I am surprised that the police have chosen to invent a new offence. They have decided that the defacement of the pedestrian crossing in Auckland is a “hate crime”.

I checked the Crimes Act. I can find no such offence. Vandalising a pedestrian crossing is “intentional damage”, like all vandalism. (I am sure that David Garrett will be along to correct me if I have erred here.)

Of course I understand that some folk see the pedestrian crossing damage as an expression of hate against the rainbow community. However, IMO it is not the role of police to criminalise hurt feelings.

Also, where was the outrage from politicians and the police when an important exhibit in Te Papa was damaged by vandals? Or statues of important historic figures are destroyed or defaced?

Incredibly a Green Party MP celebrated the defacement of the Treaty exhibit at Te Papa.

Then we have the vandalism recently perpetrated against the Jewish community in Christchurch. AFAIK the Green Party was silent.

It seems that not all vandalism is being treated equally, by the media, the police and especially by certain politicians.

One last point about social attitudes towards gay and trans people.

In the UK, social attitudes towards same sex relationships have transformed over the last 40 years.

90 percent of people have a positive view of same sex relationships, compared to about 30 percent 40 years ago. I can’t find survey findings for New Zealand, but I would expect the trends to be similar here.

However, it is somewhat startling that the same survey in the UK shows a marked decline over the last three years in tolerance towards trans people.

A reasonable hypothesis is that this trend is driven by people not being comfortable with the explosion in medical and surgical transitioning of minors, and the participation of biological men in women’s sports. People have also witnessed the cancellation of JK Rawling, and the violent attack on Kellie Jay Keen in Auckland which received wide press coverage in the UK.

The clear message from the UK Social Attitudes Survey is that people are distinguishing betwen different subsets of the “rainbow 🌈 community”.

      See my post below. Police and NZTA were both fully opposed and a letter NZTA wrote re this being illegal and dangerous was never sent. Someone intervened at a high level and this is very dangerous behaviour in so called democracy. Who was it? Why?

        I don’t believe councils know the laws. I said yesterday about a lady knocked over on a cobblestone crossing. She was found to be at fault because it was not a legal crossing. That took the current council by surprise, they had no idea it wasn’t a legal crossing

        These absurd, “rainbow crossings” are not pedestrian crossings, ( zebra crossings) and accordingly misleading to foot traffic as to their safety and use. They fail to resemble in any way legal pedestrian crossings , see the link below for required markings of pedestrian crossings and accordingly , vehicle drivers have right of way with foot traffic foolish enough to regard them as pedestrian crossings, quite likely being run over for their stupidity.

    Painting a pedestrian crossing in weird colours that has nothing to do with public or road safety is a waste of taxes and causes a breakdown in order.
    
    Stupidity does not create tolerance and just demonstrates how out of touch these councils and their officers are.
    
    Anyone feeling sorry for individuals working in government for loosing their jobs is justified but reducing the number of unnecessary employees should be celebrated collectively.
    
    If the police focus on their jobs they may well get the job done. If they have time to “police” this type of nonsense then just maybe government should tell the commissioner to get rid of the justice warrior police departments.

The intention is to needle and annoy until some of the normal people who are not part of the religion react in exactly the way that has happened here. The trans allies can then claim they are being attacked and victims of hate crime and so gain political power.

      The other women in that photo are Hastings Library staff. I saw a couple of them when I was in the library yesterday.
      
      BTW I congratulate the HDC and Library for cancelling Wednesdays visit by these people. I have no wish for my grandchildren or great grand children to be indoctrinated into the trans lifestyle.
      
      Do what you like in your own time but stay away from impressionable children and teenagers – let them sort themselves out as they grow up.

  [4] In a country, New Zealand, that was singled out in an international road safety study as having an extremely high rate of road deaths involving overseas drivers, as a result of poor road layout and confusing signage or road markings.
  
  [5] Regardless of intentions, said painting over of said pied piper crossing, brings said pedestrian crossing closer back to the international standard.
  
  Vandalism #1 is ignored.
  Vandalism #2 is treated as a major crime.

