      I wonder whether he has ever been audited? Surely a single individual who is able to sell countless Kg’s of lawnmower should be considered a business, and subject to tax?

    No Dad; his real name is Karel Sroubek. He “obtained” a passport in the name of Antolik to travel to New Zealand.
    
    Of course when that matter went to Court, the “learned” judge decided he was just misunderstood, and not a criminal at all, and discharged him without conviction.
    
    Now us taxpayers are paying for his board and food at one of Her Majesty’s fine prisons, and we will also be picking up the legal costs for enforcing the revokation of his visa, and his eventual deportantion, just as we have with the Large German Gentleman.
    
    As with the earlier post about Shane Jones’ taxpayer funded re-election slush fund, we taxpayers are generous buggers eh!

      think i heard recently that most ‘Judges’ are just failed tin pot Lawyers with Whigs. Appears a very good assessment ,as many many so called sentences of violent criminals and baby killers and drug running gangsters get treated like poor wee babes in the woods ,or is it little lambs who have lost their way.Maybe the Judges are more culpable than the criminals,having lost their ways in sentencing.
      Also could be the directive from the Peters selected out of control sickos who are at the moment in charge of NZs well being. Yes reminds me of the type of decision made by Peters.
      Peters compromised his beliefs and now we see the results.
      To quote Sir Thomas More who said. “When statesman forsake their own private conscience for the sake of their public duties,they lead their country by a short route to chaos”.
      Yes a sad sad indictment of Peters who daily lives the betrayal of NZedders and his loyal supporters.

        My thoughts are that Judges get immune to what they see and hear and so whereas Joe and Joesses think hell that crim should do X years the Judge sees it as just another day at the office and passes a sentence they know wont be appealed.
        
        Because another thought of mine is that Judges don’t like to get appealed. Its like getting called to the Head Masters study and told off for being a naughty boy or girl.
        
        And then we have the Left Wing influence on the Bench IMHO they means that soft sentences are the order of the day also to go with the Governments wish to spend as little ( no pun intended) as possible locking crims up.
        
        So all in all the citizens don’t get the justice they want just a legal system that suits the Judiciary and the Government.

        The present Government wants to ‘virtue signal’ by reducing the total number of prison cells & beds in New Zealand.
        
        Most New Zealanders want to see serious criminals locked away for lengthy periods. As usual, our COL Government wants to do the exact opposite of what its voters / citizens expect. Ardern’s administration are enemies of the people; like most lefties, they are ‘soft on crime’.

        Yet judges are prepared to push the limits of the law and invoke “exceptional circumstances” to let off everyone who comes up for sentencing under 3 strikes. They are clearly not interpreting the law as written in a balanced way or playing it safe to avoid appeal. They are pushing to the very limits of what the law will allow in the direction of letting people off.
        
        I think judges are just a bunch of wets who are soft on criminals.

        AFAIK he has not posted since the Judge told him to take down part of a posting at the start of the Bloomfield v Slater trial. He has made a few brief comments on other postings. He also has the lawsuits brought by the health professionals yet to come. There has been no MSM reporting of the Bloomfield trial.

      He was using the prison phone system available to all inmates. They have to pay pay-phone rates for calls and are limited to 10 approved numbers. He called an approved friend and a journo happened to be with his so they had a chat in breach of prison discipline rules.

      She also admitted sending the electrical hand tool with a replacement shipping container security device hidden inside – this was intended to deceive the bonded store/ customs that the container was unopened when it had been. It was only a sharp-eyed inspector who picked up the slight seal identification number discrepancy that exposed their plan.
      
      Why this woman was even allowed a visitor’s visa to come here is itself worthy of a corruption investigation of immigration/border control staff in my opinion.

One of South America’s most notorious and exceedingly wealthy drug lords said he could reach almost anyone in power, and be given favours.     If it takes (say) two seconds to type the word ‘world’ (‘cos it is, after all , ‘World’ typing day), and there are 86400 seconds in a day,
    
    What does one do with all the ‘Worlds’ that one has typed?
    
    Are they sent to a particular address so that they can be counted and creditted to an account for some good purpose (preferrably your own) or are they returned for correction or…
    
    And if you use a computer and generate 86401 ‘worlds’ will that be held against you (if only for five seconds)?
    
    These are important questions.
    
    Do you think the SLG (or even the UN; since they are interested in all sorts of ‘worlds’ – even ‘typed’ ones) will convene a comittee to consider them?
    
    One has to ask.

        I wouldn’t expect a requirement for visas in advance of travel. Rather, New Zealanders would be treated the same as visitors from other developed nations, ie 90 day visitor visa on arrival. Another scenario is a special “New Zealand” category where you get the right to live and work in Australia if you score enough points. Qualifications, skills, English language, good character.
        
        I think what happens will be partly driven by the attitude of New Zealand governments to Australia. If the government here stays in denial about the right of Australia to deport non Australian citizens, things could get messy. Australia will simply never budge on this issue. Under international conventions, to which New Zealand subscribes, it is only citizens that have the absolute right to live in the nation of which they are a citizen. Everyone else is resident at the discretion of the host country.

The Jazmine Barnes shooting is a superb frame for the real problem. What was politically exploited for a white shoots black story has turned out to be another of the thousands of black on black gang shootings that plague the USA.

