        I thought the number of beggars in Auckland was getting bad but then I went to Wellington…man oh man, the place is infested with them. As for gays, well you know they’re everywhere too, it is pretty fashionable to be gay these days, as long as it doesn’t become compulsory I don’t mind them but I wouldn’t put anything past this government. The very worst thing about Wellington is that they are all so piously left wing, it is like a cosy club down there. I guess the envy is inevitable when they look north to Auckland.     @ holysheet had to laugh at this from John Armstrong today : “Ardern and Robertson Ardern aren’t fools. Yet having forced it down to favour exporters managed to top the previous peak from 2006 of the NZ trade deficit.   Thanks for confirming the stereotype that all Kiwi blog, National party supporters and centre right voters are homophobic, conservative and are against people living their own lifestyles the way they want to. I’ve always told people that National are an open, progressive party that believes in the individual. Freedom of choice. Someone is gay, or vegan. They are allowed to be. Why does it scare you? We’re you sexually abused by someone? A vegan lifestyle can be healthier and what about all those men who ride bikes in the weekend. Keeping themselves fit.         My hubby gleefully turned up one day with a bagful of grapefruit in a very useful carrier bag the supermarkets used to pack our groceries in (don’t mention plastic!). I whizzed them all up and froze them in measured small batches so I wasn’t making marmalade for the rest of the week. Thawed and soaked overnight with added oranges and lemon added. Boiled up this morning. Marmalade is not my forte, raspberry jam is my enjoyment, like eating summer from a jar. ?

        Yeah, no worries. I’ve been doing similar for a good 20 years. I had a Thai partner who turned me on to their food and they do similar. I’ve got nine Thai birds-eye chillie plants going great guns at the mo. I’ll use them for it. They’ll be ideal.
        
        Will sneak off to the Avondale Market in the morning – lemongrass is in plentiful supply at the mo.

The reason the wages are generally shit is this: businesses can’t afford to pay employees any more than they do, because the Government takes so much from the employer, then wastes a third of it before giving it back to said employee in the form of entitlements.

    How do you expect a company to pay top wages to workers when generally productivity is lower than the rest of the OECD?
    
    We have always paid on performance because the more they do the less I have to do and if they do plenty I get plenty of relaxation. In 30 years we’ve never had a staff issue over wages.

        Not unless you “off-set” that by buying a state-funded KiwiShoe (courtesy of the COL), they will offer everyone a 15% rebate (to, cough, offset imposition of the CGT they claim of course, after all that’s, cough, “fair”)!

        My observation is that most minor parties have had traction due to leadership from prior to MMP. Except for a few notable electorates. Eventually NZ First will go the same way as others. Winston has shown he cannot hold onto an electorate. He’s showing another generation of Kiwis plenty of reasons not to vote for him or NZ Last.

Some startling US stats –

Gap yesterday announced it was closing 230 retail stores, just a few hours after J.C. Penney said it was closing 27 stores, and a day after Victoria’s Secret said it was closing 53. These announcements bring total store closings this year to 4,500. But here’s the thing: some of the biggest big boxes—Walmart, Target, Best Buy—had stellar fourth quarters.

The writer sees Amazon as driving big box improvements for customers rather than the opposite.

However, and this is the political take – Democrats may be turning away from market economics.

There is a budding school of thought out there, known as the “New Brandeisians” and led by a 29-year-old legal scholar named Lina Khan, that argues that Amazon’s bigness is, in and of itself, bad.

And

… the Daily Beast reported earlier this week that Khan is being courted for a job by House Democrats—another sign of the Democratic retreat from market economics. A political era that dawned a half century ago, when Sen. Ted Kennedy teamed with now Supreme Court Justice Stephen Breyer to push for airline deregulation, may be coming to an end.

The Climate Change Minister’s approved international travel expenses were the highest out of all ministers from October to the end of December, at $77,771, compared to Prime Minister Jacinda Ardern’s $54,487.
When asked to justify the expenses, Mr Shaw told Magic Talk on Friday the Green Party offsets all travel through tree-planting, something he said he’d “recommend people do”.

