More claims of incapacitating health and victimhood from vexatious litigants on Whale Oil again yesterday, which not only misrepresents reality. And they think the media publicity was somehow a good thing.

Nige (blog manager): Just goes to show the influence this site has eh.

But Whale Oil is not telling it’s readers about the truth of three defamation cases that Cameron Slater is involved in. As a result there are comments like:

No other journalist in NZ has so many honest people behind him.

Karma will get them in the end, and the continued growth of WOBH will ensure increasing numbers of people get to hear what’s really going on.

You might have been temporary lost in some of the battles, but you will win the war.

Some people are so vindictive they just can’t let go.

I was wondering how many court cases were still pending and how that was going to be handled. I know you would rather fight on and take it to them, but I’m certain that you are getting the right advice, health comes first.

You’ve been brutally fearless and a force of nature on the political landscape.
Stay fearless and apply those traits in your recovery.

It’s too bad that those responsible for this, the vexatious litigants, will never face the costs they should do.

As for the litigants not giving extra time, have they not dragged this on for years already?

The courts have different views.

[139] It is therefore apparent that the defendants took no heed whatsoever of the description provided by Lang J in his judgment of 18 May 2018 as to the pleading requirements for the defences of truth and honest opinion.

    There appears to have been a blanket ban on any facts of these cases at WO for those allowed to comment there. The many who have been banned don’t have a chance of saying anything there.
    
    I posted this here because some readers of WO are also likely to follow things here, and I think they should have facts available as to the true nature of the three legal and financial holes Slater has dug himself into, and keeps digging deeper.
    
    He is a victim of his own publications, tactics and legal incompetence.

      I was banned from WO for a difference of opinion. They are as much of an echo chamber on the right as the is on the left.

      I really struggle to understand why some would have sympathy for Cameron Slater just because he *sometimes* posts right-leaning views.
      
      Everything about him is disgusting. He has no sense of personal self-responsibility, he has leeched off the taxpayer for so long, he publishes absolute lies so long as someone will pay him, destroys people’s lives for fun, then when held account cries victim.
      
      Even if the stroke is genuine, it probably has more to do with being a fat lardass who sits on a computer all day, every day, than the so-called “stress” of court cases – which could have easily been avoided by simply acting like a decent human being. (After all, noone has ever tried to sue David Farrar for defamation, even if they disagreed with his political leanings.)
      
      If the stroke is real, it was a direct consequence of his unhealthy lifestyle choices. But it shouldn’t excuse him from the consequences of his shitty behaviour to other human beings, and whilst I might be tempted to laugh at his bankruptcy application, I have more sympathy for Matt Blomfield et al who may not ever receive any compensation for his defamation. Slater really is a piece of shit.

  Seems bankrupcy was inevitable and he was wise to be bankrupt now rather than someone like Matthew petition it later, although some creditor may have been about to pull the pin.
  In that sense health would not come into it, but in this instance citing health reasons (genuine or otherwise) would be an attempt to deflect from the stigma of bankrupcy.
  The OA would now work to wrap the various court actions as expeditiously as possible and presumably there would be a hefty six figure sum owing at the end of it.

    Bankruptcy now was done deliberately to frustrate the court over (i)not providing full medical details -Blomfield case
    (ii) and the other Sellman case where his bullshit during the discovery process meant the judge required Slater ( and his henchman Graham) to face discovery in front of his honour.

      Bankruptcy cannot be delayed or deferred merely because court proceedings remain pending. So Cam could file bankruptcy regardless of medical conditions. I would guess that he is seriously insolvent otherwise the OA could pay off his debts and discharge him as a bankrupt. This has the unfortunate consequence of denying his litigants their full day in court, but if he is badly insolvent perhaps the litigants should cut their financial and non financial losses and get on with life.
      Not sure how Matthew Bloomfield is feeling, but I suspect he would regard the bankruptcy as a total vindication of his reputation – especially as the recent interim judgment that Cam’s defence was hollow and rubbish. He would have been aware that he would have been unlikely to actually receive more than a small portion df any damages and costs awarded.

