        As I mentioned here yesterday, it seems she does not have all her marbles and in this context it would be inappropriate to sell up and evict her especially as her erratic actions would put her out of pocket by a few hundred thousand dollars. It is within the Council’s powers to grant relief by deferring the need to pay rates in some circumstances and it seems she may have been offered this on health grounds and declined.
        The most appropriate course of action IMO is for the Council to drop the whole thing and accept (on the basis she is not ‘all there’) and unilaterally grant rates deferral until such times the property is sold. Partial penalties should be applied such that the Council is not out of pocket ie to cover the interest on the marginal extra lending the Council has to do. There is a danger that other ratepayers could try it on, but it is unlikely to be much of a problem since such ratepayers would need to be mortgage free and Penny does seem to be ‘sui generis’. It is a case where compassion is warranted.

        Don the Kiwi – While any medical practitioner could cause her to be assessed for mental health issues, while being close to it, I doubt it crosses the barrier that warrants the Mental Health Act being invoked.
        It is telling that she has lost support from her associates, they have responsibly recognised that she is going nowhere and no doubt have tried to talk her out of fighting this and offered to help. Compare with this Manurewa woman who lost her house in a rating sale after continuing to accept irresponsible advice from a so-called mentor.
        As long as Auckland Council ratepayers are not ultimately going to be out of pocket over this, which they will not be, this matter is arguably is of no legitimate concern to them and the vocal ones should accept she has ‘problems’ and leave her alone.

        She was won a three day period to prepare papers for an injunction and the judge pretty well had to agree as the Council would not be significantly prejudiced. So presumably tenders received by 4pm cutoff will remain unopened for now.
        I am not unhappy with this development. Those treating it as a spectator sport are as detestable as those getting a thrill out of seeing gladiators fight, etc in Roman times – I felt disgusted when visiting ruins of Roman arenas in France a few years ago.

      Any relief should be conditional on a psych report ordered by the Court or under the Mental Health Act.
      
      Her penalties are like martyrs badges for activism but ratepayers are entitled to a fair go too. If she is legally unhinged rather than just pushing her issues she needs protection from herself.

        IMO she is not clinically insane, though she seems to be irrational enough to do herself damage. It is very doubtful that the Council on its own could invoke processes under the Mental Health Act. The Council could possibly consult with a psychologist to ascertain whether (at a distance) she has issues warranting compassion. However psychologists consider this ‘distance’ assessment unethical (some USA psychologists have been trying to assess Donald Trump in a similar manner).
        Other ratepayers would not be disadvantages since when the rates and penalties are ultimately paid over the penalties would cover the cost of the Council borrowing money in the meantime.
        The time has come for Penny’s circumstances to stop being a spectator sport.

        Steve – three business days of the High Court ie when the Court Registry is open for business, so the papers need to be filed by when the Registry closes on Monday
        Alex – I can quite believe it. The Judge considered a three day delay would not disadvantage the Council. Seems she will argue that the CEO should have personally signed the paperwork. I am rather gobsmacked that the Council’s legal section did not get the CEO to personally sign the papers – that was really a no-brainer. Just as the Judge ruled that the delay will not disadvantage the Council, the judge may equally rule that Penny is not disadvantaged by the papers being signed by someone exercising the CEO’s delegated authority.
        I am a bit surprised at the Judge’s [6](a) comment since it is the High Court that is conducting the sale, not the Council. The practical effect would be that the Registrar (or Barfoots) will not open up the tenders until the Judge orders.
        Even if the Judge rules that the game is up, the Judge would most likely give Penny one last chance to cough up before allowing the Registrar to accept the highest tender.

      She is apparently awaiting test results. Seems Auckland Council are using possible health issues to try and persuade her to accept deferral of rates but considers it cannot unilaterally invoke the process. I consider this is a responsible attitude from the Council who does not want to see one of its ratepayers suffer through her partial insanity.

        If Penny is partially insane that can be argued for all other activists whose expressed viewpoints conflict with other societal norms.
        If her mental health is not examined she must be presumed to be responsible for her wilful conduct and following consequences. Otherwise she in an incitement to others to pay as they please.
        A possible cancer is not terminal until referral to a hospice. Penny still seems to believe she is in charge and can do as she desires.