  It appears there were no breaches under the Companies Act and the Securities Act was not applicable because the company was not borrowing from the public or issuing shares to the public. Doug Graham, Bruce Davidson (former Auckland Law Society Chair) and the others were convicted of false statements – putting their signatures on a dud prospectus or offer document. The liquidators would have advised the FMA or SFO if there appeared to be any breaches warranting prosecution.
  I remember years ago a neighbour (Mr M) was raising money for a new invention. A retired guy and a 18 year old both put money into his venture. M found it easy to raise money even though his venture was going nowhere. The two sued M in the District Court who ordered their money to be returned. Other people did not sue because they did not want it to be known that they were taken for a ride. M appealed to the High Court and the Judge dismissed the appeal re the 18 year old (young and naive) and with great reluctance allowed the appeal re the retired guy on the grounds that he ought to have known the risks. The Judge said (in very restrained language) “Mr M is a very astute gentleman” (ouch!).
  Similarly in the Mainzeal case two directors (including Jenny) or possibly three were taken for a ride when the Board was asked to approve the shonky ‘loans’.
  I do wonder whether company law should be extended to make activities such as this criminal or at least ‘administrative’ offences with penalties. For ‘administrative’ offences a lower standard of proof applies.

    Dame jenny will have to cough up some personal funds – or get tips from Whaleoil about bankruptcy- as the insurance cover is only up to$20 mill , while the court awarded $36 mill to the liquidators ( and their funders)
    Her share is $6 mill and may have to find $2 mill from her rich chinese friends at the Construction Bank of China where she now roosts.

      Some of your statements are rather extravagant. Bryan Gaynor writing in the Herald indicates that Jenny could be fully covered by insurance meaning she would incur little cost. He knows about these things.
      The odds are too that she she has access to more funds than the Official Assignee can screw out of her if she were declared bankrupt. Also Burton could force a matrimonial property split if she is worth more than he is.
      A person facing bankrupcy in that sort of situation would make the creditor (ie the liquidators) a ‘low ball’ offer which would rake in more money than forcing bankrupcy would. The liquidators would be quite pragmatic and unemotional about this, they just want maximum payment. They are not interested in being vindictive or wanting to teach Jenny a lesson.

        A breach is a breach, its a civil action in this instance, as it wasnt found they were criminal breaches, just a failure of their duties to the company.

      Shipley and her running mates Rchardson and Bolger caused hundreds of people to loose their businesses and move offshore because of their inept leadership and behavoir when in politics. This is a small amount of justice for those but little justice for the creditors of her ignorant behavoir at Mainzeal.
      
      The Chinnaman should be pursued in China as well. Maybe the political parties and Shipley who currently suck the Chitcoms for funds can organize that he recompenses the rest of the money owed to creditors. They have been known to come after their own here and have our govt. acquiesce to their demands

    I have advocated that for deposit taking companies if they fail from the usual, borrowing-short-lending-long, the directors should be imprisoned. Some practices have been proved to be too risky over centuries of experience.

      Mainzeal was not a deposit taking company (unlike Bridgecorp and other companies where directors were punished usually for dud investor statements).
      I consider that the law should be amended to make this sort of thing an ‘administrative breach’ with the ability to impose a ‘civil’ penalty. Standard of proof in such cases is ‘balance of probabilities’.

      I agree with Bryan’s article. I still contend that Jenny Shipley (not Shipton) was taken for a ride by those who controlled Mainzeal. However as the Judgment showed she and other directors should have been aware of potential problems and took steps to avoid being taken for a ride.
      Some years ago someone I know was a CEO of one of the associated companies – he was taken for a ride too. I suspect this damaged his career. He would probably have become a CEO of one of NZ’s top 50 companies if it were not for that episode.

        I had a yarn about this with a very experienced company director (and professional company secretary) on Thursday night.
        
        We agreed that Shipley will have been under tremendous pressure both to Yan and to fulfill the responsibilities of her directorships, that she has been taken advantage of, but also that she had the option of walking away at any time, where she felt unable to carry out her responsibilities, and didn’t take it.
        
        Taking these gigs people (and absolutely politicians) are taking a risk.

        Swiftly – fully agree. She should have walked if she felt uneasy and could not get proper assurances.
        That is what the Judge told Bruce Davidson (former Auckland District Law Society Chair). He claimed he was powerless to act since Bridgecorp’s sole shareholder held all the cards. The Judge said he should have resigned – and Bridgecorp would have imploded there and then.
        
        Jenny had been successful as a director of properly run companies such as Genesis Power and her political background and knowledge would have been of value to the Board. Other directors would have had skills in different areas and there is an Audit and Risk Committee to take care of things.
        With Mainzeal there was a small Board with no Audit and risk Committee. To be a director there she needed broad Governance skills that she did not have. She was out of her depth but did not realise it.
        Also Genesis has a wide shareholding with some major shareholders especially the Crown (effectively the Treasury). They keep a broad overview of such companies and will act if they perceive governance shortcomings.
        Mainzeal (like Bridgecorp) had one shareholder who effectively ruled the roost and arguably the directors are appointed more for image than for their governance contributions.