    I have been looking at vaccine and mortality data on and off for three years. I cannot find any evidence to support your claim.
    
    The ONS in the UK released analysis of month by month mortality since the vaccine roll out. All cause mortality rates in the unvaccinated were higher than for the vaccinated – in every month.

      Without doing thorough Autopsies then we will never find out. You have too look for it.
      NZ is in a very peculiar situation whereby we had next too Zero Covid and High Vaccination rate BEFORE Covid was prevalent.
      In which case, NZ will not release the Data. If they did, Then it would either confirm or deny any excess deaths on Vaccine OR Covid.
      Just like Aids, People died of Pneumonia or any other auto immune disease, ie Not Aids etc.
      Much the same with Covid ( Vaccine), Higher cancer rates, Respiratory deaths, Heart issues etc etc.
      But unless you look for the cause , You will continue too count incorrectly.

      You have to dig deeper into the data and shift the massive number of side effects and deaths that occurred in the 14 days after vaccination from the unvaxxed cohort where they currently are, into the vaccinated cohort where any sane person who believed in truth would put them.

        That 14 days was a killer quite literally.
        
        For Benedict’s benefit and clarity, no-one was regarded as vaccinated if they had been injected less that 14 days prior.
        
        If you went into shock, keeled over and died in the vaccine clinic or on the way to the hospital from the vaccine clinic, it was counted as a Covid death in an unvaccinated person.
        
        If you felt ill, got worse, and dropped dead with 24 hours, again, an unvaccinated Covid death.
        
        Unfortunately I have lost count of the exact number of personal accounts of family members, workmates and colleagues of people I know, both here and overseas, dropping dead in this manner., but as stated it is in the dozens.

      At the risk of repeating myself….
      
      [1] Deaths are recorded every year.
      
      [2] Deaths per 100,000 every year are calculated
      
      [3] Excess deaths per 100,000 are deaths that exceed the normal. Our government’s own data show the excess deaths climbed after 2021.
      
      [4] In 2020 and the first part of 2021 showed no excess deaths.
      
      [5] If you do the research, you will find that every country over exaggerated Covid deaths by a factor of 10-15. i.e. they died of other causes or co-morbidities. Italy that supposedly had 135,000 Covid deaths at one stage, downgraded the deaths to about 7,500 as all other deaths were deaths with. Even here in NZ, I know multiple people whose parent died of all sorts of things but were written up as Covid.
      
      Even the CDC downgraded deaths by Covid to about 6% of those, the rest being deaths with Covid. The CDC banned the PCR test as of 31st Dec 2021, as it was it was generating false positive.
      
      [6] You will also find that deaths by the flu, which pre 2020 was known. Most actual Covid deaths were flu deaths.
      
      [7] Excess deaths occurred after the vaccine rollout. And anecdotal data supports that. I know of no-one, at 1, 2, or 3 degrees of separation that has side effects or dies from Covid.
      
      [8] At one degree of separation I know several dozen people that have had vaccine injuries. Some have permanent injuries. And pushing their doctors for specifics had it confirmed “off the record” as a vaccine injury. Off the record to avoid being struck off.
      
      [9] At two degrees of separation, you can add dozens and dozens more, and you can add in a handful of deaths, Same with three degrees separation. Some of those within 24 hours, some within minutes of the vaccines.
      
      [10] You can add in a number of medical professionals I know, who had hundreds of patients turn up with all sorts of issues. Many have taken early retirement, or stopped practicing medicine.
      
      [11] Hospitals, and specialists are over run with lots of health issues caused by the vaccines. It is well known among the professionals, however it is not talked about, out of fear.
      
      If however you can keep confidence and be trusted to not rat them out, they will tell you. However many medical professionals were as hoodwinked as the public.

  If you basically accept liberalism, then you have to accept transgenderism, which is a consequence thereof. There is a direct line between feminism, gay rights, and now transgenderism. All of these ideas and behaviours are destructive of the family and, therefore, deleterious to wider society, given enough time to take root.
  
