In an editorial on the police raid on Nicky Hager’s house the Herald promotes Hager’s take on what happens, and they refer to the hacking as theft six times.

It’s not theft. The hacking is either “Accessing computer system for dishonest purpose” or “Accessing a computer system without authorisation”.

The Herald also refers to it as “common old theft” and a ” relatively minor criminal offence”.

I think that political hacking and using illegally obtained data to try and bring down a Government are serious issues.

The Herald didn’t mention that they were also a recipient of the hacked data and were benefiting from the stories it enable.

Herald calls hacking “relatively minor” common theft – wrong on both counts.

D-Day for rates activist’s home as bailiffs threaten to move

Today is the first day the Auckland District Court can seize Penny Bright’s home, at the council’s request, to pay the rates bill. It has a 2011 valuation of $530,000.
She is the first of eight property owners the council is preparing to take action against. They are the front end of 179 ratepayers under review for $2.5 million in outstanding rates.
Ms Bright is first up because of the length of her debt – council records date her non-payment back to 2008

Little signalled a major shift in direction if he won the leadership, including the likely ditching of unpopular policies such as raising the pension age.
At a press conference today, the former union boss also signalled a rethink of a capital gains tax, power reforms and free doctor visits for over-65s.
Little said the policies were raised constantly on the campaign trail as either scary or unaffordable.

So this Labour leadership “primary” will be like the last –
Potential leaders spouting policies that may or may not be official Labour policies, but bribes rather than any contest to show who is the better leader, one compared to the other.
It didn’t work last time:
Three different sets of promises and those all differing from any remits submitted in any annual conference.
Labour – already not learning anything, either from the train wreck or why they went off the rails to start with … 🙂

@Other Andy / Others: I think Penny has really buggered this one up… I see she owes Council a total of ~$33k.

No doubt she will seek maximum publicity when she is dragged off into the sunset. (This is deja vu – I recall something similar when she was given the humpty from Aotea Square along with the other squatters).

As Penny is someone who desperately aspires to be a Local Body politician (or an MP) I would have expected her to demonstrate better judgement – this is one argument she is destined to lose. And all she had to do to avoid this debacle, was to pay her lawfully assessed rates.

Just like the rest of us.

Penny – if you are reading this, please bear in mind for your own sake:
1. In enforcing payment of rates, the council holds the ace of spades and all the trumps.
2. Once the CEO passes it to the court the matter is out of the Council’s hands apart from in due course receiving a cheque.
3. You may not have heard of a previous hearing, but as the house seems to be in a trust, it is only necessary that the trustees be served, and service to one probably suffices.
4. The associated costs must be by now ballooning and will be taken out of sale proceeds.
5. For your sake you better allow potential bidders to inspect – otherwise they will bid low.
6. Also for your sake you better make it clear you will give the successful bidder vacant possession. Otherwise it will be knocked down at a low price to some thick skinned b*****d will have no compunction about throwing you out, even if he does appear on TV3 as evil incarnate.
7. The good news is your trust will receive the residue of the sale proceeds after the council ane everyone else involved has clipped the ticket – it may be enough to buy a coffee and a bun.

But Lance, be reasonable.
There are more important things that require the urgent attention of Her Majesty’s Courts – like Dot Slob’s problems, like parking and traffic issues, like RMA consent issues.
Give the poor CrownLaw Office a break.
They are also busy trying to regurgitate a failed case against M Lundy ( That is not to express a view on his guilt or innocence). All that aside, the provision under which the case was dropped is based on as well known part of the NZ BoR. No laughing matter, but it does bring a 🙂

How refreshing this total support for Len Brown is this morning. All is forgiven and he can exercise his might against a political opponent confident in the 11000 staff behind him and the mandate of the people. Penny is not that Bright if she hasn’t yet got some iwi to declare her property a ‘temporary’ culturally significant site, and use Len Brown’s iniquitous legislation against him. A host of local councils in NZ are owed millions in unpaid Maori land rates, but the councils simply ‘back off’ in attempting to recover the money.

Well if the ‘dishonest purpose’ is stealing data then it’s common old theft, possibly less harmful than, say, nicking someone’s laptop. (which would potentially contain far more private data)

I’m no fan of Hager, but the raid was way over the top. Still, now the precedent has been set perhaps Slater can expect to have 5 cops raid his house and comb his files for stolen data.

I’m an Auckland business ratepayer Nostalgia. If I miss ONE rates payment, I get shitty letters and correspondence from said Auckland Council telling me to pay up, or they’ll do all sorts of dire and draconian things to me and my business.

Penny’s rate debt goes back to 2008 – six years. That’s 24 quarterly instalments she has wilfully refused to pay, to make a political point. You may have sympathy for her, but please pardon me if I don’t.

It would be good if that judge took a stand for freedom of expression. He or she will not be deciding whether the hacking was a crime, just whether the police treatment of Hager and his sources can be justified in the pursuit of that relatively minor criminal offence.

The Hager raid is now a greater evil than the “relatively minor criminal offence” that hacking Cameron Slater’s computers apparently was.