  Yes, he seems to have brought all this legal shit on himself… but FFS stop drooling over it. There’s no obligation for him to lay it all out on WOBH either. He’s not on trial on his own blog.

    Yeh, sorry, but the whole stroke thing is both suspicious and also conveniently timed, especially given that Slater has popped in and out of Discus comments as well. He created his own mess. He is the consummate hypocrite, too, especially where Blomfeld is concerned, having stolen Blomfeld’s information to write scurrilous things about MB for payola, then complaining when suffering a similar fate at the hands of the equally appalling Nicky Hager, who shares many characteristics with WO, including the physical repugnance which Slater made so much mirth out of, apparently all the while avoiding any mirrors.
    I battle to feel sorry for Slater. He engineered his own doom; even if he has suffered strokes, these were apparently brought on by his court cases. More likely brought on by losing them, just like his depression was apparently once brought on by being a loser. Newsflash. When I’m losing, I also get depressed and then it motivates me to do better, I’m not sure this is such an unusual circumstance.

    I am reminded of his ‘rules of engagement’ (which seem to have disappeared). One was about wrestling with a pig – you get muddy and the pig enjoys it. I sort of see Matthew Bloomfield and Simon Bridges in the role of the pig although I doubt they were enjoying it.

Why not divert your palpable dislike for WO to the Standard or one of those hideous lefty blogs? I haven’t been near the Standard for many years but the visit I made left me with many questions about humanity in much the same way as I find your vitriol towards WO.         I posted the same at The Standard.
        
        I don’t have a palpable dislike for WO. They’re actually managing to run things without Slater fairly well, good on them for that. The sanitised comments mean you can’t take much of that seriously, but some people are putting a lot of work into keeping the posts going.
        
        But they are also being quite deceitful with what is really going on in the courts with Slater.
        
        So I’m making facts available to those who follow WO and also follow KB, there’s probably quite an overlap. That this attracts some attempts to play interference is to be expected.

        I haven’t tried to present here as an objective, neutral observer here. I’m not. I’ve been quite open about the fact that Slater has at least twice assisted in legal attempts to go as far as imprison me, and to inflict major financial damage on me, with hopeless charges and attempts at entrapment. So I’m not impartial at all and have never claimed to be.
        
        Here I’ve presented court documents which just scratch the surface on how poorly Slater has done in various defamation cases. And he (or Whale Oil) have kept the facts from Whale Oil readers and made ridiculous claims of being the victim.
        
        Slater and others associated with him have inflicted serious attacks, vexatious, vicious, nasty, you name it, on probably hundreds of people.
        
        I’ll keep putting out facts, and there’s more to come.
        
        Given the damage Slater et al have caused the National Party alone I’m surprised that you’re taken to attacking me here, in apparent defence of Slater.
        
        Do you think that paid for hit campaigns on Whale Oil aimed at ruining careers (business and political) are acceptable?

Trevor Mallard as Speaker of the House approached the Prime Minister about the poor state of the fences around parliament stating they needed some maintenance work.

Jacinda Ardern puzzled about this. Two days later after intense thought, she realised she could use her true and tried method of working groups to solve her problem. To be balanced, she organised three working groups to find out how much it would cost to repair the fences.

After a year of work, the working groups came back with their solutions.

The first working group came back with a quote of $500.

The second working group came back with a quote of $600.

The third working group, led by Sir Michael Cullen, came back with a quote of $5000.

Ardern questioned why the third group was so much more expensive than the others. Cullen replied that they’d hire the first recommendation, procure a $3000 lawnmower for her and a $2500 genuine imitation painting from Helen Clark for himself.

Thus the third working group’s work recommendation was taken and we now know how the COL operates.

Forget the long, long list of other CoL disasters, current and still pending evil fruit (such as Sroubek LOL), this CGT nightmare means the next election is National’s to lose.

Maybe National needs to switch the Crown Prosecutor with the Big Sister / Tax Expert last minute and destroy Thick Cindy in the debates. These will be almost unwatchable, think Key V Goff (in the Christchurch Press debate) ‘show me the money’ x 10.

