After reading this article in particular ‘reading between the lines’ I have concluded that the ‘three strikes’ law is excessively harsh as applied to the recent mugging case. Robbery and aggravated robbery are the two least serious crimes covered by the ‘three strikes’ law.

“Robbery is theft accompanied by violence or threats of violence, to any person or property, used to extort the property stolen or to prevent or overcome resistance to its being stolen.” Crimes Act S234(1) – maximum penalty 10 years.
Aggravated robbery – Crimes Act S235 – “Every one is liable to imprisonment for a term not exceeding 14 years who—
(a) robs any person and, at the time of, or immediately before or immediately after, the robbery, causes grievous bodily harm to any person; or
(b) being together with any other person or persons, robs any person; or
(c) being armed with any offensive weapon or instrument, or any thing appearing to be such a weapon or instrument, robs any other person.”

I had assumed he was convicted on S235(a) – robbery involving GBH. However the violence extended no further than kicking the victim in the shin. There is no mention of a weapon etc, so it must have been S235(b) – in the company of another person, although this aspect has not been explicitly mentioned in the news reports.

In my opinion, Robbery and Aggravated Robbery (except S235(a)) should not be ‘strike’ crimes where the offending is at the lower end of seriousness, such as in the present case. I would ‘tweak’ the law as follows:
a. Delete S234, S235(b) and (c) as ‘strike’ crimes and make it retrospective or:
b. Re-cast S234 and S234 and the ‘strike’ legislation to specify different maximum penalties of grades of seriousness and more clearly specify what level of ‘seriousness’ attracts a ‘strike’.

The advantage of such a legislative change would be to undercut the Opposition’s reasoning for repealing the ‘three strikes’ legislation, and make it easier of National to attack any such Labour/Green election policy.

Research from Australia on under reporting of violence:

Male violence against women under-reported

University of Western Australia Professor of Social Work Donna Chung says most statistics underestimate the real extent of male violence against women.

Prof Chung found that less than half of women who experience domestic violence report the assaults to police.

“There will always be women who are understandably distressed or embarrassed about having been subjected to such violence, and as such, do not disclose or report it,” she wrote.

Prof Chung also found only 30 per cent (18,000) of the estimated 60,000 adult sexual assaults in Australia each year are reported to police.

They call themselves progressives, and social democrats, and socialists, and all the rest of it, but the bottom line is they are all Communists.

Because they dominate so much of our political narrative they have managed to make that word one that is culturally unacceptable, but I reject that domination, and fight against it, and that is why I will always use that word as much as I can, and why everyone else who also opposes the left should use it.

It is a word that strips all of the pretence that the liars and propagandists of the left cloak themselves in and leaves them exposed as naked amoral thieves and totalitarians and historical mass murderers.

They still dominate the political narrative, and whether you vote National or Greens or Labour, we are still all on the same Marxist train heading down the same communist line.

I seek to turn that train around and put it on the road to liberty, and I need people to help me do that.

One small way you can help is call the left out for what they really are.

Communists.

Don’t be afraid to use the word, and once you start using it you will find it therapeutic. It is refreshing in its honesty.

And it really pisses the left right off.

Too be honest Flipper – I don’t think the scientists actually know. I believe because science has produced so much knowledge historically we have given science a superior position in society, and therefore expect and seek answers from it – thus putting it under pressure to produce answers to extreme phenomena.

I think the reason we are getting so many contradictory answers is because – they actually don’t really know as much as many believe. One set of data produces certain perceived expectations, another produces something different. Due to the many variables involved – I say forget the heavy science – use commonsense (don’t pollute the marine environment if you like fish and chips – obviously don’t fill the air we breath with crap – and lets try not to kill of every other species on earth, if possible) but exactly where we are heading regarding warming/cooling appears to me to not yet be an exact science. Let’s concentrate on the things we can do something about. I don’t believe that in a long run there is anything much we can do to prevent whatever is going to happen, even if it is the end of the planet. We just ain’t that smart!

What a load of rubbish.

Married women are exposed to the same kind of abuse as non-married women, and in fact, historical research has demonstrated that in the past married women were less likely to report the abuse due to certain beliefs that they should just accept the physical and mental violence because they were married, and out of some sense of a lower position as ‘wife’.

Children from marriages are also subjected to abuse and are afforded no extra protection from it due to their parents being married or not. The same thing applies, in marriages the abuse is often not supported as much, and families close ranks to disguise abuse.

