  A “comprehensive” appeal Notsofast? Surely you jest:
  
  Convicted double murderer Mark Lundy has been granted a hearing in the country’s highest court, but on very narrow grounds.
  
  He has twice been convicted of murdering his wife Christine and daughter Amber in Palmerston North in August 2000.
  
  He was first convicted in 2002.
  
  In October 2013, the Privy Council granted him a retrial, but in 2015 he was again found guilty of their murders.
  
  After being found guilty at his 2015 retrial, Lundy was returned to jail to resume serving his 20-year non-parole jail term.
  
  His lawyers argued last week that the Court of Appeal was wrong to uphold the convictions.
  
  The Supreme Court today granted leave for his appeal to be heard, but only on narrow grounds, limited to questions around the Court of Appeal’s use of what’s known as ‘the proviso’.
  
  That was the mechanism that allowed the Court of Appeal to dismiss Lundy’s case, even though it found some of the scientific evidence put before the jury at his retrial was inadmissible.
  
  He becomes eligible to seek parole in August 2022.

  Why don’t you tell the truth? The appeal will centre on one procedural issue, not the evidence which has already seen Lundy convicted, and quite rightly convicted, in my ever-humble opinion.

    Yeah, I ploughed through the transcript. Even Lundy’s QC admits that the evidence incorrectly admitted is insignificant.
    
    As I said, more expenditure just to keep a killer where he deserves to be.

      He admits nothing of the kind. He submitted 64 pages to the appeal court defining the IHC work as junk science, he bears no responsibility for the appeal panel choosing to ignore it. There are no IHC practitioners in the world who claim that it is fit to identify unknown organic tissue outside that courtroom in 2015. It is designed to diagnose disease in known tissue. Somehow David Hislop found people who were prepared to side with the prosecution, Ironside and Smith. Read the transcript for more understanding.

      Rereading your point you are talking about mRNA.
      It is important to understand the sequence to admitting this, high court, appeal court, supreme court then high court again. The dissenting judgement at the appeal court by Ellie France described the evidence as very prejudicial, so perceived to be potentially highly significant to the jury. The defence naturally contend that the allegation the probable cooking spatter was of human origin is false. There was cow sheep and pig dna in this material.

        IHC had never been used before anywhere in the world to identify the origin of tissue in a criminal case. AFAIK it has never been used for that since. I wouldn’t go so far as to call it “junk science” but it is certainly not established mainstream stuff like DNA is. Miller is a great showman.

        In fact I understand it is a principle of IHC that it can disclose no more information about the composition of tissue than a morphological examination by microscope can. Also the tissue must be preserved immediately to conform to the method. It is remarkable that Mark Lundy is claimed to have miraculously air dried his wife’s brain when smearing it in the shirt.
        Bullshit squared but it suits people with legal training to perpetuate this. Not so handy for Lundy.

    Discussion of the admissibility of IHC science is denied, but not the quality of the evidence itself.
    Read the material.

    The police are vested with the obligation to find this dangerous killer. There are many fingerprints at the break in point on file. There are dna profiles of males from fingernail cuttings on file. These all belong to the killer.
    There are uncleared suspects for the crime at the midnight change of time, the police have the names but refuse to investigate.

        That is a good question. I would have to reread the transcripts of the second trial, at the first trial Mike Behrens ignored the fingerprints. The facts are that all people who visited the house in the month previous were tested against these prints and they remain unidentified. The conservatory area was being used as a workshop, and thoroughly cleaned the morning before the crime. The fingerprints therefore belong to the killer. Finger prints cannot be planted or arrive by secondary transfer. The appeal court completely ignored the significance of these prints in their report. The dna profiles will lead to a familial link, and inevitably to a solution. Scott Beard is working on the Japanese tourist case with dna profiles from her nail clippings, and he solved the Joanne McCarthy case with Travis Burns found with the dna found of his victim under his nails. Maureen MacKinnel’s killer was also found guilty with this incontrovertible and classic crime scene evidence. Mark Cooper dismissed its significance by talking of casual transfer, which is completely impossible.

      I was referring to Theresa May, the MP for Maidenhead. Having lived in the UK from 1992 to 2013, I observed her rise from an obscure junior minister in the Major government, to Party Chairman under Ian Duncan-Smith, to Home Secretary in the Cabinet of David Cameron. At no point did she ever demonstrate that she had what it took to be PM, let alone lead Britain through the Brexig process.
      
      As for Jacinda, now you mention it…..