Meantime, Simon Bridges forget telling Waitakere Man anything more complicated than the fact a Lotto win will be taxed even if it’s not true or Robertson denies it.

For Kiwis, taxing Lotto is tantamount to taking a dump under the goal posts at Eden Park.

Final thought. I’d advise CAC (Central Auckland Cindy) to stop referencing Morrinsville as part of what informs her and her decision-making. She would literally have cow shit thrown at her if she walked down Thames Street.

    But she has wrapped fish and chips which then qualified her to be spokesperson for small business and farmers and small business are going to be top of her mind.
    
    The only good news one can take from this is that there is so much space at the top of her mind that you could fit by in large the lion share of nz farms in there.
    
    Not sure that taking stock of the salt and vinegar supply at a fush and chup shop qualifies her for much but again, it’s a great deal more business experience than the likes of Robertson and Cullen have.

      1. Ardern is prime minister English is not.
      2. English at least had a degree remotely relevant to his portfolio
      3. It doesn’t make it ok for the ludicrous comments Adern makes because English may or may not have been a sheep shagger.
      4. English had a competent team around him so his lack of actual acumen was supported by surrounding himself with people who had walked the walk.
      5. At least English was talking about something he had some actual experience in.

        Why? Because NewstalkNB doesn’t look into things with enough time and effort. Hosking has now taken the side of PRO-cgt if it is slammed only on rental owners. He keeps going on about ‘people who own 4 or 5 rental properties’ and clearly has no knowledge that:
        
        1. MBIE figures show that of 130,000 landlords, slightly more than 100,000 owned a single property. So: Mum and Dad landlords.
        
        2. CGT is nothing but Inflation tax on Mum and Dad long-term landlords. The Bright-line test was all we needed to curb speculators.
        
        3. Many of these people are just saving for their retirement and are already middle-aged or elderly. CGT will take a huge chunk out of their retirement savings.

      When you look at Grant Robertson’s ‘financial experience’ you will find early in his um, ah, career- and he skited about this a while back – he had $7 million of funds to dish out in Samoa.
      That is his financial skill. Period.
      Handing out other people’s money.
      OPM.
      But proclaiming himself as a financial mind and taking the credit.
      
      We also need to remember that he’ learnt values from his parents’ and his father was jailed for theft from his employer after stealing for ten years and using it for gambling.
      WE are his employer.

  I doubt that Judith would get the numbers unless there was back to wall desperation. The National Caucus is nowhere near this. If Judith knows she cannot get the numbers it seems she is willing to put her best efforts into the job as she did when ‘sidelined’. The Leader must have the confidence of Caucus and provide the leadership to hold the team together and achieve optimum performance. That is far more important than aiming for a high public profile which the media is denying him anyway. Being merely a show pony just does not cut it in the long term (I am not referring to Judith). National’s best chance of success is to run with Simon into the 2020 election and to this end he needs and deserves support from as many as possible.

        I admit I have always been a bit surprised how well JK rated and how low some of the opposition leaders rated, way below their respective party support. Also, such a large amount of (undecided, informal, don’t know what they are) missing answers required to get up to a total of 100%.
        Sometimes I wonder if the respondents mistake the question for “who is the Prime Minister?
        But regardless, I don’t see National getting 50.1% of the effective votes cast in 2020 if the leader is still polling in single digits.

        It’s perfectly obvious someone touches up the photos somewhere along the way, unless Adern has a series of miraculously vanishing and reappearing moles.

        OK if they’re taken by a staff photographer they will be colour corrected and cropped, retouching is an instantly dismissable offence. Now the subject may well have had a make up job, that’s the subject’s choice and responsibility. The photog then uploads the captioned image to the DAM and a page designer calls the image from the DAM – they have precisely zero capability to edit the image here.
        
        If an image is submitted, generally via email, then the supplied image will be captioned (not in Photoshop) and submitted to the DAM. Now this image may well have been ‘chopped before it was supplied, especially if it comes from a women’s mag but Stuff is not responsible for that.

