Trevor Mallard has some thinking to do over the Christmas recess. At the forefront of his mind should be whether his tenure of the role on Speaker of the House of Representatives is tenable:

MPs are baying for blood on the final day of Parliament, calling for a vote of no confidence in the Speaker after he issued an apology for making rape allegations about a parliamentary staffer.

“No,” Trevor Mallard told Newshub when approached for an interview on Wednesday.

The Speaker is avoiding questions after apologising to a parliamentary staffer following accusations of defamation. Mallard told media last year it was his impression people have been raped at Parliament.

He said at the time Parliamentary Service had removed a threat to the safety of women.

MPs are now calling for the most powerful man in Parliament to lose his job.

“If the Speaker finds himself unable to explain his actions, then I guess the simple answer is he should no longer be the Speaker,” ACT leader David Seymour told reporters.

There’s been nearly $80,000 in court action, but we don’t know how much in total taxpayers have paid for the case.

“We think he should be upfront about how much has been spent on that case – and if a payment has been made, how much that payment was,” National’s Shadow Leader of the House Chris Bishop told media.

Mallard has come to an agreement with the individual and issued a written apology, saying his understanding of rape at the time was incorrect.

This apology was delivered to media on Tuesday afternoon, in the midst of the report into the Christchurch terror attack and the day before Parliament rises for the year.

Opposition MPs are piling on the pressure.

“I do want to ask you were if you were intending to make a statement to Parliament about reports in the media that you have apologised to someone for comments made by you as Speaker last year,” Bishop said in Parliament.

“The answer to that is no,” Mallard responded.

“The House would like an explanation and I urge you to reconsider,” Seymour added, asking Mallard to explain the seemingly cynical timing of his apology.

“I’ve released it as soon as was practical,” Mallard said.

Mallard is hiding behind an alleged confidentiality agreement; I say “alleged” as we only have his word for it. And the PM is refusing to get involved, saying it’s Mallard’s business, and it’s up to him to comment.

Given rumours of a settlement of as much as $1.5m to make a defamation trial go away, and given this comes from the taxpayer, Mallard needs to be open and transparent. He holds the most privileged position in the Parliament, but every day this continues diminishes the respect with which that office is viewed.

  I believe any agreement should be void by the apology Trevor made.
  
  “Trevor Mallard accepts that his understanding of the definition of rape at that time was incorrect and that the alleged conduct did not amount to rape (as that term is defined in the Crimes Act 1961) and that it was incorrect of him to suggest otherwise,” the statement said.
  
  To me that comment makes me believe that Trevor still thinks it was rape.

    More that he wants us to think it was rape/sexual assault and that he was justified. As far as I’m concerned, that “apology” was actually further defamation.
    He’s basically claiming that the guy’s actions were close enough to rape that it wasn’t entirely unreasonable to accuse him of it. A reasonable person would assume that meant the guy was guilty of some kind of sexual assault at the very least. That is a lie of course.

      A bit like Helen Clarke having to apologise for calling John Yelesh a murderer when he had been convicted of manslaughter.

  A shit as it is – the amount of NZ’ers that actually care about what is essentially a beltway issue – probably about 0.5%.
  
  The amount of votes national will win by raising this issue – probably 0% given it is now the summer break and no one will remember this.
  
  Sorry to put it bluntly, but the opposition have bigger fish to fry and really need to stop playing silly games – such as calling for votes of no confidence they will easily lose.
  
  Let Seymour bark at the passing cars, National need to be better are picking their issues.
  
  I know some will say – the integrity of parliament is to important not to raise it – and I actually agree. But that doesn’t change the fact that National clearly still have not yet worked out how to be a opposition party that wants to win an election.

  Mr Mallard has a record, if this is the best the Labour party can thrust forward as the leading person to respect and look up to, they certainly have a very shallow short list to pick a speaker from.
  If he wants to be a grub and falsely accuse individuals, he should pay personally for his indiscretions, if he doesn’t actually know what constitutes a rape, what the hell is he doing in the speakers position, rather sums up this populist government really.