        In 2011 I was in the UK visiting my little brother just as he was about to reach the end of his residency rope. Here he was, a white English-speaking male, born and bred in NZ, but resident in the Falkland Islands for 12 years, then 5 in Britain. He was married to a British citizen, had British-born and raised children, owned property in Britain, ran a British-based business employing British people, had paid British taxes for nearly 20 years… and they were about to throw him out. It’s all very long and complicated, as you might imagine, but it might have helped if he was Muslim and/or from the Subcontinent. His local MP was working on his case, and saw fit to pass it on to Theresa May as the then Home Secretary. May asked my brother and his wife to meet her, and as I happened to be there I babysat my three nieces while brother and sister-in-law went up to London for the day. May gave them 30 minutes of her time, saw the idiocy in my brother’s predicament, cut through all the bureaucratic bullshit, and had his residency rubber-stamped straight away. Following that I had a great deal of respect for her. Just sayin’.

        John, I am not arguing with your brother’s situation, but May as the ultimate Home Office boss did what any sane person would have done.
        
        Your comment about people from the subcontinent is valid. By 2012, I was on the wrong side of 50, was a “UK local”, too experienced and too expensive. Consequently, i was regularly overlooked for contract employment because there was cheaper immigrant labour from the subcontinent available. Whether the immigrants could do the job was irrelevant, they were cheap, but because of my CV I wasn’t.
        
        Further, in the same vein I’ve heard business leaders use the same language (ie there is a skills shortage) here in NZ. What they really mean is they can’t hire staff for the wage/salary they want to pay and what they want is for the politicians and Immigration NZ to permit them to hire from abroad.

        Undoubtedly, hullkiwi. I simply thought that she was very sympathetic, decisive and effective in my brother’s case. 30 minutes of the Home Secretary’s time is not to be sniffed at. Who was my brother in the grand scheme, after all? Just a nobody. But he had residency approved within the week thanks to May’s personal intervention. Credit where credit’s due, I reckon. I will let history judge her performance as PM once the Brexit dust has settled.

The women MPs asking Mr Seymour to apologise for calling Ms Ghahraman a ‘real menace to freedom’ could usefully take a good look at recent electoral events in Australia and elsewhere. They might find that one or two voters think they are snowflakes that can’t cope with their jobs.

The women MPs are coming across as offended and entitled because they disagree with that description of Ms Ghahraman and are trying link it to death threats. Obviously death threats are never OK but it was Ms Ghahraman’s comment about religion that sparked the whole thing. Comment incorrect but potentially inflammatory. She is the one to be careful about what she says.

    I feel disappointed to see so many women failing to cope with the stresses of a high level position. That’s what you get when someone is gifted the job without going the hard yards of getting elected. Women are perfectly capable of doing tough jobs, but they must earn it like everyone else. If Goliz is ‘vulnerable’, as claimed in that letter, perhaps she shouldn’t be in parliament where we expect elected politicians to fight for their electorate.

      They’re not women failing to cope with the stresses of a high level position. They’re women who have been appointed because they are women, and possibly in Golriz’s case because she was goodlooking at the time.
      
      They are pushing a social agenda. Which is good since the majority backlash is winding up nicely.
      
      Most women aren’t in any way similar. Rule of thumb: if there are any woke courses such as womens’ or gender studies or similar on their academic record, or if their twitter and facebook friends are predominantly ideology driven, don’t appoint them to any position at all.

    If what I read is true, what David said, was simply a criticism of her comments and behaviour around the issue of freedom of speech.
    Final question:

    David Seymour’s only mistake, if you could call it that, was one of timing. The media, along with Louisa Wall and Jo Hayes, are now determined to conflate his statement with the online death threats (if you could call them that – from what I’ve been able to glean so far it was really just immature idiots mouthing off nonsense in a closed Facebook group).
    
    Honestly, if Golriz can’t handle being called a menace, then she hasn’t the stamina or fortitude for Parliament and needs to get out.

  Listen to Liam Hehr’s interview on RNZ on Morning Report at 7.40am. His opinion is that there is no mileage in it for anybody including Ngaro setting up his own party.
  With Tamaki though, it is all about Tamaki, rather than a true centre-right Christian party being successful.

    I had a listen to that, he’s most likely correct.
    
    National’s already quite “godly” and the leader is an out and proud Christian.
    When you look at Nationals stance on euthanasia, weed legalization, abortion, all big no’s there, they’re really ticking many Christian boxes.
    
    Christian people don’t need to go anywhere else, they’re getting what they want with National.

      I don’t think National has an official position on these things. Aren’t they all conscious issues?
      Furthermore.
      National is not an overt Christian party and to promote themselves as such would be A big mistake. NZ is less than 50% Christian and plenty of those only nominally.
      The current leader may be Christian also Bill English, but John Key most certainly wasn’t and plenty of the MP aren’t.
      The last thing we want is a government that sells everything and gives all the money to the poor, isnt it, or is that not how the followers of Jesus operate these days?