It appears even worse if the story that this was a drug deal gone wrong with the mother fleeing from payment to gang members who then opened fire turns out to be true.

The USA needs to deal with the fact that the African American family has been essentially destroyed by Johnson-era welfare policies that created financial incentive for men (including black men) to leave the home. African American families survived slavery, world wars, Jim Crow, lynchings, etc. It was Johnson’s Great Society bullshit that broke the black family apart. Until this is changed, until black on black violence is acknowledged and dealt with, there will be countless more Jazmines. I note that if you take out suicide and gang on gang shootings, the USA’s gun violence rate is below that of many European nations. And before you raise the gun suicide trope, remember that Japan has highly restrictive gun laws and double the suicide rate of the USA.

This lesson on the dangers of a seemingly benign welfare state is directly applicable to NZ and our chid poverddy problem.

This is the same Sarah Hanson-Young who spent $4,000 of taxpayer money ($1,000 more than Anning) on dubious grounds:

What about a bit further back, how about those nasty Scandinavians do the decent thing and apologise for all the reaving they did up and down the coastlines of western Europe as Vikings? Should the muslim world be giving a substantial proportion of oil revenue to Europe for the way they raped and pillaged southern Europe from the Dark Ages onward? Not enough – let’s go back a bit further?
    
    You get the point? Every race or nation or people can lay claim to a grievance of some sort against another race or nation or people for some atrocity or other over the past 2 millenia.       Well said. Jeremy Waldron (this country’s finest philosopher by a country mile, and a world expert on the legal and ethical aspects of possession and ownership) – he has the sense to now live and work overseas – formulated the ‘thesis of supersession’ which, basically, says what you have expressed. There has to be a limit to the scope of historical grievance, because the world (and the people in it) now is so substantially different to the way it was when most of these things happened. He is particularly critical of the way that the Treaty of Waitangi is still regarded as ‘a living document’, for example. So, one could say that there has to be an arbitrary cutoff period (somewhat akin to the duration of copyright), after which, history is put to bed.
      Furthermore, there is a powerful argument to be advanced to the effect that Maori owned nothing of this land, prior to the arrival of Europeans: they merely occupied (and destroyed) much of it.

    In the 1820’s the only slaves were those that the maori had taken from defeated villages so I have no idea what you are talking about.
    
    The “sale” of a piece of relatively useless land almost 200 years ago for a few muskets and axes should have no bearing on present day actions, however, just to put things into perspective for the idiots like yourself, a few muskets enabled the recipient to attack, conquer and gain even more land than the land that was sold for the muskets. At that time maori didn’t really “value” land but were mightily keen on utu and eating their neighbours. Muskets made that task much easier.
    
    That is a fact so stop all the 200 year old wailing and look past the headline, or are you just not interested in a balanced approach at all?

    An interesting reply, so now a question for you (since obviously you know everything about such matters):
    
    Give ‘Maori’ land back: To whom?
    
    As you will well-know Before the British arrived Maori were never a ‘unified’ ‘nation’ in the modern term, and land was constantly changing hands as tribes won and lost.
    
    So my question: To whom should this land be given back?
    
    Those who held it on date ‘x’ in 1840?
    
    Those from whom the date x’ tribe had wrested it before date x in 1840, or…
    
    And if so, given that ‘maori’ had no written language, how can this be proven?
    
    And what about the Maoriori? A people who had their land forcibly removed from them during the ‘modern’ era?
    
    Curerent ‘Chathams’ ‘maori’ say there is no case, yet if your statement is tenable, the Maoriori have a very definite legal case for full return and, indeed, COMPENSATION by the tribe who invaded.
    
    And no, I’m not being pedantic, merely taking the case you advance to its logical conclusion.
    
    And then, there are the ‘Slaves’.
    
    As Maori kept slaves, ‘compensation’ is a most excellent idea, and no doubt various ToW cases against the tribes concerned are being prepared as we speak. From memory Ngapuhi were very ‘slave inclined’ and Tainui had a reputation as being slaves (albeit poor ones) under other tribes (Arawa for instance), so yes, ‘compensation’ could be very lucrative.

    I have some reservations about comments made from both sides of this debate.
    I’m no fan of those who would create a grievance industry out of this issue but the matter is a little bit more complex than an attitude of “Get over it” can fix.
    We need to be honest that there were problems with pre-Christian Maori society just as there were (are?) problems with the European side. The issue of slavery is one example and the Musket Wars another that should be acknowledged. But it is also true, if my recollection is correct, that these issues were partly resolved by Maori themselves prior to the signing of the Treaty. My understanding is that slavery was abolished by Maori themselves without Crown compulsion and to me this indicates that they were far from the savages saved by the white-man some seem to believe. It’s a little more complex than that. Maori society may have been technologically Stone Age, but there is no evidence of which I am aware that their moral reasoning was flawed any more than the colonials who emigrated here (or remaindered in Europe for that matter).
    It’s not all a one way street that European settlement was an unqualified benefit to the indigenous people. Nor is it true that European settlement was an unqualified disaster for them. There were pluses and minuses on both sides.
    The way I see it is that there were problems that needed to be ironed out, and one of those issues was the immorality of improper land confiscations, actual fraud and the like. If we are to move forward as a nation together we must address issues like this justly and resolve them in ways that are just for both parties. We all expect reparation if we are the victim of serious injustice – it is only proper. It is also an imperative if there is to be genuine reconciliation.
    From what I have seen Maori themselves have largely conducted themselves in a way that indicates they would be reconciled with the national community. The settlements resolved so far have entailed compensation that is often a mere fraction of that they might arguably be entitled to. I only have a casual observers opinion, but their conduct (the negotiating tribes) has not been vindictive or spiteful.
    I have reservations about those on both sides who either want to create a grievance state that will never be satisfied, and in some cases non-Maori who need to consider their own position and whether that is a reasonable one in the given circumstances too. Real problems have to be identified accurately and resolved if we are to regard ourselves as a just society.
    Like I said, I’m no fan of some predominately left-wing radicals who will not be reconciled in any circumstances, but I don’t think that position is in any way true for all Maori. Nor do I think (or hope) it is true that the non-Maori side is comprised of irredeemable racists and thieves. Hopefully the extremist elements of either side won’t prevail.

