Harbor law. All of this is illegal under Michigan State law. The Secretary of State of Michigan directed the county clerks on December 1st 2020, throughout Michigan, to delete all electronic voting records – again, totally against the law. They have the records for the 2018 election, and the 2016 election, but 2020 has been deleted.
    
    Now why do you think that is? You’d have to be totally stupid to believe all the records are gone and they everything was on the up-and up…

As an Oceana Gold shareholder was good to see Delahunty and her Green mates squealing at getting ordered to pay 79 grand in costs after their high court action failed. If they don’t pay should see a bond required before any court action is started.

But is it the case that a cruddy piece of land near Auckland airport has been purchased from Fletchers by the taxpayers when Fletchers was going to turn it into housing and the Government is now going to turn it into housing only not very quickly as their track record in Kiwi-Build would show? Some green Labour MP says it’s a good idea because her Daddy told her fairytales about it when she was Little. Egads.
