Mark Lundy is entitled to go into the prison festive season in bouyant mood for a range of reasons. Any rational study of the appeal transcripts, which will be available due to the live herald feed, show complete proof of innocence, and a recitation of disproved crown points in an extremely lacklustre and uncommitted presentation by Philip Morgan QC. Many police fabrications were exposed, and eregiously repeated, such as the detective Olsen dredging for witness X. This slimy cheat should have been left in his jail cell. Like witness B from Tamihere, prison records prove X was never in the same place at the same time, to hear a “confession”.

If the appeal court fails Lundy, to appease the Wellington masters, Andrew Little’s CCRC is custom designed to bring back every detail of the case, the voluminous records, to the table, and these show that Mark Lundy never left Petone, and that his family was killed around midnight in response to a debt collecting exercise. They show the dna of the killer under the fingernails, and his fingerprints around the window where he broke in. They show the paint flecks derive from paint that Mark never used on his tools.They show that Amber ate a few hours before she was killed, and was dead long before the 3 am earliest crown time. They also show that he had 30 liters too little petrol to do the crown’s disgracefully named “killing trip”. This is indeed new science from the racetrack. Remarkably, the most desperate driving of any marque always uses 3 times the petrol the most economical driving does, and Morgan had to make wily statements to squeak in the absurd crown case.

This is a tragic hoax for New Zealanders to confront in the new year. Enjoy your Christmas in the best prison fashion Mark, and think about the lives of the lazy villagers who vainly try to discard you. You will be back.

    The crown had to roll over on the fabricated science by the Netherlands forensic Institute. Who knew they were so strapped for cash they would accept blood money to keep an innocent man in jail. Letitia Sijens is a consummate fraud, exposed by the defence expert. Morgan was forced to claim he never needed her contention the alleged CNS tissue was human, that his conviction was safe anyway. But the panel seemed unconvinced. And why introduce the evidence of a scientific cheat if the case was already good? How do we know the jury were not influenced when Morgan thundered 33 times in summing up that no man should have his WIFE’S brain on his shirt.

      Did you ever watch the Into The Darklands episode on Mark Lundy? His behaviours leading up to and subsequent to the murders were very revealing which was one of the reasons nearly every person connected to the case were convinced of his guilt.
      
      The man is a narcissistic sociopath Notsofast; he not only was capable, but did in fact kill his wife and daughter.

        Yes. I watched the episode. I have listened to Nigel Latta explain that Mark always planned to kill his own daughter and take up with a 20 year old vixen on his new vineyard.
        Yep, heard our Nigel. He is a drop kick of the first order.
        For the record, behaviour at funerals is notoriously unpredictable. I could name a local well known case that had attendees appalled at the widow’s behaviour. She did not kill her husband.

        I don’t agree on a number of things Latta champions, but I have the utmost respect for his professional ability and experience – its strange how he was uncannily accurate in his profiling of the other violent offenders in his books and TV series but was way off on Lundy. But then perhaps William Bell, Jules Mika, Liam Reid and Antony Dixon (to name a few) were all miscarriages of justice?

        It’s interesting that his behaviour was something the jury was apparently interested in, both at the trial and when he was interviewed. People’s ability to read behaviour accurately has become the subject of a lot of scrutiny, and the Courts are requiring specific directions to avoid reaching conclusions on behaviour. For example, was Lundy’s performance at the funeral because he was a guilty man who was a poor actor portraying how he thought a bereft man should behave, or because he was a genuinely bereft man who was a poor actor portraying how he thought a bereft man should behave? These are not easy questions for juries to answer.

        Be careful here, the last sentence can be considered defamatory. Never say someone killed someone – say something like ‘he is accused of killing …’ or the case against him is considered extremely strong etc.

      Notsofast Lundy like David Bain did get a fair second trial. Excellent trial lawyers on both sides and a most fair summing up by the trial judge.
      
      I think both judge and jury though would have ignored fanciful conspiracy theories of planted evidence by Lundy’s supporters .