        I realise The Herald is not Stuff. The Herald is set in India and then printed here (which explains the atrocious grammar and dodgy spelling). For a bowl of rice these people could make Nanaia Mahuta look attractive. To even suggest Stuffed would operate any differently would be incredibly naive. In case you are wondering I’m very well qualified on this subject and have spent many years running companies that photoshop sows ears in to silk purses and then market them for a very good income.         The weirdest example was the photo after Neve was born. I figured that was supplied (i.e. the journalists weren’t actually in the hospital). when it first appeared on one of the news sites (Herald, or Stuff? Maybe both?) Jacinda looked natural for a new mother – a little worn at the edges, but glowing. The moles were very apparent, but it all looked natural and happy. A few hours later the photos were replaced with an airbrushed version of the same photo. I thought that was weird.

    They might be based on known points but at the end of the day valuations are really just a guess. 10k either way and your taxes will be affected by 3k. Not an insignificant amount, especially to someone who’s retirement nest egg is in question.
    Also opens it right up to corruption. It becomes worth paying someone a thousand to increase the value by ten. And who would know?
    There’s talk of using a computer program to do a mass calculation. Like that’ll work.
    The only true value is what someone actually pays. Up to then it’s all speculation, and having you taxes assessed on speculation is just wrong.

    And individuals get a 50% discount. And art and collectibles are taxed and lifestyle blocks are exempted up to 20,000m. So completely different to what is proposed here. It’s bloody complex once you start getting into CGT. Great for accountants and lawyers who have had bugger all tax planning work in the last ten years. The average lefty has no idea how much dead weight compliance CGT will add to the economy for a variable, unpredictable cash flow which will only bring in 2.3% of current tax take for the first five years. That’s on the TWG predicted 8b over five years. It could be less. Complete dog of a tax.

  I’m definitely not a fan of Radio NZ, but here’s what it says on the web site:

  Nothing there about NZ being the only country in the OECD without a capital gains tax.
  
  Elsewhere, the report describes New Zealand as being an “outlier” by having no capital gains tax. This is quiet correct. Of the 36 countries in the OECD, the only two I know of without capital gains tax are Singapore and Belgium. In my head, that’s about 5.5 per cent of the membership. Include NZ and the countries in the OECD without a capital gains tax make up about 8.3 per cent of the organisation.

        Just because other countries do something is no reason, in itself, that we should be doing it too – especially something as complex as taxation rules – and doubly especially when you just pick out one element (a CGT) out of a complex system and try to insert in isolation of the context in which it was originally conceived.

Lots of blanket talk about us being late to the party on CGT. But what is being proposed seems much more punishing than elsewhere. EG. From RNZ, on CGT – “University of Montreal economics professor François Vaillancourt said concerns around what a capital gains tax could mean for business and property owners have been mitigated in Canada.
“We have a $1 million exemption for small businesses, farmers and fishers. The idea is that a farmer doesn’t do much in terms of, say, formal saving plans for retirement but their farm goes up in value and they sell the farm and they make their money that way but then they get taxed on that.
“So it’s not as easy for them to accumulate savings for retirement. That’s why we have an exemption for these people.”
And Re lifestyle blocks, Labour want to punish anyone with more than 1 acre, in Aussie it doesn’t start until 5 acres.”

  The lifestyle block issue is interesting and possibly a red herring.
  
  In our neighbouhood, all lifestyle blocks, we have a mix of voters. One couple are green, no ifs no buts green voters through and through. Their block is also worth around the $1 million as are most in the street. Another couple are labour with a touch of green. Unfortunately they own 2 blocks adjoining plus a house in Auckland and a couple of rentals locally.
  
  The rest of us are National, being workers in the main with our own businesses and investments that are well diversified.
  
  The conversations have been interesting and I believe a CGT in any form will not appeal to our local lefties at all. Most lefties seem to be happy with “income redistribution” and “fair” until the reality of it steps into their back pocket.
  
  The escalation of the cannabis debate has also caused a few concerns which, considering most were active in that area in the distant past, is interesting.

  KiwiSaver will be exempt 2.9M of them.
  Baches will be exempt 250,000 of them.
  Farms and small businesses will be exempt to appease Winston.
  