      When commenting on Maori ‘moral reasoning’ you overlook a crucial point: as a pre-literate society, they had no written code of ethics (unlike the Europeans, whose ethics were highly sophisticated by the Victorian era). Accordingly, it is only a matter of supposition that they did exercise sound moral reasoning; and the fact that they evidently thought nothing of slavery, infanticide, and cannibalism would tend to suggest that they did not (and I don’t buy into the ‘ethical relativism’ argument, because it leads to so many nonsensical conclusions).
      As to modern Maori: the problem here is that the arbitrary distinction (based on bloodline, no matter how tenuous, and self-identification with Maori culture) between’Maori’ and ‘the rest’ is no longer tenable, because of the high degree of intermarriage (and hence, hybrid offspring) between the various ethnic groups. In other words, the advocates of Maori ‘sovereignty’, reparation, and similar separatist notions, are peddling a hollow sham. The days have long passed since Maori were a distinct ethno-racial group (they were never a ‘people’) and, in the twenty-first century, our government and judiciary should pandering to those who wish to trade on sentiment.

Sophisticated or not, slavery only ended in the 1800’s, the Industrial revolution had its downside for many people, and some of the European “goings on” in even the mid 20th century were rather ethically challenged (ok, ok, that hardly avoids Godwin’s Law, but it is relevant).

      Actually, what happened is that the Maoris weren’t stupid and in signing the treaty they recognised the benefits of living in an advanced democratic society.
      
      This worked well for them (and the European settlers) and generally speaking everyone got on together and built a fine cohesive colourblind society. Maoris fought for their country proudly in 2 world wars and they contributed to the economy, the arts and the intelligensia. They were New Zealanders. Kiwis.
      
      Then, 130 years or so later, everything started to change. Radical Maori elements who were smarting against a society which rewarded skills and hard work rather than mana and lineage achieved cut-through with their fanatical claims of marginalisation and one of the world’s racial success stories began to fall apart.
      
      New Zealanders have progressively fed these fanatics since the 1970s with their policies of appeasement and handouts and this has just made the problem worse. Appeasement simply doesn’t work. It just makes things worse. What was needed was a cohesive and rational rejection of their radical claims; but this seems never to have happened.
      
      We are past the point of no return. As our economy declines due to our inferior education standards and our lack of real skills there will be less to give to the Maoris. As this happens, the Maoris will become even more angry and violent as a culture, to the point that Valerie Morse and her band of beginner terrorists will look like a kindergarten troupe.
      
      New Zealand has gone.

    Whatever happens with reparations will not change the fact that NZ has an underclass that is mainly driven by poor parenting. People who were not raised properly by their own parents and have become failures and are now screwing up their own kids and perpetuating a cycle.
    
    Anyone, no matter their race or how poor they are, can help their kids exit that cycle just by raising them well and instilling good values. There is no barrier to doing so in NZ and refugees and other migrants have repeatedly demonstrated this.
    
    There is inequality but is does not transmit across generations from lack of opportunity due to economic or systemic factors. The cycle has not trapped anyone. It perpetuates only through terrible parenting. Maori are over-represented in this and handouts will not make it better.

  I don’t mind Kiwiblog moderating gratuitous obscenity and vulgarisms – because obscenities and vulgarisms demoralise Kiwiblog’s readership. It also damages the National brand. I just oppose moderation towards substantive topics and formulated opinion on third rails.
  
  I was disappointed when a comment on the Vagina Monologues was initially moderated yesterday. It was valid political critique to relate the play to Betty Friedan. As long as posts are articulate and informational, invective should be permitted. But it should be witty ideally or at least incisive. Isolated pub-house vulgar racism isolated from any substantive contextualisation is a bane. Because it aids the anti-free speech lobbies tremendously.
  
  I know many would regard me to cross that line – but I always opine with respect to an empirical basis.
  
  It is really depressing that any comment on a substantive issue related to identity politics seems to encourage vulgar racism. The Alt-Retards make life unpleasant for everyone. Analysis yes. Spare insult no.
  
  I say incendiary things – like Indians can’t code. But then I link to the story in the Hindu where that incongruity was discovered in a massive survey of engineers in New Delhi and elsewhere for example. Obviously it’s not true for every individual. But that was the finding in aggregate. I can then relate that discrepancy to the H1B Visa scheme and public infrastructure failures in California and I’m making an argument – not just expressing an attitude.
  