Hager has had nothing revealed yet, let alone a book published of his private electronic communications, but has an editorial supporting his receiving and using stolen documents and a public fund currently approaching $42,000 to help him defend his crime.

I missed this one.

On Friday, September 26, the Hooerald in a righteous PC editorial article called for the Queenstown policewoman who in a drunken, off-duty rant abused a Malaysian-Indian taxi driver to be thrown out of the police force.

The Auckland scribblers would destroy this southern woman’s life for one nasty drunken outburst.

She has paid with publicity and court appearance and is paying with the tension of waiting for a police decision on her career, now these loathsome PC hacks in Auckland revive the lynch mob. This is a family woman who made a big mistake, and now the despicable PC hounds would drive her out of a job, out of Queenstown, and perhaps, to worse.

What she has did was wrong, offensive and worse because she is (for now) a policewoman, but in gravity, a drunk nastily abusing a taxi driver is far, far lower on the scale of noxiousness than trying to torpedo an election with stolen emails – something the Hooerald was notably soft on.

i reckon this is all a smokescreen, i was surprised that the council did anything, after all its been 6 years of arrears, but just before the house is sold some idiot support will stump up with the cash, she will make a big deal of paying it ‘under duress’ and somehow find a way to blame john key and banks and contractors.

of course the perfect karma would be for a contracting agency to buy it for their contractors to live in when working for auckland council, but that seems unlikely.

IGM, I thought that Penny wasn’t paying her water rates. If that is the case why would the Council keep contributing to the debt if indeed they kept supplying water. I pay rates but in principle I reject the Council being heavy handed against the few that may not. And that isn’t just because they put small signs near storm water drains warning that tonnes of plastic, silt and other debris may go into the harbour through drains all over the city that could be easily filtered – at a lot less cost than trying to clean it up later. Strong feelings of course but pays to pick one’s fights. That’s what Penny has done, I admit I wouldn’t want to put my family under such pressure – though on the other hand I don’t begrudge her the right to take a stand against a raging, and going by the antics of the Mayor, at least morally corrupt, monolith overburdened with debt and surplus staff.

Reason, one has only to look at the terrible performance of ACC to see that lots of transparency is needed. (they are not alone of course.)

Its a council like so many iothers comp[letely out of control of the ratepayers who foot the bill.
Time for a decent rates revolt and removal of all the laws passed by Clarkula and Smith etc that allow them to spend like drunken bums on stuff ratepayers should not be having to pay for.

I think the main point Obama is making is that the War against ISIS is not for the US to solve alone. I would say it requires to begin with the Iraqi Government to have enough steel and balls to contain them with their borders and not having the US coming in perpetually to bail them out.]

And indeed, Soros’ political spending as a whole is an order of magnitude greater than anyone else – and all to left-wing political groups.

So it’s not clear why you would cite the Koch brothers’ contributions, which are extremely modest in comparison.

And of course, like NZ Labour, the Democratic Party is essentially just the political vehicle for big labour cartels to plunder the workers.

Both the Republican and Democratic parties are beholden. Your demonising one rather than the other is simply childish.

I must correct myself here. That same year there was another donation of the same size, again to the Democrats.

I’m not looking to these US midterm elections as so much of a slap in the face for Obama; I think his own inadequacies are destroying him well enough.

No, the guy I’m looking forward to seeing humiliated and made relatively powerless is Harry Reid, one of the shittiest, dirtiest politicians in the US at present. What’s worse is that he’s Senate Majority Leader. I can think of half-a-dozen other Democrat senators who would be better and more respectable leaders than thus guy. I can’t think of a worse Majority Leader in the Senate in my life time.

He’s corrupted almost every aspect of the Senate, whether it’s filibustering rules or the “law” around budgets. He’s acted as a firewall for Obama but also for his party since 2010 by playing the parliamentary game to prevent GOP proposals from coming to floor votes or even small amendments (it’s called “filling the tree”) from being added to bills that are voted on – simply because doing so would see Democrat Senators voting for GOP ideas and presenting Obama with awful veto decisions.

A corrupt, dirty bastard all the way back to his ill-gotten fortunes in Utah over the years. In a more decent world I’d like to think that a GOP senate would fully investigate Reid, but a combination of their own skeletons and “the honourable member” bullshit will prevent that.

Sigh. For once I delved into an EAD-link and that was the first thing that struck me as well. When it comes to the inflated aluminium balloon that is an airliner at 10,000m the effects of explosive decompression are the same whether it’s struck by the standard shrapnel burst of an exploding SAM warhead or the cannon shells of a fighter-plane.

I would also note that an explosive decompression also causes oxygen masks to drop automatically and creates a hail of objects flying around, so it’s hardly a surprise that some passengers wound up with such masks “wrapped around their necks”, which is not the same as saying that they were wearing them on their face.

So this claim rests on one silly, ignorant politician milking the drama with loved ones casting a final look at each other – when the reality is a loss of consciousness within seconds – and then trying to back track on it with talk about wearing oxygen masks.