I suspect that I may be waiting in vain, but I have started to note a distinct change of tone in how the actions of the COL are being reported. This may be confirmation bias caused by my search engines, but I do feel that gloss is certainly coming off this government and the PM in particular.

She is not looking well. She is under immense pressure. Her background (Chip shop, Gift Shop, Supermarket) has marked her as someone ill prepared for the rigors that is being PM. Helen Clark, for all her faults, was at least prepared for the role.

I think, that at some time in the next 12 months, the pressure of being PM will become too much for someone who is not only hopelessly ill prepared for being the PM, but has the pressure of being a new Mum in the mix as well. There will be a breakdown, or a meltdown. It will be public, and it won’t be pretty.

Phil Twyford reports “The Ministry of Health says 6000 children are admitted each year for ‘housing-sensitive hospitalisations’.”

He said these children had been found to be nearly four times more likely to be re-hospitalised and 10 times more likely to die in the following 10 years.
“We cannot continue to accept this.”

To end those 6000 children admissions each year for ‘housing-sensitive hospitalisations, he’s issued new standards for all rental homes to include amongst other things a fixed heating device that can heat the living room to 18C plus an extractor fan in the bathroom and kitchen. Windows must be operable too.

Now for the life of me I can’t figure out how having heaters, fans and operable windows just installed in a house actually stop kids getting sick.

We on kiwiblog know that when we’re cold we put more clothes on, when we’re too hot we take some off and when a room needs heating or cooling we know what to do to rectify the situation.

Not so the people in Twyford’s world.
How many stories have we read that people don’t know that ventilation is necessary to prevent mould for a kickoff?

Clearly then it’s not enough to just have a heating device capable of 18C plus an extractor fan in the bathroom and kitchen and functioning windows installed.
All these devices must have auto on/off sensors and motors on windows.

Quite how we automate the kids in Twyford’s world with snot dripping from their noses because they’re running around with no shoes on in mid winter is another matter.
Perhaps the parents of the 6000 need a robot nanny in their houses.

    Overcrowding is a major cause of dampness, not helped by life incompetent occupants who can’t manage to open a window now and again.
    
    Those who can’t get a private rental very often end up moving in with the rellies. Landlords, including Housing NZ, can do something about overcrowding but homeowners can do what they like.
    
    Damp and mould are already landlord responsibility if structural, otherwise occupants. Never mind, make greedy landlords pay and hope tenants will change their ways.

I was reflecting on the Rouxle Le Roux case a bit last night and had some thoughts on home detention.

It seems to me she is entirely the wrong candidate for HD, in major part to the people that surround her and enable her bad behaviour.

HD is, effectively, a prison sentence served at home. It isn’t just being grounded.

A good part of a prison sentence is the “corrections” part. Moving a person out of their normal (bad) environment into a structured (and better) environment where they can reset their lives. HD only does that if the person is surrounded by stable people.

Breaking HD conditions is, in principle anyway, the same as breaking conditions in prison.

Going out when not permitted is no different from breaking out of prison. Giving an HD prisoner contraband drugs/alcohol is no different from smuggling booze and alcohol into prison.

On the face of it, Le Roux’s mother is a huge factor. If I recall correctly, she tried to cover for the daughter when the crash happened and now with some cock and bull story about construction.

I’d not be surprised if the mother was also supplying booze.

This is not an environment in which Le Roux is going to learn. HD was a poor choice.

      From my limited knowledge of the “charter schools” that we had running up North, the students were taught to value their own judgements and independence and not just “run with the crowd” or have stupid decisions made for them.

Anyone watch The Nation today?. Ardern said there was a poll question that asked if you would be in favour of a CGT, if it led to a tax switch, she stated there was overwhelming support for it or words to that effect. What poll is this?, every poll I have seen has been in the region of 65-75% against a CGT. Did she once again lie to the nation?

This just happened.
I went to the doctor yesterday and he gave me my usual scrip for pills and creams. My partner suggested that intead of giving it to our local thieving chemist we should try the Chemist Wraehouse cos they will do it for free. Headed all the way out to St Lukes and it took us about ten minutes to find a park. He waited in the car while I went in. The joint was packed with what looked to me to be mainly benes. The Japanese chemist girl at the counter took my scrip and gave me a buzzer thing and told me it would buzz when the meds were ready to collect. I expained my partner was outside waiting in the car and hoped it wouldn’t take to lomg. She said “about 5 minutes, just have a brose around the shop while your waitng”. Twenty minutes later the buzzer went off! My partner was fuming. He said “they can stick there free presriptions up there arse, hes got better things to do” 🙁

    Alternatively when I was in Bangkok I bought the stuff with no prescription and no waiting for $500 for three months.