Some of our worst and more prolonged cases of child abuse and neglect have been centered around institutions that support marriage, such as the Church – however I do note that the individuals who have been responsible for this violence, despite calling themselves Christians or whatever, are clearly not behaving in a manner that would deem them to be one.

Got an interesting flyer from Labour and David Shearer at the weekend.
One side was how Labour is going to politicise the Christchurch recovery, including the Government suing insurance companies (that will bring resonance to Chch TC3 people) – the back side was Labour’s future strategy – build 100,000 homes, invest in education and create jobs.
Not a word about Pharmac-style power nationalisation! Which means Labour didn’t actually had a power strategy when they wrote this flyer – so it all belongs to the Greens!

Yes, I am aware of how we got science, and how we perceive scientific endeavour – but the question I raise is ‘are we giving it too much power’. At first scientific endeavour had much to work with. We didn’t know why apples fell off trees and not zoom off into the sky. However, I believe the current disputes among scientists is because the material they now investigate is far more complex that their ability – and in fact, they no longer ‘know’ but are instead have fallen into the habit of using their presumptions as fact – hence the variations in data produced. (Or at least, they allow others for various reasons to use their presumptions as fact – especially for financial benefit)

I think there’s probably quite a few ways of thinking about race relations in NZ.

I’ve just come up with this one: The natives…. a lot of them… if they’d had their way…. would’ve probably had the ‘white meat tastes just like chicken, who knew?’ mentality.

If it had been the other way around…. how would the Europeans have fared? Enslaved. Or on the menu.

If you apply the thinking of the locals at the time…. it should be a simple case of ‘meh, shit happens. We’re not as advanced. Game over. What can you do?’.

Should’ve just given the natives the South Island. That might’ve saved a lot of bullshit.

You do realise that anyone, from anywhere can put whatever data they like on google. There is no verification process.

I do support marriage – for any consenting adult that wants it.
I do not think that marriage provides any protection from violence, for either man or woman. If a person is the type that uses violence to attempt to solve issues, they are going to do that, regardless of a certificate or wedding ring.

Married men do not protect their wives, anymore than de-facto men protect their partners. The desire to protect the person you love does again not come with a wedding ring, but is associated with love and respect you feel for that person, something that is perfectly possible outside a marriage.

You are giving the union of marriage far too much power – it is only the people within any type of relationship, marriage or not, that decide whether violence, protection or whatever will occur. If they are the type of person that cannot handle stress, and resorts to violence then a marriage ring is not going to prevent that – and in some case studies has been attributed to actually providing the excuse that it is a ‘husbands’ right to treat his wife in that manner (mostly historical)

The Pennyweight Dunne:

“The Immigration Amendment Bill reported back from a select committee in August last year, but the Government did not have the support to progress it further as United Future leader Peter Dunne had reservations.

However the Government now has the numbers to press ahead, after Mr Dunne negotiated changes in exchange for his support.

As drafted, the legislation would have meant asylum seekers arriving in a group of 11 or more could be detained under a group warrant, and Mr Dunne said he felt that definition was harshly restrictive.

“It would potentially rule out a large family arriving, for example.”

Mr Dunne said on Friday he has negotiated a change so that number will be raised to 30,

and while he would like a higher figure, he is pleased to have moved the Government to that point.

He says he will now support the legislation through the House.”

A young killer seen licking his victim’s blood after stabbing him has followed in his father’s and grandfather’s violent footsteps.

Shayd Robinson, 21, was convicted of murder yesterday for stabbing Aaron Hadfield to death during a road rage attack in January last year.

His father, Tom Robinson, has also stabbed and killed someone, and his grandfather, Benjamin Robinson, almost killed a man when he shot him in the back during an armed robbery.

Shayd Robinson’s victim died less than 20 metres from where his father’s victim died, just across the intersection of George and Logie streets in Stokes Valley.

It can also now be revealed that Axl Stark, 23, who was also involved in the attack, pleaded guilty to charges of assault and intentional damage. He was sentenced in November to four months’ home detention.

In 1994, his father stabbed cousin Royston Hughes to death during a dispute over a car stereo. After a brief scuffle outside his flat, Tom Robinson went into his house for a blunt knife. Returning to the fight, he stabbed his cousin four times.