  Each of these stages has required a process of incessant mass indoctrination to get people to slowly accept what are, fundamentally, a rejection and a perversion of a natural order. This is why “acceptance” of each of these has increased over time, not because any or them are good in themselves, but because people have become acclimatised to unnatural things, mostly because society has no well-defined moral compass anymore.
  
  If you deny that there are any naturally determined physical and moral constraints on our behaviours, and that “being free to be the best version of yourself” is the only thing that matters, then you’ll end up with transgenderism, and then after that, whatever abomination comes next as a logical progression.

    Really? Same sex relationships and attraction have existed forever. However up until about 5 minutes ago, nobody thought that sex was a “spectrum” and that amputating the breasts of teenage girls was a good idea because they wanted to be a boy.

    Yes, liberalism means accepting that others make choices we may disagree with. But there’s a caveat on that – there has to be a mutual acceptance. In the case of the law, that means that it applies equally to all. So Trans activists are not liberals if they want to force me to use their pronouns and believe that they can magically change sex. Neither are the police acting as the servants if liberal democracy they are paid to be, by calling the vandalisation of a pedestrian crossing a hate crime while reacting to the vandalisation of the treaty exhibit at Te Papa with apparent indifference. Ditto our courts when they let off a granny basher and give him name suppression, or sentence different ethnic groups differently for the same crimes. The problem is not liberalism, which means equal rights under the rule of law. It’s authoritarian nut jobs being enabled by formerly liberal institutions that have become corrupted.

    Acceptance is a long way away from celebrating which is what we are all expected to do.
    
    Most people I know accept the Ta, might think they are freaks but they are accepted broadly speaking. But I for one, and many others I know flat out refuse to “celebrate” them because we think they are freaks and in most cases, including that of my step son, either autistic or mentally ill. As the data shows. And I don’t want to share a bathroom with them or be made to compete against them in my chosen sports.

  The reaction to the rainbow mural in Gisborne (it isn’t a crossing) being painted out was astonishing. Within 24 hours it was repainted and had a police guard.
  Compare that to the Albert Park fiasco or the far too numerous cases of young children and babies being battered and murdered.
  
  NZ police have made complete fools of themselves over this and the disparity in their reactions here vs Posey Parker are as alarming as they are massive.
  
  The police minister needs to take very urgent action. The damage done to the already poor reputation of the police is huge. Like our medical authorities, trust once lost is hard to regain.

    I’ve never seen a police minister who did not close ranks with the police when any criticism of them was made.
    
    But that’s not the Minister’s job. That’s for the Police Association (the police union) to do, and they do it pretty well, as they should.
    
    It’s the Minister’s job to hold the police to account according to the government’s agenda as per the democratic will that put that government in power.
    
    It might seem like a good idea to put a former cop in the role but I’ve never thought so. That mentality dies hard. I’ve known and worked with my share of ex-cops and they never really leave the job.

  The answer is contained in the S9(h) of the Sentencing Act:
  
  “that the offender committed the offence partly or wholly because of hostility towards a group of persons who have an enduring common characteristic such as race, colour, nationality, religion, gender identity, sexual orientation, age, or disability;”
  
  The Adern government decided that crimes appearing to meet this aggravating sentencing factor should be statistically counted by Police as “hate crimes”. However, it turned out it was very difficult to interrogate the Police database to produce these statistics.
  
  So Police upgraded their database and reporting standards. Now every single crime reported is flagged (yes/no/uncertain) as to whether it is a “hate crime”. And having been required to record crime this way, it is now how Police talk about crime when speaking to reporters.

  It is not a ‘hate crime’ in the sense there is such a provision in law. It would be ‘wilful damage to property’ or similar. The seriousness would also depend on the type of white paint used. In the 1960’s students at Auckland University unsuccessfully lobbied for a pedestrian crossing across Princes Street between the Clocktower and Albert Park (perhaps Northern Club members did not want the inconvenience of having to stop for students). So some students painted one anyway. Unfortunately the paint contained a solvent that dissolved the tar seal and the council had to repair the pavement. Council sent the Students Association the bill.

  A couple of thoughts spring to mind… good point about where was then outrage for other acts of vandalism against others.
  