        Fair second trial? I have read the transcripts.
        Witness X was exposed as a lying flatter than a flatfish. Detective Olsen brought him to the party knowing X was lying. Is that fair?
        Letitia Sijens has been exposed by the finest scientist in the field, Steve Bustin, as a fraud. She added human to the CNS hoax, and Morgan said QED. False. Is that fair? Dr Sage from Palmerston North said Amber ate at midnight in testimony, yet her grandmother testifieed she was ALWAYS in bed and sleeping at 8pm. Was it fair to allow Sage to theorise like that so a wise doctor trumps a sensible grandma?
        The trial was a sham and has been well exposed in the appeal court. There are scores of falsehoods that prosecutor Morgan wittingly or unwittingly recited. Morgan knows, I can absolutely promise you. The good news is he will never be a judge after disgracing himself in Lundy. He knows that too.

  Saw a programme on Scott Watson last evening – has some disappointing points raise and poo pooed by the Police (Inspector Pope).
  Sad that the Police appear to have told many very experienced boaties and one a boatbuilder that they never saw the vessel the Police may have wanted to talk to, along with the scruffy man in the Bar.
  This was not Watson’s boat Blade.
  This outstanding ketch was seen many times in the Sounds, then it disappeared.
  May have been seen later in Opua.
  Some of these mainly elderly very experienced boaties were very sad to be called effectively liars by the Police.
  I cannot fault the jury system but feel that this could be in the area of a stitch up.
  And nobody will listen to Watson.

    It seems that Andrew Little is reading his RPOM document. This would put him ahead of Judith Collins, who was proved to have not read Binnie’s report on Bain, and she also missed the crucially false ingredients in Kirsty MacDonald’s rejection of his previous RPOM, which consumed a lazy 4 years of her precious life. Jesus wept.
    Note: She rejected it on the basis Olivia Hope’s hairs were on the yacht Blade. They were not.

        I made these notes in 2015.
        “I have heard the same caller twice in two days giving testimony that he had a brand new video camera, and videoed everything, including Scott Watson’s boat, and two ketches, one of which matched the one described by Guy Wallace leaving the inlet at 6 am on new years day. He spent 3 and a half hours being grilled by the police. They kept his film, of which he had not made a copy, and said they would return it. He asked three times for it, they fobbed him off and he never saw it again.”
        
        I have seldom heard a more agitated caller, he said he had been waiting a long time for the opportunity to be heard. Make of it what you will.

        Probably at this remove, very hard to find the boat. As others have remarked, some evidence did exist but has apparently been destroyed – by the police.
        
        I have seen some comments on the internet of several options including one apparently owned in Wellington.
        
        But it does seem strange that not one but a number of people reported seeing such a vessel, and the water taxi driver is quite adamant about which boat he dropped the missing off at, and SW’s boat just doesn’t match the description at all. You would scramble across from the water taxi to the Blade, you would have to climb UP to the ketch – plus the distinctive markings (the stripe).
        
        It remains a question to me, why did the police not even ATTEMPT to find and if possible eliminate any Ketch from the enquiry. And why would they suppress evidence ?
        
        Finally, no jailhouse snitch should be believed, ever – last ditch attempt by a crooked prosecutor/police.

        Guy Wallace tells the police this two and a half days (63 hours to be exact) after delivering Ben and Olivia with “the guy off the boat” to the “thing that floats”.
        
        I am trying to reconcile Scott Watson claiming not to own his own boat in the circumstance where he is trying to impress the youngsters that he is kosher. Personally I can’t so here is a powerful datapoint in his favour.
        
        It seems Donald Anderson dropped John Mullens to his boat, returned to the wharf, and then delivered Scott to a boat that had a name like a weapon (blade). Just after Watson had been involved in a skirmish in the bar. Anderson returned, tied his boat up and boarded Foam for a coffee, from where he could watch those assembling for the fateful trip.
        
        Ian Wishart has another narrative, only one can be correct. Intriguing.

        Even if you do not believe Rob Popes version there were many other Police involved plus its standard practice for the file to be reviewed by a very senior officer.
        
        Tough call if you believe “all the Police involved” were mistaken or corrupt.
        
        Believe me there would be Police whistle blowers crawling out of the woodwork if anything was dodgy.
        
        Watson was and still is a real nasty bastard who is treated with extreme caution by corrections staff. Don’t be fooled by the suit and glasses.

