Treaty principles

While his speech to more than 10,000 people at Tūrangawaewae Marae in Ngāruawāhia was largely optimistic, Kiingi Tūheitia criticised the Government’s Treaty Principles Bill, which aimed to redefine the Treaty principles, and called for Te Tiriti o Waitangi to be written into legislation so politicians “can’t change nothing”.

He didn’t make specific references to any proposed legislation but did indicate his strong condemnation for the Treaty Principles Bill, created by Act and agreed to in its coalition with National.

  There are a couple of differences. One group is basing their interpretation on what the words actually say while the other is relying on unprovable assertions about meanings that are not in the written words of the text. The other difference is that one group is acting consistently with principles of equality and democracy that have been mostly successful in the past, while the other group wants different rights and entitlements based on ancestry, which modern civilised nations have mostly rejected.

  The difference is that ACT has actually read the original Treaty. And that is the resounding conclusion I came to when I read Kiingi Tūheitia’s comment in January.
  
  “There’s no principles, the Treaty is written. That’s it.”
  
  He hasn’t read the original Treaty, only a modified version of the Treaty placed in front of him. His puppeteers are relying on his ignorance, and low IQ, is being used to promote propaganda. To them he is a ‘useful idiot’.
  
  The man does not even have a proper grasp of the English language and grammar.
  
  He is a sock puppet.
  
  His statement ~~“There’s no principles, the Treaty is written. That’s it.”~~ There are no principles, the Treaty is as it is written. That’s it.”, is in fact objectively correct.
  
  [1] Kiingi is referring to a different Treaty, that is not the Treaty that was signed.
  
  [2] He has been brainwashed to believe that ACT and Seymour want to change it.

      Not surprising, since according to oral Maori history NgaPuhi arrived here 700-900 years before Tainui, most likely the Cook Islands, but Tainui came from elsewhere.
      
      And the Waitaha arrived 500 years before NgaPuhi, around 2000 years ago. And there were people here when the Waitaha arrived.
      
      Oldest history recorded in oral history was 256 generations, and that was in the late 1800s, so around 5,000-5200 years ago. 3000BC.

      Of course it is all about money. I note that many Maori tribes having been compensated for their “sacred lands”, upon receiving the land back, 2 or 3 times, immediately went out and sold the land again.

    It is not so straight forward. If a driver causes death by running someone over, I dont think that the police have much choice other than to charge the driver.
    
    In answer to your question, “what happened to – it was an accident” AFAIK that assumption has not ever been applied to the police, at least not over the last decade, during which children have been killed in driveways at a rate of about one every two months. Notably, the children are predominantly Maori and Pacific Islander ethnicity and from deprived circumstances.

    These deaths are tragic for the families. However I disagree that they should just be dismissed as “accidents”. They are preventable.

      My wife and I went to Parihaka some years ago. I needed to reverse the car in the village. I asked my partner to get out and keep a lookout for children while I reversed. It was the right and proper thing to do. People backing down driveways should do similar if there is any possibility that young children are around.

    Extremely negligent to not have sight of the boy before he selected reverse. The boy was five and five year olds don’t assess mortal risk very well, that’s our job to do it for them.
    However, laying charges achieves nothing . The man saw his sons head under a wheel. There is nothing worse.
    Maybe put the cost of prosecution towards some form of therapy for the man and the family.

      Here’s the thing, he knew his child was hanging on the back of the van because he had done this before
      
      His father drove back toward the house and pulled into a laneway in preparation for reversing into his parking space.
      
      This was where his son would normally jump off, but as the father began reversing he thought he heard his son calling out. He immediately got out to check, and saw his son underneath the vehicle.

      Laying charges will likely result in a driving ban, which i like, and are not used in nz enough nor for long enough. Although some people here seem to struggle with the concept that some people should never drive as they’re not up to the task, one of the reasons why I don’t mind public transport. I’d rather irresponsible idiots had to catch a bus, train or walked than endanger everyone by being behind the wheel.

