Snowden stuck up in Moscow, Ecuadorian president says .Ecuadorian President Rafael Correa says US surveillance whistleblower Edward Snowden is stuck up in a Moscow airport and cannot leave the country since he does not have a passport.

Correa made the remarks during an interview with The Associated Press on Sunday in Portoviejo, the Pacific coast city of Ecuador, diminishing possibility that the man, who fled the United States this month before leaking documents on secret US spy programs, will arrive in Ecuador soon.

“He doesn’t have a passport. I don’t know the Russian laws, I don’t know if he can leave the airport, but I understand that he can’t. At this moment he’s under the care of the Russian authorities. If he arrives at an Ecuadorean Embassy we’ll analyze his request for asylum,” the Ecuadorean president stated.

MAX SAYS. What’s the hold-up? Snowden does not have a passport? Did someone take it away from his physically? If not, then he is free to travel anywhere if the current and destination countries allow him to. The US may have invalidated his passport but it is still genuine and can be used. It’s up to Russia and Ecuador whether he travels or not. US does not have anything to say about it.

No Right Turn thinks that Heads must roll in Parliamentary Services.

The Greens are calling the spying illegal, and have called in the Ombudsman. But I’d go beyond that: this is a clear breach of Parliamentary Privilege. Standing Order 406 states that

The House may treat as a contempt any act or omission which—
(a) obstructs or impedes the House in the performance of its functions, or
(b) obstructs or impedes any member or officer of the House in the discharge of the member’s or officer’s duty, or
(c) has a tendency, directly or indirectly, to produce such a result.

Spying on members and tracking who they communicate with clearly impedes them in their function as elected representatives. Spying on members of the press gallery for doing their job does the same (in that communicating with the media is one of the key functions of MPs).

The irony is that this has all arisen because of GCSB spying on New Zealanders.

Henry shouldn’t just be investigated by the Ombudsman – he should be dragged before the Privileges Committee. As for the Parliamentary staff member(s) who so obligingly handed over information without once thinking about the constitutional implications, they must be sacked. There simply is no other remedy.

I don’t know if it will come to that, but it looks serious and should have a proper investigation.

MPs should not tolerate this. They should demand that no spying is done on the Parliamentary network without a warrant (and therefore under the MOU with the Police [PDF], the oversight of the Speaker).

Furthermore, they should protect themselves by demanding that the Parliamentary network be separated completely from that used by Ministers, and that it be encrypted end-to-end so that information on it cannot be stolen for political purposes. Anything less, and they’re simply asking for a future Muldoon to abuse them.

The Prime Minister must take some sort of action on this.

Putin has signed into law a measure that makes it illegal to promote homosexuality etc to young people, as well as gay parades.

If only we had some of that in the West.

MOSCOW (AP) — Russian President VladimirPutin has signed into law a measure that stigmatizes gay people and bans giving children any information about homosexuality.

The lower house of Russia’s parliament unanimously passed the Kremlin-backed bill on June 11, and the upper house approved it last week.

The ban on “propaganda of nontraditional sexual relations” is part of an effort to promote traditional Russian values over Western liberalism, which the Kremlin and the Russian Orthodox Church see as corrupting Russian youth and contributing to the protests against Mr. Putin‘s rule.

Hefty fines now can be imposed on those who provide information about the lesbian, gay, bisexual and transgender community to minors or hold gay pride rallies.

The Kremlin announced Sunday that Mr. Putin had signed the legislation into law.

“Spying on members and tracking who they communicate with … ” blah blah blah. “Spying on members of the press gallery …” blah blah blah. All well and good, UNTIL you remember that this inquiry wasn’t just done because somebody thought, “Yawn … slow Friday … let’s go spy on someone we don’t like and see what we find.” This was an inquiry set up because SOMEONE violated security practice and confidentiality, SOMEONE leaked a report, without authorisation, that was classified as “sensitive” and described by John Key as “highly sensitive”.