  What did Mallard mean by that? Is he going to restrict Seymour’s speaking opportunities next year? Is he going to take some other disciplinary action against the Act leader for daring to criticise him?
  
  In this, Mallard is his own worst enemy. He cannot resist making smart-alec remarks or interjections, almost always against Opposition MP’s. That detracts from the dignity of the role of Speaker.

  This is clearly a beltway issue – the amount of people that will actually see this, let alone change their future voting intentions i would imagine are zero.
  
  That being said, I have said this previously, but Seymour is showing how to be a proper opposition, he is constantly out-performing Collins almost to the point where he is getting her right of reply on political issues in the media.
  
  As far as i can see the only person that needs to be concerned about Seymours performance in the house is Judith Collins.

I remember when

The suggestion was that the flooding was because of heavy rainfall.
Is this another piece of rubbish reporting?
Previous serious flooding in Venice has been found to be because of tidal build-up caused by strong prevailing winds.

This is amazing because YouTube is a platform that specialises in conspiracy theories and indeed uses conspiracy theories to make people watch more YouTube. The rabbit hole conspiracy theory is a great way to engage their viewers more.

But our Big Tech overlords have decided this particular conspiracy theory is done with. That’s because they are in the tank for Biden.

In 2016 there were no problems with a conspiracy theory that said Trump was a Russian agent.

Whatever you might think of the election we should all consider the question – has Big Tech become too powerful? Should it be regulated?

  In Wayne County, Michigan, 174,384 absentee ballots (which makes up roughly 1 in 3 TOTAL absentee ballots) cannot actually be tied to any voter. As far as anyone knows, there is nobody who can be held responsible for the votes cast. They could be the result of vast fraud, rescanning ballots multiple times, fake or harvested or switched ballots etc. It is certain that some proportion of these ballots are illegal, but impossible to know exactly how many. It could be the majority.
  
  The system has failed to record the essential data that it is supposed to to ensure that there is no large scale fraud.

    Here’s 3 simple reasons why the Texas case won’t get far in the Supreme Court:
    
    1. While states can take some forms of case direct to the Supreme Court this is not one of those cases. There are other lower courts in the hierarchy that should hear this case first, in order to make a record (ie lock in all the evidence). Then plaintiffs can appeal points of law to Appeal Courts and ultimately the Supreme Court. **The Supreme Court is not where you take your evidence**.
    
    2. It’s really hard to see how Texas has standing. It’s hard to see how Texas has been credibly harmed.
    
    3. If this Texas case were successful in arguing that states can take other states to SCOTUS over voting rights then it would only be a matter of days before NY and California took all the Republican states to SCOTUS over gerrymandering and other voter suppression measures. That would kill the GOP. Be careful what you wish for.
    
    For all of those reasons I expect SCOTUS will try to find a diplomatic way to decline to hear this case.

  As a general principle, I agree with you Scott – I do not see myself as an enemy of free speech. I have one reservation in this case, and that’s when conspiracy theorists target specific members of the public who don’t have the security and protection of more public figures. For example, as I understand it (and I realise there are a hardcore group here who hold a different opinion) officials in the Republican-dominated state of Georgia have reviewed the videotape that some allege shows fraud. Seen in its entirety, they say no fraud was committed. They say that the allegations tape has been selectively edited to create that impression. I imagine that it would be relatively easy for someone in that Georgia county to work out who those people were. That worries me for those people if they are innocent of any crime.

        Okahu, the Dew report was written under terms of reference written by one of the people accused of the cover up. It also pointed out that they didn’t know it happened but that technically it didn’t count as a Labour Party issue as it was outside official hours/job responsibility or some such. It was an employment lawyer “ruling” on what was effectively a criminal case on a basis of reasonable doubt (which is obviously correct for crime purposes), but working in Jacinda’s office and being a Labour Party member do not need that level of evidence, likelihood and general bad behaviour would be enough. There is also the considerable amount of evidence regarding his bullying behaviour etc which was more than enough to justify his dismissal which was mostly ignored too.
        