        Maggy, you sound like one of those women who understand the pain that men go through when they have a cold; that is, you have given birth.
        Can you explain why the hospital authorities want to chuck women out so soon after birth. I recall my late mother saying how she enjoyed that week after her seven confinements. Luckily for my wife; after the first child severe complications came on six days after the birth of the first child. If she had been at home I would have fainted with all that blood around. Apparently part of the afterbirth had been retained and it caused all sorts of trouble. I was annoyed because on my parents’ horse stud I used to kick through the mares’ afterbirth to see that it was intact, and the maternity staff had not done that basic task for my wife. If a mare had retained afterbirth she could not conceive on the ten day heat, and the mare’s owner would want to take legal action against the stud for negligence.

        There is no “one size fits all” model. Some mums, especially those who’ve been there before and know the ropes, just want to go home. My wife was home a few hours after her later births.

        Not really. But of the folks of my vintage who were keen on homebirths or racing home within hours of delivery, I noticed that they had money and supportive family (mothers, sisters etc) nearby.
        
        I had no mother and no other family (apart from Hubby) near Wellington. As the youngest in my family, I hadn’t had a lot of exposure to life with babies, etc.
        
        Yep, the first few days of a baby’s life can be a bit of a roller-coaster for first-time mums…. my eldest started vomiting up nasty bloody deposits on her 2nd-3rd day….. Seems she must have swallowed muck on her way down the birth canal…
        
        I liked hospital food, the warmth of the place, and the company of other new mums.

        More babies are being permanently disabled thanks to the mantra that “childbirth is a natural process”, not needing medical intervention.
        My grandson had jaundice but was still kicked out after 3 days.
        Shortly after he got worse but the midwife and a GP said just wait til after the weekend.
        Fortunately the kids consulted a paediatrician privately and had his blood tested.
        He was off the chart and re-admitted to hospital.
        If they’d taken the first advice and waited, he would have cerebal palsy.
        This is WHY they “used” to keep mums and babies in for at least a week.
        But these days, the midwives are in charge it seems.
        Apparently this country does not even keep a record of preventable damage to babies, only actual deaths.

        Man I saw that a couple of weeks ago. It is like some people stop evolving. A doctor who was asked to comment pointed out that the placenta is like a filter that protects the baby from toxins for nine months. So blending it and eating it is probably not a good idea.

A new prince has been born: Congratulations to Catherine, the Duchess of Cambridge and Prince William for their new baby boy born overnight at 11.01pm. Arthur is the front-runner name hoped for by the British public. James and Albert are a possibility, or will he be named after his great-grandfather Phillip?
Whats-his-name will be 5th in line to the throne.

Cindy’s sister-in-law is included in the official NZ gift givers with a white cotton romper suit embroidered with a buzzy bee on it. As well there are some childrens’ books and a woolly blanket.

And just for redeye above, Kate left the hospital 7 hours after giving birth.

Is it my imagination or has Stuff fallen out of love with the selected PM. Even a once in a lifetime trip to see the socialists running Europe only got a few puff pieces about whether Merkel liked her and how well she wore a feather cloak to that fancy dress dinner she had.
One thing I have found annoying is the lack of political pieces that have a comments section. Perhaps the avalanche of negative comments got too much. It sure was fun to vent though.

    I don’t usually swear, but FFS, when did Ngati Rhanina (the Maori cultural group in London) get elevated to the status of being an iwi?
    
    As someone who has had dealings with Ngati Rhanina in my past, I know they can be a precious bunch of pricks, but calling a disparate bunch of Maoris from NZ is taking the piss!

        The beautiful market square in Brussels has them fitted at each entrance to the square. Prettied up of course with flowers and greenery, but substantial barriers none the less. Supplemented with heavily armed serious looking soldiers of course.

I was disappointed in Taranaki locals for seemingly giving the cabinet minister Woods an easy ride yesterday. I suppose I more or less hoped for riots, pitchforks and the throwing of rotten vegetables in response to her government’s lunacy regarding oil and gas exploration/extraction. When the CoL comes to smash the Taranaki dairy industry I hope the response from the locals is less muted. You know it must only be a matter of time!