In any case, the whole false flag meme would require believing that our current Western leaders would be willing to go to war with Russia when they can’t even bring themselves to put troops on the ground against ISIS. Pfft.

No, the simple truth is that Vlad has armed the Ukranian rebels, that he has done so with increasingly heavy weapons including SAM batteries to shoot down Ukrainian military planes, that they did that on several occasions and boasted about in the days and weeks before MH17, but that either their training or lack of good judgement saw them stupidly target a civilian airliner.

It’s no more complex than that and the efforts to make it so are not evidence of complex thinking but it’s exact opposite.

No Tom – the report issued last month said less than nothing because to tell the truth and answer the questions would reveal the awful truth that this plane was brought down in an attempt to draw NATO into the conflict in Donbass.

Hager, like Dot.com and Hone, appears to have his demographic clearly defined. They want to throw even more money at their hero.

It’s a free country and long may it last. I don’t think Hagers effect on the centerist voter offers anything but assistance to National.

Russian TV uses crash pictures in ‘mass grave’ reports

The website of Russian TV channel REN TV has been using images of victims of the MH17 Malaysian airline disaster to illustrate reports about the alleged discovery of “mass graves” in east Ukraine.

Over the past week, pro-Kremlin media have been full of stories of “mass graves” said to contain victims, including civilians, “tortured”, “executed” and “raped” by retreating Ukrainian troops in and around the village of Nizhnya Krynka, 60 km from the insurgent stronghold of Donetsk.

The graves are clear evidence of “war crimes”, the Russian media have been saying.

Quite a blatant propaganda attempt, but hard to get away with given the nature of the internet.

Some one must not have sent the memo to the Russian separatist leaders that putting out videos warning Poland that “we will come for you” is not the way to keep up the pretense that it is NATO escalating matters and not Russia.

Eastern Ukraine separatist threatens Poland

A ‘commander’ for the self-proclaimed Donetsk People’s Republic has warned Poland to “stop sending weapons” otherwise his forces “will come for you”.

“I’d like to appeal, not only to the Ukrainian government, but also to Poland’s. Stop sending weapons here. And tanks. We will destroy all that. And then we will come for you. Everyone who invades our land will die,” says the man going by the name of ‘Givi’ in a video (see below) shown on the NovorossiaTV.com web site.

“Personally, I would like to organize for them the same delights they have sent the people of the Donetsk People’s Republic,” the man says towards the end of the video, where he warns what he calls the “pseudo-Ukrainian government” in Kiev to withdraw its troops.

A similar threat was made against Poland by another militant in eastern Ukraine on video in September.

Disturbing post Lucia.

The terrorist thugs Putin is backing in order to assimilate the Ukraine are out of control. If the idiots in the Kremlin think they can win a war with NATO they are delusional, and seriously endangering the world. The Russian military is a joke. Poorly trained, ill-disciplined thugs who don’t come remotely close to any NATO nation in terms of professionalism and ability.

Putin can either stop his attempts to assimilate the Ukrsaine, stop his goons from threatening the West, or face the consequences.

There are some scary growth predictions for ebola . At current rates the number of infected persons doubles or triple each month.

The worst case scenario is that this cannot be controlled until a vaccine is available.

I wonder if the anti-vaccination brigade would say no to an ebola vaccine! After all, there is an unproven link between vaccination and autism!!

The Right Way

At week’s end it is appropriate to reflect that tomorrow it will be three weeks since we dodged not a bullet but a howitzer shell.

Imagine what the past three weeks would have been like if things had turned out differently:

– Business and investment confidence through the floor (along with the NZ dollar)
– Gut-wrenching night-after-night TV news items featuring Peter’s supercilious grin
– Hone, Harre, Sykes and the Skull, having been photographed on Parliament’s steps, endlessly banging on about “poverty”
– Silent T in full flight preaching like a Southern Baptist Minister (even God’s toes would have curled)
– Joe 90 (David Parker) daily trying to reassure financial markets and business that his CGT and the unseemly coalition his side was cobbling together wouldn’t lead to capital flight
– Resignations from Parliament of arguably some of the most talented political talent New Zealand has had
– Pictures of arguably the most talented Prime Minister New Zealand has had at Auckland Airport in a Hawaiian shirt
– My faith in collective sanity utterly destroyed

Did any Kiwiblog followers hear Penny Bright on Gentleman Jim’s Panel on Radio Labour this afternoon?

Gentleman Jim had to fade her out a couple of times when she wouldn’t stop talking.

If she’s correct, she does have a point about the Auckland Council not releasing details of contracts. I guess this is to protect the council when it doesn’t award a contract to the lowest bidder when it is cautious about a contractor for various reasons.

Penny’s likely to be too busy to hammer Kiwiblog’s General Debate for a day or two.

What makes Penny so stubborn? What drives her to centre her life on a do-or-die arm wrestle with the bureaucratic giant (by NZ standards) Auckland Council? Why doesn’t she just take her million and move to a delightful spot in Northland or Coromandel and run a furious blog to work off her aggression?
