A High Court Judge allowed an appeal and discharged an assault offender without conviction. He had punched a security guard who “needed reconstructive nose surgery and claims he suffered ongoing pain and sleep deprivation after the punch”. He also suffered a chipped tooth. He was charged with ‘common assault’ presumably under the Summary Offences Act maximum 6 months. He should have thanked his lucky stars he was not charged with “Every one is liable to imprisonment for a term not exceeding 5 years who, with intent to injure any one, or with reckless disregard for the safety of others, injures any person” s189(2) Crimes Act (unfortunately it is not a ‘strike’ crime).

Following the District Court conviction the Minister put him on 5 years ‘good behaviour’ notice since he was granted residency in 2012 (a lenient but not unreasonable decision). The offender appealed on the grounds that his lawyer failed to advise him of the potential consequences of the conviction and that he should seek discharge without conviction. The HC Judge swallowed that line and ‘discharged him without conviction’.

What an utter insult to the victim. The nature of the assault was sufficiently serious that ‘discharge without conviction’ should have been out of the question, whether there were immigration or travel consequences or not. This is particularly so as he was not facing imminent deportation. I hope that Crown Law takes this to the Court of Appeal. The way things are going, someone will be discharged without conviction for blowing up a Synagogue.

  Someone may be acquitted for blowing up a synagogue, but imagine the sentence if someone was caught blowing up a mosque . . . Sleeze would want them deported, regardless of citizen status.

    If a charge is laid under the Summary Offences Act, it is heard by the District Court (could be by a JP or Community Magistrate) and there is no right of jury trial. Normally, if the penalty is greater than three months jail, the accused is entitled to a jury trial. Not that long ago, Parliament increased the maximum sentence for common assault (and assault of police officer etc) under that Act to 6 months but made it clear that there was no right of jury trial. The Crimes Act has various crimes against the person from common assault (1 year) to murder including various more serious assault charges such as against women or children, intentionally wounding etc with various maximum sentences up to 14 years for the worst assault cases. Those accused of these offences are entitled to a jury trial and historically these cases were heard in the High Court. However since over the years JP’s and other unqualified magistrates were replaced by legally qualified stipendiary magistrates (later renamed District Court Judges), all but the most serious indictable crimes are now tried by District Court juries. The requirement for High Court and District Court judges is the same – at least 7 years practice as a barrister or solicitor.
    One of the arts of a good lawyer is the ability to negotiate a lesser charge perhaps in exchange for a ‘guilty’ plea. This is called ‘plea bargaining’ and is often frowned upon. However where the evidence only marginally supports a more serious charge but the accused is prepared to plead guilty to a lesser charge, this is quite legitimate since is saves prosecution costs, saves court time and saves the victims from the need to appear and give evidence.

      The choice of charge lies with Police and if they feel they have a ‘bad un’ they may find multiple charges–the totality of those affects the Courts attitudes.
      
      Plea bargaining at an early stage may not be unreasonable. Charges get dropped in return for a guilty plea with certain outcomes and the Police not having to produce evidence to prove a case. Their Statement of Facts is sufficient.
      
      I was involved in a case where such a bargain meant Police could take their annual leave. Nobody lost. The criminal was convicted and the Statement of Facts presented by the Police Prosecutor to the Court was agreed beforehand. Everyone was saved a great deal of work and a fair sentence of imprisonment imposed.
      
      Having seen the judicial system at the coal face I am impressed with the integrity of it.

    This is a tricky one. I do not think the offender had any intention of causing harm when pushing the Lady, but the other offender did intent to inflict pain (at the very least) when he punched the Security Officer. On that basis alone the latter offender should not have been let off with a ‘discharge without conviction’. In the former case I indicated yesterday that he should have been given 6 months home detention (he got a 200 hour community sentence). The latter offender got 60 hours community sentence – it should have been 9 months home detention.

      ps A 9 month home detention would not have been available to the guy who punched the Security Officer as a summary charge of assault has 6 months imprisonment maximum. He should have been charged under s189(2) Crimes Act with its 5 year maximum (as the person who injured the Lady was).