      Concerning Mr Sessions: He seems to be trying to play both ways, and evidently doesn’t appreciate that he was hired by the President (a businessman, never a politician) for his abilities, NOT his politics, in the same way that, to date all the presidental hires have been; on ability, not on political associations. What Mr Trump did not appreciate in his innocence, was that in the rarified air of DC, its politics first, not America. On that basis, he hired Mr Sessions, believing him the best and most suited for the task. So far however, Sessions ‘abilities’ have been less about what is required and more about not wanting to ‘offend’ anyone; especially his swamp-mates. On that basis, I doubt that he will last much longer. As I already noted, Mr Trump’s attitude is ‘I gave you a job to do; do it and I will reward you. don’t and you’re gone’ and the Sessions ‘recusal’ over the Mueller ‘Russian’ matter was, at minimum, a shock to a man (Mr Trump) who was used to managing businesses and had never contemplated the fact that his appointee might actually be dead-keen to oppose whatever he proposed.. I don’t see any evidence that Mr Sessions has changed his viewpoint or is even remotely interested in the idea of MAGA. He’s stalling for time, playing evasion, stonewalling and generally trying to avoid at all costs doing his job, especially in relation to the Clintons. No matter which way its viewed, ultimately he is NOT doing what he was hired for. I believe that Mr Trump has shown extraordinary patience, but suspect that the Sessions tenure is coming to an end. When that happens, cue the usual CNN-led hysteria, while Mr Trump just gets on and does exactly what he has intended to do from the start: MAGA.

      Speaking of British subjects executed for treason committed during World War II, this is fascinating – New Zealand-born Patrick Stanley Vaughan Heenan who helped betray Malaya to the Japanese in 1941:
      
      During 1941, as fears of a Japanese invasion of Southeast Asia grew, Heenan’s unit was sent to Malaya. He was transferred to an Indian Army air liaison unit and was sent to Singapore for training. Following the completion of air liaison training, Heenan was stationed at Alor Star, in Kedah, northern Malaya, in June 1941.[2] It was in this area that most of the British Royal Air Force, Royal Australian Air Force and Royal New Zealand Air Force squadrons in Malaya were based.[citation needed]
      Circa 8 February 1941. Bristol Blenheim Mark I bombers of No. 62 Squadron RAF lined up at Tengah, Singapore, before flying north to their new base at Alor Star, Kedah, Malaya. Heenan was attached to the squadron at Alor Star in late 1941.
      
      Japanese forces invaded Thailand and Malaya on 8 December. Mr Sydney Tavender, chairman of the Cotswold branch of the Far East Prisoners of War, and who served in the AIL unit with Heenan, said the Japanese aircraft always seemed to know the correct recognition codes, despite the fact that they were changed every 24 hours. By 10 December, the Japanese had destroyed most of the Allied aircraft in northern Malaya.
      
      Heenan was caught during an air raid. “When we discovered he wasn’t in the slit trenches with us we became suspicious,” Mr Tavender reported. “We went to his quarters and discovered a radio, which was still warm. That was the last we saw of him. He was arrested.”[6] The Japanese air raids were assisted by radio transmissions made by Heenan.[1] Among other espionage equipment, he reportedly had a morse code transmitter operated by an alphanumeric keyboard — similar to a Traeger Transceiver — which was disguised as a typewriter.[citation needed] Heenan was sent to Singapore, and was reportedly court-martialled in January 1942.[1] He does not seem to have been formally sentenced, but the normal sentence for treason by British officers was death.[citation needed]
      
      Heenan remained in custody at Singapore for several weeks. The Japanese gradually drove the Allies out of Malaya, and on 8 February they invaded Singapore Island. Within days, it became clear that the battle was being won by the Japanese. In the words of journalist and author Lynette Silver (whose main source is Elphick):
      
      By February 13[,] Heenan had become very cocky, taunting his guards … that he would soon be free and they would be prisoners. It appears that … British military police took matters into their own hands. After cards were cut to decide who would … [kill] Heenan, it is alleged he was taken to the dockside, where a sergeant executed him with a single pistol shot to the back of the head. The body was then dumped in the harbour.[7]
      
      Elphick also says that Heenan was shot at Keppel Harbour.[1]

Mrs Carroll died a few years later, and Bernard Carroll, who was an accountant, married Anne.[3] From 1923 to 1926, Patrick was a boarder at Sevenoaks School in Kent, and in 1927 proceeded to Cheltenham College, as a day boy, in a stream of students preparing for military careers.[3] Although he was then 16 years old, at Cheltenham he was put in classes with pupils as young as 13.
        
