So after the MSM globally slams Trump for tweeting “fake news” and that assailant from the video was actually “Dutch” – the full picture quietly comes out (if ya can read between the lines)…..

On Wednesday (Thursday NZT), the Dutch embassy in the US responded via a tweet saying: “@realDonaldTrump Facts do matter. The perpetrator of the violent act in this video was born and raised in the Netherlands. He received and completed his sentence under Dutch law

This is MSM obfuscation at its best. It’s exactly what they did when a coal black man stabbed to death a woman in Russell Square, London last year was described as a “Norwegian man”.

    EAD is always confusing ideology with ethnicity (and in the horse/mouse example even with species).
    
    EAD: a human born in another country is also a human. A human born with more melanin is just as human as one with less (and more protected from NZ’s high UV).
    
    Surely you’ve seen some totally white and many-generation British islamists shouting their slogans?
    
    If you make the islamism issue about ethnicity, you’re playing completely into the hands of SJWs who would love to shut sites like this down for ‘hate speech’.
    
    Also, it seems that in that particular video the perp wasn’t even muslim. Trump really did misuse that video if his (valid) point was ‘islamism threatens the West’.

    Vic, what is the connection to a ladle? Are you saying Mark was a cook in the army. I think the truth is he joined the Regular Force as a cadet when they took kids in at about age 16, and taught them trades. His was a mechanic, which is an honest way to earn your bread, and no I’m not one.
    
    What the fuck is it with you guys who look down your noses at someone for having been a mechanic in the Army?
    
    I don’t care much for Mark’s politics at the moment, but I think it’s a bit rough attacking a man for his service in the armed forces.

      It’s especially rich when it comes from people who have had a very privileged upbringing with no service in the armed forces themselves.
      
      National (especially Gerry Brownlee) did themselves no favours with anyone in the NZDF with their constant sneering attacks on Ron Mark – they falsely called him a cook when you are right he was a mechanic. But everyone in NZ Army is a soldier first.
      
      Having said that, Ron Mark does himself no favours by letting it be said / reported / insinuated that he was a combat corps officer or even a Special Forces officer. He once wrote an NZ Herald column where they described him as a “combat veteran and peacemaker in the Middle East”!

        It’s interesting that Gerry Brownlee, a tradie himself, should sneer at Mark’s trade.
        
        Relevant to snobbiness and trades is the report in the Hooerald today claiming that completing an apprenticeship can return you as much cash over a lifetime as a degree does.

        That is exactly the point. I don’t look down my nose at anyone who serves their country in any field but I do look down my nose at anyone who embellishes their service to make themselves seem more important than they are and who wear medals they are not entitled to. I think you’ll find that is why people comment about what he did in the army. No different from this so called “refugee” in the Green Party.

      I was in the NZ Army and served with Ron Mark ( he was a Captain) at 3 Field Workshops (RNZEME) at Burnham. He was well liked and respected, served a stint with the Sultan of Oman”s Army and has always supported the NZ Defence Forces.
      To have failed in the NZSAS selection course is no shame; it’s one of the most rigerous in the world and few achieve being “badged”.

        By all accounts Mark was a capable and well liked government servant during his service in the military. He also has practical skills of use during war and peace. Just as the darling of Mark’s detractors, Bill English, can shear a sheep and put up a fence. Oh and Jacinda can wrap chips…

      This was reflected in World War 2, when the Aussies brought their troops back from the Middle East to fight in Papua New Guinea then further north, while we left our battle-hardened veterans to fight on in Italy.

NZ s Political embarrassment a guy called Peters is once more caught in the headlights of obsfucation.
When challenged over his now personal and said to be very upsetting derogarty comments regarding Susan Devoy.
He seemed to remember that at that time his quip to her was “Fit” not “Fat”.
Difference was his lying was exposed again. By the well known and respected Sports writer Phil Gifford.
In an interview with Larry Williams,Peters referred to Phil as loosehead Len.
As usual the “pest” for all seasons and reasons Peters was attacking the person and not what he was heard to say.
Interesting he could recall someting word for word that happened thirty years ago.Yet just a few years ago he couldn’t remember the $100,000 Donation he got from Owen Glenn.
Also the “pest” at that time produced a huge sign with the word NO! on it.Which was later confirmed he was a manifest liar .
With the denial of his comments against Susan Devoy,will he once more ressurect the huge NO! Sign denying the truth which he was heard to say regarding at that time a top performing and very popular NZ athlete.

      Again, I do not disagree with you. I did not listen to Peters’ comments so it is possible that I misinterpreted your point. I thought for a minute that you may not have been aware of Gifford’s background. Sorry if I was wrong.
      