        The camp one of course did happen, he just plead out. That doesn’t change the facts.
        
        The cover ups were my biggest issues with both of these.
        
        As for the innocence point. I never said that the person should be thrown in jail, just that we don’t actually know if they’re actually innocent. Many guilty people get off due to lack of evidence. It’s a fundamental part of our legal system. That doesn’t make them innocent. We do however know that the person Mallard accused was innocent of rape based on the accusations laid upon him.

    There would be instances of fraud in every election that is one of the reasons why the scrutineers are present.
    You don’t seem to grasp that the latest nonsense is not based on a finding of widespread fraud but rather by allegations of such made before the election, likely in preparation for Trump losing.
    No credible evidence has been put before the Court.
    Instead, there have poorly written pleadings made public for the desperate which eventually sink from sight. If there was evidence the system itself would be reacting, not Texas pretending it’s looking out for a neighbour state. Crazy, crazy stuff.

  The states in question are refusing to allow detailed auditing of ballots without court orders (the one instance where it has been allowed in Arizona showed 3% of 100 ballots were switched from Trump to Biden during vote counting), and judges are refusing to grant such orders. How can you prove it beyond a shadow of doubt when you are prevented from examining/auditing the ballots? Everything that can be done with regard to statistical analysis and affidavits from 1000’s of people who witnessed dodgy doings has been done, and now the judicial-political system is conspiring to prevent investigation of suspicious ballots.

Muslims in New Zealand seem to be submitted to abuse, of varying degree, as a reflection of attitudes formed from media reports of negative Islamic actions or incidents occurring overseas – from London and Manchester bombings, to beheadings in France, from individuals to organised forces like ISIS.

Although Islam is as diverse as any other religion, it is characterised as being invariable as is the Koran, the eternal unchanging word of Allah, the one Supreme God. Which gives rise to questions of “In what way can Islam in New Zealand vary from Islam in the UK or France?” and “Does Islam’s allowance of ’taqiya’ – deception in the interests of Islam – allow an apparently less extreme version of Islam to exist until it has the numbers to enforce accommodation of basically political demands?”

Misunderstood or not, Islam is seen in New Zealand in terms of international evidence, and as constantly as we told ‘Islam is a religion of peace’ one can ask “Why do we need to be told that … so constantly?”

That is the context which Andrew Little needs to consider in the introduction of any “hate speech” legislation.
The other context is surely Christianity and other religions – and whether any should be treated differently to the other.

  The assertion that “Islam means peace/Islam is the religion of peace” is 1. nothing more than political propaganda and akin to political party electioneering messages i.e. meaningless puffery and 2. unable to withstand even the slightest critique or analysis.
  
  Ask yourself, or any Muslim, how the assertion could be substantiated? If you took the view that it meant that in accepting Islam do people/countries become more peaceful, then you could analyse whether Islamic countries more peaceful than non-Islamic countries. Or, are Muslims more peaceful than non-Muslims?
  
  I argue that in both cases either that they are not or that the results are not clear enough to draw a conclusion.
  
  If on the other hand one argues that they are just talking about the literal interpretation of the word Islam i.e. that Islam derives from the Arabic word ‘Salam’ meaning peace then that’s a poor argument too – in that it only means ‘peace through submission (to God)” and that a the more widely accepted meaning of Islam is “submission or obedience (full stop) and that a Muslim is a “submitter” i.e. peace will come ONLY to those who submit and look out the rest of you.

  Cutting to the chase though, one only needs to look at the recent reactions by Islamic leaders, clerics and lecturers to the decapitation of the French teacher who dared to show the Mohammed cartoons in a lesson about freedom of speech. Did we get Dalai Llama-like expressions of forgiveness, of tolerance and understanding? Did we see the clerics and leaders imploring their followers to keep calm, perform extra-special acts of kindness to non-Muslims and to re-double their efforts to remain peaceful and zen-like?
  