        Accounts of his time at Sevenoaks and Cheltenham show Heenan to have been a poor student and — in the words of the Dictionary of National Biography — a “gloomy, resentful misfit disliked by other pupils”.[3] He nevertheless excelled at sports, especially boxing, due largely to his impressive physique.[1][3] According to Elphick, Heenan was unpopular with other students at Cheltenham and was often in trouble with school authorities. Although he joined the Officers Training Corps (OTC) at Cheltenham, Heenan did not gain any formal qualifications;[3] because of this, he was not able to be admitted to British Army officer training, when he left school at the age of 19. Heenan instead joined Steel Brothers, a trading company with interests in Asia.
        
        In the early 1930s, Heenan applied for the Army Supplementary Reserve, the only way he could become an officer without formal qualifications. According to Elphick, had Heenan’s illegitimacy been known, it would have prevented him becoming an officer. He was able to join the reserve by presenting his baptism certificate, along with a certificate signed by his school headmaster, stating that Heenan was capable of performing the duties of an officer. This was endorsed by the commander of Cheltenham’s OTC.
        
        In 1932, he was placed on the Supplementary Reserve.[citation needed]
        
        In 1935, Heenan was commissioned into the British Army, with the service number 547AI.[5] His address at this time was recorded as Cheam, Surrey, England. He was put on the Indian Army’s Unattached List, and was sent to India. After six months’ training with a British regiment, Heenan was not accepted by any Indian Army regiments. He had to do an additional six months with another British regiment before being accepted by the 16th Punjab Regiment. He reportedly performed well in a skirmish on the North-West Frontier, but was later transferred to the Indian Army Service Corps. According to Elphick, this was a device commonly used to get unsatisfactory officers away from prestigious frontline regiments.[1] However, Heenan later returned to the 16th Punjabs, but to a different battalion.[citation needed]
        
        In 1938–39, Heenan took a six-month “long leave” (an Indian Army tradition) in Japan.[citation needed]

Nothing unpatriotic or dishonourable with being a Roman Catholic and/or an Irish patriot…but there is when you sit on the sideline or even assist the Kaiser and later the Axis during wartime.

  There certainly is poverty in NZ. There are some people who ripe the system off. However, there are others who for various reasons will never be successful for a variety of reasons. Some will have low IQ others will have mental health issues.
  
  This huge divide between the wealthy and those who cannot afford the necessitates to live decently is not good. I think nearly all National MPs would agree with me.
  
  However, National and the left have a different idea how to reduce the gap.
  
  There is no silver bullet and there is no simple solution.

She is heralding the Families Package as their greatest achievement but it too broad overshooting the target group.     But if the EQC have already paid their $100,000 then they have no further liability unless another EVENT can be proven – there has been over 10,000 followup quakes so which one is appropriate to call another claim.
    A claim must be proven by the policy holder who also has a valid policy with an insurance company.
    Those who bought “repaired ” houses will find that unless a valid claim as above is proven then they will have no insurable interest – ie zilch.
    I assume that when these people bought the houses under claim they had a building inspector’s report (caveat emptor) and a copy of the Council sign off. Doubt a LIM has any benefit as they are vague Council earners.

    Most people are unaware that a medical doctor is not actually a doctor i.e. they don’t have a doctorate. A medical doctor simply has two bachelor degrees. Specialists are different, they have doctorates. A person who has a doctorate has a higher level of education than a straight out medical doctor.

        It’s related to the history of surgery. The original surgeons were barbers, who branches into pulling teeth. They became barber surgeons and took on more surgical techniques. As time went by and they became more skilled, they wanted to join the guild of physic ( doctors or physicians ) but the snobbery of the physicians wouldn’t allow it. They also would now allow them to use “Dr”.They therefore formed their own guild, which evolved into the college of surgeons and as homage to their origins kept the “Mr”.
        
        Mr is now an acknowledgement that one has transcended mere medical training and is a member of that esteemed “guild”.

Right of way is Way of Right

There are a great many people in our little corner of the world who rejoice in our supposed geographical isolation, thinking in some way that it removes us from some of the worst aspects of humanity.

One of our former Prime Ministers even used our remoteness as a strategic platform when designing our Defence Force, and removing our air strike capability, preferring to vest our security in the United Nations apparently, which in the event, probably wouldn’t do a hell of a lot to assist us in part because we are so very far away. Isn’t THAT ironic!

Then every so often, something pops up that reminds me that we’re not so far removed from events at all.

Six months ago, my wife and I were in Toronto.