NRT is trying for the hysteria award by referring to the inquiry as “spying”. Bollocks. If someone uses a work phone, or computer, or email account, or whatever, then it is entirely realistic to expect the records relating to that phone/computer/email account to be subject to audit. As you have pointed out yourself previously, if someone desires privacy then it is extremely simple to use personal phones, email accounts, and computers which are not subject to audit.

I’ve had my swipe card access records checked previously, and was asked to account for my movements when I entered a work premises early one morning, and some equipment went missing at roughly the same time. Was that “spying” on me? Of course not, and anybody who persists in calling this “spying” is just playing the hysteria card needlessly.

So graham, you don’t have any problem with the Prime Minister setting up an inquiry and then allowing that inquiry to request any data on MPs or journalists it wants for it’s inquiry, and for that data to be handed over to the inquiry by Parliamentary Services without question? In secret, without telling anyone what has been done?

And would you be concerned if there was a possibility that the GCSB had some sort of involvement in this? You know, the spy agency that is not allowed to spy on New Zealanders but is only answerable to the Prime Minister?

Would you be as happy with all of this if David Shearer was the Prime Minister?

Why do you think John Key, David Shearer and Russel Norman have all now expressed concern with some this? (We don’t know all of what’s been done yet).

David has a right to apply for compensation by a particular process the NZ Govt put in place when they declined to be a signatory to a UN mandate for compulsory compensation. If you think that Ministerial powers are beyond scrutiny then you’re speaking from the time before the Magna Carta was enacted. When the decision was made as to the current process as opposed to that recommended by the Law Commission it can’t have been considered that applicants using the process were to be ‘displaced’ of their rights to fairness and so on.

‘It has been suggested that Collins has also descended into the arena of conflict. Of course she has. She is a party to the claim. She has to make recommendations to the Cabinet.’

And that recommendation has to be consistent with due process and the Law. She effectively instructed that a secret hearing took place and gave a design as to what she had expected from Binnie and therefore consequently what she expected of Fisher.

If Binnie’s approach was wrong, and no doubt to me it wasn’t, David Bain isn’t responsible for that. Nor is he responsible for being left out of the ‘loop’ while 34 points of ‘concern’ were looked into on the Minister’s instructions. You’re looking for a directive in some naïve way, but the subtext was if Binnie was wrong on 34 points (as the Minister claimed) then so was his recommendation – the language and purpose were clear. You could be the only person in NZ that might believe that the Minister expected Fisher to tell her she was wrong on her 34 points, or even for going behind the back Binnie, the applicant and his lawyers to mine for a different result than what Binnie offered. That might be what a shady car dealer might do to obtain a sale, but not a Minister of the Crown, a lawyer in fact, dealing with a Judge, a QC and other lawyers even putting aside the fundamental rights of one New Zealander.

The inquiry was not empowered to request ANY data, only certain relevant data – check the terms of reference in Appendix Two.

We are informed that the GCSB was involved only to the extent of providing assistance in the gathering of records. There is no evidence to suggest that they went beyond this remit and targeted Dunne simply as a form of payback against an MP who had voiced concerns about the power of the GCSB, and as a way of damaging a journalist who had embarrassed the GCSB, as you have strongly hinted. I’m sorry, as you have “asked the question”.

Correct. But the issue is whether it is a legally enforceable right — Bora only deals with legally enforceable rights. Can there is a legally enforceable right if the Government has not legal obligation to pay?

Correct but I dispute that she has done anything wrong based on evidence to date. The Court may rule otherwise. I do not have details of the original arrangement and cannot assess the rightful expectations of the parties.

It was not a hearing. This was not an arbitration or adjudication. It was an advisory report. Unless the Government was contractually bound to accept the report, it is entitled to have it reviewed. I cannot see either party stating that they would unconditionally accept a report regardless of what errors may appear.

Prove it! Where is the evidence that Fisher wrote what Collins directed? Letters such as Collins’ brief to Fisher go out every day. You are alleging bad faith ie that Collins directed the outcome. Where is your evidence?