  Being gay I couldn’t care less about the white washing of rainbow crossings and am not offended. I asked a few others from my ilk and one said “couldn’t give a shit, except it’s Destiny Church”. If I think about it, why don’t I give a shit … in part its because I don’t see rainbow crossings as ours anyway. They’re put their by do-gooder virtue signalling councillors, not by us, as far as I can tell. And … well … Destiny Church … if it was a group of sane people saying death to all LGB… then I’d have an issue.
  
  Then other point I’d like to make is our ol’ LGB of years ago has been hijacked. The LGB is about who you’re attracted to and love. The rest of the alphabet soup is about what sex or gender you are, nothing to do with us. So yeah … there are factions but the LGB are pretty much silenced by the rest. They should get their own group and treehouse.

Last night on Sky Open news, the lead Story was the painting over in white of the Rainbow crossing in K road, which was described as a “hate crime”.

That’s right folks, painting over something that you don’t agree with is a hate crime.

The VERY NEXT story was about accusing Paul Goldsmith of over reaching by questioning why Te Papa has not repaired the damage done by painting over the English language version of the Treaty of Waitangi display.

Do they even realise the irony?

  Jackson is the authority on gutter politics. But I note that National’s Sanford is happy with segregation at the U of Auckland. Two NZers of Maori descent (Seymour, Peters) do not like it at all and rightly so but yet again National opts out. Segregation is wrong.   Unfortunately `Te Reo’ Luxon is increasingly showing his true colours. His latest effort being to retain unelected Maori Wards in Councils. He seems to prefer soft targets like reprimanding Minister Penny Simmonds for a genuine error in the way she got some very necessary information and rule changes to the Disability community.
  
  Prime Minister the country voted for thei removal of Maori Wards in October – so time to get on with it.

        Agree there gb – Mahuta killed the ratepayer referendum capability under urgency to beat the Feb 2021 requirements for the 2022 LB election requirement . All coalition partners campaigned on restoring that capability which is what Luxon said.

        70 – Local Bodies can do nothing until the Government passes legislation.
        
        Besides I doubt any/many aspiring Mayors or Councillors in the next LB elections are going to be bold enough to stand up and say that they will get rid of separate Maori Wards. That would be election suicide in todays environment.
        
        What would be the use anyway because my understanding is they are locked in until the law is changed and that seemingly rests with Luxon.

        Not disputing any of that pdm – just think that there will be a little bit of legal stuff required to sort out reinstatement of the prior situation, possibly including a requirement for those LB’s that have (and still plan to) circumvent a referendum under Mahuta’s rules, to hold a referendum. One LB I pay rates to had planned a referendum with the 2022 elections but instead created an monstrosity that resulted in the 4 maori ward council reps needing only about 1000 votes per rep compared to around 6-7 k for the 6 general ward reps. The worst part was that the LGC signed off on the review proposal despite it being very evident there was a discrepancy which was out side of the rules **. The rationale for that approval was shoddy as hell!
        
        ** Appeals and objections against final local authority representation review proposals and proposals that are non-compliant with the statutory fair representation requirements (the ‘+/- 10% rule’) – see LGC /What we do etc

    Yet, the Maori seats survived, as Joseph writes “through indifference and neglect”.30 The seats were retained throughout the life of the First-Past-the-Post (FPP) voting system,31 but when the Royal Commission on the Electoral System was created in 1985, the issue of Maori representation in Parliament came directly under the microscope.
    
    Along with its broad and inclusive terms of reference to review the electoral system, the Royal Commission was specifically directed to consider “the nature and basis of Maori representation in Parliament”. The Royal Commission recommended New Zealand replace FPP with MMP, a proportional system of voting. The below is from the PSA, sure they are looking out for their members, but most of these functions are already available. Frankly a special ministry to replicate existing functions based on ethnicity looks like a great way to get more race based taxpayer money.

  2. Pedestrian crossings are prescibed in regulation – they are intended to be black and white, standardised, and to provide assurance to pedestrians and drivers as to their purpose.
  A rainbow painted on a road is not a pedestrian crossing, and it is not actually a permitted decoration.
  
