For the seven days before Duwayne Pailegutu died, he was kept inside his mother and stepfather’s small flat in Nelson – so no one could see he had been beaten so badly he was paralysed, incontinent, and slowly suffocating on his own blood.

The left side of his body was disabled after repeated blows to the right side of his head which caused a stroke, and he struggled to eat or drink.

In addition to the haemorrhage, an autopsy found at least 10 deep bruises to his scalp – some of them inflicted by the shoes of his stepfather as the little boy cowered in the corner of his Fergusson St bedroom.

A further 75 bruises were found over the rest of his small body. …

And for the six weeks before his death on July 2 last year, Duwayne had been living with three broken ribs.

Words again fail me, that I share a species with the person who did this.

    There is a biological aspect, there is a biological impulse in the male to kill the offspring of other males. Civilisation overcomes this in most, but not all cases. Recent research in to the shape and size of the human penis (far larger than other primates) is that the head is designed so it can scoop out the semen left by a previous male.

    There is a guy in New Zealand, he lived on the Kapiti coast. Ian Lee Mutton was his name. He was a good guy. Father, husband, two little kiddies, and he was a good sportsman, and he worked and he liked a wee drink and having fun. And his business was, and he worked hard at it, was putting in air conditioning units in new office towers. And he had a dream, he dreamt that rather than working for other people he could go out into business on his own. And he did that. And he was good at the work, but he was a lousy businessman. He quoted too low, some of his people didn’t pay, and the costs got out of control. But he persevered and he learnt. He got to the end of one year 1992, and he owed $6,000 terminal tax.

    No big deal, knew he owed it, was going to pay it. He then had an accident off a ladder at work and broke his ankle and couldn’t work. He had been assessed for this tax, and the demands kept coming. His ACC, such as it is for self-employed didn’t come, even though he had been paying it all these years. So he and his family were suffering no end. Here he was hobbling around on crutches. He went repeatedly to the IRD with his wife saying, “Look, I can’t pay this”. They wouldn’t listen to him. He had to pay, they’re the rules. He says, “I’m not working”, doesn’t matter.

    He gets back to work, someone smashes his utility up and he has to spend more money so he can keep working. He pays his tax that year, he pays his tax the next year, he pays in his next year more tax than he has ever paid in his life as a percentage. And he gets to the end of that year, and he owes more than he did at the start. Because the penalties and the interest are just overwhelming him. His accountant and his business manager go in to see the IRD begging them to give this guy some relief. He’s working hard, here’s all his accounts, give him some relief. They wouldn’t.

    His marriage split up, his wife couldn’t take the pressure. He was behaving strangely, the pressure was huge on him. That bills were just being generated by that horrible computer that the IRD has and they would be arriving at his house in envelopes and in the finish, he couldn’t even open them, he just threw them in the bin. In his final year, he went on booze a bit. He didn’t pay any tax, so it mounted, and the debt got to $45,000. He then snapped out of it, he stopped the drinking, he got back with his wife, he realised that he had to make his business go bankrupt, stop his dreams, stop his aspirations. And he got a job working in Queenstown, putting in air conditioning units working for someone else. All he had in the world at that point was a utility worth $5,000 and $1,100 worth of tools.

    On the day that he was to leave to Queenstown to take up his new job, the IRD turned up. They wanted the ute, and the tools, to offset the debt. They were going to take the very means that he had to make a living. He drove the utility up to the Otaki Gorge and killed himself. He penned before he died a message to the IRD, saying that “you are responsible for this, that you have taken everything that I ever had, that I now leave this world like I came into it, with nothing, but that I beat you, because you no longer going to get any more out of me,” and he signed, the last thing he did on earth, was to sign
    that note, “one happy man”.

    The IRD got that note, they turned up at the widow’s house wanting the ute and the tools. She then, ladies and gentlemen, goes outside and stands on the porch and sees her twelve-year-old son hanging dead from the tree. He couldn’t take his father’s death. The IRD have never apologised, never said they have done wrong.

    Who in politics is actually getting to the real heart of this matter, which is the fact that almost every one of us could build up a list of risk factors.