      There is nothing we can do about the dedicated Peters’ supporters. They are more of an impassioned cult rather than discerning followers. For those arriving in NZ and who are trying to tell when to take him seriously, I have developed an almost fail-proof test of determining whether Peters is engaging in his unique brand of hogwash, obfuscation or deceit.
      If his lips are moving, I tune to another channel.

Our Lizzie Marvelly is now an expert on the Americas Cup. In the failing newspaper she tells the syndicate to “pull its head in” with its demands for a hosting fee.
The cup its turning into a disaster, with a bumbling flipflop government and a ‘can’t be trusted’ Mayor, who between them, want to turn the whole thing into a second rate side show rather than a showpiece for Auckland and NZ. The MSM are in a flap about Flynn being charged by Mueller as if this is the BIG DEAL.
This is what the it is about.

“CNBC reported:

Specifically, Flynn is accused of falsely claiming that he had not asked Russia’s ambassador to the United States last Dec. 29 “to refrain from escalating the situation in response to sanctions that the United States had imposed against Russia that same day.”

Flynn also allegedly lied by telling the FBI “he did not recall the Russian Ambassador subsequently telling him that Russia had chosen to moderate its response to those sanctions as a result of his request,” the information says. ”

This was after the election so nothing to do with so called collusion to affect the election.
Technically, I suppose, they are right in that he lied but it really is “kindergarten” stuff.

  Clearly Flynn has flipped and is now helping Mueller’s special investigation. He has promised “full cooperation”.
  
  This indictment/charge is clearly part of a deal. It’s enough of a marker to hold him with, and easy enough to dismiss if Flynn plays his part.
  
  Clearly Mueller would only offer a deal like this if he thought it gave him an extremely strong case with the next soldier up the chain (Kushner?).
  
  Papadopoulos. Manafort. Flynn. This is how a net tightens.

      Meanwhile … Flynn is done to rights on not registering as an agent of a foreign country (Russia, Turkey), of inaccurate disclosures on his national security documents, of the Logan Act etc etc etc.
      
      If you really think Flynn is in the clear then why has he flipped and done a deal with Mueller? Reality is that Flynn must have known he was done stone cold, or else he wouldn’t have taken the deal.

Here’s some words from a former Federal prosecutor, someone who has worked closely with the FBI and who has prosecuted cases from beginning to end, Andrew McCarthy (I highly recommend his book, Wilful Blindness on the prosecution and conviction of The Blind Sheik) – in short, someone who knows what he’s talking about when it comes to guilty pleas and witness cooperation:
      
      [W]hen a prosecutor has a cooperator who was an accomplice in a major criminal scheme, the cooperator is made to plead guilty to the scheme.
      
      This is critical because it proves the existence of the scheme. In his guilty-plea allocution (the part of a plea proceeding in which the defendant admits what he did that makes him guilty), the accomplice explains the scheme and the actions taken by himself and his co-conspirators to carry it out. This goes a long way toward proving the case against all of the subjects of the investigation.
      
      That is not happening in Flynn’s situation. Instead, like Papadopoulos, he is being permitted to plead guilty to a mere process crime. A breaking report from ABC News indicates that Flynn is prepared to testify that Trump directed him to make contact with the Russians — initially to lay the groundwork for mutual efforts against ISIS in Syria.
      
      That, however, is exactly the sort of thing the incoming national-security adviser is supposed to do in a transition phase between administrations. If it were part of the basis for a “collusion” case arising out of Russia’s election meddling, then Flynn would not be pleading guilty to a process crime — he’d be pleading guilty to an espionage conspiracy.
      
      I recall the MSM being equally excited about Papadopolis’s plea too – and that’s been a nothingburger. So goes the modern MSM insanity.

The MSM- Red Radio leading the NZ pack- are rubbing their hands gloatingly and in glee at the news that Michael Flynn is reported to be about to testify against Trump in the Russian collusion scenario.

The jury remains out with me until we see just what the evidence is and whether Flynn is able to finger Trump personally.

However, the most interesting and unsurprising thing is the way that the MSM are so pleased with themselves and display their utter lack of objectivity in their reporting of the situation. Naked hatred. At last the MSM feel they’ve got him!! We’ll see.

        Given the scathing comments I made about Trump on this blog through 2015-16, I don’t think I can be taken as a fan.
        
        But frankly – and as per DPF’s thread yesterday – Trump’s administration has actually performed a lot better than I expected in many areas. Frankly it’s been the GOP in the House and Senate that has been a real letdown.
        
