Hone knows ‘how the law works’. The law exists to protect the wealthy and the powerful from the social disasters that arise from the exercise of that wealth and power against society generally.

If it had been a National MP joining a protest that the establishment deemed acceptable and that National MP recklessly used a vehicle to endanger others nothing would be done.

The Intelligence and Security Committee report on the GCSB Amendment Bill is now available. It clarifies and closes up gaps in the original bill. It includes the proposal from John Banks but the seven Dunne amendments will be dealt with separately by Supplementary Order Papers.

There’s no indication of whether National will submit their own SOPs.

The public meeting on the bill (with streaming link) starts soon in Auckland but it won’t have had time to address the amendments proposed by the committee.

Yes Griff, BP has spent billions on alternative energy development. This does not support your BIG OIL conspiracy theories. Nor do the company websites of BIG OIL, which clearly show concern for climate change. These companies spend millions on their public image and will not set themselves up as a target by telling the truth about AGW. They want to be seen as clean and green. None of your claims about BIG OIL are supported by the readily available facts.

Complete nonsense, as this Rolling Stone article points out:

In April, BP announced that it is selling off its entire $3.1 billion U.S. wind energy business – including 16 farms spread across nine states – as “part of a continuing effort to become a more focused oil and gas company,” according to a company spokesperson. Indeed, though it famously rebranded itself “Beyond Petroleum” in 2000, BP also exited the solar energy business back in 2011. Today, its alternative energy investments are limited to biofuels and a lone wind farm in the Netherlands.

And BP is far from alone. You wouldn’t know it from their advertising, but the world’s major oil companies have either entirely divested from alternative energy or significantly reduced their investments in favor of doubling down on ever-more risky and destructive sources of oil and natural gas

Not that those commitments to alternatives were ever particularly grand. Using very generous estimates, BP holds the oil industry record for the highest percentage of expenditures committed to alternatives, with just 6 percent of its overall expenditures in 2011, right before it started selling off its solar operations. Chevron and Shell run a distant second with highs of 2.5 percent; none of the others have ever even cracked 1 percent.

Interesting article on the fallibility of DNA testing in the New York Times (I know, it is the NYT, but the article is an op-ed by a law professor, not something by one of their repeaters):

SAN FRANCISCO — WHEN the police arrived last November at the ransacked mansion of the millionaire investor Raveesh Kumra, outside of San Jose, Calif., they found Mr. Kumra had been blindfolded, tied and gagged. The robbers took cash, rare coins and ultimately Mr. Kumra’s life; he died at the scene, suffocated by the packaging tape used to stifle his screams. A forensics team found DNA on his fingernails that belonged to an unknown person, presumably one of the assailants. The sample was put into a DNA database and turned up a “hit” — a local man by the name of Lukis Anderson.

Bingo. Mr. Anderson was arrested and charged with murder.

There was one small problem: the 26-year-old Mr. Anderson couldn’t have been the culprit. During the night in question, he was at the Santa Clara Valley Medical Center, suffering from severe intoxication.

Yet he spent more than five months in jail with a possible death sentence hanging over his head. Once presented with Mr. Anderson’s hospital records, prosecutors struggled to figure out how an innocent man’s DNA could have ended up on a murder victim.

Late last month, prosecutors announced what they believe to be the answer: the paramedics who transported Mr. Anderson to the hospital were the very same individuals who responded to the crime scene at the mansion a few hours later. Prosecutors now conclude that at some point, Mr. Anderson’s DNA must have been accidentally transferred to Mr. Kumra’s body — likely by way of the paramedics’ clothing or equipment.

This theory of transference is still under investigation. Nevertheless, the certainty with which prosecutors charged Mr. Anderson with murder highlights the very real injustices that can occur when we place too much faith in DNA forensic technologies.

In the end, Mr. Anderson was lucky. His alibi was rock solid; prosecutors were forced to concede that there must have been some other explanation. It’s hard to believe that, out of the growing number of convictions based largely or exclusively on DNA evidence, there haven’t been any similar mistakes.

In one famous case of crime scene contamination, German police searched for around 15 years for a serial killer they called the “Phantom of Heilbronn” — an unknown female linked by traces of DNA to six murders across Germany and Austria. In 2009, the police found their “suspect”: a worker at a factory that produced the cotton swabs police used in their investigations had been accidentally contaminating them with her own DNA.

