Any news here in NZ about all the trouble on the streets of K.L.? A mass rally against the corrupt , despicable rulers lead to the arrest of the various leaders , tear gas and water cannons. They are very brave. Malaysia has the I.S.A. law which means people can be held without trial indefinitly. The longest time i have heard of anyone being held under this law was 32 years. Of course , he was a Chinese man. This law is a legacy of the British , but the UMNO crowd could have repealed it at any time and have not done so. No mention of human rights when NZ was rushing to sign a free trade agreement with these mongrels.

You wanted to argue that Maori didn’t own NZ in 1840. so far as I’m aware, about the last people to advance that were the NZ Company with there purported purchases in the 1840s. Even then, the British government were prepared to recognise sovereignty where it lay.

Is your argument that as Maori ‘ownership’ could be based on conquest that it was invalid? Do you really believe that there is a viable compensation claim for incidents during the musket wars? Should tribes who conquered in Auckland, Wellington, the Chathams, wherever be now held responsible? Is this relevant at all to present-day relationships? The iwi concerned don’t appear to think so, barring some argument about the extent of rohe in various areas.

Did warfare between tribes invalidate claims of ownership?

Sounds a bit like the old myth that because Maori displaced Moriori then they should yield in turn to the superior Europeans.

I wouldn’t have thought I’d see SOLO advocating for dispossession of property.

If there is compensation for what happened from 1840 onwards, then whyever shouldn’t there be compensation for incidents during the musket wars, which happened just a few years earlier?

Basically, what you’re saying is this. The Maori 1 who displaced Maori 2 gained ownership and need not compensate Maori 2. But where Pakeha displaced Maori 1…OH NO! Compensation must be paid.

And that is before any consideration of the disgrace to humanity that was what Maori 1 did to Maori 2 during the process. Thankfully, Pakeha came in and halted that part of everyday life for Maori. But are still paying compensation for so doing.

You want crap, look at the pufficanes. Bitch about no love when the contract is sitting on the managers desk – and read about the others (Gear, Jane etc). They have been offered deals and have not responded for their own personal reasons but still allowed the perception that they were being ignored to fester. The Crusaders didnt have it last night but if you are talking folding under pressure look at their record. Maybe if some of the other teams pulled their weight then NZ would be a bloody sight better off.

The British government recognised Maori sovereignty in 1840 and instituted a system for purchasing land from the Maori owners. Are we clear on that?

Prior to 1840, Maori ‘regulated’ land ownerships through mechanisms of their own choice, including warfare. After 1840, the situation was a recognised by the Crown, those in possession of the land were considered the owners. No one has ever suggested a return to a pre-1840 situation. Where would one set the starting point? 1830? 1810? 1769?

NZ rugby has had a long record of failure when there are Cantabs in positions of power, we can go back to the embarrassing days of Blackadder and Thorne to see the start of this inability to deal with pressure, McCheat is simply continuing the legacy.

Growing persecution and arrests of Christians in both countries, so these KL protests for reform are welcome. Same pressures for sharia law and radical Islamisation now confront Indo. as it is other nations. Malaysia quite challenged on this, as has been historically secular and moderate, but Islam is polarising governments and populaces. Ideological civil war.

Mike, obviously you haven’t read Peter Creswell’s article in full to fully grasp his argument?

They only owned what they were currently occupying at the time recognized by British common law at the time and that explained what you’ve just stated above. But there was no common law recognized in this country before the British arrived, because it was the law of the jungle here at the time. The reason the British settlers purchased land here was because they already had 600 years of common law in place. They could have just cruised along here and shoot everybody and grabbed their land, but they didn’t, because they abode by their own standard, the civilized common law that they brought here. That’s why they purchased, instead of land grab by shooting. They could have done the easy option of land grab by shooting since it was the norm of the day. There was no chance at all that Maoris would have resisted.

Mike, may I suggest that you educate your self (just any topics) because I find your arguments here on this blog, not sharp at all. Either philosophically, intellectual level or even facts. Educate yourself because it will make your debating very formidable. Its hard to convey a point to you in a debate, because your understanding of issues is really empty and don’t be insult by this, because I’m pointing out a fact. Well I have to repeat to you something 100 times and you still don’t get it.