At this very moment, Chile is going to the polls to elect a new president. Who cares? Well, for this political junkie, it is the most interesting election in the world right now. And, bringing it closer to home, when our own dear leader was at the Apec summit she remarked that the foreign leader she conversed with the most was Chilean president Michelle Bachelet. Which I thought was curious, because Ms Bachelet is about to lose power, with her political legacy in tatters. As an NZ citizen concerned with who Jacinda choses as her friends (and chronicler of things Hispanic), I thought I would give this more attention, so here are my thoughts…
The two candidates in the run-off election today (Sunday in Chile) are:

Sebastián Piñera (68): Piñera, a centre right politician, was president from 2010-2014. He is one of the richest men in the country, having made his fortune in credit cards and airlines. His family are blue blood criollo aristocrats, including ambassadors, bishops, and business leaders. His elder brother was a senior civilian minister in General Augusto Pinochet’s “regime” in the 1980s and architect of much of Chile’s economic reforms (which influenced the 4th Labour govt in NZ). Socially conservative, economically liberal, Catholic, but gaffe prone (like George W Bush), Piñera has been a big figure in the political scene for decades. His crowning achievement when he was last president was being the guy who first welcomed the 33 trapped miners as they emerged above ground after the dramatic rescue in 2010 (see the movie starring Antonio Banderas for more information).

Alejandro Guillier (64): In the left corner is former TV news journalist turned senator Guillier. He is a newcomer to the political scene but apparently has been a regular face in the press for many years (I say apparently because I never came across him when I was in Chile, not that that really means anything). Guillier is a social democrat, left-leaning moderate who is standing as an independent (more on this below).

La primera vuelta: The first round of voting took place on 19 November. The polls had pointed to Piñera as a possible outright winner (to avoid a run-off, he needed to get more than 50%), but his support dropped to the mid-40s before voting day. Guillier was well behind in second place.

The polls turned out to be hopelessly wrong. Piñera ended up with 36.6%, with Guillier on 22.7%. Guillier was followed very closely behind by the hard-left candidate Beatriz Sánchez, who got 20.27%. This is where things get interesting (and also where this story needs to get into of Chile’s horrendously factional political system).

Some background: Guillier is supported by a coalition called the “New Force of the Majority”, which until just before the election was called the “New Majority” (Nueva Mayoría), so I will keep calling it that. The New Majority, in one form or another, has governed Chile ever since the return to democracy in 1990 (apart from Piñera’s term in 2010-2014). In the broadest sense, the New Majority consists of the centre-left political parties that opposed General Pinochet. Middle-of-the-road social democrats and socialists, but also including socially conservative Christian democrats, this coalition retained many of the free market reforms introduced by military regime but with some tinkering around the edges. They also retained Pinochet’s pro-Catholic social policies (divorce was only legalised 10 or so years ago). This didn’t stop them presenting themselves as right-on bien pessant libs and left wing, even though they never really acted on that ideology in practice. Most of them did get rich though.

This changed with Michelle Bachelet’s election in 2014. Bachelet had previously been president from 2006-2010 (the first ever woman), but she didn’t really do anything, which was fine because that was the whole point of the New Majority. However, she returned in 2014 with a left-wing reform programme – legalising abortion (previously, it was illegal in all circumstances), pro- gay marriage, raising taxes, providing free university education, greater recognition to the victims of the military regime, etc. You can argue about whether her programme was good for the country or not, but her government has been a basket case. Her approval ratings are in the mid-20s, her family is embroiled in a corruption scandal and many of her policies have been watered down or rejected completely. The economy has had a down turn, although this may be attributed equally to falling mineral prices as well as Bachelet’s ham-fisted administration. Piñera has cruised along on this discontent hoping that it would return him to the presidency. His last term in government was relatively stable, with the economy doing well, so he has successfully presented himself as a safe pair of hands.

Judean People’s Front vs the People’s Front of Judea: The constitution bars presidents from having consecutive terms so the New Majority (re-styled as the “Force for the Majority”) brought in Guillier, an outsider untainted by connections to Bachelet (who is widely considered to be politically toxic). However, Guillier has been unable to consolidate support on the left, which is where Beatriz Sánchez comes in (she’s the woman who almost beat Guillier in the first round).

Sánchez was the candidate for the “Broad Front” (Frente Amplio), which is a new coalition of left wing parties. Much as the New Majority defined itself by its opposition to Pinochet and the political right wing, the Broad Front defines itself by its opposition to the New Majority, plus they despise Bachelet (and, by implication, Guillier). They see the New Majority as sell-outs, which is kinda true. It’s hard to put the Broad Front in one box: their leaders and candidates are mostly young (under 30), anti-establishment, but don’t really seem to have actual policies. They are like the Podemos movement in Spain, the Five Star movement in Italy, or Macron’s movement in France.