Contamination is not the only way DNA forensics can lead to injustice. Consider the frequent claim that it is highly unlikely, if not impossible, for two DNA profiles to match by coincidence. A 2005 audit of Arizona’s DNA database showed that, out of some 65,000 profiles, nearly 150 pairs matched at a level typically considered high enough to identify and prosecute suspects. Yet these profiles were clearly from different people.

There are also problems with the way DNA evidence is interpreted and presented to juries. In 2008, John Puckett — a California man in his 70s with a sexual assault record — was accused of a 1972 killing, after a trawl of the state database partially linked his DNA to crime scene evidence. As in the Anderson case, Mr. Puckett was identified and implicated primarily by this evidence. Jurors — told that there was only a one-in-1.1 million chance that this DNA match was pure coincidence — convicted him. He is now serving a life sentence.

But that one-in-1.1 million figure is misleading, according to two different expert committees, one convened by the F.B.I., the other by the National Research Council. It reflects the chance of a coincidental match in relation to the size of the general population (assuming that the suspect is the only one examined and is not related to the real culprit). Instead of the general population, we should be looking at only the number of profiles in the DNA database. Taking the size of the database into account in Mr. Puckett’s case (and, again, assuming the real culprit’s profile is not in the database) would have led to a dramatic change in the estimate, to one in three.

One juror was asked whether this figure would have affected the jury’s deliberations. “Of course it would have changed things,” he told reporters. “It would have changed a lot of things.”

DNA forensics is an invaluable tool for law enforcement. But it is most useful when it corroborates other evidence pointing to a suspect, or when used to determine whether any two individual samples match, like in the exonerations pursued by the Innocence Project.

But when the government gets into the business of warehousing millions of DNA profiles to seek “cold hits” as the primary basis for prosecutions, much more oversight by and accountability to the public is warranted. For far too long, we have allowed the myth of DNA infallibility to chip away at our skepticism of government’s prosecutorial power, undoubtedly leading to untold injustices.

In the Anderson case, thankfully, prosecutors acknowledged the obvious: their suspect could not have been in two places at once. But he was dangerously close to being on his way to death row because of that speck of DNA. That one piece of evidence — obtained from a technology with known limitations, and susceptible to human error and prosecutorial misuse — might mistakenly lead to execution at the hands of the state should send chills down every one of our spines. The next Lukis Anderson could be you. Better hope your alibi is as well documented as his.

We also know that DNA matches can be faked, and that there is also room for an unscrupulous scientist to falsify results with a very good chance of getting away with it. In NZ, there is very little verification of DNA testing, and obtaining funding from legal aid to do so is pretty difficult, whilst doing it privately is very expensive.

(Disclosure time: I once worked at Wellington Zoo… for a very short time as a part-time school teacher….. worst job I ever had).

Now I’ve been to a few zoos and I was surprised, to say the least, that Wellington Zoo would rank so highly.
So I thought I’d check out the website that had carried out the ranking exercise .. EscapeHere.com…. seems to be run by a few website writers who compile travel gumpf from various sources into lists…… top 10 volcanoes, Australia’s 10 lakes, etc. No evidence that any of the writers have actually been to any of the destinations they rank.

When someone comes visiting Wellington Zoo with reallife experience/background in assessing (or even visiting) Zoological parks then I might pay attention to their opinion of the place.

So Yoza attempts to prove me wrong by linking to an article pointing out that BP has indeed spent billions on alternative energy. They are a business and need to make a profit, unlike the well paid weathermen who are paid to promote AGW and are funded by tax dollars. BP had to abandon a multi billion dollar alternative energy commitment, because it is a crap investment.

Some one may have already mentioned it, my apologies if so – I think it is excellent that the NZDF pleaded guilty to the charges over the death of Private Michael Ross. Hopefully it was a genuine decision not to indulge in obvious butt covering and is a good template for taking responsibility right from the top in such organisations – fairly rare in NZ and to be applauded.

Not scheduled for publication until next year, a leaked report by the United Nations’ Intergovernmental Panel on Climate Change (IPCC) presents evidence that fear-mongering over the magnitude of global warming may be a little too ambitious.

He seems not to understand that the AGW theory claims our standard energy production methods are causing the climate change. He thinks climate change is a thing, not a result, and that spending money on that thing will somehow save the world from mans evil. Sort of like tithing. 🙂 🙂

Probably the big news of the meeting was Cunliffe upstaging Shearer during question time.