  I was wondering about this too. There is a difference between this and similar cases in that the father had driven a vehicle in circumstances where it was unsafe and admitted that was a regular habit. Quite apart from it being a driving matter it was also a ‘health and safety’ matter since the father was still ‘at work’ when he emptied his van into the skip. These aggravating matters must have also been on the minds of the Police investigators and the Crown Prosecutor when they decided to prosecute. It seems unfortunate that despite publicity children keep getting injured or killed in similar driving incidents. So despite the traumatic effect on the family a prosecution in this case does seem warranted. The Judge can then decide the appropriate sentence and in this case the wet bus ticket may well suffice. I personally think the Crown should not have prosecuted but I do not think that would have been the right decision.
  As far as the ‘granny basher’ case is concerned, ‘home detention’ has undermined sentencing options. Common assault (unlike any other ‘summary offence’) has a maximum sentence of 6 months in prison, but unfortunately judges are pretty well obliged to turn this into home detention. As explained in the media, the incident would not qualify for assault with GBH. Nor is male assaults female charge used except in domestic circumstances. This would be because of gender equality – why should a woman who bashes an elderly guy be treated more leniently than a male who bashes an elderly woman.

    I would like to know what the guy who attacked James Shaws and broke a bone near his eye that was similar to the injury to the granny was charged with.

      it wasn’t similar, he also said he did not want home detention because it would be stressful on his wife. He planed to track down James and confront him.
      
      It is not GBH and if the police had of laid such a charge it would have gone nowhere. As much as you want to to think it was and that he should have been charged with it, it was not and wouldn’t have passed the legal requirements for such a charge.
      
      Two completely different cases, two different circumstances. Just because both people were punched doesn’t make it the same.

  There was the tragic case in 2015 of a mother who left her baby in her car instead of taking her to the creche while she was at work. The baby died and the mother pleaded guilty to manslaughter, but the judge compassionately discharged her without conviction.
  
  Disappointing the cops are handling this current case the way they are.

      I wonder if V meant that the driver should have been charged with manslaughter. In this instance there was a suitable driving offence he could be charged with (the careless / reckless driving causing death offences were added to the law as juries were reluctant to return manslaughter convictions in such cases). The police and Crown Prosecutor weigh up carefully whether to go for a manslaughter charge and will do so where considered warranted.
      In the case of the woman who left her child in the car I am not sure if there was a lesser charge that could have been laid. She no doubt sought high level advice on the best way forward in her circumstances. Possibly quickly pleading ‘guilty’ to manslaughter saved her medical registration (the Medical Council would have reviewed the case).

  Why shouldn’t he be charged? The father drove with his child hanging onto the outside of the van. Dangerous. Just because he killed his child doesn’t excuse his actions that caused the death of his child. His child would be alive today if he hadn’t of done that, his actions caused the death. If a father shakes their child and kills them should they not be charged too because well, they are suffering the loss of the child.

No need to be wary and scared of our personal agendas and business policies around bias and funding.
We are just nice, ordinary people who like dogs and sun streaming through the window.
Susie – be nice for a while at least. Try to contain your own authoritarian demands for information from politicians on the “wrong” side. Steel yourself to ask a few hard questions of the ones we like in Labour and the Greens.

  No amount of (far?) left-wing propaganda can change the fact that when Ferguson was a host on Morning Report she would take an aggressive approach against National MP’s, constantly over-talk them (she held them in such disdain she didn’t think their answers needed to be heard in full) and employed the technique of dropping their audio levels down to make them sound diminutive whilst she boomed over the top of them (perhaps she thought she wielded ultimate power).
  
  Contrast to her interviews of Ardern at the time and it sounded like they were a couple of long lost friends enjoying a friendly, uninterrupted catch up (on one occasion she appeared to surprise the then PM by changing the subject to discuss something unrelated that Ferguson was involved in, sounding like she wanted Ardern’s approval which was duly given as it allowed Ardern to escape talking about politics)!
  
  I would regard Ferguson as unprofessional who disgraced the once good name of Morning Report and was totally unworthy of being anywhere near their studio.
  
  Her openly displayed bias (and rudeness against those she disagreed with) was the main reason why I stopped listening to Morning Report daily and once I changed there was no reason to come back to listen to their other (leftie slanted, urban elitist focused) shows.
  
  From first listening to Morning Report as a kid at breakfast time (parents had it on in the kitchen) then myself as an adult I decry Morning Report’s change to opinionated and slanted journalism that started with the likes of Guyon Espiner and Susie Ferguson. Is it any wonder their listenership has declined?
  