Who will win? Going into voting day today, the polls between Piñera and Guillier are neck and neck. In recent days, Piñera has pivoted to the right in some respects – his main opponent in the first round was José Antonio Kast, a hard-right senator who adores General Pinochet and is an extreme social conservative (he opposes contraception, and has nine kids to show for it). Kast got 8% of the vote, which may just be enough to put Piñera in power. However, Piñera has continued to fight for the centre ground too, by promising to expand Bachelet’s policy of free university education. This comes to what I dislike about Piñera – watching the debate between him and Guillier last week, Piñera has the schmuck of a used car salesman. He really will say anything to win.

Guillier has struggled because he contends with Piñera on the right and the Broad Front on the left. In the final week of the campaign, the leaders of the Broad Front changed tune bigtime and voiced support for Guillier. They see him as the lesser of two evils. If he can pull together the 20-odd percent that Sánchez won in the first round, he will become president.

Piñera may still just win it, but nothing is certain. Whoever wins will need to govern a country that has become increasingly politically polarised. Michelle Bachelet did not have the personal leadership skills to successfully implement her programme. The result was the disintegration of the centre-left coalition that had held power on and off for 25 years and a country whose citizens are at each other’s throats. Nice one.

TL;DR – close election in Chile today; right wing candidate may just win it; lessons for Jacinda.

    Thanks Dave. No, I am very much a frustrated amateur. I would like to write more but it won’t pay the bills as well as my day job. Plus I don’t have the provocateur combative instinct to operate on the public with my right wing views. The cloak of anonymity remains for now.

        Piñera is appealing to Christian social conservatives for votes by opposing gay marriage. You know, like Barack Obama and Hillary Clinton did when it suited them.
        
        I wouldn’t believe what you read in the English language press about Chile (or any of Latin America, for that matter). They always take a left wing slant. You need to follow the local press to get the full picture (which means you need to understand Spanish).

It is disappointing to hear that until now nobody has done anything on Road Safety by putting rumble strips on rural roads. I do not know where the hundreds of millions in recent years has been spent if not in such areas?
She has not commented about SH2 in the Bay of Plenty which is probably the greatest disaster in terms of deaths – it is a death road through bad driving.
J A Genter is to congratulated now that her Government will spend over $20 million on this.
She has set a target of a reduction in road fatalities by doing this within six months.
She will be kept to that.
But how do you stop a young drugged/drunk you gang of hooligans car from going into a tree – it jumps the rumble strip doesn’t it ?
Surely money would be better spent in chopping down the trees at the side of rural roads first – eh!
Great PR but hope she is right.

    Correct Salacious. Drove from Auckland to Paihia this past weekend and that road is atrocious. The NZTA acknowledge that poor road design/condition by sticking up signs saying “High Crash Area” and lowering the speed limit to 80 kph.

      But if you are talking about lives lost and serious injury then what should a cost benefit ratio matter?

  Paulus… More cars on the road, lack of respect for other road users/police (note pursuits) just plain bad driving plus stoners and cell phone use.

    There has been a huge upswing in deaths of drivers without seatbelts on.
    
    Approx 90 out of last year’s road toll were not wearing seatbelts. If just 60 of those had worn seatbelts and lived, the picture would be very different.

  We need a more high profile Highway Patrol in brightly coloured vehicles and greater numbers to remind everyone that they are out there. How many times have you driven 100s of ks and not seen a cop.
  
  You need the ripple effect of a stone landing in a pond. You tend to watch your driving habits for a while after seeing a cop. You need to regularily see another cop to remind you again.

  Rumble strips on the left edge of the road cause more accidents than not having them. On the centre line – yes, they alert inattentive drivers to correct their path, but on the left they cause cars towing trailers, horse floats, caravans, and also motor-homes to drive near the centre line, not keeping as far as practical to the left. This then obscures following vehicles’ line of sight for safe overtaking and general distance traffic awareness – most of these types of vehicles prevent forward general vision through their rear window, also making high level brake lights redundant.