  Peter, did you read about ILG’s part in this? He said the guy did not have to leave immediately. If ILG said he could stay permanently that may be debatable. However, compared to the dud Czech it was a reasonable decision.
  
  In any case, Knott is correct. Deportation should be left to immigration. Common assault should not automatically mean deportation.

    Yes, and I thought that I had noted that in my posting. ILG’s decision (which I have no particular objection to) was available to the High Court Judge who would have known the offender was not subject to immediate deportation if the conviction had remained.

      The offender was wrongly charged. An assault resulting in the need for reconstructive surgery is far more serious than ‘common assault’. It was a clear case of s189(2) assault which has 5 year maximum sentence.

  Of particular interest is he isn’t allowed to associate with the Avondale Mosque. If that Mosque is such an issue why is it still allowed to operate and the Iman and other senior figures not kicked out of NZ.
  
  Apparently his review excuse stated it was hard for a Muslim man to cope with the vast cultural differences in the West compared to those held up by his religion

  The problem is human nature. Judges will be swayed by their beliefs no matter what they might say. So a Left Wing Judge will use the law to pass a sentence that reflects their views.
  Similarly a Right Wing Judge will do likewise.
  
  Don’t Bullshit me that Judges are supreme entities they shit just like the rest of us.
  
  Over many decades its been obvious which side of the political divide most of them are and that’s the Left rather than the Right.
  The more extreme of them have gone to absurd lengths sometimes fatal like allowing rapists to roam the streets to rape and even kill when they would have been locked up by a Citizen with a brain.

  It seems to me that the core elements of democracy are seriously under threat around the western world. – When the judiciary make their decisions based upon their political views rather than the spirit of the legislation
  – When a remainer leader does their very best to circumvent the result of a referendum about leaving a customs union that has bastardised into a totalitarian political entity
  – When a party leader with a little over 1/3 of the popular vote has sweeping parliamentary majority and is able to embark on a program of economic vandalism
  – When a single teutonic party leader can force genocidal muslim immigration on 26 other (supposed) sovereign countries
  – When an outgoing corrupt President can leave behind an army of Benedict Arnold traitors to effect a coup against a duly elected President
  – When local officials can use vote manipulation to steal senate and congressional seats after the polls close
  
  When all this is happening, it’s hard not to look at benign dictatorships like Singapore with a little envy compared to the cancer of socialist democratic dictatorships slowly killing off the West.

I have seen much international correspondence on the Lundy case. The consensus is clear, this is the most blatant case of innocence these people have seen. Why is this so difficult for locals to understand? We would be better with the death penalty, Lundy would be a perfect candidate.

Cameron Todd Willingham may be the only innocent man executed in America in modern times. The death penalty focuses minds and forces people to study the evidence in cases. The death penalty focuses minds of scientists like a plane crash, they get studied until fully understood.

It is helpful the police are studying dna in the Kirsty Bentley case. This may give a taste for using dna to figure the Lundy case, there is a huge amount of evidence in the dna domain that proves Lundy is innocent, and points to the precise identity of the killer.

    Yes he may be innocent. Most Australians thought Lindy Chamberlain was guilty. But the dingo really did take the baby. The problem with lundy is there is no dingo. There is no other plausible explanation.

      Of course there is a plausible explanation. Lundy was associated with a man with massive debts. This man had invoiced the Lundys with a 500 thousand bill for grape stock root cuttings, and told his creditors Lundy owed him. One of them became impatient and went straight to source, but Lundy was in Petone.

  The judge using their role to make immigration decisions which are political decisions. The judge should just be deciding on wether punching someone was a crime. It’s the immigrations departments job to decide how that affects their status as residents.

Last Tuesday Amy Adams asked a Parliamentary Question about this Government’s

Meanwhile, the Herald says – National MP Maggie Barry has been twice investigated over bullying claims this year – including accusations she expected staff to do political party work on taxpayer time, which would be unlawful.

Taking the latter part of that – “political party work on taxpayer time, which would be unlawful” – shouldn’t Amy Adams have asked, in her Question regarding all the entities she mentions, not only if they are a wise use of taxpayer funds, but whether they are also even a lawful use of taxpayer funding?

The Tax Working Group was indeed Jacinda Ardern’s “captain’s call” to shove Labour’s original damaging water tax doubts sideways out of voter’s concern with the promise that any new taxes would return only as policy for the next Election.
What was clearly an Election policy – water tax – was a declared task of the Tax Group to work out, along with any other ‘new’ schemes, and earmarked not to be reported back before the 2020 Election and presumably introduced after an Election mandate.

Until Ardern was forced to take over, Labour did not expect to win the last Election.
They had no policy and most of the entities, appointed since, have been working on that – the result of Labour spending nine years doing little but change leaders multiple times, and then realising that Little wouldn’t do.
But they have been making up policy ever since by farming it out to committees of mostly Labour’s mates, as quasi-Government entities payed taxpayer funds.

And the question remains – Is it a lawful use of taxpayer funding?

  I am assuming you have asked a serious question, and not merely a rhetorical one.
  
  Yes, the expenditure is lawful. Governments are entitled to do reviews on policy issues. Of course Labour has more, because as you note they were unprepared for government. And yes they can appoint their mates.
  
  Unlawful spending is directly asking for a vote, or using party logos on government material. Parliamentary money (as opposed to government money, and yes I know they all come from taxes) can be used to generically promote a political party, but not to directly ask for a vote.

    Perhaps though, instead of “Is it a lawful use of taxpayer funding?”, the question should rather have been “Is it moral?” or “Is it lacking in transparency, integrity and honesty?”

      Good point. Unfortunately, nowadays in many walks of life, there’s a prevalent attitude which says: “If it’s not against the law, then it’s okay.” This, as you say, ignores the moral implications; but, then again, when did politicians, in particular, ever concern themselves with the ethical aspects of their own behaviour? It’s small wonder that the general public rate them lower than used car salesmen when it comes to integrity.

    I’ll bet the school hasn’t bothered to ask the parents of these kids what they think about external exams. Tonga, a country that has never been colonised puts a huge emphasis on external exams. Of course in the Tongan way it helps enormously when your auntie has set the exam paper and your uncle marks it!!

  NZQA is an external check on teachers and the standard to which they are teaching. They check that schools are teaching subjects that will enable kids to get a jobs and survive in the real world.
  We certainly don’t wont that to happen or our friends at WINZ would be without a Job and we teachers would need to up-skill so our pupils can cope with a changing world. This would eat into our 9 to 3 job and all our holiday time.

    When we have 1 std deviation between the mean of the Euro Pakeha population and the Maori Pi population measured from the Euro mean we have an educational problem. That difference puts the av. Maori/PI achievers at the college dropout level for the Euro.
    Not having external exams hides that. We need creative schooling and special competency to fit these lesser able people into suitable work. If we import all out labourers what have we left available?

  What is interesting about this ‘no exams’ idea, is that, in the ‘real world’ environment (ie, that world of employment etc outside the college grounds) it unintentionally places its students (especially those of ‘Maori’ and PI ethnicity) at a DISadvantage, even against their peers from other, similar, schools.
  
  Like it or not, employers place faith in ‘academic’ achievement (aka ‘Exams’) as they provide some indication of a job applicant’s abilities and contribute to worker ‘classification’ and suitability for both training and the job itself. Those ‘unexamined’ kids have had that chance removed and will inevitably and immediately be lower down the pecking order for any jobs they apply for.
  
  There is however another aspect which so far has not been addressed: the unintended message that this well-intentioned Principal is sending to her students:
  
  ‘That, in her opinion, you are too DUMB to be able to pass any exams and so I’ve taken them away to make your life easier’!
  
  The added implication being that ‘We are all equal and no-one must have hurt feelings’.
  
  Sorrry ma’am, the real world isn’t like that, and your students will learn that reality very quickly.

    In that context, some 35 years ago there was a lot of concern being expressed about the phenomenon of ‘Samoan flight’ from schools in one particular east Auckland suburb, as immigrant Samoan parents believed that the state schools in the area were not meeting their educational expectations for their children.
    
    The phenomenon was unheard of, and ruffled a lot of feathers within the Dept of Ed as it was inconceivable to the SJW, white, middle class inhabitants of that Department, that (mere) ‘Islanders’ would know what ‘good’ education was, much less actually do something about it and physically remove their offspring!
    
    It would appear that SJW’s are still misguided and still believe they are ‘helping’, even when they aren’t…

      One question to which I still can find no answer.     We have shown ourselves to be politically against Trump’s USA, rightly or wrongly. The odds are that Donald Trump will run again and will probably win based on current form.
    
    China, lovem or hatem are a major trading partner which we do need so NZ has to walk a fine line between the two. Our current govt is “bad” for our NZ/USA relationship so I am at a loss as to decide which path we walk but the current one is not right.
    
    I do not subscribe to the belief that the nutters on here keep pushing that we are selling our country to the Chinese politically or economically and if they are so worried I have no issue with them popping off and locating “new”trading partners but unfortunately this blog allows some very disturbed people a chance to air their paranoid theories.

  The fact is that China is our major trading partner, whereas the USA won’t even enter into a FTA with us and is penalising us further with tariffs. Also, being a military and diplomatic ally of the USA seems to count for absolutely nothing in their world view.
  
  Yes, China is expanding her influence in the Pacific. But the country is fucking huge and their economy is on track to soon be the largest in the world. What would you expect them to do?
  
  I’m generally not a fan of totalitarian systems per se, but maybe the Chinese political system suits China far better than a system where one drunkrnen dwarf can unilaterally install a government of socialist ecofucks who then destroy the country that has not elected them. Just saying….

    You are oh so right igm. We have a distinct preference for senior workers because of their work ethic. Our oldest employee is 74 – he works 60 hours a month and is a retired marketing director. We hired him at the age of 67 and he contributes so much to our business outside of his sales role. He doesn’t need the money but revels in the challenge and the competitive nature of commerce. He’s not the only one either – 60% of our employees are over 60. They are all teck savvy enough to cope with technology having worked with computers from the 70s.

Last I heard NZ (under Labour BTW; odd that) went all anti-nuclear and anti-USA, and the Americans, correctly, decided we couldn’t be trusted (aka an ‘Own goal’) and then the SLG (in her breathless, niave, stupidity) managed to insult President Trump (again, an own goal).

Bottom line: You don’t insult your friends and then expect them to be all luvvy-duvvy towards you afterwards!!

I gather that HDP is a Saffir, so perhaps she can’t be expected to know such things, but then again…

    Any change couldn’t be enacted until well after 2020 and should the coalition regain the treasury benches without putting a CGT on their election manifesto they would be unable to get the numbers I think and they certainly couldn’t claim a “mandate”. Not that that seems to bother ardern the liar but the drunken gnome would certainly block it.
    
    Transferring the house to your children would only increase their liability so a pointless exercise in my opinion.
    
    The argument that a CGT/death duty will reduce house prices is a myth, the tax will just be factored into the sale.

From Australia: Students strike for climate change protests, defying calls to stay in school

Thousands of Australian students have defied calls by the Prime Minister to stay in school and instead marched on the nation’s capital cities, and some regional centres, demanding an end to political inertia on climate change.

A 14-year-old protestor said:

“We have to sacrifice our education, which is something we really value, so we’re showing them that at the moment this is even more important than our education.”

A false dichotomy. They could have protested during the weekend – and shown that protesting was more important than doing homework, playing sport or watching movies.

But the protests have sparked their own reaction among key members of the Federal Government who have used commercial radio to dress down the students. Resources Minister Matt Canavan said the only thing children would be learn from the protest was how to collect government benefits:

“Walking off school and protesting, you don’t learn anything from that. The best thing you learn about going to a protest is how to join the dole queue. That’s what your future life will look like, up in a line asking for a handout, not actually taking charge of your life and getting a real job.”

        Fair enough Biscuit although I do have to admit that our neighbour is a great young teacher and she has bugger all of her weekends left after supervising and coaching sports on Saturdays and doing prep work on Sundays. She leaves home at 6.30 on weekdays and I don’t see her home most nights until 6.00. She’s not a union member and neither are the majority of the teachers at her school. The big worry is that dedicated teachers are leaving for overseas jobs. One teacher in our area is now teaching in Korea and is paid $130k a year tax-free and will pocket a $100k performance bonus at the end of his four year contract.

        Oh, I agree Biscuit and so do an increasing number of excellent teachers who see their only way forward is to leave NZ and be paid what they are worth and be paid on a performance basis. They are being replaced by new graduates supplemented by immigrant teachers who will know sweet FA about the NZ curricula.
        
        It’s a fucken shambles and needs to be dismantled from Hipkins down and reassembled on modern professional lines. It won’t happen of course and our good teachers will leave the profession, leave NZ or leave the state system and head to private schools.

        And in all fairness rockape the good teachers do a ton of work out of hours with kids. Regrettably much of it is social work for kids with dysfunctional parents or parents who just don’t have a clue about their responsibilities to their children’s education. Some kids start school never having had stories read to them or learning basic counting skills in the kitchen. Some don’t even have toileting sorted at five years. Teacher critics forget that teachers only have the kids with them 35 hours a week and parents have them for the balance.
        
        I’m not a teacher and yes the profession in NZ has its warts but I can’t go along with the one-sided BS on KB.
        
        If the profession is so dysfunctional then why do most Asian kids excel and only a minority of the rest of us achieve? They have the same teachers after all. The answer lies in the home environment.

So I’ve had a little more in depth look at the migration compact. This is a longer post. Bear with me. I’ve read it and sat through an hour and a half video on it so you can have fun!

How Labour voters who were anti immigration could support this is beyond me. And NZ First voters?!?! Why National are not using an opportunity to take swing votes is beyond me. You don’t even have to deal with the migrant issue? How about pure national sovereignty? The potential for Iwi/kiwi dichotomies is immense. Winston and our idiot PM said many things on immigration. Why are National not exploiting it? Go around the media until they have to report on it.

Clause 11 says, paraphrasing ‘because illegal immigration is going to happen anyway we need to facilitate it’. As Stefan Molyneux points out, that logic only applies to illegal immigration. Not guns for example. Or free speech. Or free enterprise. Or sex trafficking. Imagine applying that logic to rape. Rapes are going to happen anyway so we need to facilitate rape and cooperate with rapists at the points of departure, transit, and ‘settlement’.

Clause 12 says ‘countries are being transformed forever’ as if it has nothing to do with deliberate policy decisions. It’s just a fait accompli a priori premise.

Cl 13 “migration should never be an act of desperation” – why? It should be ‘consensual’ lol. They do that Jordan Peterson Crowleyian redefining of words. Its consensual if coerced.

Cl 14: allows for national sovereignty before the total carve outs.

CL 15: the Compact is an anti discrimination Trojan Horse. “We reaffirm the commitment to oppose all forms if discrimination against migrants”- If you oppose anything migrants want like genital mutilation etc that’s an offence at international law.

There are 23 objectives which are a total wishlist. They simply dissolve any difference between citizen and illegal alien. Just a few examples “facilitate mutual recognition of skills” – because the University of Swahili is the same as Otago. “Provide full access to services” – why? They are a privilege of citizenship. “Establish procedures for the portability of social security and other earned benefits” – right. So national super should just be a voucher the wielder ia entitled to instantly and from anywhere, including back home in Mumbai! And its totally equal you know. Any white person is fully entitled to portability of their Pakistani benefits in New Zealand.

“Ensure all migrants have total legal support and individualised due process” – the compact actually bans collective actions. See, in every single other facet of life the globalist SJW promotes group identity. But not here. Here, everyone is an individual entitled to tax payer funded legal deliberations. And the compact would set up a while set of new bureaucracies to defend illegal aliens from any form of legal redress.

Objective 8 bans govts from preventing ‘humanitarian assistance’. So if Soros wants to fund the Indragheta to ship in millions of Africans to Sicily he can do that with impunity. A govt cannot prevent NGOs ‘helping’ and is prohibited from ‘collective actions’. Anyone who says they are “enhancing reception and integration capabilities” like the Muslim Brotherhood or B’nai B’rith has total impunity. You cannot stop them. Likewise these parasites have a total right to life. If they come and get into trouble they have to be saved, and must be ushered in, at which point all their other ‘rights’ catalyse.

Objective 11.27 “we commit to manage our borders in a coordinated manner… to facilitate regular migration…”
There is no national sovereignty here. None. The compact says to prevent ‘irregular’ migration you make all immigration ‘regular’ as all migrants have a right to citizenship benefits im western countries because of climate change.

Obj 12 – detention is a last resort, and can only come after exhausting all alternatives.

Obj 16 ’empower integration’ by massive diversity and inclusion campaigns and removal of threats to ‘social cohesion’ based on ‘mutual respect’. That’s funny because Indians, Chinese and Muslims don’t respect elements of western culture in various ways. There is zero obligation in the compact on the migrant. We are all to simply be reengineered from birth to love the illegal alien.

Obj 17 eliminates discrimination ‘against migrants’. There is no provision for discrimination that goes the other way.

It says migrants have to be given tax payer dollars to collectively punish ‘incitements to violence’ defined as infringements on their right to do whatever they like. Ah, that looks familiar. The NSW law criminalised speech using exactly the same tacit language. I wonder who will benefit from this little ? criticism of migrants will become a hate crime equivalent to violent physical assault.

Objective 17 c is the worst one. It says states must re-educate media to be pro migration, and ban all forms of media which are ‘xenophobic or discriminatory, including internet based media’…

“…stopping allocation of public funding or material support to media that systematically promote intolerance
…in full respect for freedom of the media”

17 g is amazing – it says you have to give migrants tax payer funding to prosecute ‘discrimination’ “…including in the context of electoral campaigns”.

(But they might not)
How much have they risen in the last two century’s since the Industrial revolution started pouring tonnes of CO2 into the atmosphere?

So what happened to Labour’s internal polls that they kept on trying to sway the punters with by saying National were below 40% but in the high thirties. Have the punters woken up about their trust for the Coalition with NZ First on 4% and the Green just making 5% and Labour 43%. National will be extremely happy on 46 % after the JLR saga and will know that the country is starting to waver on the Show Ponies honesty so interesting times ahead. Also what happened to Simon Lusks prediction on the blubber site last week not so good on facts all piss and wind.

Breaking News
The President of the United States, Donald J. Trump, and President Xi Jinping of China, have just concluded what both have said was a “highly successful meeting” between themselves and their most senior representatives in Buenos Aires, Argentina.
Very importantly, President Xi, has agreed to designate Fentanyl as a Controlled Substance, meaning that people selling Fentanyl to the United States will be subject to China’s maximum penalty under the law.
On Trade, President Trump has agreed that on January 1, 2019, he will leave the tariffs on $200 billion worth of product at the 10% rate, and not raise it to 25% at this time. China will agree to purchase a not yet agreed upon, but very substantial, amount of agricultural,energy, industrial, and other product from the United States to reduce the trade imbalance between the two countries. China has agreed to start purchasing agricultural product from US farmers immediately.
President Trump and President Xi have agreed to immediately begin negotiations on structural changes with respect to forced technology transfer, intellectual property protection, non-tariff barriers, cyber intrusions and cyber theft, services and agriculture.
Both parties agree that they will endeavor to have this transaction completed within the next 90 days. If at the end of this period of time, the parties are unable to reach an agreement, the 10% tariffs will be raised to 25%.
It was also agreed that great progress has been made with respect to North Korea and that President Trump, together with President Xi, will strive, along with Chairman Kim Jong Un, to see a nuclear free Korean Peninsula.
President Trump expressed his friendship and respect for Chairman Kim.

President Xi also stated that he is open to approving the previously unapproved Qualcomm-NXP deal should it again be presented to him.
President Trump stated: “This was an amazing and productive meeting with unlimited possibilities for both the United States and China. It is my great honor to be working with President Xi.”

The Fentanyl move is very good news. It’s a killer.
As I mentioned in the IPhone thread yesterday, Xi has blinked and come to the party.
Just like Canada and Mexico have.