He claimed self-defence, saying his cousin had cut himself on the knife as he lunged forward, though a pathologist at the time said all four stab wounds went deeply downwards and the killer blow was delivered to the hilt. Robinson was convicted of manslaughter.

I have never said that I am against marriage – the point I made was that if a person is violent and the sort that is going to resort to violence as a means of control or temper, then being married is not going to stop them and therefore marriage offers no protection.

I am married. It’s never protected me from anything, but then my husband didn’t resort to violence – either before or after we were married.

Don’t blame me for what the statistics support – however, carry on with your lies – afterall, you seem to base your entire life on the biggest one of all.

A VIOLENT LEGACY

BEN ROBINSON

On January 12, 1981, aged 25, he broke into the Grand National pub in Petone, wearing a balaclava and carrying a sawnoff shotgun. He pointed the gun at 42-year-old manager Rick Bullock and told him to open the safe, before ordering him to lie on the floor.

After taking $12,000, he shot Bullock in the back from close range, in what police initially called “a cold-blooded . . . premeditated attempt to kill”.

Bullock suffered an 11cm-by-5cm wound to his lower back and spent six weeks in hospital.

Robinson remained on the run for three months, during which time he claimed to have spent all the money. He burned his clothes on Petone beach after the robbery and threw his shotgun into the sea at Makara.

On May 15, he pleaded guilty to aggravated robbery and discharging a weapon causing injury. The shooting was downgraded to accidental discharge after Robinson’s confession. He was jailed for six years.

TOM ROBINSON

Fatally stabbed his cousin, Royston Hughes, during a dispute over a car stereo on February 20, 1994.

Hughes, who had a wife and three children, had visited Robinson’s Stokes Valley home, annoyed that a car he had bought from him a month earlier for $400 had no stereo in it. After some shouting and shoving, Robinson, 20, went into his flat and picked up a small blunt knife with which he stabbed Hughes four times.

Robinson’s father, Ben, found him cowering in a corner shortly after the stabbing, “shaking and rocking back and forwards like a child does”.

Robinson was jailed for four years for manslaughter. He is now waiting to be sentenced for another stabbing incident, after pleading guilty on April 16 to wounding Brendon Oliver with intent to injure. The two men, who knew each other, had a fight in the doorway of a pharmacy, during which Robinson stabbed Oliver in the hip. He pleaded guilty on the basis of self-defence, though he admitted using a knife was excessive in the circumstances.

Robinson has had several convictions since killing his cousin. The most significant were possessing a firearm and ammunition in 2000, for which he was sentenced to periodic detention, and a Summary Offences Act conviction in 2005 for possessing a knife in a public place.

SHAYD ROBINSON

Stabbed and killed motorist Aaron Hadfield, 27, on January 26 last year, in Stokes Valley.

Robinson and Axl Stark were walking along the street as Hadfield drove past and, according to Robinson, almost struck Stark.

Hadfield stopped his car and Robinson and Stark threw punches at him. Robinson then reached into the car and stabbed Hadfield once in the chest. The blow struck his heart and lung.

Witnesses said they saw Robinson lick the blade of the knife and they heard him tell his dying victim that he liked the taste of his blood.

Hadfield, who had a partner and two children, was taken to hospital but died early the next day.

No idea. What power do they have now compared to any other time?

The human race has never been more educated. I’m not too worried about someone doing something really dumb because the nerds advised them to. By really dumb I mean… say… the overlords introduce petrol rationing for 2014. 10 litres per week per person. We’re trying to keep emissions down people!! That level of stupidity. Well… it might not be such a bad thing if it saved the human race I suppose. At least we live in a country where not all people just bend over. There’s debate and freedom to speak.

I don’t know how you measure the power or influence of scientists exactly and then decide if they’ve got too much or not. I know what you mean though. Climate change issue has certainly been done to death. Like a stadium full of journos with a dead horse flogging fetish and a solitary dead horse.

It’s tangent time: Apparently the most eco-friendly thing any person can do is die/kill themselves. Then you stop using up resources. Sort of defeats the purpose though. It’s a bit lose-lose. 7B people. That’s a lot of resources. Forget the climate… aren’t the resources just going to run out first before we’re cooked?

The reason I made that point was people constantly ask (including myself) for proof. We request scientific verification on most things and whatever is supplied, is generally accepted as being the answer. By doing this, we give science power.