        The “fool” bit I always find amusing. Nobody doubted that Obama was smart and well-educated – and he sounded it. But in area after area he revealed himself to be a fool, despite the erudite manner in which he proclaimed the foolishness.
        
        Even in a situation as seemingly hopeless as North Korea, I appreciate Trump’s different approach, and have little time for the expert diplomats who have merely counselled an endless repitition of the failures of the previous twenty years.
        
        As the NRO article yesterday revealed (and NRO was the one that devoted an entire edition to rejecting Trump as the GOP nominee) – there’s a big difference between Trump Tweetworld and Trump Administration in practice.

        One major way Obama ruined his reputation was with the endless “redlines” in Syria. The reality was that each time a redline was crossed the equation was still the same … it’s not an important enough issue to put lots of US lives at risk.
        
        Trump and North Korea is the same dynamic. There’s no winning play for the US. But every “rocket man” “short and fat” “daddy’s boy” tweet is just like Obama’s redlines. Eventually Trump will have to play his cards or fold. I wager the world will be better off if he folds. But if he does his credibility takes another dent.

    I don’t detect much more hatred than they directed at GW Bush – or your namesake for that matter. It may seem worse because of the modern 24-hour social media world, and Trump’s use of it to constantly attack the media (and their automatic response).
    
    But frankly the US MSM have stuck it to every Republican president for forty years now. They have only two stereotypes for a GOP politician: stupid (GW, Reagan) or evil (Nixon, Cheney).

As mentioned yesterday, prompted by someone else’s comment, I had wondered “If New Zealand receives such adamant opprobrium from tabling Resolution 2334 in the UN Security Council, and it passing, what the hell could have been in Egypt’s draft, which was even more emphatically rejected (by Netanyahu and Trump) and withdrawn?”

I have compared both texts, but another kiwiblog commentor yesterday summed it up …
Copying each document to Pages (Mac) for word counts:
Text of Egyptian-draft … 933 words
New Zealand resolution … 946 words
difference: 13 paragraph numbers, added to the New Zealand version.

So New Zealand’s Resolution 2334 (December 24, 2016) in fact is word-for-word a copy of the Egyptian-drafted resolution scheduled for vote at the UN Security Council on December 22, 2016
So if someone stumbles on a truth such as this, what happens then?

Just a couple of little matters …
1 – The two dozen legal experts recently meeting at The Hague and denouncing the resolution are still
• right to damn the content: that it did not “adequately take into account the legal, historical, political and military complexities of these territories and peoples”
• right to criticise New Zealand for tabling it to facilitate its passing, but
• wrong that New Zealand wrote it. That was Egypt with the help of the UK and approval of the Palestinians.

2 – What diplomatic rules has New Zealand broken (besides, probably, international law on plagiarisation) taking the sovereign state of Egypt’s material which they had withdrawn, but now could reflect on that nation the opprobrium they obviously had withdrawn it to avoid?

3 – What should new New Zealand Foreign Minister Winston Peters now do with this mess?

There’s more implications, but these could be answered for a start?

      Er, why? It’s not like the Egyptians are claiming…breach of copyright! 😉 And so the Egyptians chose to withdraw it for whatever reason…so what? McCully never made any secret of the fact that the opportunity came to assert our long-standing (since 1947!) policy of a two-state solution,
      
      …and while we (and UNSC2334) affirms the right of Israel to occupy the West Bank, perhaps indefinitely if no peace settlement can be reached,
      
      …nonetheless we (rightly IMHO) do not support annexation by conquest, stealth and increment (which is what the current Likud-government policy amounts to)
      
      ….and our government’s position, as also per the wording of UNSC2334, is that any future general Jewish access to Jerusalem and the holy sites of the occupied territories should be based on negotiation and agreement with the Palestinians
      
      …and that continued Jewish settlement hindered that possibility.
      
      Is Jewish settlement the biggest impediment to peace? Likely not. But nonetheless it is a real one, and hence it is one Israel can do something about. All reflected in UNSC2334, which is consistent with our desire for both a Jewish, and a Palestinian Arab state living in peace with one another…west of the Jordan River.     That is actually a mite unfair to WO. There are frequently good posts and videos showing points of view that you won’t find in the MSM. Spanish Bride often posts interesting articles that are not as venomous as her hubby’s. The moderation is strict and that can be irritating as so many of us have been banned at various times (mine is permanent, it seems) but that does also mean that personal attacks and foul language of The Standard and often KB variety don’t get through.
    
    It is simply wrong to dismiss WO out of hand. I rather like the homely, community type of mood that is engendered in the evening posts where there is a genuine sense of familiarity and friendliness.