On Yonge Street, in Toronto, there is a huge shopping mall at the south end, with some wonderful food shops, and the friendliest staff. I bought a bag there, my wife bought a hat. We were there to watch a friend competing in the Invictus games, and Yonge street was the main thoroughfare between where we were staying and some of the wheelchair rugby matches and the indoor rowing. So we got to walk through it frequently, past the theatre district, briskly past some of the theatres that showed movies that were a little more risque. We looked at some of the wonderful restaurants and cafe’s that line the streets of Toronto, it’s a gourmands delight, with the myriad of ethnicities providing a delicious melange of scents that didn’t mingle at all with the pungent waft from the subway vents as a train thundered under our feet.

We never got as far as Finch street though, and it was on the intersection of Yonge and Finch where a white rental van ploughed in to pedestrians today.

I wonder, who did it hit?

Was it the wonderful waitress at the Japanese restaurant where I enjoyed the most delightful bento box for lunch?

Was it one of the many hundreds of volunteers who helped make the Invictus Games so successful?

Was it the hot dog vendor outside the hotel? Was it the concierge at the Sheraton who, on hearing that we were from Auckland, upgraded us to a corner room on the top floor, just because his brother lived in Auckland? That room had the best views that I have ever had from a hotel room.

Was it the hostess at the revolving restaurant at CN Tower? Was it the Taxi driver that took us from Pearson Airport to our hotel at 6 in the morning, who took the time to tell us about all the attractions in his wonderful city, of which he was so proud!

Was it one of the two afro-canadians in the hat shop who were the friendliest, most helpful people I have ever had help me in a shop, and so damn funny to boot.

I don’t know what it is about Canadians, but whenever they meet New Zealanders, there seems to be a kinship. We have so much in common. We’re rugged individualists at heart, sons and daughters of the commonwealth, and we both have to put up with loud, obnoxious neighbours.

We both know how to brew great beer, and cook good food. They need to learn a bit more about coffee, we need to understand poutine, but we do get on. We are very similar people.

Today, some of those similar people were killed in a manner that has all the hallmarks of an IS attack.

We may be a long way from Toronto, but the people who died today are not very far from who and what we are at all.

Will the government like its Aussie counterpart set up an inquiry in the Banks and other financial institutions given the following;

1. The Big 4 are Aussie owned.
2. The Head Offices appoint the CEOs
3. The senior staff are interchanged across the Tasman.
4. Multinationals have international cultures procedures and processes.

Turnbull resists for 2 years saying an inquiry wasnt necessary. Even a week before the inquiry he was on TV saying its wouldnt find anything which is why he limited it to 1 year so as not to waste money.
The Banks said nothing to see here move on just as their NZ operations are saying now.
The Governor of the RB and the Min of Fin are saying the same.
I suspect as with the Aussies we will see whistleblowers going to the media with compelling stories that will force a back track and we will see the same behaviour here.
Disclosure. I am a long time shareholder in the Aussie Banks but am considering quitting if the NZ situation is the same as Aussie.

Well here’s a very good reason for the US to continue to keep on Obama’s policy of financing Iranian’s sponsorship of terrorism.

Iran’s foreign minister threatens an “unpleasant” response if the US pulls out of Obama’s “Joint Comprehensive Plan of Action” – I would have wanted to sign up to it if they’d called it the “Joint Comprehensive and Progressive Plan of Action”.

Well, that’s fine then. A bully threatens that unless you keep on paying them otherwise they’ll bully you some more!

So let me get this straight, the deal was:
– the US is to fund a rabidly anti-US state
– to not develop nuclear weapons (by funding them sufficiently to develop nuclear weapons like Clinton’s Nork deal)
– in addition, Iran would get relief from the nuclear related sanctions (to assist it in developing nuclear weapons)

Maybe I’ll talk to my neighbours and, after shitting on their lawn, I’ll ask them to pay me to stop shitting on their lawn. And I’ll warn them they’ll have to keep on paying me otherwise I’ll shit on their lawn again. I can’t see why they wouldn’t pay up under those eminently reasonable (to an Iranian) circumstances.

    According to the ad, the views that people like myself and Israel have are discriminatory, “formidable and deeply devious”. If they aren’t talking about Israel’s views, then who else? I don’t see it aimed at anyone else. It’s pretty much a direct response to what Israel said and is pushing back against anyone who disagrees with the gay ideology. As Scott said the other day, acceptance of gay sex is becoming mandatory.

