A day or two late, but instead of screwing about nit-picking with the OIA to ‘out’ that $ 6000 was spent on official cars to facilitate the visit of Warners team, why not for once try and establish exactly how much the taxpayer is actually paying towards the two HOBBIT movies as apposed to what is tax allowances: either tax forfeitable, or tax paid in then refunded – ie: a supposed loss to taxpayers, but not a liability?

This is partly relevant today as Aussies spend $ 5 million to get Oprah to record two programmes there for a supposed benefit of $ 25 million in tourism.

Two points from the self-sought receivership of Pike River Coal that is going to be as big an economic blow to the West Coast as the the mine disaster was in terms of loss of life. Not only the poor bloody miners but small, medium and big suppliers will be hammered.

First, Pike River’s keystone shareholder, NZ Oil & Gas, stands to benefit most from the receivership. It’s stake is protected. Mines Minister Gerry Brownlee, who has repeatedly touted mining as a saving industry for NZ, can bring pressure on NZ Oil & Gas. NZOG’s main assets are stakes in NZ’s small oil resources. It is an active explorer. To succeed in this it needs State approval and co-operation. Key and Brownlee have the power to twist NZOG’s balls to get a decent deal for Coasters.

Second, the Pike River receivership again highlights the inordinate power of receivers in NZ. The big creditor is usually the one who appoints the receiver, and they look after that creditor. NZOG,as a key shareholder, morally should not be in a position of power to appoint the receiver. Another instance of this is the Crafar farms receivership, where the big receivers, probably appointed by bankers, are making a decision on farmland which affects the national interest.

Our receivership process needs reform, IMHO.

As for Coasters, they can but sadly reflect, it’s no Christmas without Scrooge.

Section 22 of the Tax Administration Act 1994 (“TAA”) requires a person who carries on any business or any other activity for the purpose of deriving assessable income in New Zealand, to keep sufficient records in New Zealand, in the English language, to enable the Commissioner to readily ascertain information about their tax affairs…

It is the Commissioner’s view that only business records stored in data centres physically located in New Zealand will comply with the record keeping obligations in the Inland Revenue Acts. Taxpayers are responsible for ensuring they comply with their record keeping obligations. Therefore, taxpayers using a cloud computing service will need to be satisfied that all their business records will be stored in data centres located in New Zealand.

The failure to keep the books and documents in New Zealand as required by the Inland Revenue Acts is an absolute offence under section 143 of the TAA. A person convicted of this offence is liable to a fine.

So its fine to keep paper based records in a shoebox in your basement, but if you put your accounting data in a secure, backed up facility located in Singapore with 24 x 7 access from anywhere in the world, then you are in breach? I think the 1994 act this stems from needs updating. I’m sure Xero and MYOB online would agree.

Well at one level anyhow, but yes, thankful for that decision, even if it is only one step on the way to a Supreme Court decision (assuming the GOP does not defund the damned thing sooner).

I have to say that I was (and still am) very concerned about this use of the Commerce Clause in the Constitution, less for what it meant in stopping Obamacare, than for what it meant across the board between government and the individual.

In rejecting the government’s argument that it has the power under the Constitution to require individuals to buy health insurance, a provision that will start in 2014, Judge Hudson really has hit the nail on the head with this comment:

“Of course, the same reasoning could apply to transportation, housing or nutritional decisions,”
…
“This broad definition of the economic activity subject to congressional regulation lacks logical limitation” and is unsupported by previous legal cases around the Commerce Clause of the Constitution.

Let’s hope the Supreme Court sees it the same way, otherwise it will be open season on individuals choices.

Why outsource our tax data storage to Asia? If online storage in NZ is overpriced, start a new storage site and undercut the gougers.

I just read a fascinating article on Istanbul by Claire Berlinksi, an American journalist who lives there. She refers to it as a Wiemar City. The article is in City Journal

She makes the point that while it’s not the same situation as Germany between the wars, there are certainly a hell of a lot of eerie parallels, in terms of the wildness and craziness, between Instanbul now and Berlin in the 1920’s. Sounds like a great place to live – while it lasts:

The historian Eric Hobsbawm recalled his return from the dying Weimar Republic thus:

“ ‘Imagine yourselves,’ I told my fellow Old Philologians, ‘as a newspaper correspondent based in Manhattan and transferred by your editor to Omaha, Nebraska. That’s how I felt when I came to England after almost two years in the unbelievably exciting, sophisticated, intellectually and politically explosive Berlin of the Weimar Republic. The place was a terrible letdown.’ ”

I am often asked why I stay in Istanbul. Often, I ask myself. But in the end, isn’t it obvious? After this, anyplace else would bore me senseless. What curious student of history could resist the chance to see something like this with her own eyes?

Who wouldn’t want to know what will happen next?