Farrar has always had very lenient moderation but what gets said reflects poorly on Kiwiblog – I think this may become a problem for Farrar, especially with the diving of standards at Whale Oil and the inevitable linking of them and ‘Dirty Politics’.

We should all click on Pete’s good blog commenting link and lift our standards!

How you can add value and enhance good blog discussions, and how to be less bad. Every commenter should read this and take on board some sensible principles of good blog commenting. If we learn from this we will all make our blogs a wee bit better.

On second thoughts, maybe not!

  From my own data the median house for sale price in NZ from May to September was $550,000 in October it jumped to $580,000 and in November it was $590,000. So if you want your beloved Labour Government to cool the market, they are already failing miserably.
  
  As I said a couple days ago falling nominal house prices go in tandem with increased unemployment. Nobody wants increased unemployment especially politicians.

      The Israeli – Palestinian issue is a local tribal conflict between the followers of a Middle Eastern god who differ over their religious interpretations concerning a small strip of land. In that conflict abuses and terror have been carried out by both sides, possibly in nearly equal measure. The conflict is of no relevance to anyone other than the participants, name the Israelis and Palestinians, and perhaps their close neighbors. Westerners who take sides in that conflict, regardless of which side they take, and claim to be doing so in the name of human rights, are abusing the concept of human rights, and butting their noses into a religious tribal war that is none of their business.         Human language skills come from the brain’s neural networks that run just about everything else inside us.
        
        Why do some languages have no concept of left and right. Similarly with colour. Why was there no blue in Maori when whites arrived? There is no universal language organ.
        
        There is no dedicated brain part for this. Chomsky was wrong!
        If robots by themselves evolve a language it will probably be different from any human language because they are wired differently. No universal wiring diagram needs to be followed.

      I’m also amused by Maggie’s angle on Chomsky. In my case it was computer science that led me to the man’s writings, since in the early 1980’s efforts were still being made to develop AI based on his linguistic theories (I did some development work around that). This proved to be a dead end, which the AI community realised when they went back and dug a bit deeper into the theories.

        For over 60 years Chomsky has been collecting his 30 pieces of silver from the war-mongerers.

  Prison officers have a skill set well beyond that of mental health workers but the future is about employing more women with low skill sets. Job sharing they call it. Socialism they used to call it.
  
  The business community has been doing exactly that for 3 decades now, they dumb the workforce down to doing repetitive mindless tasks for lower wages and they then employ women as low paid management ‘box tickers’ to manage those low wage workers, who are increasingly remaining so. ‘Thinking’ used to see people climb the ladder and pay levels at work, but ‘non thinking compliance’ is the order of the day in most workplaces now, and you can remain there for life, and if you want to better yourself you have to leave.
  ‘Certification’ is probably the single most unproductive attribute to the economy and individuals. Some certification is necessary and worthwhile but most is an appalling judgement upon individual capability.

It’s taken just three weeks for Simon Bridges to display his vastly superior knowledge of Parliamentary statutes and procedures to leave Mallard visibly on the back foot whenever he makes a call. Mallard has been reduced to a standard phrase “the member will resume his seat” when on the losing end of a debate with Bridges which is nine times out of ten.

I’m getting weary of Mallard’s school masterly approach of debiting supplementary questions for unseemly behaviour. Clad in his black gown he reminds me of my crotchety old maths teacher handing out detentions. Childish stuff.

Wiggles, while you may disagree with some of Chomsky’s mumblings, as do I, it does not follow we should automatically dismiss all he says.

The thing I admire about him is the way he will speak out and point to the failings of both left and right. He famously says things lefty Jewish intellectuals are not supposed to say. In recent times he has torn apart the credibility of lefty darlings like Obama. He has upset others with comments about Israel. He clearly upsets the right. And he doesn’t give a fuck.

He represents the best of the Jewish intellectual culture and for it he has been denied entry to Israel.

To my mind he makes a worthwhile contribution. He is not a joiner and is fairly immune to group think. These are qualities I admire.

  Tell you what I think is a brilliant piece of Chomsky –
  his view on Teaching
  My own feeling is that teaching is mostly common sense. I taught children when I was a college student. I worked my way through college in part by teaching Hebrew school. I’ve taught graduate students across the range, and just from my own experience or anything I’ve read, it seems to me that ninety-nine percent of good teaching is getting people interested in the task or problem and providing them with a rich enough environment in which they can begin to pursue what they find interesting in a constructive way. I don’t know of any methods for doing that other than being interested in it yourself, being interested in the people you are teaching, and learning from the experience yourself. In that kind of environment, something good happens, and I suppose that’s true with writing as much as auto mechanics.