  The alleged victim(s) had complaints ignored about five years ago during the term of the previous administration.
  Whether or not the politicians were aware of what was going on at the time I don’t know.

    Complaints had been investigated by Parliamentary Services at the time. Given the complaints involved parliamentary staff, this was the appropriate channel for these complaints. Whether the investigation(s) were sufficient or not, that is an entirely different question.

    It appears that the complaint was investigated Last year.
    Speaking on The AM Show on Thursday, Bennett said it had come out that the man involved was looked at after a complaint in 2018, “and I think questions will need to be asked as to how that was followed through, and whether or not they did a thorough enough job.”

When are we going to have management of RNZ and TVNZ who are going to rid us of overtly politically broadcasters on the state funded broadcasting platforms?

This morning, our son had TVNZ’s Breakfast on and they had just finished an item on Andrea Ledsom resigning her position of Leader of the House in the UK. And with it, that breathless fool Campbell couldn’t resist passing a comment about David Caneron and Brexit.

For the benefit of Campbell and other Kiwi liberal luvvies who support the remain proposition, the 2016 Brexit referendum gave a clear outcome, which every voting Briton was entitled to do. Accept the result and move on.

  Hull kiwi – some good points. One of the big trends for the last few years is the rise of nationalism and anti-globalism. People are resistant to being part of a consumer-based world order that seeks to abolish national boundaries and favours the global elites who become very rich.
  Brexit is part of that trend. Pres Trump is part of that trend. Scott Morrison in Australia who ran on a platform of cutting back immigration is part of that trend.
  
  People want to live in a place of customs and values and traditions that they can call home. Some of the swing is religion based, some of it is part of a broader desire to conserve the values and traditions of their own country and their own people.
  
  I actually think in New Zealand there is room for a more conservative party that actually wants to look after New Zealand for New Zealanders and cuts back on mass immigration. Labour ran on a platform of less immigration. But they are globalists in their heart and so immigration has not been cut back.
  
  There is room in my opinion for a party of more traditional values than the National/Labour parties which are both full of globalists.

    Scott, I understand your position and I understand and support Brexit.
    
    That said, I accept and understand:
    1. We live in a global world and NZ has always depended on that for purposes of trade and it’s own prosperity;
    2. I’m in favour of Brexit, yet the UK and other European countries must learn to work together for the benefit of all European nations and their respective citizens (I don’t have the time or space to do a full thesis);
    3. I am not anti-Europe, I am anti everything the EU was and is. This given that the EU is most definitely not a series of democratic institutions working for the benefits of the European citizens.

      The idea of the EU as a free trade bloc was a good idea. Where it went wrong IMHO was allowing free immigration and subjecting countries legal system to a Court that could override law and over turn cases.
      
      These are both matter for countries citizens to determine through their democratic systems NOT for some unelected civil servant living high on the hog in Brussels.
      
      Imagine if Canberra decided our immigration policies and could override our laws and overturn our Courts decisions.

        Agreed but
        I believe where it went wrong, under the guise of creating a federal system (similar to the USA), France and Germany started to dominate the EU and bring in lesser economies, who voted with them on issues. Out of gratitude.

  May used a Statutory Instrument to extend Brexit SI,s are secondary regulations usually meant to fix up minor Law errors etc so in my opinion cannot override primary legislation which has been passed in commons/lords and received royal assent. Bill Cash has started a legal case that UK left on 29/3 as the referendum contained no qualification for deal etc just in or out. Two retired appeal court judges have stated Cash is right but should the Judiciary rule the UK has left there will massive problems for the UK & EU. If they use some legal chicanery to claim May is right I advise them to retire instantly and emigrate to Pitcairn were they maybe safe, bullets are cheap, plentiful and many know how to use them.

The Canadian David Seymour does however have a keen sense of humour. He has added the words “Probably not a Kiwi politician” to his Twitter profile. That in itself makes him a better comedian than Guy Williams 😀

Winston Peters has told media he will “lodge a serious action” when his lawyer returns from an overseas holiday today.
“This is humbug. It’s tawdry. It’s dirty. It’s filthy, and they should not succeed on that”, Mr Peters said.
Mr Peters said “they would try and impute my character straight away. That’s exactly what the typical what I might call ‘band of rascals’ went out to do.”
“I’ll find out every last thing.”
Mr Peters claims the leaks go all the way to the Prime Minister.
“You’ve got a political party that’s been deeply exposed now. That’s all the way to the Prime Minister. Don’t tell me Paula Bennett knew and the Prime Minister didn’t know,” Mr Peters said.

