Oh what a surprise. First it is a speedway that has been operating for three quarters of a century, next it is an invasion of your property rights and now it is a business that has been run for a decade. What will be the next casualty of this draconian law? Something must be done, preferably a change in government.

At least the pretty pebbles on the Marlborough Sounds beaches will be preserved – that’ll please the luddites who campaigned for the speed limit. Next stop for the ferries might very well be Cloudy Bay. Then we’ll see what the RMA toting twits say when the tourism dies and their jobs disappear.

That ferry wake is nasty, both to people in the sounds and to the sounds themselves. I’m bloody glad it’s been slowed in the sounds. Would you guys prefer the alternative of anyone being able to plow through the Sounds at any speed they like?

If people want to get from the SI to the NI quickly they fly, a ferry is not a time crucial operation, and being held to a speed slow enough to protect the marlborough sounds shoreline is as reasonable as preventing someone from starting a landfill site on the hill above your house.

They will cut off their noses to spite their faces. Surely, this will accelerate development of an alternative to the Sounds ferry terminals, along with the massive commercial losses to Marlborough. But too bad for them, because the sooner they do move, the better for all.

Out of interest, what does the right of NZ politics plan to replace the RMA with? No development controls? Or discretion to local councils?

BTW – does anyone know the political affiliations of Queenstown Council – I’d lay bets they aren’t of the left..

Personally I’d love to see the ferrys go to Whites Bay. Much more practical for travellers, and the Marlborough sounds would be free to develop as a purely tourist destination, with a peak season passenger ferry from Wellington ( going slowly 😉

The alternative would be to dynamite the tory channel straighter to save another 30 minutes. After all its how fast the ferry can cross that’s important, who gives a fuck about a few pebbles and trees eh?

Hang on – you people are mad. How is a law passed in 1991 responsible for things which are being suddenly enforced *now*?

Councils create bylaws and both this issue and the Queenstown accommodation issue are caused by bylaws that the Councils concerned have passed.

*Any* planning framework would leave the local TLA with the ability to make those decisions, unless you want to see a vast centralisation of power over local govt in Wellington, with the Minister dictating what each council can and cannot do.

Stop pointing at the wrong problem, David. The TLA in Marlborough is (from memory) as Tory as the day is long. If you are unhappy with their decisions, why don’t you talk to them about it?

Hang on, isn’t this a good case of the RMA working well?

It’s stopping one company selfishly destroying public held property for its own gain.

Or should anyone be able to cruise through the Marlborough sounds at any speed they like, no matter what the damage to both the environment and other users?

When they have been operating at that speed legally for the last ten years, yes they should be able to continue without the RMA allowing the rules to be changed retrospectively changing their resource consent.

I too am left wondering what the big deal is.

Changes in socity’s values and expectations are routinely reflected in rule changes that alter the business landscape. There’s a long list of industries that were legitimate for ten years or more, but which were subsequently regulated when their negative effects became apparent: asbestos, cigarettes, pesticides…

This is just another example, and the RMA is simply the enabling regulation. If this wasn’t being fought in the RMA arena, it would be fought elsewhere, under some other framework.

It takes time to use a legal system to enact change. Always has. Evidence gathered etc etc. If the change was done in 10 months you’d be complaining it was rushed.

The last refuge for those who have no argument is to claim merely that the other’s comparison (which was not indeed a comparison, but an example) is a long bow, rather than argue for why their view is accurate.