  The COL will then say its dealt to the Rich Pricks who own rentals and shares and left in tact the Kiwi lifestyle of the bach the boat and the Bimmer.

Has the public service gone rogue on the CoL and picked out Twitford as the weakest link.

Over the past month there have been a series of news stories, not necessarily linked, but when put run together indicate that Housing and Transport are out of control.

The list goes as follows:
1. KiwiSlumBuild – there have been a series of stories ranging from the failure of the CEO to the failure to meet any targets; and last week stories of failing to sell homes; failure of the programme to add to the national stock of available homes and then there was bribing people to buy homes with $5k of furniture or white ware.
2. Transport
Recent stories have included that plans for Auckland’s LRT programme are behind schedule;
That SH6 Havlock to Nelson will get the same “safety measures” as other dangerous pieces of road in the country instead of a proper express route.
And yesterday…
Hints that NZTA are dragging their feet on SkyPath, suggesting they are hoping for a change of government next year.

These are indications of things not being well in two ministries of 1 minister, is anyone aware of any other problems in any other portfolio areas. If so, National needs to start turning up the pressure on the CoL.

      He will appeal, and if you followed the case, you should see that the verdict is an appalling miscarriage of justice. There were witnesses that stated that the alleged abuse could not have happened, yet they were ignored and unsubstantiated allegations believed despite contrary evidence. No way that could pass the “reasonable doubt” threshold.
      
      He will appeal and the appeal *should* succeed, though the depths of irrational hatred of Catholics in Australia may yet hold sway.

  Without defending Pell, it does appear an iffy conviction in that it was one person’s word against another, and the second victim (now dead) denied anything had occurred.
  
  Two trials, first was a hung jury, second trial the jury took 3.5 days to come back with a verdict.
  
  The Victorian DPP refused to prosecute the case three times, and it was the Vic Police who forced the trial.
  
  Take the name Cardinal Pell out of it, and it looks suspect.

    What makes this case iffy is the lack of other victims. Paedophiles seldom only have one or two victims, when one comes forward, usually, many more come out of the woodwork. Look at some of the high profile cases recently in New Zealand. Lots of victims. If Pell is a paedophile, he is a piss poor one as he has managed one shag…. what, and then decide, oops this is not for me and never offended again?? Bullshit.
    The circumstances of the offending seem strange. Shagging an altar boy in the sacristy straight after Mass seems a bit odd as they can be very public places.
    
    On the other hand, if he actually did do as alleged, well fuck him.

  George Pell is not the only one on trial here, this conviction makes it clear beyond doubt that the Victorian Justice system has broken down and is totally dysfunctional.
  I am not a great fan of the Catholic church, but this lies bare how bad our judicial system has become.
  In Victoria, the police can now convict someone on another persons word, nothing else.
  Whilst in New Zealand, a 20 year old can put his hand down multiple adolescents pants in a room full of people, yet no one saw anything and his name remains semi concealed.
  The courts taking an eternity to bring this guy to Justice, and may never face the public.
  You wood hope it is made public, if it isn’t, NZ is going down the same road as Victoria.
  It is a very serious world we live in, our traditional justice system as we know it, looks like disappearing.
  Both systems appear to be corrupted by government intervention.
  I hope someone can prove me wrong.

“Property investor: I’ve paid more in tax in 20 years than you’ll earn your lifetime”

He has around 80 houses, many with the mortgage paid off or soon. Which must put his net worth around 50 million.

I guarantee he has paid nowhere near 13 million in tax (which is what someone would pay in income tax for the same amount).

So , why should he escape paying his share of tax ? It is people like me supporting this guy!

    They also fall and into a much deeper pit than the envious do. Capital gains means the risk of capital losses. Business enterprise may or not provide a gain from something escaping the income tax net but it does surely provide a sea-full of risks exposing the enterpriser and family to damage for which there is no other compensating reward. Taxing such gains is to attack hope and enterprise. Only those already rich would be willing then to venture capital.