The U.S.’s Weak Legal Case Against WikiLeaks

Efforts in either direction will likely run into the same obstacle: The First Amendment. Thanks to nearly a century of cases dealing with the clash between national security and the freedom of the press, the Constitution provides enormous protection for publishers of state secrets. Those who leak the secrets in the first place — government officials, even soldiers, for instance — can and are prosecuted, such as Army private, Bradley Manning, now sitting in a military prison after having been charged with illegally downloading secret files amid suspicions that he gave them to WikiLeaks.

Putting someone like Assange in jail for publishing documents he did not himself steal, on the other hand, is exactly the kind of thing that First Amendment makes difficult. “From everything we’ve seen, Manning was merely responding to the notion that Assange might publish the cables,” said former CIA inspector general Frederick P. Hitz. “There’s nothing to show that Assange played an active role in obtaining the information.” He conceded that the leaks had been tremendously damaging, but added “I don’t see any easy effort there” in pursuing charges.

In a widely cited concurrence, Justice Potter Stewart’s conclusion (1971) that it’s the President’s responsibility, not the press’s, to keep secret the nation’s secrets — and to be judicious in deciding which are secrets worth keeping — could easily apply today.

PM Key has warned of a budget blowout with the cash deficit at the outer limit of what the govt regards as acceptable

There will be only one colour when the government’s books are opened today – red.

Prime Minister John Key has warned of a budget blowout with the cash deficit “at the outer limit of what we regard as acceptable.”

At his last post-Cabinet press conference for 2010, Mr Key said economic growth this year would be slightly lower than the forecast 3.1 percent. The May Budget forecast a cash deficit of $13.3 billion would fall to $9.7 billion in 2012 then $7.5 billion and $6 billion by the end of the 2014 year.

Mr Key said the new deficit forecast would be “a significant number”. Analysts expect a deficit of up to $15 billion as the government continues to borrow around $1 billion a month to take the sharp edge off the recession. Paying back the borrowed money will be one of the biggest challenges for the government.

Mr Key said there have been a number of factors beyond the government’s control in the past six months, particularly the Canterbury earthquake and subdued domestic recovery. The tax take is down due to people saving more and spending and borrowing less. He said the government plans to return the books to surplus as fast as possible

The economy has been growing for more than a year and the unemployment rate is 6.5 percent, around two percent under the OECD average. New Zealand’s trading partners, particularly Australia and China are relatively strong, which will help New Zealand.

As he reveals the numbers today, Finance Minister, Bill English, will also release the Government’s investment statement, which will show how well or poorly the state’s assets are managed

After the “Obama Tax Cuts” debate the other day I thought the following NYT article might prove of interest to our left-wing citizens:

How much money makes you ‘rich’?

Not that it will change their minds but it’s not surprising to me to see that a combined family income of $US310,000 per year in NYT makes a nonsense of threshold arguments within a progressive tax system. Still, it’s good to see that hairdressers are the 21st century’s robber barrons (and at $150 per haircut, I can see the argument to be made there….).

Jack5, also check out this short 2 min video about Christian boys who are kidnapped and forced to learn the Koran. They are beaten if they do not do well enough, or if they are caught playing – “playing is harmful”, says one of the teachers, as it takes them away from their studies. “Anyone who misbehaves, he is whipped, so that he doesn’t play any more”.

Rodney isn’t the Mayor, Len is. The same Len who campaigned on keeping rates rises in line with inflation. Not, “in line with inflation after the first year because we will have transition costs.” There is always an excuse.

I know a good way they could start saving money, how about not taking the pay rise they just got a after a month in the job????

I know Len Brown is part of the problem with rates levels in Auckland. But Hide will have known anyone could be elected to the mayoralty and the council.

The present Auckland councils’ combined operating budget is $2,000 million, and I am confident that the structure will ensure better value from rates and central government funding by reducing duplication and delays in previously intractable problems such as transport issues. Services such as administration, office systems, finance, human resources, and information technology will be integrated and streamlined. Each council now operates its own systems, so there are real savings to be made. Unified decision-making, better transport and infrastructure, and more efficient delivery of services will all contribute to a great Auckland region where people will want to live and do business.

The grand plan was always going to be a grand risk.

Pete George at 11.58 likens to education by the nuns the kidnapping of Christian Sudanese kids, with flogging and chains on ankles (as in the video pointed to in Fletch’s 11.46 post).

Also in the clip that Pete George refers to are reports of these little kids being forced to write Islamic texts on boards, then wash this off and drink the wash. The video also tells of Christian girls aged nine being repeatedly raped.

By likening this brutality to early-day education of nuns, Pete George, whether he intended this or not, could be viewed as covertly defending these Islamic fundamentalist outrages.

Not good, Mr George. Not good at all.

Where did nuns keep kids in chains? Where did they kidnap kids and hold them in a Catholic version of madrasas?