Cunliffe must have been seated near the front, he wouldn’t have seen Shearer arrive late and stand at the back.

A question was what would opposition parties do if they got in to Government.

Camera on Shearer thinking looking like he’s thinking “what the fuck do I do, what the fuck can I say?”

Switch to Cunliffe who has the mic – “I think I can talk on behalf of colleagues in the Labour caucus and we will repeal the bill, it cannot and most not stay” (rough quote from memory).

Someone has tweeted that he said repeal, not review. Shearer has never mentioned repeal. he hasn’t been taught that word yet.

Good to see Shearer at the meeting, but the cynic in me thinks it was for the wrong reasons. I can’t decide whether I wish he had been able to answer the questions or if it’s better that he didn’t.

Arfamo: I suspect he was having the same internal dialogue himself. I reckon he made the right choice

Yeah, we tend to put too much reliance upon DNA as being absolute proof (and much of the time it is) but it is still something that we need to check and double check, just to be safe.

Are you suggesting that I ever cared about what oil companies said about climate change? Just because you keep accusing people of being under the influence of big oil doesn’t make it true.

Except that they’re diversifying, so they’re not just reliant on oil. They have been for years, and I’ve pointed out to you the Stanford research funding before but you’re too obstinate to be able to understand what I’ve been saying. Big oil has been buying into the club for a long time. Just about all the energy companies are putting on a public show of being environmentally friendly, it’s not just good for their public image, there’s a shit load of money in it.

Yeah. Black guy catches 3 white youths breaking into cars at 3am outside his home. One of them allegedly charges him. Black guy shoots him.

Kid dies. Black guy is immediately charged with murder, down graded to first degree manslaughter. Black guy is tried and acquitted.

Yes it’s a tragic episode, but very different from the Trayvon Martin killing. For starters the black guy doesn’t stalk his prey, and there are three youths to contend with, not one.

I can answer that for you Scotty.

It is because the US has an abundance of black youths. The statistics are clear. Most youths killed are black and most are killed by other blacks. Blacks commit crime at a rate many times higher than other groups. It has been said that if you removed black crime from the statistics, the US would have a crime rate comparable with Belgium.

The report The Color of Crime (2005, second expanded edition) by the New Century Foundation states that there are several problems with the official crime statistics in the United States. These tend to cause underestimation of racial crime differences. One example being “Whites” sometimes including Hispanics. Another is not adjusting for that the different racial groups differ in population size. The report reviews the more accurate statistics that is available and describes many large differences in crime rates between races. The report also examines the research on possible bias against racial minorities in the justice system and the police and concludes that bias not a significant explanation for the different racial crime rates.[3]
It major findings were stated as:[3]

Blacks are seven times more likely than people of other races to commit murder, and eight times more likely to commit robbery.

When Blacks commit crimes of violence, they are nearly three times more likely than non-Blacks to use a gun, and more than twice as likely to use a knife.

Hispanics commit violent crimes at roughly three times the white rate, and Asians commit violent crimes at about one quarter the White rate.

The single best indicator of violent crime levels in an area is the percentage of the population that is Black and Hispanic.
Of the nearly 770,000 violent interracial crimes committed every year involving Blacks and Whites, Blacks commit 85 percent and Whites commit 15 percent.

Blacks commit more violent crime against whites than against blacks. Forty-five percent of their victims are white, 43 percent are Black, and 10 percent are Hispanic. When Whites commit violent crime, only three percent of their victims are Black.

Blacks are an estimated 39 times more likely to commit a violent crime against a White than vice versa, and 136 times more likely to commit robbery.

“The 15-year stop in global warming is now outside the range of climate ‘noise’ and climate models. It is statistically significant. […] from a science point a view, it is sheer absurdity to want to maintain ‘a nice, comfortable, stable climate’ through a few turns of some sort of CO2 control-knob.”

Cunliffe’s answer to whether opposition parties would repeal the GCSB bill.

Sometimes you have issues where you feel your ancestors fluttering around the ceiling, and the Labour party has a proud tradition of taking on evil and iniquitous legislation, whether it’s apartheid, or nuclear weapons, or other things of that nature.

Our leader has committed to a thorough review of this legislation.

And based upon what we have heard tonight, I personally and I’m sure my caucus colleagues, would be of the view that this legislation must not, will not and cannot stand.