    The real points to note about this case are that a) the police had evidence which would have made it clear that there was no case to answer, but which they failed to pass on to the defence and prosecution, and b) the poor bloke was needlessly in torment for more than two years because of police incompetence.
    
    The question arises of whether the UK police are so intent on tackling what they see as rape culture that they are blinded to the obvious.
    
    And it’s not the first time this sort of thing has happened recently. Remember the poor bastard who was prosecuted for supposedly having sexually penetrated a woman in broad daylight at rush hour on Waterloo Station? There was even time lapse video showing he was carrying something in both hands when he passed the woman and could not have been in contact with the woman (if at all) for more than a fraction of a second.

        Do you really think a record number (46!)of Maori and PI medical graduates in Auckland in 2016 suggests that a decline in the percentage of Maori language speakers did not take place between 2001 and 2011? Good grief!
        
        News reports from several years ago reported a slight decline, though whether this was a decline in the number of young speakers acquiring competence, or the consequence of older mother tongue speakers dying, or even caused by an increase in the number of mixed race non-Maori speaking people identifying as Maori, I don’t know.

  Calling the programme substandard is rhetoric. he may have a point that there are some fact free operators freely offering advice that gets media attention and distracts work.
  
  Fact is, It’s only in the last few years it’s been confirmed what’s causing the issue and possible ways to manage it have been thought about – there is no cure known. So how, in the absence of science, could you have a plan to deal with a disease in slow growing trees? It’s not like you can run triple blind clinical studies with trees.
  
  My non scientific opinion is, accept the disease is going to kill a whole lot of trees, focus on building a stock of resistant trees and propagate them and replant. You aren’t going to be able to cleanse and sterilise the soil

‘One Lisa Bloom client who received financial help from Bloom was New York City makeup artist Jill Harth.
The former beauty contestant manager filed a sexual harassment lawsuit against Trump in 1997 and then withdrew it. The news media discovered the litigation during the election, and Harth’s name became public in the summer of 2016. She asked Bloom to represent her in the fall after hearing Trump describe her allegations against him as false, and became a vocal critic of Trump.’
‘Bloom arranged for a donor to make a contribution to help Harth pay off the mortgage on her Queens apartment in New York City. The amount was under $30,000, according to a source directly familiar with Harth’s situation. Public records show Harth’s mortgage was recorded as extinguished on Dec. 19, 2016.
Harth said the payments did not affect the merits of her allegations. ( edit-Yeah sure they didn’t ….)She alleges that during a January 1993 meeting at Trump’s Mar-a-Lago estate, the future president pushed her up against a wall and groped her.’

Well, that’s one way to get the mortgage repaid.

Great to see the Auditor General whistle blowing on dodgy school spending, $7000 dollars spent on staff party, $250k spent by school for kids trip to Raro, and a wellbeing and revitalisation sabbatical grant! But would be good if he put the same scrutiny on our Councils and cco’s. Where is the same report on our council spending?. Actually my Council gives an annual grant to one of the schools name for dodgy spending.

I read in the media how Trump has again show true statesmanship by providing information to Putin to help prevent a terrorist attack.

Under Obama Muslim terrorists were told they had a right to self determination in their efforts to create separatist Islamic states in the region. Many of the leaders in places like Chechnya became leaders in ISIS.

Obama’s ignorance and lack of character saw terrorism rocket while at the same time restarting the cold war. Trump deserves a peace prize for disarming this very dangerous situation.

Norway’s parliament has voted to decriminalise drug use.

Users caught with small amounts of drugs – from marijuana to heroin, and everything in between – won’t be arrested or charged, but instead be offered treatment.

The move was inspired by a recent trip to Portugal by a government health committee. Portugal decriminalised drugs in 2001, and has seen use plummet since then.

“[We will] stop punishing people who struggle, but instead give them help and treatment,” said Nicolas Wilkinson, health spokesman for the Socialist Left Party, one of the four parties that backed the change in policy.

“It has started a political process, [but] it’s just the starting point.”

One way or another New Zealand looks to be making a move on medicinal cannabis.

Prime Minister Jacinda Ardern has revealed the Government will introduce a Bill to Parliament on Tuesday around cannabis but is keeping quiet on its contents.

It’s expected that the legislation would make it easier for people with a terminal illness or debilitating condition to access medicinal cannabis.