Did anyone see Little on the Nation? He was basically saying the judges were not doing their jobs properly in regard bail. In the US is is okay for Trump to critisize judges. It is not here legal for anyone but it is rarely enforced. However, it is not okay for the Minister of Justice to do so. If he does not like how judges are interpreting the law then change the law but do not tell judges how they should interpret the law.

How great it was to hear a genuine expert on NZ history, Dr Don Brash, take Kim Hill apart this morning. Brash bravely spoke the truth – he explained that the first NZers were non-Maori, the Morioris, and that these were wiped out by Maori and are now extinct. Lately a fake Morori tribe has been created and given a treaty deal. This is all part of the PC conspiracy to rewrite NZ history. Don blew that out of the water with the facts about Moriori.

I have over the years had conversations with several esteemed elders from two totally separate Maori tribes about this. One was a tribe in the Bay of Plenty: one in Poverty Bay. BoTH tribes have stories which say that their ancestors GREETED the Maori canoes when they came ashore. How this fits in with your well-held viewpoint I have no idea, but bring it to your attention for what it may be worth. Thanks.

Duncan Garner tries to be harsh and cold and aggressive, but he doesn’t really have his heart in it. Someone obviously wrote his questions for him, and told him to “get” Golriz, but it’s clear that he early on recognizes Golriz is far brighter than him, as well as holding the moral high ground over him. This clip finishes a bit early, unfortunately, and doesn’t include the very interesting back and forth between Garner, Mark Richardson and Amanda Gillies, immediately after this travesty. All of them acknowledged that Golriz had done nothing wrong, and Amanda Gillies did not hide her distaste for what Garner had been instructed to do…..

DUNCAN GARNER: Green M.P. Golriz Ghahraman has come under criticism for failing to mention her work defending a war criminal convicting of inciting genocide IN RWANDA. Around eight hundred thousand TUTSI are estimated to have been killed during the nineteen ninety-FOUR ethnic cleansing, uh, by the Hutu EXTREMISTS. Ghahraman was involved in the deFENCE, and she joins me now, Golriz good to have you on the program, really apPRECiate it. Why didn’t you just tell us? Why hasn’t this been OUT there before?

GOLRIZ GHAHRAMAN: I did. It was out there. There’s been a number of journalists that have come forward, Kirsty Johnston from the Herald, Vice New Zealand’s released a transcript, I did a number of interviews before the election where I talked about this. I went around, um, various law schools, I’ve talked about this in the past. My C.V. was online and completely open. Um, so it’s not a problem for me at all, it’s not a problem for any lawyer, and the U.N. is certainly really proud that we now have these trials where there is a defense and a prosecution. It’s about returning communities to a rule of law model, to a human rights model.

GARNER: Okaaaayyy. Okay.

GOLRIZ GHAHRAMAN: So it is actually about stopping the cycle of violence. Having the defense ensures that, so either side can’t say, you know, it was victor’s justice, you just came in and arrested our people. Um, so it’s something that I’m really proud of, and I’ve put it out there, there’s been a number of articles, um, it wouldn’t have occurred to me to hide it—

GARNER: [brusquely] I put it to you that you HAVEN’T, actuallyyyy. I put it to you that the GREEN Party, you see the GREEN Party WEBSITE said, uh, “Golriz worked in Africa, The Hague, and Cambodia, putting on trial world leaders for abusing their power.” It DOESN’T SAY that you DEFENDED these war criminals.

GOLRIZ GHAHRAMAN: So in the context of all of these articles that I’ve done and all of these talks that I’ve given, and making my C.V. public well before the election, there’s just this ONE line that people have gotten a hold of and—-

GARNER: [interrupting] Quite CRUCIAL, it’s quite CRUCIAL, Golriz.

GOLRIZ GHAHRAMAN: Well, I would, I mean I would suggest if the Green Party was trying to hide this, someone would have brought me up and said you’ve got to stop doing Herald interviews about this work, it would’ve been a no-brainer, um, for someone from the party to pull me up and say, Stop, stop doing these interviews about it, um, and it di–, it hadn’t occurred to me, I mean the reason it’s come up NOW is because, again, there was a Herald article where they said to me, What’s a defining era in your life? And I said, well actually this was the difficult, you know, this was the thing that was really life-changing for me is when I first went in to the U.N. system, um, it was working for the defense and, what do, you know it really made me think about—

GARNER: [interrupting] Weeeell, I, I READ some of the articles.

GOLRIZ GHAHRAMAN: —-and that—

GARNER: And I’ve READ some of these articles, Golriz, and—

GOLRIZ GHAHRAMAN: It was me that brought it up, I mean it wouldn’t have occurred to me to hide it.