  As for tuning in to Saturday Morning … no thank you! If she was incapable on Morning Report why would anyone wanting balanced journalism bother to listen to her new show?

    Her session this week was awful. Maori spoken with an affected Irish accent is bad enough but she continued with speaking “Maori” phrases and words so that most listeners would have turned off. Give her the push along with many of her colleagues in TV. I also comment on Kim Hill who was the consummate broadcaster but I thought the interview she did with a previous American Ambassador was so rude I was sure she would be censured.

When are those that want to hold the Government on racial devide, going to stand up and hold the Wellington woman’s rugby team to account for their abuse of the Government in their haka before their game in Woman’s super rugby that has happened two weeks in a row now. This is blatant abuse of our Government and has no place in sport and thoe responsible needed to be held to account after being given a warning one week before.

So this is why I distrust the MSM. The story focusses on a widow with 8 children, of whom 5 still live at home. After $480 rent she has just $100 for food. With the benefits available, that seems unlikely. There’s also no comment about other fathers or mothers of these 8 children (it just seems unlikely that this is a nuclear family); nor whether the older children who have left home contribute; nor whether wider family contribute. Life insurance, or at least an “I wish” is not touched on. Above all, there’s no reflection on why having 8 children without the means to support them beyond picking the pocket of taxpayers and philanthropists is a dumb and selfish thing to do.

Now, perhaps that’s my prejudice talking. But, either these questions weren’t asked through poor journalism or they were asked & the answers are off message. Either way, my trust in the media suffers.

Stuff article on NZ’s deadliest intersections. They are almost all single stop signs on rural highways.

Wanted to give an example a rural highway T intersection that is really good (Wilks Road/ Dairy Flat Highway). They have two sets of gateway warnings before the stop sign, a sign on each side of the road, saying stop sign in 200m then 100 m. This seems pretty cheap and a good option.

The Dairy flat highway standard is also good with wide shoulders and a wider than normal centre line providing a bit more separation and room to overtake a cyclist if you saw one.

Would be good to see a consistent standard.

There’s a small point I’d like to make about the hypocrisy of many New Zealanders and of our news media.

It must have been tens and tens of times, throughout Ardern’s leadership but particularly 2020-23, in response to criticism that the results just aren’t coming, that I saw and read citizens and the news media trot out the line, or variations of it, “but at least she’s trying!!!!!!!”

What does it say about people that they used this line for years in a desperate attempt to protect Labour’s appalling performance – whereas this new government has barely taken their seats and they are lambasted, slurred, labelled and cursed and not afforded anything like the same latitude so generously given to Ardern and Labour.

I’m absolutely certain that even in the event that The Coalition delivers solid, tangible, real and measurable achievements for the country, the scale of which Labour could only look on in slack-jawed amazement (and soul-destroying jealousy and fury), many New Zealanders would still curse and lash them while simultaneously calling for a return to the incompetent and bungling policy incoherence and fiscal irresponsibility of Labour and their cronies.

New Zealanders can be bloody stupid at times. They really deserve everything they get.

    The repair is going to take at least 15 to 20 years.
    
    That’s what worries me. The only four-term government we’ve had in the last century was the Holyoake National one from 1960-1972 – and that was during vastly more settled times, even with the Vietnam War and 60’s counter-culture (which didn’t really crank up until the very late 60’s).
    
    I’ve seen several commentators here opine that the next Labour-led government will be more Left-wing than Ardern’s and I’m one of them.
    
    Post 2029 or, if we’re lucky, 2035, we’re going to be facing a shitstorm of incoming Lefty nuttery and I don’t think we’ll have built enough protection to weather it.
    
    Back in 2008 I had doubts about the incoming Key government but I was still hopeful for the future.
    
    Not now.
    
    I thought we’d not only have things in good shape (true, at least as best as ..), but that Labour would be as pragmatic as Clark/Cullen were. And at least on the economic front of indulging the Trotter/Bradbury wet dream of reversing Rogernomics, they were – to the latter’s eternal anger.
    
    But on every other front they pushed further Left than Clark/Cullen, and have set things up so that by 2032 the Trotter/Bradbury faction may get to see their dreams achieved, if only via taxation because new and increased taxes will be all that remains to support the State that has been built by Labour and left in place by National.