Magdalene asylums

In May 2009, the Commission to Inquire into Child Abuse released a 2000 page report recording claims from hundreds of Irish residents that they were physically, sexually or emotionally abused as children between the 1930s and the 1990s in a network of state administered and church-run residential schools meant to care for the poor, the vulnerable and the unwanted. The alleged abuse was by nuns, priests and non-clerical staff and helpers.The allegations of abuse cover many Catholic and State run Irish Industrial schools, including the Magdalene asylums.

The last Magdalene asylum in the Republic of Ireland closed on September 25, 1996.

I was referring to what Fletch posted (I don’t often click through to video links and didn’t watch that one at all). Terrible things have been done to kids all over the world, to Christians and by Christians (and other religions).

The Pike River mine disaster is a huge tragedy, especially for the families of the lost men. The receivership announced yesterday was unfortunately inevitable given the financial circumstances the company was facing. No company can put itself in receivership – only a secured creditor can do that. Pike River Coal Ltd therefore asked NZOG to arrange the receivership.
It should be remembered that after the explosion on 19th November, NZOG loaned Pike $12m, to give it the financial breathing space to concentrate on the rescue efforts. That money is now in the hands of the receivers.
In total NZOG as a debt holder is owed around $64m and as a shareholder it has contributed around $82m. So NZOG’s 15,000 shareholders – most of them kiwi mum and dad investors – have seen almost $150m invested in Pike – with no guarantee that any of that will be recovered. The impact of this disaster extends far and wide.

I agree, Manolo. The miners who can move will find work in the Australian mines, and I hope the few South African miners can, too, or else find work here. What a lousy Christmas for the West Coast.

What will Gerry Brownlee, the Minister of Mining Dreams, do for miners if the Chinese coal demand continues and new mines open on the Coast? Bring in 10,000 Chinese miners?

A question in my mind is why did keystone shareholder NZ Oil & Gas pull the plug on its subsidiary, Pike River, before redundancy was settled.? The company will probably say the receivership was requested by Pike River, but NZ Oil & Gas has always had the power in Pike River. It started Pike River, and floated it on the stock exchange.

This is a classic fudge defence, similar to the one used by pro-tour folk in the unrest about rugby contacts with South Africa: others are racist, too.

In your 11.46 post (not 11.58 as I said earlier) you diverted discussion of Sudanese militant-Islam brutality against Christian boys to Irish nuns brutality against Irish kids. This is the same diversionary defence.

Given your repeated defence of ultra-Islam over months the reasonable conclusion must be you are a defender of Islamic funamentalist extremist abuse.

If not please say so categorically, without widening it to other religions or peoples.

Fletch didn’t mention the Sudanese, so I wasn’t diverting from that, I was unaware – I was responding to Fletch’s comments. How he described it was no worse than what happened in the Magdalene Laundries.

I have never defended Islam, nor “ultra-Islam”, I don’t like or agree with Islam. I think it’s worse than Christianity as a religion and at least as bad as Christianity has been for abuse.

I have been repeatedly anti brutality against any kids here. If I get a chance and an inclination to watch the video I may comment on it then. In the meantime, don’t try to construct accusations out of nothing.

Why are you so touchy about the Magdalene Laundries?

RB. the answer is yes. You are correct.

At the risk of upsetting our host, I find DPF is afraid to criticise National in any strong terms (at times he’s “pissed off”, but nothing more).

Our host is a Wellington insider who knows perfectly how to navigate the system. This makes him a perfect attacker of Labour policies (thanks for that!), but also clouds his opinion on matters related to the National Party.

Let me offer an example, where is the analysis of the today’s deficit announcement? What about a critique of Smith and Groser signing to the U.N. Global Fund? Do we know? What about disecting election promises not delivered?

I did not realise that I am an old civil libertarian at heart.
I’ve just read the Tax Dept’s latest Business Tax Update.
Once upon a time if a wog said he had a work permit, you could employ him. He had his rights and the employer had his rights. The wog had a right to privacy and his word was deemed to be his bond.
Not any longer.
If the wog says he has a permit to work, the employer MUST check up on VisaView with the Dept of Labour. That is, the wog’s privacy is infringed. I do not like that. But, with a big increase in immigrants who will never ever possess that basic Kiwi attitude of give a bloke a fair go; we all lose some of our privacy.
VisaView will be extended to passport validation for all employers. Whether or not I have a passport is no damned business of any employer.
I haven’t been an employee since 1977 but I can see something nasty here.

All the big fuel companies have increased fuel prices today.

BP, Shell and Caltex have raised the price of petrol by three cents a litre taking 91 to $1.95 and 95 to $2.02.

Diesel prices have increased by two cents at Caltex taking it to $1.30 and by four cents at Shell taking the price to $1.32

He managed to fix the mess in Bosnia, pulling together a 20-day negotiating session that became known as the Dayton, Accord and divided the country into a Muslim-Croat Federation and a Serbian Republic, bringing about a lasting peace.