  “Ministry of Business, Innovation and Employment released figures in 2015 showing there were about 130,000 landlords with rental properties – slightly more than 100,000 owned a single property”
  
  And those single property investors will be paying a huge chunk out of what is nothing but *inflation*. They have just been trying to save a nest-egg for retirement.

For MBIE (tenancy bond) purposes a landlord may be an owner or a property manager or a trust. Each of which can correctly be called a landlord and not just in MBIE terms.

      Campbell’s article at Scoop says Shipley is also a director of the NZ water exporter Oravida, which is owned (ultimately, through another company) by James William Blackwell, of Mt Maunganui.
      
      The other three directors of Oravida are Blackwell, Stone Shi and Julia Jiyan Xu, the latter two both of Auckland.

@ Evadne – re how do the photos get published.

OK if they’re taken by a staff photographer they will be colour corrected and cropped, retouching is an instantly dismissable offence. Now the subject may well have had a make up job, that’s the subject’s choice and responsibility. The photog then uploads the captioned image to the DAM and a page designer calls the image from the DAM – they have precisely zero capability to edit the image here.

If an image is submitted, generally via email, then the supplied image will be captioned (not in Photoshop) and submitted to the DAM. Now this image may well have been ‘chopped before it was supplied, especially if it comes from a women’s mag but Stuff is not responsible for that.

A $500 million dollar defecit means our banks have to borrow $500 million overseas to cover it and then we have to pay the interest on that.

Importing more oil and gas will be great idea.

No, I’m referring to the total inability of the Prime Minister to answer two very simple questions about the Treaty of Waitangi.

A few days ago, I asked a journalist if she could tell me what the first two Articles of the Treaty were, and she couldn’t, but knew that the Treaty was about partnership. I wasn’t asking her to recite the exact wording – though given how short the two Articles are it might not be unreasonable to expect many New Zealanders to be able to do that.

I was simply asking her, as the Prime Minister had been asked, what the first two Articles of the Treaty provided. And she didn’t know, talking instead about partnership.

I suspect that that ignorance is widespread, despite the fact that all political parties claim a commitment to the Treaty, and to its so-called principles. And fundamental to those so-called principles is partnership.”…..

  Something about ‘fairness’, and the tax only being based on ‘a number in a bank account’, whatever that means.
  So now it’s not fair for Maori to pay tax ?

    At first I thought a wee bit of it did sound fair. After thinking about how it would actually work, and listening to others, I am now thinking it would create more unfairness than it fixed.
    
    The way to help those who are struggling is through less tax not more.

      The part that really concerns me is that CGT provides the biggest return to government when inflation is at its highest. There is no incentive for our political masters to rein in inflation which cripples investment & growth.

        The inflation issue is a big one. It is a tax on inflation, which is an appalling idea for all kinds of reasons too obvious to mention. Yet you no mention of a tax refund if your property decreases in value.
        
        It is also another dig at the long suffering farmers whom the govt and media hate.

Who remembers the trial & sentencing last year of Rouxle Le Roux, a then 19yo who killed a kid riding a bike while pissed & stoned then drove off. There was a justifiable backlash from those who considered that her sentence of 11 months of home detention was manifestly inadequate.

One would have thought that the overentitled little prat would have gone home & served her sentence but no:

…..” On February 20 it is alleged she failed to respond to two visits where probation officers knocked repeatedly on the door of her home.

She has been charged with failing to comply with the conditions of her sentence and will appear in the North Shore District Court next month”……

    It’s highly unlikely that we’ll see anything resembling justice. That would involve serving the balance of the sentence at a women’s prison on the basis that she is totally unfit for community punishment.

Looks like the conviction of Pell was a fit-up .

    There’s no doubt there was plenty of abuse going on.
    And that some Senior Police probably didn’t investigate when they should have- possibly because of their own connections with the Church.
    But the Pell conviction is a bit suss.
    Lots of money paid to victims in Oz…
    That said, Pell did *not see* a couple of abusers who were right under his nose.
    
    Oh, and several people in the Media have been after Pell for a long time. A real crusade.
    He’s not perfect but this one doesn’t seem right.