        In my case my problem was diagnosed over there at a top hospital. Insurance paid only a fraction of the cost of the medication and the hospital charged triple the price of identical pills from the drug store. Back here in NZ the doctors prescribe exactly the same stuff.
        Conversely my wife takes migraine medication that is replaced by a generic brand over there. I should imagine that’s when you could run into trouble.

He told her many people were Anti CGT and if she was concerned about this Remember Soper has previously announced that she was crapping herself as she had under estimated the anti feeling.

True to form the liar talks non stop and when you later translate what she has said, she has not answered the bloody question.

Maori are bringing a claim for part of the radio spectrum that will host 5G networks.

A claim has been lodged with the Waitangi Tribunal by Graeme Everton, a former Telecom radio spectrum technician. His mother, Rangiaho Everton, 19 years ago brought the claim to the tribunal which found that Maori had a right to fair and equitable access to radio spectrum.

Richina’s purchase of the State-owned tannery in Shanghai, with land rights that Gaynor says may now have a value of more than $US1 billion, figures large in the Mainzeal mess. Richard Yan seems to have ended up super rich, and that will really piss off Mainzeal’s unpaid suppliers and subcontractors.

Gaynor argues that Jenny Shipton, Yan, and the other directors, got off lightly with the penalties awarded.

      Primarily because we are not in an election cycle and so we have ardern the liar appearing in the media and not being challenged on her lies or inactivity.
      
      Simon Bridges on the other hand is being continually denied reasonable exposure and most of what is based on him is either derogatory or insultingly inaccurate.
      
      In an election cycle we have all leaders being profiled and there will be a readjustment, some down and others up.
      
      FFS, who cares what the media think about the leader of the National party at this point. Next year, he will get more air time and he will be seen more regularly and his popularity will grow.

    The Nats. need to get a decent education policy that returns the locals back in charge, remove the union influence. reinstate and increase the number of charter schools and give out Education vouchers to parents so they can exercise their rights to education money for their kids.
    
    There is no reason why the previous private schools run by many shouldn’t get the benefit of vouchers. It would remove the state control and leave them with just curriculum issues. Private enterprise can build schools where needed. all they need to respond to is bums on seats with appropriate curriculum settings.
    
    We did it before the communists in the unions and politics decided to control everyone.

An accompanying graphics shows –

While the text says –

It would seem that the area circled in the graphic as Pit Bottom should be “Pit Bottom South” and is in fact inaccessible, on the workings side of the roof fall at the end of the drift. “Pit Bottom in Stone” is an area between the roof fall and entrance and should be accessible.

I apologise if I am wrong and would be pleased to be corrected.
Otherwise this article is Herald “Premium content” which means they deem it worthy of hanging around for days.
If so, and if inaccurate – indicating the re-entry will involve areas it won’t – it should be corrected.

‘Thank you Prime Minister Ardern for those blunt comments just now in which you publicly indicated that deporting Kiwis from Australia is to your way of thinking ‘corrosive’ to the trans-Tasman relationship. I hadn’t realised this joint press conference was going to be used to make public criticisms of each country’s government’s policies. So let me reply in kind, bluntly and in public, and then perhaps I can air a few matters of New Zealand government policy that I think might also be ‘corrosive’ to our countries’ relationship.

‘On the deportation issue, people on visas who break any serious law will be deported, full stop. If they have under-age children then they will be sent back with their parents. That is our policy. We make no apology for it. Nor should we. You obviously disagree on that point, Ms Ardern, but my government thinks you are wrong. Who knows? If Mr Shorten wins our upcoming election you may get your wish granted.

‘And as you have thought it proper to indulge in the game of publicly denouncing the other country’s government policies, here are a few of New Zealand’s that I think are ‘corrosive’. You Kiwis are complete and total free-riders as far as defence is concerned. You take advantage of Australia and the US because you know that we will come to your aid even though you spend vanishingly little on defence. Worse, your country’s long-standing virtue-signalling on US naval ships – banning nuclear-armed US ships, which means all of them because it’s US military policy not to say whether they are nuclear or not – led to New Zealand being thrown out of the security obligations under the Anzus treaty. You first did this during the Cold War in the mid-1980s, undermining the Americans and with a seeming belief that unilateral disarmament is anything other than stupid. I disagree with that Kiwi move. In fact it was precisely that clear American intent to defend the democratic world, by spending heavily on defence, that led to the fall of the Soviet Union. In my government’s view that was a wholly good thing for the world. I realise that you, as a one-time socialist activist, might have a warmer view of Soviet communism. But you’re wrong. And when you first became Prime Minister back at the end of 2017 and called capitalism a ‘blatant failure’, let me just say that I think you were an idiot. Comments like that are very – how did you put it? – ah yes, they’re ‘corrosive’ to the relations between New Zealand and Australia because in Australia we recognise that capitalism has lifted hundreds of millions out of poverty in the last few decades alone. Just look at China and India. Socialism, by contrast, has taken the once-wealthy Venezuela and turned it into an impoverished basket case. Frankly, on matters economic you are clueless, Ms Ardern.