  All the paint is also a traction hazard for motorists, cyclists and other legitimate road users.

The govt needs now to be upfront and indicate when the legislation will be enacted OR whether they have had a change of heart and wimped out on the back of resistance from Maori.     He has said that a number of leaks have come through the public service, but at no point did he identify which ones.
    
    When asked, the prime minister said the leaks from his Cabinet were “not a biggie” and that “we’re not particularly losing a lot of sleep over it”.

Wellington mayor Tory Whanau is to meet the Prime Minister with concerns about job cuts in the capital. Never heard of any meetings with Prime Minister Ardern when Wellington public service jobs exploded. Apart from Wellington has high rents and a housing shortage, so taxpayers have to provide more social and emergency housing.

No worries. Some of the laid off from the public service and closed down businesses will head to less Green pastures. Silver lining – housing problem ameliorated.

Do the colours make the crossing less rather than more obvious.
They likely cost more and are more costly to maintain.
Normal, can we even use that word without being haters, pedestrian crossings are easy to notice, making oversight less likely.
Traffic signs, of every kind, should be simple, easy to understand and clearly visible.
In nature bright colours are often used as camouflage, so colour alone does not always make something more easily seen.

    Wellington’s is fairly unique in that it actually is a pedestrian crossing. However it is controlled by traffic lights, so no particular danger.

My son studying at Auckland University supports the maori only spaces — he says those students are rowdy and disruptive so these spaces help to keep the noise down for other students.

  Surfing, I attended Auckland University in the 1970s/1980s. At the time there was in the old Student Union Building a room called Women’s Space (a sexist abomination of its time).
  
  Then in the 1980s, the University built a Marae in Grafton Rd for the Maori department. Why was that not sufficient?
  
  These separate facilities are BS! If any student cannot study without being disruptive, then they are in the wrong place.

Sports-betting corruption features in today’s Wall Street Journal. What’s the position in New Zealand?

NZ’s statutory monopoly, the TAB, now offers betting on 31 types of sport in the country and overseas, including sheep shearing as well as favourites such as rugby and cricket.

Meanwhile, TAB NZ’s chief executive, Nick Roberts, says New Zealanders are spending as much as $200 million a year betting on overseas gambling sites.

The WSJ reports that in the last two weeks alone players across America’s major professional and college leagues were drawn into a “building avalanche” of gambling scandals.

This month America’s Basketball Association received complaints from players and a head coach about betting’s growing influence and its potential dangers. Days later Toronto Raptors forward Jontay Porter became the subject of a league investigation of alleged suspicious betting activity. The National Football League, meanwhile, suspended 10 players for betting last year.

The newspaper says the controversy extends to college basketball.

  US sport is populated by, largely black, athletes who are suddenly introduced to riches beyond their wildest dreams.
  Along with the often obscene amounts of money comes idolisation which suggests they can do no wrong.
  They usually have neither the skills or background that would allow them to handle either.

  A fundamental issue with sports betting is that the sport upon which bets are placed and its players need to be regulated to avoid fraud and corruption. These issues would have been identified right from early times. That is why for example a jockey is forbidden to place a bet on the horse he or she is riding. So USA College Basketball would be rightly concerned it it was to become the unwitting subject of sports betting. It would be of serious concern to NZ for example if overseas betting outfits offered bets on school First XV rugby matches (Auckland schools have even clamped down on such matches being streamed).

A post in general debate yesterday by C. James deserves more attention …

Thank you to CJames for highlighting that the Law Commission wants to introduce Maori “hearsay” into evidence.

Amokura Kawharu, president of the Law Commission, is reported in the Herald as saying statements handed down from tupuna are treated as hearsay and therefore unreliable. She said there needs to be a way they can be admitted into court as evidence.

CJames says this would make the statements unchallengeable.

Tupuna are “ancestors” or “grandparents”.

To lay folk such as me this sound like giving preference to evidence from one group of people.