GARNER: Yyeeah. But it HAS been hidden by the GREEN Party. Why was, so let’s, okay, so the media might have SAID it, but what about your own Green Party, it wasn’t on your website and you’ve since CHANGED that of course which is the right thing to do.

GOLRIZ GHAHRAMAN: Oh of course I asked them to change it immediately. I had, ha–, I hadn’t even, er, looked at that, I don’t think, but I mean—
GARNER: Well hang on, hang on, lemme test that, lemme TEST that. You say you hadn’t looked at it, you DON’T THINK. Did you know that it said it, or it didn’t say it?

GOLRIZ GHAHRAMAN: I, to be honest, would have skimmed it at some point, but I would’ve gone Yep, it’s got the places I worked, moving on. I mean, those trials are ABOUT the defense being there as well. Otherwise we wouldn’t have trials, we’d take people out the back. You know, it’s, as a law student, I was inspired essentially by the Nuremberg Trials, you know, when we went, okay, you’re not above the law, genocide IS a crime, but we’re not gonna sink to your level, we’re not gonna be tyrants, we’re gonna have these open, transparent, fair trials—

GARNER: [interrupting] So the GUARDIAN—

GOLRIZ GHAHRAMAN: It’s so INSPIRING as a lawyer—

GARNER: Hmmm.

GOLRIZ GHAHRAMAN: You know, I wouldn’t have, there’s NO WAY I would have hidden something like that, that’s why I was doing the articles about it.
GARNER: Did you complain to the Guardian, ‘cos the Guardian, ahh, three weeks ago, doing a tri–, a piece on you, a really good piece on you too, said that you “represented the U.N. in tribunals, prosecuting some of the world’s worst war criminals, including perpetrators of the Rwandan genocide.” They said that you PROSECUTED THE RWANDAN GENOCIDE!

GOLRIZ GHAHRAMAN: Yeah I understand our comms team has written to the Guardian. I understand they have written to the Guardian. I mean, yeah, that’s blatantly not what I’ve ever said in interviews. And I mean, the Vice article was all about the defense work, um, Kirsty Johnston’s came forward and said that the latest Herald piece was all about the defense work, and that’s ‘cos I wanted to talk about it. I think it’s an important conversation actually, um, and it IS about the human rights framework—

GARNER: [interrupting] Do you acCEPT—

GOLRIZ GHAHRAMAN: It’s not about denying genocide. That’s what I find offensive. Because we’re all there, the United Nations is there because we want to say genocide is a crime, but we will have a process, we’re not going to have cycles of violence, um, continuing. So that’s the part of it that’s really offensive to me.

GARNER: Okay. And some people might be offended at, in your maiden SPEECH, in parliament, in recent weeks, you talk about your WORK, and this is in your own words, you no doubt wrote your own speech, you talk about this criminal justice system internationally on the front li-i-i-ine, where you went out the-e-ere, y’know, you fought hard for what you di-i-id, and you worked in Africa, worked alongside these genocide trials, and you saw it at the Rwanda tribunal, you saw it at the Hague, and when you PROSECUTED the Khmer Rouge in Cambodia, you “held politicians and armies to account for breaching their powers, giving voice to women, and minorities.” You don’t ONCE [brandishing his notes accusingly] describe it in your OWN words, in your OWN maiden SPEECH in parliament that you were DEFENDING some of these people!

GOLRIZ GHAHRAMAN: That IS putting people on trial. I mean, everyone in that trial is putting those people on trial. It’s not the prosecutors putting them on trial—

GARNER: [interrupting] But you don’t say you were deFENDing them, Golriz. You’re happy to talk about PROSECUTING.

GOLRIZ GHAHRAMAN: My maiden speech is all about being a DEFENCE lawyer. I raised the fact that I defended a child MURDERER at the Auckland High Court. It’s— my maiden speech talks about human rights in terms of defense work. I mean, to isolate a line out of it, is just, it’s just wrong. And I mean you have to—

GARNER: [interrupting] See I think you’re MINIMIZING it.

GOLRIZ GHAHRAMAN: You have to take it in the context that for the entire year of the election I was doing these interviews about both the defense and the prosecution work that I’ve done. So to me it’s VERY public, and it SHOULD be very public, we should be really proud of adv—-

GARNER: [interrupting] So why didn’t you sa-a-a-a-yyy…..

GOLRIZ GHAHRAMAN: —of advocating for a justice system that has both.