  Anyway, I just have a couple of entries I’d like to talk about today. Will see how we go.

      Well put – to be judicious, not gratuitous. I know that gratuitous comments demoralise the readership because they demoralise me.
      
      If I browse I want to see vivacity or at least earnestness. I very much dislike seeing crudeness. I would expect crudeness and baseness from the Standard given it’s clientele and hosts. But not here amongst the more affluent. I can be crude, yes, but only for effect not because it’s my desired default mode.
      
      I know my material can have a chilling effect on the board. Which surprises me. But only presumably because it’s dense, which is annoying, and incongruous, questioning common view points.
      
      I just want one forum, just one, where natural cadence and preference doesn’t have to be filtered and self-censored for the benefit of people with diminished capacities of understanding, limited emotional resilience, or deficits in attention and literacy.
      
      Just one. That’s why I waste my time here.
      
      There is nowhere else. It’s when the last forum is removed that the problems will really start.

      But everyone knew that if and when she scrunched up her hands, shook her body indignantly and exclaimed ‘BOTHER!’ that:
      a) Some boundary or other had been crossed
      and

    I get where you are coming from, but I always remember my old Mum telling me that vulgarisms and swearing were the sign of a limited vocabulary and a lazy brain. Or possibly its a busy brain that doesn’t appreciate the subtlety of of the English language.
    Either way it detracts from the reader’s appreciation of the writer’s comments.

As a number of people have advised, a small number of people are obviously misusing the report function here as “quickest way to remove an abusive comment from view”. The problem is it can be used to remove any comment from view.

The other way you can signal you think a comment is unacceptable, is to click on the link which says “Report Abusive Comment”. If a certain threshold is reached of people reporting it, then the system will automatically hide the comment from view, and place it into moderation for a moderator to review. This can be the quickest way to remove an abusive comment from view. This should not be used for comments you merely disagree with, but only ones that are abusive.

I’ve had another two comments parked in m moderation from yesterday’s GD:

Your comment is awaiting moderation.

Tall Man – it’s not the hidden comments due to down ticks that are the problem.

There seems to be semi organised reporting (clicking REPORT) that, if several clicks are registered, puts a comment into moderation, so it isn’t visible until it is released from moderation by presumably DPF. This can take some time, like a day.

This doesn’t just hide the reported comment in the moderation queue, it also appears to hide all comments in the thread below the reported comment.

This system was put in place by DPF to make it easier to report abusive and defamatory comments that have long been a problem here. It is a good idea, but some have been abusing this by malicious reporting. It amounts to mob censorship.

And:

Your comment is awaiting moderation.

Linking to a source is normal practice, especially when there is more detail there.

In the site Comments Policy – https://www.kiwiblog.co.nz/comments_policy – there is no indication that linking to a source is a problem. I have never seen DPF say not to do it. I have had a strike for doing it.

Accusations of ‘link whoring’ amounts to a form of trolling to try to disrupt or discredit or censor. Reporting ‘link whoring’ seems to me to be an abuse of site processes. It is used to try to suppress free speech, something that is against the pro-free speech principles of Kiwiblog.

Be aware that this deliberate suppression of comments – it can affect whole threads – is an attempt to manipulate what comments everyone can see.

While DPF is staunch in promoting and defending free speech you cannot rely on discussions here being freely displayed due to the abuse of moderation by some.

It’s impossible to know how many comments are being affected as you only know if your own comments are being parked in moderation.

User-initiated censorship is not just an abuse of reporting here, it is an attack on free speech.

As Kiwi Dave said yesterday “the result of reporting some comments into oblivion (as distinct from downticking, which still lets people see comments if they really want) is censorship of some contributors to a blog whose attraction includes its lack of censorship.”

        You’re wrong. I explained yesterday but you may have missed it. This has nothing to do with hidden comments due to downticks.
        
        If enough people maliciously click REPORT a comment and it’s thread automatically gets removed from anyone’s view into a moderation queue, where it remains hidden from everyone but the commenter unless it is released from moderation (this can take up to a day from my experience).
        
        Some people are doing this deliberately to suppress comments from general view.

        Pete is right in this case. Down-ticking to hide a comment (so you can still view if you wish to amuse yourself) is distinct from reporting a comment so it is completely removed until moderated.
        
        This can be misused. I report some comments that I believe are completely improper or reveal personal ID’s or something like that. Otherwise I go with the idea that downticks is the appropriate way for the community to show it’s disapproval.
        
        And that applies even if you dislike PG on principle.

        I have reported posts that I think are possibly defamatory. Those that are abusive that are directed at others I ignore, anyone brave enough to abuse me will receive adequate response, unless it is from an absolute numbnuts which i take as an uptick and move on.
        
        Use your time to work on the big stuff, ardern the liar, lees-galloway’s inept and corrupt practices, genter’s useless husband gaining hundreds and thousands of dollars from her department without review, a lying thieving deputy pm with a measly 7% approval rating now down to 3.something.
        
        Don’t sweat the little stuff, life is too short and if the owner/facilitator of this blog wants to moderate, block, hide comments, that is his right.

      I disagree.
      
      I believe that for the great majority of the time people use both the ‘thumbs up/thumbs down’ and ‘report’ features appropriately.
      