Can any legal type who follows Kiwiblog explain how making “tupuna” statements (if the word statements itself applies to them) could be made to fit the Hearsay Rule in Section 17 of the Evidence Act. (This is the third crosslink if the Moderator permits as a special exception to the two-link rule for a complicated topic – on a quiet holiday.)

The Law Commission is a statutory body. In the second link below, you can read its function in the 1985 Act that set it up.

Even though it’s undemocratic, Luxon is not going to do anything about maori wards on local councils.

The guy is gutless. He is also completely out of touch with the electorate.

I hope he gets rolled simply because he has no courage. Then again, the Nats have a history of being namby-pamby.

I cannot see any reason for me to ever again consider voting for such bunch of pansies.

And seriously with the rates bill going through the roof how can blowing rate payer money on a pedestrian crossing be justified in the first place???? What an inspiration Peter Beck is!

The company is now worth US$2 billion and is growing very rapidly.

His company employs 700 people in NZ, not counting the employment generated in his hi-tech supply chain, nor the jobs created when his well-paid employees spend their wages and salaries.

Without a shadow of a doubt, none of this would have happened, if a NZ government had set a wealth limit.

All his operations would now be in the USA.

The first 100 days of the Coalition has finished.

The Coalition have substantially outperformed my expectations to date.

Seymour has been magnificent so far, and is the standout performer. Winston has been surprisingly good to date.

Although Luxon / Willis / Stanford et al have been extremely weak, they have still outperformed my expectations, which were admittedly very low for them.

I now feel optimistic about the future.

In the past under MMP, the smaller parties in government achieved nothing. What is clear now is that the small parties actually have enormous power, if they choose to wield it. This gives me hope for the future.

If ACT holds the balance of power after the next election, they can demand pretty much whatever policies they choose. Core Crown spending below 25% of GDP? National will need to agree with it, or they won’t be able to form a government. Mr Luxon is jelly. He will sign up. The alternative would be a coalition with the Greens.

The Coalition still have a huge task in front of them. During Covid, I realized that the neo-Marxists had marched through all our institutions. Nonetheless, the one thing that has stunned me since the election has been how comprehensive the coup has been. The media, courts, universities, police, film commission, government departments – everything has been taken over by extreme left-wing activists.

The main task over the next three years is to purge these far-left infiltrators, one by one.

Honestly, who isn’t enjoying the propagandists from legacy media losing their jobs?

My schadenfreude super-sized cup runneth over!

  I agree with most of your observations, and your sentiments.
  I do however think that to count-out Mr. Luxon so early in his position is maybe to do him an injustice. He didn’t get there because he was stupid. As I have commented elsewhere in this blog about his performance, he has his priorities. I think that Luxon, Peters and Seymour are possibly the three men who can drag NZ out of the shithole created by Labour.
  I do have reservations about Nicola Willis: she apparently has a lot of supporters but I am damned if I can find anything in her CV which makes her a Finance Minister. I hope I am proven wrong to doubt her.

  It does indeed look like fabricated “evidence” in support of their collective bargaining.
  
  The article also quotes the partner of a “detective sergeant”, claiming that his salary has “only” doubled in 17 years (so on average, 4% per annum compounded), but no mention of whether that has been for the same role or not.
  And she also claims they live “week to week” with three kids, despite her also working full time. Its unclear what an experienced “detective sergeant” is paid (police collective agreement conveniently doesnt appear to be public, unlike that of say, nurses), but their combined pretax income must surely be in excess of $150k. Thus living “week to week” sounds like they might be living beyond their means…

The two exchanged Christmas cards. Did they exchange Easter cards also? Mitchell is just another spineless National MP. He should be demanding Coster’s resignation every single day but he won’t because he actually agrees with the commissioner’s actions and statements.

The Nats are pathetic.

NZ have to get rid of Devine, Bates, Tahuhu and all the other old players: they should assemble a squad of 16 – 20 year olds, spend 12 months coaching and melding them into a proud and competent team.
The emphasis should be on building-up a competent TEST team: T20 is crap, and 50-over cricket is not much better these days.
There is far too much overseas Indian big-money cricket ruining our NZ players.