GARNER: Why didn’t you saaaay, why didn’t you SAY in your maiden SPEECH that you learned a lot—

GOLRIZ GHAHRAMAN: But why did I make all these Herald articles about the defense work?

GARNER: Can I just finish the question?

GOLRIZ GHAHRAMAN: I mean—

GARNER: I, I’ll just finish the question if I CAN, Golriz, because I’ve let you finish, I, if I could just please finish this question.

GOLRIZ GHAHRAMAN: Go for it.

GARNER: Why didn’t you in your maiden speech say that you defended some of the world’s most evil men? Like the BUTCHER of Bosnia.

GOLRIZ GHAHRAMAN: No, I never had anything to do with that trial. That’s patently wrong. That’s the Mladić trial you’re talking about and I’ve never had anything to do with the Mladić trial at all.

GARNER: You didn’t do any pre, pre-TRIAL work?

GOLRIZ GHAHRAMAN: That was on the Karadžić trial, so that’s a completely different defendant.

GARNER: But the same sort of THING, though, isn’t it!

GOLRIZ GHAHRAMAN: What happened in the Karadžić trial, I can explain that, is that that defendant was self-represented, and in the pre-trial stage the court needs lawyers to actually make the legal arguments when you’re coming up to, you know, defining the crimes and defining, um, the, essentially the spectrum of the trial. Um, and so there are lawyers that work on that, it’s to assist the trial, because actually the prosecution has lawyers, and a self-represented defendant doesn’t, so you can’t have a fair trial without those legal points being hashed out properly. That’s what I did for about five or six months, before I went to prosecutio—

GARNER: [interrupting> Right so obviously he was an EVIL man, okay, a convicted war criminal. Did you morally STRUGGLE with any of this?

…[Here there are a couple of seconds of silence as she tries to deal civilly with the imbecility and insolence of that question]…

GOLRIZ GHAHRAMAN: I don’t want us to resort back to, we take people out back and shoot them. These are, this is what these trials are about, and like I say, from Nuremberg onwards we’ve said, No, we have the moral authority. You ARE criminals, I don’t care if you’re the head of the army, I don’t care if you’re the president of a country, but we’re not gonna resort to what YOU resorted to, we’re gonna put you into a fair process, this community gets to see exactly who’s responsible, we’re not denying that genocide happened, but we wanna know exactly who did what, we want it to be transparent, we want the evidence to be tested and the historical record to be set right. Every lawyer in that system is proud to be involved in that, as was I, and as was I of my prosecution work. Is it difficult work? Totally. It’s REALLY hard to act on the defense in those trials but you’ve got to be really, really committed to that human rights-based process.

GARNER: Mmmkay. Ah, d-, have you EVER deFENDED anyone in New Zealand, say a Rwandan refugee who’s linked to that brutal reGIME?

GOLRIZ GHAHRAMAN: Ah, I’ve defended a Rwandan refugee that’s been accused of being linked to, not the regime per se, but yeah that’s something I’ve spoken to on radio before as well. It was around the confidentiality measures of the refugee process in New Zealand that we were challenging.

GARNER: Hmmm. And he was—

GOLRIZ GHAHRAMAN: So it was about, it was about people who were trying to disprove claims being able to go back in to a repressive regime and get witnesses and for us to protect those witnesses.

GARNER: [interrupting> Wasn’t he 2-i-c?

GOLRIZ GHAHRAMAN: And I’ve—

GARNER: [interrupting> Wasn’t he 2-i-c in the regime? Okay, so—

GOLRIZ GHAHRAMAN: —I’ve openly spoken about that.

GARNER: So who WAS he?

GOLRIZ GHAHRAMAN: Sorry?

GARNER: Okay, so wha-, wha-, wha-, so who WAS he? Wasn’t he 2-i-c in the regime?

GOLRIZ GHAHRAMAN: Um, the problem with that case is that actually the courts have suppressed a lot of the information, but I’ve spoken about the legal point that we were taking before on radio, which was about the confidentiality measures. Um, in terms of the details of the case I don’t wanna, I don’t wanna be breaching any of the suppression orders that the court imposed. That’s an ongoing case which I’m not on any more.

GARNER: So WHY did YOU get involved in THAT?

GOLRIZ GHAHRAMAN: But you can talk to Deborah Maning about that, you know, refugee lawyers who’ve, um, previously defended people like, you know, Ahmed Zaoui, and it’s a similar case to that—

GARNER: [interrupting> This is a guy that LIED. This is a guy that LIED on his refugee, ahmmm, application to come—

GOLRIZ GHAHRAMAN: Ooh, I’d be careful there. That’s all been disproven. [laughs derisively] So, yeah.

GARNER: You tell me what ‘e DID.

GOLRIZ GHAHRAMAN: Sorry?

GARNER: You tell me what ‘e DID.

GOLRIZ GHAHRAMAN: Ahmed Zaoui?

GARNER: No, not Zaoui. No I’m talking about—

GOLRIZ GHAHRAMAN: Oh I’m sorry.

GARNER: I’m talking about this RWANDAN, ahhhmm, who was here in New Zealand that you were—

GOLRIZ GHAHRAMAN: That’s an ongoing case and there’s suppression orders around it, but he’s being accused by the Rwandan government, um, and sought for extradition. So it’s an extradition case, um, and we were trying to get a fair process around it HERE, so that everyone could present their witness evidence, essentially.

GARNER: Right. Where did you— so you were in AFRICA. You LIVED in Africa, did you?

GOLRIZ GHAHRAMAN: In Tanzania, sort of on and off when I worked on cases, yeah.

GARNER: Right. Have you been to RWANDA? Did you go in there and have a look?

GOLRIZ GHAHRAMAN: Yeah I’ve been into Rwanda, yeah, but the court isn’t in Rwanda, so you go into Rwanda, you speak to witnesses or, y’know, I mean you’re next door, so you go into Rwanda a lot, yeah. But nobody lives in Rwanda and works on the trial.

GARNER: No, sure. Um, and just, just finally, did you ever have a choice, I don’t know how this works, I mean did the U.N. ever give you a choice and say, Golriz you don’t HAVE to work on this if you have any issues with it, y’know morally or ETHICALLY. Did you ever have a choice to say, I don’t WANTA defend this, y’know, this man?

GOLRIZ GHAHRAMAN: I certainly don’t have any moral, ethical choice, as does NO lawyer that works on criminal trials, in terms of working for either side. You are there to make the process fair. So to say that there’s a moral problem, you know, to suggest that all of these United Nations lawyers, where the U.N. requires that there is a defense and a prosecution, are somehow, um, you know, morally repugnant, um, is just, it is actually offensive, to be honest. I mean, nobody there is denying that a genocide happened—

GARNER: [interrupting] What SOME people—

GOLRIZ GHAHRAMAN: We’re there because we KNOW a genocide happened.

GARNER: Course. Yeah. And what some people are also saying that THEY’re offended by the fact that y-you, y-y-you are in PHOTOS, sort of you know, like a SELFIE with, with some of these WAR criminals, here you are standing with one of these RWANDAN guys who was convicted. Y’know, like a, like a HOLIDAY SNAP!

GOLRIZ GHAHRAMAN: Yeah, he was convicted, but I, well, we believe in innocent till proven guilty, right? So when you go over and you’re representing someone, you don’t treat them like they’re guilty. That would kind of subvert the whole process.

GARNER: But do you take HOLIDAY SNAPS with a mass MURDERER?

GOLRIZ GHAHRAMAN: I can absolutely see how it’s jarring to people. But if you actually believe in the system you’re not going there and going, You’re a mass murderer. The minute you start representing them that would be you making the decision for the Court. So it’s not, it doesn’t work that way.

GARNER: Mm.

GOLRIZ GHAHRAMAN: But I can totally see how it’s jarring. And, I mean, it’s a process that not many people would wanna be involved in, but to me it’s really important, as my prosecution work was important. It’s really important that we make sure these trials are fair, so that community can actually rely on those verdicts and move forward.

GARNER: Okay, look, um, Golriz, um, we’d better GO-O-O-O. I appreciate you coming on the program. Do you REGRET any of, any of your approach, or the lack of coming FORWARD in terms of the public stuff on the Green Party website and your maiden SPEECH? Do you regret that you could have been fuller?

GOLRIZ GHAHRAMAN: I mean, I’ve had the Green Party website fixed, but I don’t think, because I’ve been so open and I’ve done all of these interviews, coming out to the election, I think taking all of that in context it was all VERY public. But the thing is, I’m glad we’re having this conversation, because we DO need to have a conversation about what fair trials mean, and what justice means to us. Um so, no, let’s, you know, let’s keep talking about it.

GARNER: That you don’t think you have anything to apologize for?

GOLRIZ GHAHRAMAN: No, as I don’t think anyone working in our justice system has anything to apologize for. We’re all there making the process fair.

A man and his girlfriend were driving out in the country when they got a puncture. Getting out, the boyfriend was about to start changing it when he spotted a farmer sitting on his horse , rolling a smoke. He told his girlfriend that he would make the farmer change the tire and for her to just wait there.

“Hey arsehole, get down off of that horse and come over here and change this tire” he said.