      What I do see though is people here getting heartily sick of a few anti-social individuals using this blog to promote their personal or business interests in often very lengthy and repetitive posts and/or clearly attempt to drive traffic to their own sites – despite, in some cases, years of requests to stop it or at least tone it down.
      
      To lump these cases in to your argument of ‘free speech suppression’ is ludicrous – these people are free to speak all they want on any subject on their own blog. Of course, they choose to continue to dump their shite on KB because their own sites have no readership.
      
      I totally welcome the report feature as it allows the KB readership to exercise some influence over the small number of largely single-issue nutters who choose to come here and spoil things for the great majority.
      
      If people don’t like this development – then they are free to move elsewhere.

        I didn’t lump valid cases of abuse in my criticism. There are two distinct things here, reporting valid abuse and maliciously misreporting abuse.

        a) you don’t know what the great majority think of individual comments. The great majority of readers don’t comment or tick.
        
        b) It’s important in a democracy that different opinions and views are tolerated – that’s a fundamental aspect of free speech that some (a small number) here are trying to shit on.

      In my view the report function is very seldom abused. We have a few who purposefully annoy and their rash irritations may be quickly erased. They are subject to users at the time too and reporting is not automatic by commentator, reader or date.
      
      Another group who get reported are the Labour Interns/trolls/ mischief makers who turn up when the COL needs diversion. They may get their noses tweaked or their tails pulled in this political forum. They are seldom offensive but do provide sport.
      
      Comments can go into moderation randomly, which is not a bad thing for gentle control, when the post button is clicked. Those seem to appear quite quickly. We all post here as guests and DPF provides as wider forum and as well managed as can be reasonably expected. Freedom carries the price of tolerance.

  Note that this feature should not be used on comments just because you disagree with them. If you continually report comments that are not abusive or trolling, then I’ll suspend your account. The up and down vote buttons are what you use for agreeing or disagreeing with a comment. This feature is for comments that are highly abusive.

  Now, I’m not blaming you as such… for as you rightly put it some days back
  Sadly shitting in other people’s online nests is very common – some people get way with as much nastiness as they can, and then push boundaries more. I guess some people just have nasty streaks. perhaps they get some sort of power thrill from attacking others.
  
  I don’t shit in other people’s blogs… I have never had one of my comments removed (unless nested below a removed comment)
  I do not do personal abuse.
  
  But I don’t know who anonymous abusers are; I don’t know the relationship between those who abuse me across different blogs.
  I suspect there is a connection.
  
  I applaud your desire for free speech free from intimidation, but I didn’t get it on your blog.
  Currently, I figure it is safe for me to post on KB.

    I often look at some post or other KiwiBlog and see (say) 45 upticks and 1 downtick and strive valiantly to see just what it was that the solitary downticker had seen to make him/her/it so moved to vote.
    
    I’ve never reported with a view to having a post removed just because I disagreed with it … and wonder if one way to see that sort of thing curtailed would be if the names of each ‘reporter’ were carried below the posts they did report.
    
    Along with an automated ‘suggestion’ by DPF after every tenth (or so) ‘report’ that the reporter in question go outside and smell the daisies for a while rather than vent in here…

    Maggy, as far as I’m aware i dealt with the issue raised by you in Your NZ straight away, and I’m not aware of anything since – you haven’t reported anything further.
    
    Unless all comments are pre-moderated (that would cripple most blogs) there is no way of stopping all abuse from happening. It should be dealt with as soon as possible after it has been reported or noticed. That’s what i do, and in my experience that’s what DPF does – but with the much larger number of comments here it’s difficult to handle.

There are a handful here to whom anybody not of their is ilk is a decided enemy. They are at war with most of the world and probably themselves too.   Pete George, exactly what moderation policies would you have DPF implement? He does have a responsibility to police genuinely abusive comments, and he doesn’t have unlimited time to devote to moderating. As far as I can see the current policy is a reasonable compromise between these requirements.
  
  I don’t buy there is even semi-organised mob-censorship of comments using the report function, because plenty of comments from posters with unpopular views (Muttonbird, marquess, stephieboy, etc.) remain visible. Not saying there can’t be cases of comment that don’t deserve it being deliberately reported out, but claiming it is some organised censorship just doesn’t fit with the facts.

    My comment quickly disappeared into moderation – I think there is a high chance others took starboard’s comment as a signal to others to do likewise. That started the spate of report initiated disappearances.

    Certainly have done the same, but it takes at least 5 reports to send a comment into moderation, and I simply don’t buy that as an explanation for that reason. One or two, sure, but 5 ?
    
    And note Muttonbird’s find from DBF’s rules, abusive use of the report function will lead to suspension. If David would do that a couple of times to those who do abuse the report function, I think it would improve matters.
    
    But fair comment from Than, is there really enough of this going on ? Haven’t seen much, though NSF has been affected a bit lately.

      NSF is a perfect example of why hiding comments by downticks is a good system. Regardless of whether you agree or disagree with him (I honestly don’t know or care whether Lundy is guilty – just not an issue that interests me) his posts are just obnoxiously long*. Hiding them saves a lot of tedious scrolling. It’s not censorship because those who want to read them (or are just curious) can expand or collapse them as they wish.
      