Now, tell me was Bain would have done if the Binnie report concluded that he was guilty and Bain found 34 errors of fact and law?

Sorry to interrupt here, but I doubt you will read my comment on the other thread.

I have no problem with anyone having an opinion. If I disagree I will tell them and likewise.

But this situation was different. The person concerned had applied for official information and then lied about what they received. In short, they stated that it said various things that it did not say and so on.

Whilst he was entitled to pass any opinion, to pass off a senior police officer as saying something he never said and so on, it not on. That is what I am complaining about, and that is what I’m pointing out.

If I did that to you, you’d be on my case as well.

I think the answer is clearly yes. Which is the point I made earlier that when NZ put this process in place rather than follow the UN mandate it could never be argued that it was NZ’s intention to have in place a compensation procedure that was essentially at the whim of the Government of the day and rendered normal rights under TBORA and HRA obsolete on a critical analysis of whether the State had wrongfully imprisoned a citizen. It may happen but it would be a woeful situation for NZ on the world stage to claim that a citizen had no enforceable rights for false imprisonment, of course there is also precedent unhelpful to such a position if it were taken. It could possibly also be an invitation to promote an argument that anyone in Bain’s situation could sue for damages, something which may yet happen, and which the Courts allowed in the case Susan Couch.

I think the Court will see it as a ‘quasi hearing’ where the Minister had taken on the role as Judge, The Minister invited all the participants excluding the Applicant. It was an advisory report as you say and you tell me how a Court would view a process that deliberately excluded one party, loosely the plaintiff, but included the respondent particularly when the ‘brief’ to that point had resulted in Binnie copying all sides any paperwork coming into his hands.

I’d simply argue that the result is the proof, and that the Minister’s actions invited, or would invite to a prudent and neutral person to that observation.

That’s hypothetical of course because it didn’t happen. But it has been revealed that there was already an undertaking that Bain would have accepted the recommendation whatever it was. Of course I assume that acceptance would have been on the basis that the process was transparent, followed due process and natural justice – until this Minister got hold of the report all those conditions had been met.

Brisbane’s median house price tipped to leap 17pc by 2015, to about $515k

AFTER years of sluggish price growth, Brisbane’s median house price is tipped to jump by 17 per cent in the next three years.

According to economic forecaster BIS Sharpnel’s latest Residential Property Prospects report Brisbane’s median house price at the moment is about $440,000, only two per cent higher than it was at the same time last year.

The predicted increase would lift the median house price to about $514,800.

This is a story to inspire you to reach for your dreams.

Many years ago I came a close 2nd in the Miss Amateur Pasifika 1969 competition. Later that year I emigrated and was beset by a long period of bad luck.

I suffered years of drug and alcohol abuse and a series of eating disorders. I lost a leg and needed facial reconstruction surgery after a road traffic accident. Later, I suffered 90% burns in an unprovoked acid attack. Several of my teeth were knocked out and an eye gouged in a bitch fight outside a KFC. The stress caused severe hair loss and facial warts. But I never stopped believing.

And then finally last week I was crowned Miss South Auckland 2013.

After landing my new job as a Bunnings “Greeter” – a good find for many retirees, I lasted less than a day . . . . .
About two hours into my first day on the job a very loud, unattractive, mean-acting Bogan babe walked into the store with her two kids, yelling obscenities at them all the way through the entrance.

I then said, “Nice children you have there. Are they twins?”

The woman stopped yelling long enough to say,
“No, they ain’t effin twins. The oldest one’s 9, and the other one’s 7, why the hell would you think they’re twins? Are you blind, or just effin stupid?”

I replied, “I’m neither blind nor stupid, Madam. I just couldn’t believe someone shagged you twice…. Have a good day and thank you for shopping at Bunnings.”

My supervisor said I probably wasn’t cut out for this line of work.

The lawyer didn’t really know.

I just had an interesting conversation with a friend, whose husband has been working in Christchurch for a month.

He finally came home for the weekend, and they spent some much valued time together, at least until they started talking about the blogs they had been visiting to pass the time.

My friend told her husband about this wanker she had been arguing with on a blog similar to this.

Apparently the ‘wanker’ was her husband. She was happy to see him return to Christchurch this morning.

Who knows, maybe I’m your wife! 😉

A propos Bain’s right to compensation based on the BORA argument. Here is Section 27 NZBOA . Please note the reference to “rights, obligations or interests protected or recognised by law”. Given that Bain has to rely on an ad hoc process and an ex gratia payment, how do you suggest that his right to compensation is recognised or protected by law? It is the very absence of recognition and protection that has us in the present predicament.
“(1)Every person has the right to the observance of the principles of natural justice by any tribunal or other public authority which has the power to make a determination in respect of that person’s rights, obligations, or interests protected or recognised by law.
(2)Every person whose rights, obligations, or interests protected or recognised by law have been affected by a determination of any tribunal or other public authority has the right to apply, in accordance with law, for judicial review of that determination.
(3) Every person has the right to bring civil proceedings against, and to defend civil proceedings brought by, the Crown, and to have those proceedings heard, according to law, in the same way as civil proceedings between individuals.”

You talk about false imprisonment. This is a well-defined tort which has its limits. Bain was not wrongfully imprisoned. He was convicted by a court after a trial and therefore lawfully detained. He cannot sue for wrongful imprisonment because he was not.

You might then suggest that the PC decision vitiates the legitimacy of the trial because of the short-comings of the police. If so, Bain’s only remedy is malicious prosecution. That entails proof of bad faith. No such action has been brought and has never been intimated by the defence team. Those facts speak volumes.

Collins is not, in any sense, the judge and has no judicial role. She is simply the minister of the ministry responsible for implementing the guidelines and bringing the issue to cabinet. She is one of a number of people who will make the decision. She would have been entitled to make comment on the report if she chose. Any of the members of cabinet would have been entitled to debate, accept or reject any part of the report. Collins had concerns and took additional material to the cabinet in the form of peer review. Where is that precluded?

You cannot simply assume bad faith because you do not like the outcome. You need to establish facts that point to bad faith. You need a bit more than you have produced.

It seems to me that Bain may have a further problem. Collins did not make any decision on a substantive issue. She made an administrative decision on the material to take to cabinet. I am not sure that such a decision n is susceptible to review.

Time will tell.

1. Bain spent a long time in jail for murder, but has no conviction.

2. An independent review indicated he did not do it.

3. All proper processes were followed in accordance with our laws.

4. Bain should get compensation to maintain the integrity of our system of law.

I reckon he is a guilty as sin, but that is not relevant. What is relevant is following our own laws and process. Gut feelings and arm chair experts should not hold sway.

I have been lucky enough to see “Freemen” like Ugly, in Court. I have been even more fortunate to be challenged in Court by one. It really is a treat and a welcome respite from a busy day. The first thing they do is challenge the Judge and the sovereignty of parliament. This sets the tone and helps put the Judge in the right frame of mind ! Next they will bore the Judge with the most garbled incoherent bullshit you could imagine. Typically even the most talented Judges are unable to distill any actual point or legal position the Freeman might hold.

This all sits in stark contrast to the fantastic claims Freemen make, all over the internet, about their day in Court. They really are lunatic 🙂

There seem to be two origins to Freeman thinking –

1. English/Protestant nationalism

common law being recognised by Alfred (as the secular equivalent of biblical authority within religion) as constitutional law for England and thus immune from the influences of the foreign – that is Roman law (that of the mob/masses)

2. Small government survivalists of the USA

they build on the English/Protestant foundation a negation of government legislative action post the constitution (as if English common law legacy in the USA at that time cannot be later challenged) – as if democratic populism has to be resisted as an undue expansion of some foreign government imposing itself on Americans.