  No, we saw the opposite – with baying Islamic leaders all around the world praising the assassin, offering money for those who delivered Macron the same fate and reminding the followers that the assassin was on a one-way ticket to paradise and seating at the right hand of Allah.
  
  One of these days a member of our news media might summon the sufficient courage to sit down with NZ Islamic leaders and grill them hard on their views on this and other matters. I confidently predict we will witness a lesson on dissembly, evasion, soft-soaping and outright deceit.

      HOWEVER:
      
      Unlike past years I will have VERY LITTLE sympathy if the moaning starts regarding viability and increased cost loading on rural operations due to government inaction and/or policy. Outside of Epsom no other seat in NZ had a National majority and few had a combined National/Act majority.
      
      Plenty got sucked into the myth of the Blairite, St Ash, the 2nd coming of the bubonic plague and little Aotearoa the greatest country in the world at ‘absoludly everythink’. This included approx. $400,000 former National voters – not all these resided in the big cities
      
      Therefore you get what you pay for. I fear the provinces and the rural sector are in for a kicking downstream.

Weird question:
Can the man that Mallard defamed go after Mallard for defamation again over his “apology”?
The “apology” was for saying it was rape so I would assume covers the requirements of the agreement.
However, it implies heavily that the man had in some way acted inappropriately in a sexual manner (to the implied point that it was almost rape, just not technically) which is untrue and in itself potentially defamatory so can he go after Mallard again for again defaming him?

  I would imagine that the text of the apology was approved by the plaintiff’s lawyers before Mallard was allowed to deliver it. If Mallard has subsequently made any comment beyond the scope of the agreed statement, I would suggest he would be on shaky legal ground.

    That compensation was for the original accusation. My question was whether the “apology” counts as a further act of defamation. That is obviously outside of the defamation that caused the supposed payment of $1.5m. I guess, as Tony Stuart said, it comes down to whether the text of the “apology” was approved by the plaintiff’s lawyers or not.

Barry Soper has indeed been around Parliament for a long time, and he’s seen almost as many Speakers come and go as he’s had late nights with Winston Peters; almost! He’s also completely demolished Mallard’s defence that he was uncertain as to what the definition of rape was.

Mallard’s reputation, such as it is, has been completely trashed by this incident. Even Labour commentators have ceased to defend his actions. He needs to seriously consider resigning from the role before he brings Parliament into further disrepute by his intemperate actions.

  Everyone knows what rape is. What Mallard has said is that he accused someone of being a rapist when he knew clearly that he was not. Saying he didn’t know the legal definition of rape is the same as a rapist saying he should get off because he didn’t know that what he did was rape. Next, from the file of “ohhh f***, I didn’t think that would be the consequence”.

Once the containers have cleared customs, over the next week, over 300 trucks will be running a relay between Northport and Auckland companies distributing the 1,200 containers that have been unloaded at Northport this week. It is expected that many trucks will return to Northport for further containers to deliver once their first or second containers are delivered (that stands to reason if there are 1200 containers and only 300 to 400 trucks).

We are told the trucks will run between midnight and 6.00am in order to reduce congestion on the roads and the trucks will be watched over by police and NZTA staff.

The reason for using the roads is that for the past year, the rail line to Northland has been under repair/redevelopment. The only problem is that it is a single track, so cannot cope with multiple return journeys of freight trains and there is still the problem of distribution hubs in the North and Auckland.

People, this is one ship, that is being unloaded and causing concern. Northport with 2 dock cranes can barely cope with this one ship, and the reports are suggesting (because of a lack of transport infrastructure between Whangarei and Auckland) we are going to witness problems on the road. So the questions beg:
1. what would happen if all Ports of Auckland activity really did move to Northport?; and
2. How accurate and reliable have all those reports proposing that Ports of Auckland move its activity to Northport really been?

You could probably fit your answers on the back of a postage stamp.

  It’s not the rail track that’s the problem for Northport, it’s a tunnel or two that are too tight for containers.
  