      * I say this with full awareness that many of my posts are on the long side, although I do at least try to post on more than a single topic.

        I think I’ve seen at least a couple of cases though where NSF’s posts have outright disappeared rather than just hidden (click to read more).
        
        Of course if you don’t monitor the comments all the time one probably misses most outright removals unless another poster refers to that post in some way.

    The old way that all the fuel companies used to do this was to make their profits at the wholesale level by agreeing to a higher price at the refinery. Thus they could demonstrate that they weren’t making much profit at all at the retail level while pulling in the cash via their dividends from the jointly owned refinery.
    
    This was largely negated as a technique with the introduction of retailers like Gull who don’t buy from the refinery but internationally so they introduced extra competition.
    
    Competition and ensuring that it really exists is the best way to keep prices at the appropriate level – enough to make it worth being in the business but not so much as to extract some form of monopoly rents.

      This is not true. NZRC is a tolling refinery and has been for decades. They never own or sell the oil they process. Instead they receive a fixed fee based on regional refining costs.
      
      The input and output costs of oil and fuel products is done by each oil company. Transfer pricing is closely watched by IRD to ensure it’s reasonable.

        Oh sure, the big retailers never gamed the transfer pricing mechanism and never took out significant cash dividends from the refinery. Nope, never happened.
        
        Probably a little more policed now, but the IRD doesn’t have much concern over internal transfer pricing. The TP regime is really intended for international transfers, much easier to get away with it internally because as far as the IRD is concerned, the tax is paid at some point so there’s no tax evasion involved, just a shift in who is paying it.

        I think you are mixing up transfer pricing of oil and petrol with internal transfers for services etc.
        
        For the former, you can’t really boost it because oil, refining and shipping prices are fully transparent. IRD would come knocking if you were charging your subsidiary $100 a barrel if the market was only $50.
        
        But the cost of internal services is much harder. All global businesses legitimately build up service operations in low tax locations – NZ based businesses are no exception – and maximise revenue in them through internal charges.
        
        But it’s still not a blank cheque to charge what you like because IRD has the ability to assess what it considers a real cost, independent of what a company thinks, and it has a lot of data to draw on.
        
        You’d be stupid to overburden your local business with internal service charges because you’d just make yourself an audit target. And no-one likes being audited…
        
        Also the refinery is a publicly listed company. It is a nice reliable dividend provider for people like me. I suspect me and other shareholders would be concerned if its dividend policy stripped out cash

  Further, if as a spokesperson for BP says that information about the breakdown of costs has always been available on the company website, “once the Commerce Commission gets cracking” why will it take a year to check out the figures?
  
  And when this issue is as sensitive as it seems, with Ardern’s “fleecing us” comment, would BP conceivably print a pamphlet giving figures which would be different to those they’d give the Inquiry?

Having just finished Emma by Jane Austen despite my extreme opposition to Ruth Bader Ginsberg I am appalled at the Democrats callous disregard for her wellbeing as an elderly woman.

RBG was unable to appear in the Supreme Court because her condition is so degraded and so unpleasant to observe she is being withheld from public view.

An 85 year old woman who has served her causes industriously should be permitted to retire and have a care for her own wellbeing.

It grates very much that the Democrats so vociferously champion the affairs of women, whilst literally hounding their supposed favourite women into an early grave for political expediency.

RBG is going to die because the Democrats won’t allow an old woman any peace.

  I disagree KeaRea. RBG is going to die because she has an illness. While it is usually safe to presume the Democrats are behind pretty much all the evils of the world – in this case I believe RBG is very much the main culprit in exacerbating her health issues.
  
  From the appallingly injudicious comments she made about being unable to serve Trump if elected, to the clear hubris she showed in clinging on during the Obama years when she should have retired and made way for Obama to replace her with another alt-left idealogue – she is the author of her own problems. Clearly RBG was hanging on for what she expected to be an orgy of feminist self-congratulating when the first female SCOTUS judge resigned to the first female President (HRC).
  
  Sadly like all modern feminist claptrap – the separation between her fantasy world and the real one was huge.
  
  The silly old duffer boxed herself in to this impossible situation. Having announced she’d move to NZ rather than serve Trump, when he won – she couldn’t do the honest, honourable, principled, decent thing and step-down – because she’d give up a liberal seat for a conservative. So she has to cling on in the hope that Trump is unseated in 2020.
  
  If she’d been so smart, so brilliant, so insightful, so committed to the cause – she’d have retired at the start of Obama’s second term – but as she wasn’t any of those things – she’s successfully screwed SCOTUS to the right (barely given how Kavanaugh is working out and how Roberts appears to have gone off the reservation) for a couple of generations.
  
  Golf claps to the poster-girl, alt-left feminist, in the end delivering the whip hand to the man she hates so much.

    Sadly, I largely agree with you, DP. I think a 28th Amendment is very much overdue.
    
    Some years ago, I read somewhere of a plan for reforming the Supreme Court by abolishing life tenure and instead appointing justices to a fixed 18-year term, staggered such that one seat comes up every two years. An Amendment such as this would ensure that every president would be able to appoint at least 2 justices, and it would reduce the incentive to appoint young jurists, who might serve for more than 30 years (with the risk of ending up like RBG). (Bush 43 appointed Justice Roberts to the Court (as Chief Justice!) in 2005 when he (Roberts) was just 40 years and 8 months old!!)
    