HELL EXPLAINED BY CHEMISTRY STUDENT

The following is an actual question given on a University of Washington chemistry mid term.
The answer by one student was so ‘profound’ that the professor shared it with colleagues, via the Internet, which is, of course, why we now have the pleasure of enjoying it as well :
Bonus Question: Is Hell exothermic (gives off heat) or endothermic (absorbs heat)?
Most of the students wrote proofs of their beliefs using Boyle’s Law (gas cools when it expands and heats when it is compressed) or some variant.
One student, however, wrote the following:
First, we need to know how the mass of Hell is changing in time. So we need to know the rate at which souls are moving into Hell and the rate at which they are leaving. I think that we can safely assume that once a soul gets to Hell, it will not leave. Therefore, no souls are leaving. As for how many souls are entering Hell, let’s look at the different religions that exist in the world today.
Most of these religions state that if you are not a member of their religion, you will go to Hell. Since there is more than one of these religions and since people do not belong to more than one religion, we can project that all souls go to Hell. With birth and death rates as they are, we can expect the number of souls in Hell to increase exponentially. Now, we look at the rate of change of the volume in Hell because Boyle’s Law states that in order for the temperature and pressure in Hell to stay the same, the volume of Hell has to expand proportionately as souls are added.
This gives two possibilities:
1. If Hell is expanding at a slower rate than the rate at which souls enter Hell, then the temperature and pressure in Hell will increase until all Hell breaks loose.
2. If Hell is expanding at a rate faster than the increase of souls in Hell, then the temperature and pressure will drop until Hell freezes over.
So which is it?
If we accept the postulate given to me by Teresa during my Freshman year that, ‘It will be a cold day in Hell before I sleep with you,’ and take into account the fact that I slept with her last night, then number two must be true, and thus I am sure that Hell is exothermic and has already frozen over. The corollary of this theory is that since Hell has frozen over, it follows that it is not accepting any more souls and is therefore, extinct……..leaving only Heaven, thereby proving the existence of a divine being which explains why, last night, Teresa kept shouting ‘Oh my God.’

The British government explicitly recognised Maori sovereignty prior to 1840, which led to it seeking a treaty. As for ‘they could have just cruised along here and shoot everybody and grabbed their land’, well in reality, the British lacked any substantial force to challenge actual Maori sovereignty until 1845, and the results then weren’t too flash.

@IV2: not really ironical when you remember that inconveniences such as laws and such like do not apply to socialists. The PAYE was, after all, their money and they were simply redistributing it without the need of the middleman (ie the government).

Actually Nookin, the PAYE was McCarten’s employees’ money, especially that which had been deducted for Kiwisaver. For McCarten to have retained it and not passed in on to IRD borders on theft. It’s a disgraceful example for a union leader to be setting.

One thing you could clarify. if the union does not stump up, do the employees have to make up the shortfall? I assume that they do.

I’m sure you’ll find that PAYE is paid in good faith by employees (via deductions) and the employer holds it in trust until such time it is due to be paid to the IRD. If the employer reneges on his / her obligations,the employees would not be expected to pay it a second time.

You could probably find this in any standard general history of NZ. But here’s a passage from the 1981 Oxford History talking about Britain’s role before 1840:

‘In October 1837, for example, Busby convened a gathering of thirty-four northern chiefs at Waitangi where they declared their country to be an independent state…the British Government, which had recognized a national flag organized by Busby in 1834, formally accepted its role as parent and protector.’ JMR Owens, p 43.

Or:
‘To do this it was necessary to negotiate a Treaty with the New Zealanders, because the British Government had explicitly disclaimed political rights in New Zealand, and had formally recognized the sovereign independence of the several Maori chiefs.’ J Rutherford, 1947, p 6.

By the way it is very easy to blame British laws for modern oppression. The difference is that under British rule British judges would have applied British standards of justice and I assume there was always a right to appeal all the way to London if necessary (thanks for taking that one Labour).

But in todays’ former colonies the appeal is likely to go to a govt stooge .

British judges and British justice was brutal. They were always great fans of hanging wherever they went and starvation was a favourite too. The ISA law or the Internal Security Act was brought to into deal with the communists who were mainly Chinese. They tried to starve them out of the jungle. But as I said this law could easily have been repealed but their previous dictator was as brutal as the British so kept it for the same reasons , to keep himself in power.

Jane is unlucky but the biggest loser must be Crockett. Few have come close to him this year. Possibility that mobility is the key. Forward pack is big and mobile. Feel sorry for Josevata but I think the game has overtaken him. The modern wing seems to need real gas in a confined space — like the two Reds wings. Ben Smith is in that league. Toeava may not have the gas but he can beat a man. I rate him. Zac is lucky. Has gas but needs to work on change of direction, both ways.

Labour poll disaster

The lates 3News/Reid Research poll has come out and it is a disaster for Labour and this is before the population learned of Labour’s plan to tax then harder.

The results are:

National — up 2.% to $55.1%

Labour — down 2.9% to 29.9%

Greens — up 2.6% to 9.1%

ACT — down 0.5% to 1.7%

Maori — down 0.8% to 0.8%

Mana — up 0.2% to 0.7%

In the preferred Prime Minister stakes John Key has 50.%% and Phil Goff has 6.9%.

Also, cue Labour bleating that the only poll that matters is in November. Being so weak now just makes likely supporters look harder at alternatives.