I cant understand why Biden wants a second term as President given his age and medical issues. He has already achieved the ultimate political goal. There is a high probability that it will end ignominiously for him. He might be defeated in November. If he wins, it appears possible that he wont complete his next term, because he will become incapacitated and need to be replaced. Why put yourself at risk of having a tarnished legacy, when you can quit now with some honour. My suspicions are that his wife and those behind the throne like the power and are pushing Joe into it.

They came from the Kaipara and drove the existing tribe off their land. That tribe fled to the Waikato. Another little known fact is that Ngati Whatua gifted 3000 acres of central Auckland to the government in return for protection from other tribes from the north. So why, then, have they been gifted valuable downtown Auckland land back and are still claiming more?

From April, these investors can offset 80 per cent of their interest against tax liability, and this will increase to 100 per cent from April next year.

To be fair, home owners should get the same tax offset. They won’t.

It will likely raise a few eyebrows given that so many members of Parliament, of varying political shades, are heavily invested in rental housing.

As I recall, Seymour at one stage said his personal property investment was through a property company. Presumably its loan costs will already have been offset against tax liability.

Seems little chance of NZ getting a meaningful capital gains tax, which virtually every successful developed country uses.

Those opposed are already trying to confuse this in voters’ minds with an unwanted wealth tax.

Is our coalition serious about fighting inflation when it’s doing things that will keep the property market hot?

  Interest deductibility for homeowners. This has been suggested a few times based on imputed rent to create a level playing field. Imputed rent is the equivalent of rental income, so net taxable after expenses.
  
  It will never happen – all the folk who have worked and saved to pay off their mortgage for their retirement but have to pay income tax on imputed rent less expenses.

    It’s an interesting concept. If your home is owned by a family trust, the trust is liable to pay tax on rental income foregone if a market rent is not paid. If you loan someone money interest free you are liable to pay tax on the interest foregone (hence why such loans are made repayable on demand, so the amount foregone is indeterminable) A friend from the UK owns a holiday home in Spain as a non-resident, and she pays tax every year based on the income foregone from not having it rented out. The idea is not a completely novel one, but in a country where Ardern almost fell over herself to insist that capital gains tax would never be paid on the family home even as she was announcing a working group to look into all aspects of tax, it is unlikely to fly. But equally, to have an economy where the principal driver of wealth is capital gains made on residential housing, whether by owners or landlords, is at the root of New Zealand’s failure to thrive in productivity. Why produce something when it is easier to sit back and wait for ever-increasing numbers of migrants to pour in and drive housing prices up?

  Why on earth should a home owner get a tax deduction for interest on their mortgage? A landlord will once again be able to treat the interest on their mortgage as a business expense which means it will lower their income on paper and they will pay less tax.
  
  But they are running a business and landlords obviously agree with the government that the interest a bank charges them is a legitimate cost of doing business. A normal homeowner isn’t renting out their home as a business so can’t claim any business expenses.

One of the more spiteful and incompetent moves by labour, removing the ability for landlords to deduct some business expenses from their income, is now being extended by national.

National have been a bit disappointing so far, it was very wrong for labour to attack landlords in this way, and now national are saying it wasn’t so bad.

It will be interesting to see what happens here. The hapu? are going to court for customary rights across Whangarei Harbour.

“If granted, the order would give hapū a voice when it came to new developments, planning documents for the area, granting mineral rights and the designation of sacred sites, where public access may be restricted.
Under the current law, an iwi or hapū applicant group has to meet two main criteria before the customary title is recognised.
It has to hold the area in accordance with Māori customs and practices and to have exclusively used and occupied the area since 1840, without substantial interruption.”

Straight away it’s clear they have not had exclusive use of the Whangarei area since 1840, what about all the private land owners, the port, marine and land conservation sites? The scary thing though is that it’s being heard in the Whangarei Maori Land Court.

PSA: if you have an EV, park it a long way from where you live while charging. My neighbour’s Tesla spontaneous combusted at 4.00am taking out neighbouring garages. All the environmental brownie points earned went up in smoke, and it was a LOT of smoke. Not to mention the effects of wrecking this thing along with three other vehicles in a neighbouring garage. EVs are a joke, and a hazard. Don’t buy into the Green bullshit.