  If Ports of Auckland did move to Marsden Point holus bolus, the rail would be upgraded and extended to Marsden Point. You’d probably need a rail base in Western Auckland where trucks could pick up containers for delivery.

    Jack5, they’ve been working on the track from West Auckland to Northport since pre-lockdown 1 because of the tunnels. We have a site just south of us where they are have been deepening a tunnel. Even though, a single track Auckland to Northport would not be sufficient if they moved all PoA activity to Northport. As you say, they will need a freight “port” somewhere.
    
    Irrespective, of the ability to cope with freight movements, the added cost on all goods transported this way will be far greater than any benefit to Auckland or NZ.

  For the financial years ending 30 June 2020 and 2021 Ports of Auckland has agreed with its owner Auckland Council to pay a dividend of 20% of after-tax profits, reduced from 80%, in order to fund the investment programme. The dividend for the year ended June 2020 was $4.9 million, to be paid on 30 September.

    The popular vote gap is 7+ million.
    
    The percentage win is 51.3% to 46.8%.

Ruahine at 8.26 commented on our contemptible government that has Mallard as one of its most esteemed members.
I looked in my dictionary and found a word that has two meanings;
1. The female genitalia.
2. A most contemptible person.
As a polite person I think Mallard is a most contemptible person. The word referred to has been used twice by my wife in our 42 years of marriage. The first time was, and I hope I don’t bore you with a lengthy anecdote, when I arrived home fly blown drunk with friends, one of whom being a greaser plucked a pretty miniature orchid and presented it to my wife. She used that word to describe my friend as she had been cultivating that orchid out of a rock for 18 months. She was distraught. She kicked them all out so we could not attack the Cointreau, Drambuie, Grand Marnier and Dom Benedictine as drunken middle aged men are wont to do.
The second occasion was when she heard about Mallard’s specious apology.
My wife is not part of the “beltway” so I think this dreadful matter could have long term consequences for this government.

They were celebrating on Sky News last night the fact that Australia has risen to 10th place in the Maths and Sciences in schools. Meanwhile NZ continues to slump ever downwards to now be in 40th place. Bloody disgusting if you ask me, we should be much closer on the scale. Does anybody in this country care? Meanwhile, in a year where our teachers have had lengthy periods off, bar cursory, short video messages, they still took teacher only days once lock down was over and are spending the last couple of weeks of the year taking the kids on picnics, tidying their classrooms and having games days. That there is why we are in such a dismal position, they seem to do anything but teach.

The Royal Commission of Inquiry into the mosques massacres appears to have dismissed reports of complaints about the Bruce Rifle Club, where the shooter, Brenton Harrison Tarrant , practised.

Allegations about the club may have fanned concerns about NZ firearms regulation.

In a Facebook post on 19 March 2019, Peter Breidahl said that he had met Tarrant at the Bruce Rifle Club on 19 November 2017 and that he was “not fucking right”. In his statement to police on 21 March 2019, six days after the massacres, Breidahl said that he “strongly” believed he had seen Tarrant at the competition. He said Tarrant was involved in a conversation about the Port Arthur (Tasmania) attack.

The Commission in its report says: “ Peter Breidahl also confirmed to us that he believed he had seen the individual [Tarrant] at the Bruce Rifle Club on 19 November 2017 (although he conceded he could not be certain). He recalled that what stood out about the person he thought was the individual was his lack of empathy when discussing the details of the Port Arthur attack.”

Breidahl said in a Facebook post that the Bruce Rifle Club was “the perfect breeding ground” for someone to train for a terrorist attack. He repeated these allegations during the interview with the police on 21 March.

The Bruce Rifle Club range, which is in South Otago, subsequently closed.

Breidahl told police (after the massacre) that the culture of the Bruce Rifle Club, and particularly the discussion about the Port Arthur (Tasmania) attack, disturbed him to such an extent that he left the shooting competition early; and that on 20 or 21 November 2017 he lodged a formal complaint in person at the Dunedin Central Police Station.