But I’m really not sure that science (knowledge) is quite up to it. Pierre Bordieu and other theorists suggested that education is responsible for the reproduction of knowledge, in which regardless of method and in each ‘age’, facets of that knowledge is merely passed down, determining our culture, and what/how we think – parts of which are then passed down again. And so knowledge always possesses facets of previous knowledge and method. That is we continue to conduct research, investigation and learn from the same space – my argument is that ‘space’ is now so full of old cultural knowledge, that we are just regurgitating – when what in fact is required is a completely new ‘knowledge’, completely new methods, completely separate from the past. Problem being – it is virtually impossible to achieve, because all we know, is based in part, from what we have learned. We cannot establish anything new, without incorporating at least some – even if only method, from what we already know. Hence we will continue to ‘chase our tails’ IMO.

Yours was a thoughtful comment on the DAGW BS. The only problem is that not ONE, not one single scientist of world repute, subscribes to the DAGW scam.

Moreover, not a single shred of evidence has yet been produced to substantiate the specious claim that there is a link between carbon dioxide and climate change. There have been half-baked papers (often based on NGO and student activist claims), but none that have ever been subject to proper peer review.

I could go on, but instead defer to my friend and colleague in the UK, Rupert. C. E. Wyndham, who just last month admonished the President of the UK Royal Society in no uncertain terms. I quote from his letter to Paul Nurse:

You see I argue that we are giving too much attention to well established criminals, where we should be looking at those when they begin their offending, and putting the attention in at that point (we tend to give 1st timers a soft approach).

The latest murderer in that family has earlier offences (minor, not serious and not strike stuff) however, if he had been addressed sufficiently at the point of his first offence (no matter what his age) and his family’s history indicating he was a ‘very high risk’ – then perhaps his offending would not have got to the point where another person was killed – in short the cycle of violence in the family stopped. Even if it required the removal of the young man from his family situation before he too became a career criminal.

I think we have it wrong – I think we need to target first timers – stop them before they get really started. Take them from environments that encourage them to continue offending. That is where money needs to be spent.

Research from Australia on under reporting of violence:

Female violence against men is the most under reported crime of all.

Male violence against women is over reported in the statistics. Any complaint regarding a sexual assault is counted in the statistics, even if the complaint is found to false, withdrawn, or the accused is found innocent.

Male hate groups suggest the problem is the lack of convictions and lobby for the standard of evidence to be lowered so that men are basically assumed guilty on accusation. The real problem is women not being convicted for false complaints.

The Supplementary Disclosure Document is supplemental to, and should be read in conjunction with, the Mighty River Power Share Offer Document.

What if I wish to withdraw my application?

The publication of the Supplementary Disclosure Document means that applicants who have already applied for Shares in Mighty River Power have the right to withdraw their Application in the manner described below. If you withdraw your Application, you will not be allocated any Shares in Mighty River Power in respect of that Application and your Application payment will be refunded to you. We expect you will receive any refund between 14 and 28 May 2013.

If your Application for Shares is dated on or before 23 April 2013, and your Application Form is received by 5.00pm on 3 May 2013, you have the right to withdraw using one of the methods described below:

by calling 0800 90 30 90; or

by completing the online withdrawal form which is accessible from here.
The last time to withdraw is 11.59pm on Wednesday 1 May 2013.”

Griff you do not seem to understand that not all “scientists” know about climate. A medical doctor can not claim to know any more about these things than a plumber or carpet layer. That includes the retired Indian railroad engineer who heads the IPCC. You are really pretty naive for someone who claims to be so well informed about things.

I listen to suitably qualified professionals in the field, who do not rely on “proving” AGW for their sole source of income.

Penny, for somebody who is concerned about ethics (“Mighty River Power is an unethical investment”) http://www.kiwiblog.co.nz/2013/02/general_debate_11_february_2013.html#comment-1094758, I’m surprised that you are acting so unethically in trying to derail a share float that has been carried out under the correct due process, by a democratically elected government, and which has been tested in court.

Lance, thanks for your constructive comments. We all tried to teach Griff the difference, between weather and climate, when he ranted daily about it being a bit hot in the Aussie desert during summer and some what draughty in the hurricane belt during the hurricane season.

But the guy who used to tap train wheels in India said hot weather was global warming, and so was cold weather, and windy weather, and stable weather…