      As Winston’s behaviour in resolving the overpayment issue in itself was exemplary – dropping everything and flying to Auckland and sorting it out in under 24 hours, to the extent he claims to have a letter from IRD commending his swift co-operation, and particularly in comparison to the Metiria Turei moral mess – there appears to be no way that his reputation was damaged, unless of course it was his subsequent actions of leak which-hunt and other whining, and to that end I would hope any judge would find that any damage would seem to be Winston’s own doing – as per the Craig case which resulted in a similar conclusion.
      Also, Brendan Boyle supposedly consulted the then Solicitor General, regarding who should be told under the “mo-surprises” provision, and her recommendation, if any, has never been revealed.
      
      Surely, however, Winston would still need to prove how his reputation was damaged as well as prove exactly who did that.

Sugar, soft drinks,and now guns …

Two of those busy bodies, public health lecturers, have joined the clamour against fire owners in the wake of the Christchurch massacre. In an opinion piece on Stuff, two academics from the University of Otago Medical School’s department of public health, based in Wellington, claim firearm owners are “happy for the rest of us” to subsidise them through taxes.

You can bet that the opining pair are liberals who either do, or at least like and support, cycling and tramping, and activities that typically find favour among the woke.

You won’t hear from them that cyclists and trampers benefit from ACC and the health system without any special taxes on them.

The pair say in the Stuff article: “Firearms administration cost police well over $11 million in 2016-17, but the gun owners’ licence fees accounted for less than half of the costs.”

Which, of course is a much higher percentage of costs than cyclists contribute. (Yes, cyclists pay general taxes, but so do firearms owners.)

One of the pair does work on bus and train public transport, both of which bludge heavily on taxpayers and ratepayers. Another works on rental housing and buyuilding, where one of the main themes in New Zealand is taxpayer funded and subsidised public housing.

Now that public health academics are increasingly entering the opinion/political scene, we should know more about them and their background.

Here the is the background of the pair who, on Stuff today, effectively, if not in exact words, brand firearms owners as whining bludgers:

Marie Russell’s academic background is described at the Otago Univefrsity web site thus: her 2012 PhD used mixed methods research to explore how bus and train passengers use their travel time and how this affects their wellbeing. Other qualications BA (English); MA (Applied) Social Science Research. Russell works on the “Resilient Urban Futures” research project. Other research interests include tobacco policy, workers’ history and children’s wellbeing.

Lucy Telford-Bennett, has a Ph.D. The university web site describes Telford-Bennett’s research interests as: seasonal and cold-temperature-related morbidity and mortality; respiratory disease; tenancy law and the regulation of rental housing quality; housing construction types, their distribution, classification and associated health outcomes; and novel epidemiological uses of administrative datasets. She is measuring New Zealand’s respiratory disease burden, and assessing the effect of mechanised home ventilation systems on health outcomes.

  As a licensed firearms owner I would like to point out that I did not ask for a renewable license to be introduced, I did not ask for in home interviews and regular inspections just as I did not ask for parking wardens or dental nurses when I was at school.
  
  These were implemented for the “greater good” of society therefore have a cost.
  
  Nor did I ask for my money to be given to “numbnut” academics who want to be seen as “woke” and making their mark on society.
  
  My guess is that way more than $11 million or even $5.5 million is wasted on a monthly basis basis within the hallowed halls of Otago University.

  Expect JW that should read “Govt will stand by revised targets to reduce child poverty.” Like so many recent announcements this revised target is for 10 years. This is after rejigging the units of measure to help them save face over yet another failure. They still fail to understand the unintended consequences that their policies create or the outcomes of throwing more money at problems.
  While they make continuous claims of the amounts gained by recipients of the Families Package the same group are just marking time. The $600 million drop in tax receipts indicates they are not getting the lift they expected from this wasted funding. While even greater numbers are really feeling the pinch as they adjust their spending to meet cost of living increases. Along with a drop in confidence from voters as well as business come a natural reduction in the velocity of money. The vital element that helps drive a healthy, buoyant economy which is the means to address serious issues with fiscal responsibility along with the funds to do it. The biggest question now is how much more is the Wellness Budget going to push NZ to the dark side of the 8 ball? Since they think it is all a game.

Among the many different categories analyzed was the price of public transportation in 55 major cities. The research uncovered a major disparity in the cost of a monthly ticket and it ranged from $89 in Berlin to just $15 in Buenos Aires on average. Nowhere has average public transportation costs as high as London, however and a monthly pass sets commuters back a whopping $179. I have no criticism of their findings which are in all likelihood factual & complete.

What I do take issue with is the time taken for completion of these & other reports/findings. Instance coroner’s decisions that take three years & more to surface.

So many examples exist of the lives of families & individuals grossly inconvenienced & grieving delayed because some worthless & overpaid petty official will not be hurried.