The Commission says in its report:

“In his interview with New Zealand Police on 21 March 2019, and again when speaking to us, Peter Breidahl said that he asked New Zealand Police in 2017 to send a plainclothes officer to a range shoot at the Bruce Rifle Club. He expected that, if this happened, it would result in members’ firearms licences being revoked.”

The Commission concluded Tarrant was not at the Bruce Rifle Club on 19 November 2017; it also concluded that Breidahl did not complain to police about the culture of the Bruce Rifle Club on 20 or 21 November 2017.

Stan, a streaming service, has commissioned a film of killer Martin Bryant’s pre-massacre life, directed by acclaimed filmmaker Justin Kurzel. The news has been greeted with outrage. MPs, particularly in Tasmania, where the crimes happened, victim groups and the media have complained that the victims’ families – and Australians collectively – should not have to revisit these horrific events. Even prime minister Scott Morrison has said he was ‘unnerved’ by the prospect of the film.

First their is the issue with the burst watermain which no one can find any paperwork or evidence for.

Then their is the surveillance video. The “fact checkers” who claim to debunk it seem to focus on the terminology suitcase which is really a ballot box which is irrelevant. The question is why did all the media and observers and other operators leave. According to mainstream media “No one told observers they had to leave, and both an independent monitor and an investigator oversaw the vote count, according to state and county officials. Confusion arose when election workers thought they were done for the night, but then were instructed to continue scanning ballots.” Yeah right. That sounds weird. So everyone packed up all their stations left and it was a mistake? The actual observers say they were told they were done and video footage shows only 5 people in the room . 4 of those have been named. There are a number of other clips that are interesting from the day including what appears to be a secret pass of an item between three of the people who stayed behind for the private counting. https://twitter.com/i/status/1334747404847833088
Second interesting clip is the same guy looking under the desk with the tablecloth opening the ballot boxes that would be counted later by the five that night, and then pumping his fists in the air with excitement.

And this is the same guy filmed at a processing what looked like ballots, giving the papers the finger, and then pumping his fist angrily and screwing up the papers. This we were later told he was just reading the instructions? Yeah ok. Pretty weird behaviour. https://youtu.be/GWCkrkZVLIE

Simultaneously there is a weird vote spike at the same time this lot were counting the ballots alone.

Will be interesting to see how this turns out. Lots of mistakes confusion and changed stories on the day.

A couple of Thursday afternoon Fun Facts for those in the mood.

San Francisco recently voted to make it illegal to smoke tobacco products inside your own apartment; however it is still legal to smoke cannabis inside your own apartment.

The reason for the different rules requires a very special type of mental gymnastics. I’ll try and explain it as best I can.

1. They banned smoking inside, to protect other inhabitants from the effects of second-hand smoke.
2. Smokers can still go outside and smoke, so they’re not prevented from partaking in a legal activity.
3. Smoking cannabis in public is still illegal, so to protect the rights of cannabis smokers they allowed it inside apartments.

So what they’re saying is, we’re banning smoking tobacco because the rights of people not to be exposed to second-hand (tobacco) smoke outweighs the right of a citizen to enjoy a legal activity.

But they’re not banning smoking cannabis inside, because the rights of people to enjoy cannabis apparently outweighs the rights of people not to be exposed to second-hand (cannabis) smoke.

Another fun fact is that smoking kills more than 480,000 people year in the US. COVID has “killed” (I use the term very loosely) 286,000 people in the US since February, some 10 months. If the current rate continues that will be around 340,000 people dying from (or with) COVID-19 in a year – still well short of tobacco-related deaths. Fancy that.

The Texas suit claims that illegal votes elsewhere materially affected legal
votes. There are 14th amendment issues too. If it is successful, the election will
be determined in the house 22-27. The Republicans have 27 votes. Ted Cruz
has offered to argue the Penn case. The injunction was thrown out. Not the whole case.
A lot of states have joined the Texas suit.