  There’s nothing wrong at all with rugby trying to shed it’s stereotyped image of being a homophobic breeding ground, full of spousal abusers.

  A true conservative would support this as they quite rightly make the point that it’s nobody’s business and it shouldn’t matter as long as they are good at the game.

  It’s not ‘our national sports teams’. It’s the insurance company – the American International Group.
  
  The CEO, Brian Duperreault, is a committed Catholic and one who experiences God speaking to him – but one from a single parent family whose mother was ‘looked down on’ and ‘knows what it’s like to feel excluded’ and so relates to all he perceives to be ‘excluded’. He’s preaching ‘diversity’. (Of course, recent articles on the ethnic make-up of the All Blacks makes a joke of that.)
  
  It’s the humanist distortion of Christianity which focuses on victimhood rather than on every human being learning to treat every other with dignity and respect. Having said that, there’s nothing wrong with wanting to act in accordance with the principles of your faith.
  
  I just have to wonder if his ‘inclusiveness’ included equal pay for equal work at all levels by those ‘included’- especially given his “43.1 million pay package last year after he took over as the insurer’s chief executive officer”. Like women, or the autistic he’s talked about.
  
  Then there’s the specific example from John Browne in ‘The Glass Closet: Why Coming Out is Good for Business” of how the gay network targeted an insurance company which wasn’t pro-gay (not anti-discriminatory against gays but actively pushing their agenda, particularly to get their business – having more disposable income than heterosexuals generally). As Duperreault wants to ‘grow the business’, I daresay he’s had to give in to that agenda.

    Yeah, nah. I call “bullshit” on that, irrespective of the priorities that sponsors rightly enforce on sports bodies who take their money.
    
    But in NZ rugby, at all levels, especially at the amateur club level, we need as much community buy-in and involvement as possible. We can’t afford to turn anyone away, or else, in a tight competitive market for the leisure time of Kiwis, we will eventually die.
    
    As per my post to Fletch about his Catholicism, as a good Calvinist Protestant I genuinely find aspects of his faith offensive and sinful. But I don’t get to use my membership of rugby to push that. Indeed, even though the Marist rugby club in our union is maybe a source of recruitment for the Catholic Church, that club still deserves the support and cooperation of all the other clubs in our union, mine included. Indeed, it is one of the most hospitable and it is a pleasure to visit and play them.
    
    And I don’t think my Calvinist faith is compromised fellowshipping with and in some way strengthening a community of idolaters. Instead, maybe you and Fletch have an issue walking and chewing gum at the same time when it comes to the LGBT community and how rugby, and Christians within it should be responding and engaging in the light of Israel Folau’s pronouncements.

There is no need for one to attack the other – and that’s what needs to be promoted. But then, I’m not aware of anyone saying rugby is not recruiting or should not recruit from every group.
      
      The argument is about what beliefs people hold outside rugby and/or one group insisting on the right to change or control whole belief systems.

        But what you overlook is that it is almost certainly above and beyond NZ Rugby’s contractural requirements to AIG. Therefore, it was in the interests of both AIG (to limit the brand association damage Folau’s comments may have brought to them as the All Black sponsors) and also NZ Rugby (because his comments also damaged their inclusive membership policy) to make an additional ad.
        
        And as AIG have the deeper pockets to pay for the damage limitation that Folau’s stupidity made necessary, and it is a chance for them to leverage of their association with rugby (which Folau sought to do in an illegitimate manner to publicise his beliefs)
        
        …the ad is in AIG’s name in the first instance.
        
        Don’t like it? Blame Israel Folau, whose stupidity jeopardised the brand and commercial and community activities of both AIG and NZ Rugby.

An 87-year-old American World War II Army veteran decided to take his family to France as a last hoorah. Everyone was excited to go, so they took their vacations, booked their flights and off they went across the big pond.

After exiting the plane, the vet approached customs and was asked by the agent for his passport.

He fumbled a bit to look for it in his bag but couldn’t find it. His family came to his aid, but the French agent was incredibly impatient and rude.

“Sir, have you ever been to France,” he asked.

The veteran respectfully answered that he had.

“Well, you should know then that you should have your passport handy when entering France,” he said rather harshly.

Without missing a beat the vet fired back, “To be honest, the last time I was in France was on D-Day in 1944 and there wasn’t a fucking Frenchman in sight to show my papers to.”