    There seems to be no recognition of the simple fact that these events are preventable merely by changing our politically correct orientation.

    Directing all the relevant state agencies to proactively cooperate and share all relevant information is the first part of the answer. The second part is to direct all relevant state agencies to assume the worst case scenario in any family unit that has been identified. The third part is to require, not permit but require, all relevant state agencies to intervene with the most vigorous and proactive possible response and with the utmost alacrity. The fourth part of the answer is to silence or ignore the hand-wringing fuckheads that munt and moan about how tewwible parts 1-3 are. You could do this by painting them as supporting violence against children in exactly the same way that they themselves have painted the critics of anti-smacking. The fifth and most critical part of the answer is to make all the line managers of all relevant agencies directly accountable such that if a single case like this surfaces in future, every one of them will be summarily dismissed, immediately and without redundancy compensation. The sixth part is amending/enacting relevant legislation to facilitate parts 1-5 because if this continues to be treated as a mere operational matter without statutory authority and obligation, it’s quite clear that it will continue to happen.

    We all know the risk factors as I said. In other words, the answer is clear and present. Preventing this is therefore a matter of political will, nothing more.

    However The New Zeal Parliament (by an overwhelming majority) ,The NZ Society of Pediatricians and various groups working with Kid(Barnadoes as an example) all agree with the repeal of section 52
    You were allowed to hit your kid but not your dog . Noone can seriously think that was a good state of affairs

    So what do we do to ensure the tragedy of Duwayne Pailegutu is not repeated ?
    I am pretty sure that capital punishment or locking up and throwing away the key is not the answer

    We have to have a good idea of why parents behave like this and use this knowledge to try and ensure it doesn’t happen again.
    So any positive ideas out there ?

    Doing a detailed psychological profile on every one of these bastards that has committed these crimes would be a useful start. Guess what they’d turn up? Low education; angry attitude; self-centred; abusive background; emotional immaturity and victim-mentality (it’s not my fault). Ethnicity would no doubt feature as a correlation, given the cases to date, as would socio-economic circumstance but don’t be fooled into thinking that either of those are causal factors because most Maori don’t do this and nor do most poor people.

    All it takes then is a bit of common sense and unfortunately, lefties have proven they lack this by their obdurate insistence that it’s all about eliminating poverty. No doubt the next revelation is that a neighbour, friend, family member or passer-by suspected something was up and did nothing.

    John 11:33 When Jesus saw her weeping, and the Jews who had come along with her also weeping, he was deeply moved in spirit and troubled. 34 “Where have you laid him?” he asked.
    “Come and see, Lord,” they replied.
    JN 11:35 Jesus wept.

    But yes I think Jesus does care about all the little children. The appropriate bible reference would be- Matthew 18 starting at verse 1-

    1. Change drug policy to one of harm minimisation. That would see marijuana treated more liberally than alcohol, for example.

    2. Eliminate the tax concessions given to religious bodies, thus allowing the rest of us to get a decent tax cut when we no longer have to subsidise parasitical religions.

    3. Prohibit any form of religious instruction to anyone below the age of 16. This will aid in the development of critical thinking and empathy.

    4. Permit abortion on demand and prosecute anyone who attempts to prevent an abortion or who villifies or in any way makes a woman who has had an abortion feel guilt. More abortions without guilt = less abused children.

    I heard a woman call talkback in the early hours of the morning and claim the wife who received three year was the victim of battered women’s syndrome and should receive psychiatric help and instead of jail. The woman claimed to be a psychologist working for DHB. If true my taxes pay her wages. Just like my taxes pay for the Commissioner of Families and the Commissioner of Children. Neither of them have come out and condemned this pitiful excuse for a mother. The stepfather has been thoroughly condemned and rightfully so. No one is making excuses for him. If this mother gets off without jail time what message does this send to other mothers in similar circumstances?

    Mara, that is exactly the message it will send. She is lucky she just got three years. I hope if she appeals that she gets extra time added on. I understand she is pregnant again. If she gets custody of that child and something happens to time or her who will accept responsibility? Not the Commissioner for saying nothing about gross neglect that cost a child his life but dribbling on about reasonable parental physical discipline