Note for political trivia gatherers: As the Wikileaks controversy swirls around us, Holbrooke actually wrote one volume of what became known as the “Pentagon Papers”.

Holbrooke was Obama’s best hope for sorting out Afghanistan, so expect things to go even further downhill there…

If employers are not capable of payimg competitive wages in NZ why the fuck are they in business ?

The question is who is the competition in the wages stakes. The guy down the road? The fellow’s in Aussie or the Chinaman that makes stuff at 20% of the price in NZ because he works for wages that Kiwi’s earned in about 1840.
NZ actually moved on after we controlled the savages but it seems they want to return to that wage rate.
I actually struggle with the stupidity of importing so much at Chinese Labour rates just to keep Kiwi’ s in Welfare that we don’t need and can’t pay for.

Todays example. Rail wagons, to be made in China because Kiwi workers don’t or cannot afford to work at Chinese wage rates.
So GOH how are ya gunna fix that?

Happening to engineering all through NZ and will move onto other things as well. Won’t be long and the Chinese will know more about cows and milk then we do and then what you going to do. Retire on a pension that won’t be there?
Don’t apply much thought do we.

Can we expect Adolf to stand up and show his true colours and support what Brash, Douglas and ACT have been saying for the last six years? This post looks like his first tentative steps towards finding salvation.

It’s What You Spend That Sends You Broke
Today’s economic figures released by Blenglish will at last bring home to New Zealanders the raw truth that they can’t keep on spending that which they don’t have.

While the idiots at The Standard bleat on about tax cuts for the rich being the cause of it all (presumably because they think you can raise an extra billion or three by taxing out of existance the top five percent of the country’s earners) the truth is New Zealanders are being carefully conditioned to accept the politically charged inevitable. The rolling back of Helen Clark’s outrageously irresponsible election bribes of 2005 and 2008.

Adolf looks forward to the day when;

* no longer will a family with a household salary income of $35,000 be able to draw down $911 per week in welfare disguised as ‘tax credits.’
* no longer will the children of well off New Zealanders be able to borrow money and pay no interest.
* no longer will New Zealanders pay for myriads of government ‘commissions’ which write meaningless reports for other meaningless people to read.
* no longer will New Zealanders pay life time loafers to sit on their fat, mainly black arses, breeding generations of kids whose one aim in life is to sit on their own fat arses while someone else feeds them.

Have a look at the fate of New Zealand’s rich listers of just ten years ago. Most of them were property developers or finance company directors. Most of them are bankrupt or about to be bankrupt.

Why, because they were addicted to spending.

It is time for John Key and Blenglish to blow the whistle on government spending. Preparations have been underway for some time. The report of the working group on welfare should be accelerated and a list of SOEs to be made the subject of a partial minority float should be put out for public discussion.

Let’s face it, even Hillary Calvert’s ping pong ball receptacle came out the other day in support of partial floats for SOEs.

Grumpyoldhori asked when was a foreigner’s word his bond. Well, Grumpy, I have employed Iraqis, Indians, Zimbabweans, South Africans and poms. I found all of them much more believable than I have found your mokopuna. Grumpy should consider shifting to an area just north of Marton called Tutaenui. For that is what he is.

Viking what they should have been doing since they first realised how parlous this current state of affairs is: i.e. since the first week they were elected was to:
a) trust the even the reef-fish aren’t morons and give them information and trust them with it
b) stick to their election promises
c) vigorously non-stop 24/7/365 blame Liarbore for it using the entire machinery of govt

If we were now in year two of them having been doing that for 2 years now:
a) the reef-fish would have long ago gotten over their shock that apparently, Hulun wasn’t the greatest PM ever
b) the reef-fish would know it was her fault the economy is totally fucked
c) Key would not be quite as popular as he is but still would be secure in leadership

It’s called spending political capital and so far Key hasn’t spent any and its not good for the country. The longer he takes before adopting this strategy the more his political capital evaporates which it has already started amongst his own supporters.

As usual the reef-fish are the last to catch on but as like real reef-fish, they are very flighty and once they do catch on, it’s very swift. And sometime after 2011 they will realise, eventually, that Smile and Wave had no clothes, after all, and then it’s too late. It’s frankly IMO almost already too late because he’s almost already established his groove and once he does that if he shifts out of it, the shift causes cognitive dissonance.

Politics is like a relationship, you need to start as you intend to continue in it. Key is almost but not quite history. He has about twelve more months, until he’s toast, if he doesn’t change.

reid, when petrol has gone up to 2.00 per litre, it will hasten Key’s demise. The ETS and gst hikes are one major reason why petrol is this high. John Key even admitted before he was elected that if they raise gst, they are doing something wrong. The emporer is doing a good job in covering himself up, but for how long?