I think your query was raised when the news first broke re McCarten / his tax issues and one of the posters here suggested that the liability lay with the employer as the PAYE was, in effect held in trust. It seems to be a reasonable position given that the deductions have been made by the employer on behalf of the IRD.

Perhaps a tax specialist / someone who deals in this, could confirm?

I’m no expert, but unpaid PAYE is one of the biggest causes of bankruptcies/company wind ups. Liability definitely remains with the employer. IRD quite rightly take a very strict view on this – if someone can’t pass on the PAYE then they shouldn’t be in business. IRD helps them to get out of business.

PAYE is explicitly defined in the Income Tax Act as “trust monies.”

McCarten stole from his employees, as this money was held in trust, by him, on their behalf. What would he say about that, if he was talking about another employer, say ACT for example, who did the same thing?

The future for builders.

Nice little graph here in this article about Metro Glass. Look at 1974 before and after and then project that to this year and next and the year after. Last years was the lowest number of consents on the graph followed closely by the two tears back. Someone clever than me might like to do a graph with this information and population imposed on it.

My initial thoughts are that next year will see arise especially with CHCH but the year after will see a big leap. And don’t forget Auckland is loosing 700 houses to motorways in the next year or so.

He said Metro GlassTech’s outlook for the rest of the 2011 calendar year wasn’t great but things were looking better for 2012, with the rebuild of Christchurch after the earthquakes and a broader improving building outlook.
“I think the 2012 calendar year is looking really strong,” Ellis said.
The latest Statistics New Zealand figures, for May, show annualised building consents for dwellings and apartments of just 13,917. That’s the lowest May year figure since records began in 1966. It’s also way down on the recent peak of 32,193 in the year to May 2004 and record high of 39,636 in the year to May 1974. See more here.

Over the next year Ellis said 4,000 to 5,000 consents could come out of Christchurch, which would make a big difference.
“20,000 plus (on an annualised basis) could be there very soon which is pretty useful,” he said.
New residential building and commercial work was the bulk of Metro GlassTech’s business but the firm was also getting a fillip from a rapidly growing, albeit small, amount of work fitting retro double glazing.

. What Indian call centres are really like – This piece by Andrew Marantz in Mother Jones is today’s must-read.

It is his account of posing as an Indian call centre worker.

It poses some uncomfortable questions about the outsourcing of services.

It makes you think more than twice about globalisation.

The detail is excruciating and fascinating.

Luckily many of our banks and Telcos have held back from outsourcing so far.

Yellow Pages is in the Philippines, as is Telecom’s broadband. Vodafone used to outsource to Egypt but has since decided to move back.

Is this all a good idea? I used to think it was. It gave New Zealanders cheaper services and increased the wages of those in the third world.

But now I’m beggining to wonder. Perhaps all it does is take jobs off the middle classes in the developed world and create sweat shop jobs in the third world. Multinational companies then pocket the difference as profits on the way through and distribute the money as higher dividends or bonuses to the most senior managers.

Is this sustainable? I wonder.

Two Aussie sheep drovers are sitting in their tent after a hard days work. Because of the size of the property they work on, they are miles from home. In fact, they’re bloody miles from anywhere, totally the back of beyond. They are both enjoying a beer under the shade of the awning of their tent when a man in a pin-striped suit, carrying a small brown briefcase and wearing a bowler hat passes by.

‘Go and see who that bloody clown is, Bruce, he must be lost,’ says the senior of the two.

So Bruce scampers off after the city type gent. After about fifty yards he catches him up.

‘Scuze me mate, are you bleedin’ lost or summat.’

‘Not at all, my man. I am conducting some field work connected with my employment.’ was the haughty reply.

‘You must have a funny kind of job, mate. What do you do for a living?’ said the drover.

‘I am a taxidermist.’

‘No good you being out here then, there’s no taxi’s in the outback.’

‘You don’t understand, I stuff animals for a living.’

The drover is shocked but eventually asks, ‘What sort of animals do you stuff?’

‘Well, I’ve stuffed all sorts in my time, fish, birds, snakes, rabbits, crocodiles and I even stuffed an emu once.’

The drover is now very suspicious,

‘You ever stuffed a sheep?’

‘Why certainly.’

When the sheep-man eventually returns to the tent his mate asks,

‘Well, who was that bloody Charlie?’

‘Nobody special,’ was the reply, ‘Just another drover.’

To put the War on Terror’s cost in context, according to the Congressional Budget Office, the total cost of World War II, adjusted for inflation, was $4.1 trillion.

But those who ploughed on to the centre spread found a nicely-timed reminder of the unholy trinity at work. “On Thursday,” ran the taster for the Sun’s 16th Police Bravery Awards, “Prime Minister David Cameron will welcome the 59 nominees to Number 10 before a glittering awards ceremony at The Savoy.” Glittering indeed.