‘I might also take this opportunity, given that you have decided that these diplomatic meetings are in fact an opportunity for you to show off for your home audience back in New Zealand, to make it clear that your public intervention into how we police our borders – I refer to your government’s offer to take a few hundred of those claiming to be refugees from Australia’s offshore detention centres – is making it harder for us to keep our borders secure. If you want to bumper-sticker moralise, do it about something else. Incentives matter and you are weakening the ones that we have put in place to stop the boats. This has resulted in the boats stopping completely, along with the hundreds and hundreds who died coming on those boats.

‘Perhaps a blunter way to make this point is to say that you and your government across the Tasman are not morally superior to me and mine. Indeed, you are classic free-riders whose geography has allowed you to avoid hard decisions. Fine. Lucky you. But have the good graces to shut up about it, at least in public, because Australia is differently situated. If we want your advice we’ll ask for it.

‘Which brings me to how it is that you are even in the position of being New Zealand’s Prime Minister and hence able to stand up here today and sanctimoniously posture and virtue-signal. Of course normally I wouldn’t comment on another country’s domestic affairs, certainly not a democratic one with which we have shared a long and friendly history. But as you have changed the rules of the game, I will play by the new ones. Because let’s be honest: in any sane voting system you wouldn’t be prime minister would you? Your main opponents the National party at the last election in 2017 garnered 44.5 per cent of the vote and your Labour party won 37 per cent. Even with the Green party votes thrown in you did worse. You’re only PM because an embittered former National party politician who set up the New Zealand First party – my fellow Australians can think in terms of Clive Palmer at this point – well, he opted to put you and the Left in power despite it being clear most of his party’s voters were much more conservatively inclined. I suppose we’ll see how that pans out for New Zealand First, or whatever it’s called, at the next election. But basically it required one of the world’s most virulently proportional voting systems to make you PM, a voting system the Americans imposed on Germany after World War II and one in which about half of MPs get into the New Zealand parliament simply because their own party has put them high up on some list drawn up by party insiders. You can even lose at the constituency level and still get a seat because you are good buddies with the insider class of your own party. Frankly, I think that’s ‘corrosive’ of democracy. But of course that’s something for Kiwis to decide and not for me to raise – well, that was what I took the conventions to be before you opted to use this joint press conference to air your views on what you think is and isn’t ‘corrosive’. Now you’ve heard what I think, maybe we can turn to questions from the press?’

  His Conviction was overturned on a technicality..
  Antolik, as he was known back in 2011, was a New Zealand representative kickboxer and aspiring businessman.
  
  He was a minor player in Operation Ark; charged with manufacturing a few hundred pills and evidence he ordered 10,000 more.
  
  Antolik argued the pills were training supplements, but in 2014, he was convicted in a judge-alone trial of manufacturing a Class-C drug and sentenced to home detention.
  
  The conviction was seized on by Immigration New Zealand, as Antolik had been discharged without conviction on the passport and immigration fraud – despite the jury’s guilty verdicts.
  
  But the Operation Ark conviction was overturned on a technicality by the Court of Appeal.
  
  Instead, the Court of Appeal said the charge of manufacturing a Class-C drug should be replaced with possession of a Class-C drug for supply.
  
  A new trial was ordered but never went ahead, as he traded Ecstasy analogues for the real deal.

    Decide if the mine will ever be reactivated as “opencast”..I doubt it, put a decent memorial in place, open up walking tracks in the area as the greens thought it was of “National Significance”, hence the bastard type of mine allowed.
    
    Build a couple of “accomodation huts”, named for the miners and remember them as “west coasters of significance.
    
    If not, then why don’t we scour the hillsides of Espiritu Santo looking for the bodies of our airman who died there?

  There’s something about this re-entry that I can’t get my head around. From all accounts Little, Peters, a brass band & associated clowns want to walk into the mine to collect forensic evidence.
  
  We are told that there’s a rockfall on the entrance side of the ventilation shaft & before the main part of the mine where the bodies or remains are presumably located. Refer diagram: https://www.radionz.co.nz/news/national/244076/pike-river-rockfall-larger-than-thought
  
  So the wankers are preparing, at vast cost, to walk up to a pile of fallen rock & look at it