    And, of course, such an Amendment would greatly reduce the incentive for justices to time their resignations (should they wish to resign, rather than cling on to the bitter end) so that they are replaced by a politically-friendly president.
    
    Having said all that, I like the way we do things. This is how the Chief Justice (Justices?) gets to be appointed: https://www.beehive.govt.nz/release/process-underway-appoint-next-chief-justice-new-zealand. And, in New Zealand, we have a mandatory retirement age for judges of 70.

An 18 year old Saudi woman did a runner from her parents in Kuwait heading for Australia where she hoped to claim asylum.
She made it as far as Bangkok Airport where she was kidnapped in the transit area by some Saudis and taken to an airport hotel waiting for deportation back to her family who she said would kill her because she’d renounced Islam.
We know all this because she’d managed to hang onto her phone and has a Twitter account.
By now the very recently appointed head of Thai immigration, Surachate Hakparn aka Big Joke by the Thais, was rushing to the airport.
Rather than coming to her assistance he insisted she be deported.
However she’d barracaded herself in the dunny and missed the flight.
Later some UNHCR people turned up and she left with them after being given a temporary visa.
By now the spotlight was on Thailand who have their tourist industry to think about.
However there’s a reason why Surachate is known as Big Joke and there’s no telling what he’ll do now.
Also.
There’s already bad blood between Saudi & Thailand going back almost thirty years to when a Thai worker pinched a huge amount of jewelry and shot off back home. He would have got away with it except his village suddenly had big parties every night . . . .
Most of it was never recovered, but the wife of a top policeman was seen wearing some at an official function.
I wouldn’t be surprised if in a while when the dust is settled something happens to this unfortunate woman.
Could be wrong.

Is Trump preparing for a popular uprising, rather than re-election?

OPINION: Donald Trump is not behaving like a man seeking re-election. His latest nod to the radical possibility of declaring National Emergency powers to erect his beloved border wall is just the latest case in point.

There are two theories as to why this is, but only one of them makes any sense as a political strategy for the embattled United States president.

The first is to take Trump at his word: that he expects to run in 2020 and his relentless pursuit of his 35 per cent base will somehow deliver enough votes for re-election. In reality, Trump’s abandonment of swing voters in favour of a base-only approach will doom any prospect of a second term (if he makes it that far).
Don’t take my word for it. Barely two months ago, Republicans lost the national House race by 10 million votes, the largest such margin since Watergate. The midterms were so indisputably a referendum on the Trump presidency that even Trump admitted as much – in fact, he did so ad nauseam throughout his red state rally tour in October…’

The important point is that the President is relying on his core blue collar, evangelical and conservative vote base. The 35 %.He has no proposals to expand that by putting forward more moderate polices to attract more moderate supporters ( including the existing ones within the GOP and elsewhere ). A non-compromise,non negotiation stance that could see further polarisation with no consensus. A drift towards either running as an independent or open rebellion as he promised if Hillary Clinton had won the poll 8th November 2016.

Odd also that you don’t think the weaponisation of utterly unsubstantiated rape allegations to prevent a good man from being put on SCOTUS is “chilling”.

An interesting Reuters article: Explainer: Trump’s emergency threat on wall risks dual legal challenge

It covers (among other things) the law:

Under the Constitution, decisions about spending taxpayer funds and creating new policy are made by Congress. However, the president can make quick decisions during emergencies under a patchwork of laws in specific situations such as war, natural disasters and epidemics.

A 2007 report by the Congressional Research Service, a nonpartisan research arm of the legislature, said: “Both the judiciary and Congress, as co-equal branches, can restrain the executive regarding emergency powers.”

The National Emergencies Act of 1976 was meant to create a congressional check on presidential emergencies. Under the law, the president must notify Congress and the public about an emergency declaration. Congress can override such a declaration, but it requires approval by both chambers. That could be hard to get with the House of Representatives under the control of Democrats, but the Senate in the hands of Trump’s fellow Republicans.

So, if the Congress process leads to a stalemate, then it’s off to court.

Legal scholars said it was unclear exactly how such a step would play out, but they agreed that a court test would likely focus on whether an emergency actually exists on the southern border and on the limits of presidential power over taxpayer funds.

The position is unclear (for me at least).

One scenario: Trump declares a national emergency; gets access to the money; spends the money (while his legal team defends the national emergency declaration in court proceedings that take years) – by which time the wall is built.

Another scenario: a court issues an injunction that preserves the status quo (ie the money can’t be spent until a court rules on the matter). An injunction in a supposed national emergency situation seems unlikely, but who knows.

  In that first scenario, it seem unlikely that much of the wall could be built before the emergency was tested in court. But maybe some of the fencing that the president was showing off recently could be in place. No way is there ever gonig to be a multi-billion dollar wall the full length of the border as repeatedly promised

    I don’t know anything about US injunction law, but in NZ (and similar jurisdictions) the three-part test is: (1) serious question to be tried; (2) damages would be an adequate remedy; (3) balance of convenience [ie is it easiest to preserve the status quo or allow things to proceed in the meantime].
    