NZ shocks some UN body. We need perspective before Andrew Little and the Human Rights Commission use it for propaganda purposes.

A UN human rights committee is shocked by New Zealand’s record on child poverty, inadequate housing, the incarceration rate, and violence, abuse and bullying.

Note that the committee’s 18 members include the representatives of such bastions of democracy as China, Russia, Belarus, Egypt, and Algeria. Another is Cameroon, where the English-speaking minority has been subject to murder and torture.

Could it be that the dictatorships and Third Worlders use this committee to nit-pick Western countries? Some of its work seems to have included attacking America for the poverty of some of its citizens. I think even New Zealand had to get exemption to shield itself from committee criticism for ending compulsory union membership.

Regardless, our media will use this report to flail our moral back today, ignoring what a weird outfit the committee is. It is part of the office of the United Nations Commissioner on Human rights. Its title is the Committee on Economic, Social and Cultural Rights (CESCR). The committee meets in Geneva twice a year.

The committee monitors implementation of the International Covenant on Economic, Social and Cultural Rights by its states’ parties.

Here’s how the UN, on one of its internet sites, describes the committee’s operation:

All states parties are obliged to submit regular reports to the committee on how the rights are being implemented. States must report initially within two years of accepting the covenant and thereafter every five years. The committee examines each report and addresses its concerns and recommendations to the state party in the form of “concluding observations”.

We started with the A’s and have decided with immediate effect that we will raise our child poverty and human rights standards to match those of Afghanistan, Albania, Algeria, Andorra, Angola and Azerbaijan.   I read the article as well and do question what Andrew Little handed to them in the first place. Anecdotally, I hear many stories of people with no money having 5 kids, so no surprise this will exacerbate poverty. Then those kids rapidly breed and ever increasing wealth inequalities are created. The way Labour talk it is as if a few rich people are hording lots of money and screwing the rest of us.

  Being that less than 2% of the population is gay, that’s an awfully big percentage of gay people getting HIV and syphilis. No one really has to wonder why, do they? It’s gay sex.

      Not that incompetence is necessarily the case here. Just as the Auckland Council have been very slow and have been very risk averse in initiating his action against a “rates protestor”, so the judge is probably erring on the side of caution.

  I’m surprised that the judge granted Penny an interim injunction. The legal requirements for an injunction are well-established. One requirement )balance of convenience) favours the status quo. But another requirement (serious question to be tried) is at best debatable.
  
  Section 74 of the Local Government (Rating) Act 2002 states:
  
  Presumption of valid rating sale or lease
  (1) A rating sale or lease made under this Act is valid for all purposes, even if there has been an irregularity in the conduct of the sale or lease.
  (2) No purchaser or lessee is obliged to inquire whether the sale or lease was properly conducted.
  
  It seems to me that, to avoid section 74, Penny will need to establish that the sale process can’t lawfully proceed. I can’t see any compelling legal arguments but, as we’ve seen, the lottery of justice can be unpredictable.
  
  Penny can do a victory dance (for now) but she hasn’t won the war yet.

      Actually, Casey was one of the more engaging judges to appear before and I have never seen him referred to as an activist, previously.
      
      The two lawyers clearly had standing and the remedy of judicial review gives the little guy the chance to ensure that reviewable entities make lawful decisions and take into account the appropriate criteria. It took guts to take that case. Good on them.

But just because you belong to an organisation and you disagree with a decision of the leadership that is a reflection of the will of thousands of other members, doesn’t mean you should be accorded “standing” such that you are able to use the courts to override their decision. Is like you or me using the courts to sideline Jacinda Ardern and the cabinet, in defiance of the decision of millions of voters.         Sorry, Patrick Finnegan. Both he and Phil Recordon are good guys, and I know they had what they considered was best for NZ rugby at heart. As also did the NZ Ugby Union councillors, who accepted the invite to send the aall Blacks to South Africa. And who also, unlike Finnegan and Recordon, had put their names forward and had been rewarded by the rugby community with the authority to make decisions on their behalf.     Some fine central pinot noir from queensbury has helped me get over the shock.
    I didn’t think Penny would get over the line in terms of either balance of convenience or serious question.
    But it is only, according to the Herald, a temporary reprieve until Friday to enable her to file an affidavit in support of her application for judicial review. That should be, in due course, an interesting read.