    Yes, US courts have issued injunctions with respect to Trump decisions, but where a national emergency is asserted, how quickly can a matter go to trial? There’s an exchange of documents (and preliminary skirmishes about whether or not specific documents are required to be disclosed). Then there’s preparation and presentation of legal argument. And then there’s appeal after appeal as things move up the judicial ladder.
    
    What I’m not clear on is how closely a court would scrutinise a claim that a declaration was justified on national emergency grounds (on a preliminary basis). This situation strikes me as different from others that we’ve seen – eg the Muslim ban, where a decision can be suspended while the court considers the matter. Time will tell I guess.

      So it so insignificant as a national emergency that he is taking a couple days to decide whether or not it’s an emergency. Allied to that, he’s come right out and said it’s just a tactic to get the wall funded.

Equally, though, if he’d quickly declared a national emergency when the migrant caravan was approaching, and played up the potential terrorist thread, it’s quite possible that a court would have given him the benefit of the doubt.         The keyword in that definition to me is “immediate”; an emergency is a sudden change in circumstances, requiring action as quickly as possible. If Trump can afford to take his time deciding whether something is an emergency, then it’s not an emergency.

Traditionally a first bill for consideration sets out the priorities of the Executive and Senate majority. What might one expect a Republican bill at present to consider? International trade? Foreign Policy? Russia, China, Europe? Immigration? Health Insurance? Judicial Reform?

The bill, sponsored by Marco Rubio seeks to give state and local governments legal authority to boycott any US companies which refrain from trading with Israel – which is defined to be a ‘boycott’.

Twenty six states have already enacted law sanctioning entities which divert trade from Israel. Thirteen more states are pending. Rubio’s bill is designed to prevent constitutional challenge to those sanctions.

These punishments will also hit individual American citizens. The sanctions will apply to individual contractors who are sole proprietors or director/share-holder companies.

That is what happened to Bahia Amawi, who lost her job working with autistic children because she refused to promise not to buy goods produced from Israel. Bahia didn’t actually say she would not buy goods from Israel. She only reserved her right to choose to buy and sell at her discretion.

Not only that – the Bill says the United States must arm Israel sufficient to ‘superiority over any combination of states’. ‘Any’ states. It mandates transfer of all new American technologies. It also requires the establishment of an indeterminately sized fund for the Kingdom of Jordan, $1billion per year to Jordan, and actually mandates that the US maintain a troop presence in Syria.

Thus, the priority of the Republican Senate is totally divorced from the priority of the Executive and the President, or the electorate. The United States’ governs for Israel first; observably, undeniably, literally.

The priorities of the United States’ Senate led by Marco Rubio are totally opposed to the priorities of the United States of America. Democrat, or Republican, Black, White or Hispanic. Not a soul or a citizen beyond the United States Senate, AIPAC and the Jewish community regards repudiating the First Amendment of the United States Constitution for Israel’s benefit the singular legislative priority of a government in shutdown.

It is clear, the United States Senate on a bipartisan basis serves the interests of AIPAC, not the United States’ electorate. Setting the S1 Senate bundle to Israel could not be a more resounding literal and symbolic demonstration of Israel’s supremacy.

The United States is a salient topic for general debate because it is the source of the major trends that will effect New Zealand. Theory and economy. The changes in conservative philosophy occurring in the United States will profoundly affect us. I do a favour actually, even alluding to it.

Commenters here often complain about an irrational preoccupation by other commenters with the affairs of Israel.

But here is the reason for the attentiveness. Because a clearer demonstration could not be provided that AIPAC and Israel determine the intellectual and governance agendas of the United States of America.

Food-stamps for urban dependencies will not be forthcoming until the Wall is funded. Those urban zones could burn. And until there is a wall, they should burn. But the priority is Israel.

If a person of insight wants to discuss contemporary affairs, it is impossible not to discuss Israel and Jewish occupation, because if not central or primary it is salient. It is not a morbid fascination or unfounded pathological obsession on the part of observers of this phenomenon. If it arises, again, and again, and again, that is because it is relevant.

I may or may not be a European male in the range of 25 – 35. One of the first proper novels I read was The Hope by Herman Wouk, which sub-grouped to reading about the figures named therein. I formed a set of favourable views.

Rather then express my present view, I’ll just quote Theodore Beale’s response to this Bill – which is representative.

  That is a point of view. I’ve removed the objectionable parts.
  
  That point of view reflects that of every principled conservative who has an interest in the United States’ Constitution, the single last sanctuary for free speech in the world.
  
  My position is that S.1 is deliberate provocation drafted by virulent anti-semites. The bill will cause an explosive backlash once it is understood. The bill is a disaster for the Israel – United States’ relationship, and anyone who is a friend of either.
  
  Here is how perverse the Bill is. It places a presumption of anti-semitism on every commercial decision made by a commercial operator in the United States. A decision favouring a non-Israeli counter-party or product in any commercial context with an Israeli actor will be prima facie boycott divestment and sanction.
  
  The Bill would literally end the first amendment to the Constitution, and make every American the outright economic slave of the Israeli.
  
  The Bill is going to have very serious consequences. I would encourage all the friends of Israel who read Kiwiblog, quite seriously, to contact their acquaintances and protest this anti-semitic attempt to end the Israel – United States alliance and cause outrage and hostility to the Jews by their friends.

Renters will be hit hard this year: so glad we sold our rental when we did:
